3.1 Canada and Toronto

3.3 Osgoode Hall Law School and Osgoode Professional Development

Osgoode Hall Law School is the largest common law school inCanada,with

thelargestgraduatelawprogram.TheOsgoodeLawLibraryhouses the most extensive legal collection in the British Commonwealth. Osgoode consistently ranks in the top three law schools in Canada in the Canadian Lawyer and MacLean’s rankings.

4. Program Requirements and CurriculumStudents enrolled in the International Business law LLM programneed36creditstograduate:

• 6creditsaredrawnfromrequiredcoursesinLegal ResearchandWriting(3credits)andeither IntroductiontoCanadianLaworFoundationsof CanadianLaw(each3credits)

• 21creditsaredrawnfromaselectionofthe InternationalBusinessLawcorecourses,including:

-InternationalBusinessTransactions(6credits) -InternationalFinance(3credits) -TaxationofCross-BorderTransactions(6credits) -InternationalTradeLaw(6credits) -InternationalCommercialArbitration(6credits) -LawofInternationalSaleofGoods(3credits)*

• 9electivecreditsaredrawnfromremainingInternational BusinessLawcorecourses,complementaryLLM specializations and/or select upper year JD courses

Course descriptions and schedules for all LLM courses are found on our website. Course planning suggestions and elective options will be made available during course selection in June/July,2015.

Studentsalsorequiredtocompleteaminimum30pageresearchpaperaspartofthedegree.Youmaycompletethe

researchpaperrequirementbyeither:

• Submittinga30pageSignificantResearchPaper(SRP) as a form of evaluation in at least one course

• CompletinganIndependentSignificantResearchPaper [3credits](30pages);or

• CompletingaMajorResearchPaper[6credits] (70pages)

4.1 Preparatory Courses

Somestudentsarerequiredtotakeoneourpreparatorycoursespriortothestartoftheacademicprogram.Youwillknowfromyour offer of admission which (if any) of these courses you arerequiredtotake.Thisyear,weareofferingtwodifferentpreparatory courses:

• LLMPreparatoryCourseforInternationalStudents (0credits).ThisisafourweeklanguageandLLM preparatory course that starts July 16 and runs until August13.

• IntroductiontoCanadianLLMStudies(0credits).This isatwoandahalfweekLLMpreparatorycourse.The coursestartsJuly27andendsAugust7.

Thepreparatorycoursesareintendedforstudentswhohavestudied law at an institution where standards and expectations may be different from those at Osgoode. Both courses are pass/fail. Students who do not pass will not be allowed to continue on with their LLM studies.

4.2 Elective Courses

Studentshave9electivecredits.Electivecoursesmaybetakeninthefall,winterorsummersemesters.ElectivesmaybechosenfromremainingInternationalBusinesslawcorecourses,complementary Professional LLM specializations (including the LLM in Canadian Common Law) and/or select upper year JD courses offered through the JD program at Osgoode Hall Law School. Elective course options include international and businesslawandrelatedcourses,aswellascoreCanadianlawcoursesthataredesignedtomeettherequirementsoftheNational Committee of Accreditation (NCA). Course planning suggestions and elective options will be made available during the course selection period in June and July 2015.

Note that NCA approved courses will only be made available to studentswhomeettheminimumlanguagerequirement(i.e.7.5IELTSscoreorequivalent)fortheCanadianCommonLawLLM program.

4.3 Research Paper Component

a) Course-based SRP

Inmostcases,studentscompletetheresearchpapercomponentthroughsubmittinganSRPinatleastonecourse.

TheformatforanSRPis30+pages(equivalentto8,000words),double-spaced,12pointfont,1”margins,excludingbibliography and cover page.

StudentscompletinganSRPaspartofacourseareexpectedto start thinking about their topic for the research paper at the start of the course in which they write their paper and have theirproposedtopicapprovedbythecourseinstructor.Unlesstherearecompellingreasonsnottoallowthis,normallytheinstructorwillcomplywithsucharequestasanalternativeform of evaluation (not an additional form of evaluation).

b) Independent Significant Research Paper Option and Major Research Paper Option

StudentsmaycompleteanIndependentSignificantResearchPaper(SRP)ofapproximately30pagesonanytopicrelatedtotheInternationalBusinessLawspecialization,providedappropriatesupervisionisavailable.TheformatforanSRPis30+pages(equivalentto8,000words),double-spaced,12pointfont,1”margins,excludingbibliographyandcoverpage.

Alternatively,studentsmayinsteadcompleteaMajorResearchPaper(MRP)ofapproximately70pages(doublespaced,12pointfont,1”margins,footnotes(excludingbibliography)(equivalentto18,000words).

AnIndependentSRPorMRPisnotathesis,andconsequentlythenormalUniversityrulesrelatingtothesisrequirementsanddegreeofsupervisiondonotapply.YoumaywriteanIndependentSRPorMRPonatopicrelatedtotheInternationalBusinessLawspecialization,providedadequatesupervisoryresourcesareavailable.YoucanbeginthinkingabouttheIndependentSRPorMRPalmostassoonasyoustarttheprogram.Keepanotebookandjotdownideasastheycomeupinclass(areasoflawthatareunsettled,thatareunjust,orout-of-stepwithothercountriesaregoodstartingpoints).Yourpaper should go beyond merely describing legal developments to include independent critical analysis of its subject matter. It shouldbeworkofpublishablequality.

TheindependentSRPmustbeastand-alonepaper.TheMRPontheotherhand,maybeastand-alonepaper,oritmaybestructuredasanextendedrequirementinoneofyourcourses(i.e. you can use a previously submitted paper to form the basisofyourMRPbutthepapercannotsimplybe“pasted”intoanotherpapertoform70pages).

Students are requiredtosecureasupervisor for their IndependentSRPorMRPontheirown.Yoursupervisorwillnormally be the main instructor in the course most

closelyrelatedtothetopicareaofthepaper,althoughitmayalsobepossibletohaveanoutsidesupervisor.ThepermissionoftheprogramisrequiredifyouchooseasupervisoroutsideofOsgoodeHallLawSchoolorOsgoodePD.Youshouldnormallyproceedbyfirstthinkingabouttheareainwhichyouwouldliketowritethepaper,thenbydiscussingyourideasandthespecifictopicaswellasthedegreeofsupervisionwiththatindividual. He or she must approve the topic and is responsible forgradingthepaper.Youarerequired,ataminimum,tosubmit an outline and bibliography to your supervisor for approval.

IfyouwishtowriteanIndependentSRPorMRP,pleasecontactyourGPAwhowillprovideyouwithanIndependentSRPorMRPConfirmationForm.Ifyouhaveanyproblemsobtainingappropriate supervision or concerning any other matter relating toyourIndependentSRPorMRP,pleasecontactyourGPA.OnceyouhavedeterminedyourMRPtopicandobtainedasupervisor,youmustprovideyourGPAwiththecompletedConfirmationForm.TheConfirmationFormmustbesubmittedpriortoyoustartingtoworkonyourIndependentSRPorMRP.

TheIndependentSRPorMRPisnormallydueattheendoftheterminwhichitiswritten,e.g.December15fortheFallterm,April 15 for the Winter term and August 15 for the Summer term.YourIBLtuitioncoversyouforfourterms(summer,fall,winterandthefollowingsummer).Ifyoutakelongertocompleteyourpaper,youwillbechargedthefullone-termfeeofapproximately$930.00perterm.

Students wishing to conduct research involving human participantsshouldconsultthe“EthicsReview”sectionofthishandbook.

PleasenotethatwhiletheIndependentSRPisgraded,theMRPfinalpaperismarkedonapass/failbasis,whichisthegradethatwillappearontheacademicrecord.Thesupervisorwill also indicate on the paper a ‘notional’ letter grade so that the student has some idea of their standing. Once you have passedtheIndependentSRPorMRP,yourGPAwillconductadegree audit to ensure that you have completed all the course requirementsforyourprogram.YouwillthenbecontactedbyyourGPAwithconvocationinformation.

4.4 Summer Internship (Optional and not guaranteed)

Studentshavetheoptionofapplyingforatwo-monthunpaidinternshipinsettingssuchaslawfirms,financialinstitutionsand legal departments of corporations and governments. Thesummerinternshipqualifiesasa0creditcourse.TheinternshipsoccuranytimebetweenMayandAugust,afterclasseshavefinished,andareintendedtoprovidestudentswith the opportunity to experience what it is like to work in a legal setting and to apply the knowledge and skills learned throughout the course of the LLM program. Assistance is provided in résumé and interview preparation. Host organizations elect whether to interview or take on students.

No student is guaranteed an internship position and the process is highly competitive.

Note:Notallcoursesareofferedeveryyear.Curriculum,coursedescriptionsanddegreerequirementsaresubjecttochangewithout notice. New courses and course changes are subject to YorkUniversitySenateapproval.

4.5 Course Load Per Term and Extra Courses

IBL students typically take between 12 and 18 credits per term. Whilestudentsmayrequestacourseoverload,approvalisdiscretionary;weoftenrefusesuchrequestsinordertoensurestudent success or deal with excess course space demands. Attheendoftheprogram,studentsmayalsorequestcoursesoverandabovethe36-creditprogramrequirement,buttheserequestsaresubjecttospaceavailabilityandtriggeradditional fees (calculated using the fees for LLM Single Course Enrollment).

Theonlyexceptiontothisruleiswherestudentsarerequestingto take two 6 credit elective course as part of their program of study.Insuchcases,studentswillendupwith39creditsattheend of the program but will not be charged any additional fees.

5. Program Format and 2015/2016 Sessional DatesTheLLMinInternationalBusinessLawisavailableonlyasaone-year,full-timeprogram.StudentsstartineitherJulyorAugust. While some students may be able to complete their programrequirementsbylatespring,otherstakeafullyearand complete the program by August. Courses are offered in a combination of weekly and intensive formats.

StartdatesfortheIBLprogramvary,dependingonwhetherornotyouarerequiredtotakeoneofoursummerpreparatorycourses.ForstudentsenrolledintheLLMPreparatoryCourseforInternationalStudents(GSLaw6512),theprogramcommenceson July 16, 2015.ForstudentsenrolledinIntroductiontoCanadianLLMStudies(GSLaw6514),theprogramcommenceson July 27, 2015.Forallotherstudents,theprogramcommences on August 17.

ThefalltermwillendonDecember23,2015.ThewintertermwillbeginonJanuary3,2016andwillendonApril30,2016.SummertermcoursesrunanytimebetweenMay1,2016andAugust31,2016.Theoptionalunpaidsummerinternshipsareapproximately two months in length and may occur any time betweenMay1,2016andAugust31,2016.

7. Registration and EnrollmentRegistrationandenrollmentaredifferent.ThinkofregistrationasthestatusthatyouhavewiththeUniversityvisàvisyourprogram; enrollment refers to your status within a course.

YourGPAwillregisterandenrollyouinyourrequiredcourseson your behalf upon your arrival. Elective course offerings will be made available upon your arrival and Eriona will subsequentlyconfirmyourenrollmentinelectivecourses.

Onceregistered,youareconsideredtohaveacceptedthetermsofacontractwiththeUniversitythatrequiresyoutoabidebytheFacultyRegulationsoftheFacultyofGraduateStudies(FGS).Youarerequiredtoreadtheinformationin

12.1 Attendance and Participation

Students are expected to attend all classes in each course. Ifstudentsmissmorethan20%ofclasstime,theywillgenerallyberequiredtodoanassignmentrelatingtothemissedmaterial.Thedetailsoftheassignmentareuptoeachinstructor,butmightincludelisteningtoanaudioarchiveofthe missed class time and writing a comment. Students who miss more than 50% of class time are not eligible to pass the course.

12.4 Course Evaluation

GradingEvaluation procedures in North American universities may be different from those you previously studied at. Evaluation generallyconsistsofpapers,smallertestsorassignments,“take-homeexams”(examsthatyoutakehomewithyouandreturn several days later) and class participation. Evaluation for NCA approved courses also typically include an invigilated exam.

Deadlinesforsubmissionofrequiredwrittenworkaresetbytheinstructorineachcourse.Studentsarerequiredtokeep track of deadlines for all of their courses. An evaluation form is prepared for every LLM course and theprogramoverall,andwerelyonstudentfeedbackwhenrevising our program planning. We have made numerous changes to courses and programs based on the comments and suggestions we have received from our students and encourage students to continue to take the time to share their course and program evaluations with us.

12.5 Grade Reappraisals

LLM students are subject to the Grade Reappraisals Policy as setoutintheFacultyofGraduateStudiesFacultyRegulations.

12.6 Ethics Review

Additionally,studentsarerequiredtonotifytheirGPAiftheyplan on conducting research involving human participants. Researchinvolvinghumanparticipantsforlawstudents(typically,questionnaires,surveysandinterviews)mustcomplywithYorkUniversity’spolicy,administeredbytheHumanParticipantsReviewCommittee(HPRC),asubcommitteeoftheSenateCommitteeonResearch(SCOR).TheHPRCrequiresthatallresearchbyYorkstudentsinvolvinghumansmustmeet

theHPRC’sethicalguidelinesand,inthecaseofMRPs,mustbereviewedbyanEthicsReviewCommitteeoftheFacultyordepartmentwheretheresearchisbeingconducted.Inaddition,anonlineethicstutorialmustbecompleted.Youwillberequiredtoobtaininformedconsentfromallparticipantspriortoconductinginterviewsorcompletingquestionnaires.Theconsentform,togetherwithabriefdescriptionoftheresearchproject and an assessment of whether theresearch poses a risk toparticipants,mustbereviewedbytheOsgoodePDEthics

13.1 Dropping or Withdrawing from Course or Program

Required or Core Course: Youmaynot,atanytime,droporwithdrawfromarequiredcoursewithoutpriorpermissionfromtheInternationalProgramLawyerand/ortheFacultyofGraduateStudies.

Elective Course: Tograduate,studentsmustsuccessfullycomplete9creditsdrawnfromelectivecourses.Studentswill only be allowed to drop or withdraw from elective courses if the courses they wish to drop or withdraw from are additionalelectives.Thefollowingpoliciesapplytodroppingorwithdrawing from additional electives.

a) Optional JD Elective Courses

ThecoursechangeperiodforJDcoursestakesplaceduringthefirsttwoweeksofthefallandwintersemesters.Requeststodrop JD elective courses must be made within this two week period.RequestsshouldbemadetoyourGPA.

Inexceptionalcircumstances,astudentmaybeallowedtowithdrawfromacourseorseminarafterthefinaldropdate.RequestsforwithdrawalmustbebroughttotheattentionofyourGPA.Whetherornotastudentwillbeallowedtowithdraw from a course is in the discretion of the International ProgramLawyeratOPD,theDirectorofOPDandtheAssociateDean of Osgoode Hall Law School. A student may drop an elective professional LLM course before 1/3ofthecoursehasbeencompleted.RequeststodropelectiveLLMcoursesshouldbemadetoyourGPA.

Ifthedropdeadlinehaspassed,studentsmayelecttowithdraw from an elective course provided not more than 2/3ofthecoursehasbeencompleted.Thesymbol‘W’willbe recorded in place of a grade to indicate that a student was authorized to withdraw from a course in which he or she wasregistered.RequeststowithdrawshouldbemadetotheInternationalProgramLawyer.Afterthistime,studentsmustremain registered and will be assigned grades as appropriate WithdrawingfromtheProgram/GraduateStudies: Voluntary withdrawal from the program may happen for various reasons. Towithdrawingoodstandingfromthe LLMprogramandtheFacultyofGraduateStudies,youmustobtainaprogramwithdrawal form from yourGPA,signitandreturnit.Theeffective date of withdrawal will be the date your letter is received.Thisdateisusedtodetermineifyouwillbeeligibleforanyrefund.Pleasenotethatsimplydroppingcourses,orfailingtoattendclasses,isnotrecognizedasanofficialwithdrawal and as such you would still be responsible to pay yourprogramandotherassociatedfees.Therefore,pleaseprovide yourGPAwithofficialnoticeofwithdrawal.

Tobeeligibletowithdrawingoodstanding,astudent’sacademic record may not include any coursework ‘Incompletes’ and may not include any combination of ‘C’ grades or combinationof‘C’and‘F’gradesthatwouldnormallyresultinwithdrawal for failure to maintain academic standards.

13.2 Course Extensions

It is expected that students will submit assignments by the deadlines communicated to them by their instructors. Extensions may be granted in certain circumstances (for example,incasesofillness,illnessordeathinthefamily,religious reasons or other legitimate reasons) at the discretion

of the International Program Lawyer and the course instructor. If astudentrequiresanextension,heorshemustmakearequestin writing setting out the reasons as to why an extension is beingrequestedtothe

International Program Lawyer and the instructor before the assignmentdeadline.StudentsmayalsoberequiredtosubmitapetitionforanextensiontotheFacultyofGraduateStudies.

If a student has not obtained an extension prior to the deadline andhandsinanassignmentlate,gradepenaltieswillgenerallyapply.Unlessotherwisecommunicatedbytheinstructor,thefollowing penalties will apply: for late papers and other written assignments,adeductionofonegradeleveleveryfourdays;

andforlatetake-homeexams,adeductionofonegradelevelevery two days.

Forpurposesofclarification,aonegradeleveldeductionmeans adeductionfromanA+toanA,anAtoanA-,anA-toaB+,aB+toaB,aBtoaCandaCtoanF.

14. Academic Culture at Osgoode and in North America Generally

14.1 The Classroom Environment

Classrooms are often similar in appearance in different cultures. Here are some notes about the classroom environment at Osgoode:

• AtOsgoode,avarietyoflectureandseminarrooms areavailable,withtypicaltechnologicalresources suchasoverheadandcomputerprojectors,audiovisual equipment,andsoon.

• Beveragesaregenerallypermittedinclasses.The consumptionoffood,however,canbedisruptive. Students are asked to be considerate of others in this regard.

• Studentsareexpectedtotakeresponsibilityfor disposingofanywastematerialstheybringintoclass, includingbeveragecontainers,wastepaper,etc.Please notethatcans,bottles,andwastepapershouldbe placed in specially designated bins for recycling.

14.2 Lecture and Seminar Practices: Participation, Multiple Perspectives, Teamwork

One key difference that many international students have noticed in North American universities is the interactive nature of seminars and lectures. Students are expected to participateactivelybyaskingquestions,seekingclarification,and offering their own perspectives on content being presented by the instructor. Instructors will often ask students to share theirknowledgeandopinions.Aswell,unlikeinsomeothercultures,professorsandinstructorsinCanadaexpectstudentstohavetherequiredreading(s)completedpriortoclass.Yourprofessor and/or instructor will provide you with a schedule oftherequisitereadingssoyoucanmanageyourreadingsaccordingly.

AnothersignificantcharacteristicofmostNorthAmericanclassrooms is the recognition of more than one viewpoint oranalysisofanissueorsituation.Theexpressionofdiverseviews,andofopposingviewpoints,shouldbeaccomplishedwithanattitudeofrespectforsuchdiversity,andacknowledgement of the legitimacy of multiple perspectives.

23.1 Arriving in Toronto

It is important that you know where you are going once youarriveinToronto.PlanaheadforthetriptotheOsgoodeProfessionalDevelopmentcampus,andmakesureyouhaveeverythingyouwillneedforyourfirstfewnightsinCanada.ThoughpublictransportationispossiblefromPearsonInternationalAirport(Toronto’smainairport),itcantakealongtime and involve several transfers. A better option is to take a taxiorairportlimousinefromtheairport.Thecostwilldependonyourdestination,butshouldrangesomewherebetween$40-$75.

Youwillneedclothesforallseasons.Summercanbeveryhot–above30°C–andwintercanbeverycold–occasionallybelow-20°C.Studentsdressquitecasually,butformalclothingisrecommendedforcertainoccasions.Thosewhoplantotakeaninternship will need business attire to wear to their placements. Therefore,studentsshouldplantheirclothingforalloccasions:cold,warm,formalandcasual.

Money

Itisnotadvisabletotravelwithlargesumsofcash.Youmay wish to bring up to $500 in cash and the remainder in a bank draft.

Opening a bank account

ToopenabankaccountinCanada,youwillneedyourpassport,YUStudentIDcard,proofofregistrationanddocumentationverifying your address in Canada (such as a phone bill or residencecontract).Dependingonthebank,youmayneedto make an appointment before opening an account. Transferring funds to Canada

YoucanwiretransfermoneyintoyourCanadianbankaccountfrom your home country. Obtain a bank draft for the amount you wish to transfer and bring it with you to Canada. Study Permit

Asageneralrule,internationalstudentsarerequiredtoobtaina Study Permit from Citizenship and Immigration Canada before pursuing their studies (see Citizenship and Immigration Canada’s website for certain exceptions). Q: Can I practise law in Canada?

TheLLMinInternationalBusinessLaw,aswithallLLMsinCanada,doesnotqualifyyoutopractiselawinCanada.However,studentsenrolledintheprogramcantakesomeNCAaccreditedcoursesaspartoftheirdegree.Thoseinterestedinpractising law in Canada should contact the National Committee on Accreditation (NCA) for details.

Q: Does the LLM give me a Certificate of Qualification from the NCA?

No. We have some courses that are recognized by the NCA but youwillnotbeabletocompleteallofyourNCArequirementsin this program.

GraduateswhoremaininCanadahavegoneontofurthergraduatestudiesinlaw,havebeenacceptedtoJDprograms,andhaveobtainedpositionsinbusinessorin-houselegaldepartments.PleasenotethatifyouintendtoqualifytopractiselawintheProvinceofOntario,followingyourLLM,youwillhavetogainaCertificateofQualificationfromtheNationalCommitteeonAccreditation,completea10monthworktermwithalicensedlawyerreferredtoas“articling”,andsuccessfullycomplete Bar Examinations.

AllLLMcoursestakeplaceatOPD,whileelectiveJDprogramsareheldonKeelecampus.BecauseIBLstudentshaveonlyoneelectivecourseperterm,manyelecttolivedowntown.IttakeapproximatelyonehourtotravelfromKeeleCampustoOPDusing public transit.

Q: When do I get my York University student card?

YorkUniversitystudentcardsareavailableforpickupuponregistration. Osgoode Professional Development will register eachstudentoncewereceiveconfirmationfromthestudentthattheir visa (study permit) has been issued.

Osgoode Professional Development will make arrangements to have the student cards picked up during the university campus tour.ThisisscheduledonceallthestudentshavearrivedinToronto.

Otherwise,studentcardsmaybepickedupindividually attheStudentServicesBuildingatYorkUniversity’sKeelecampus.

Thereisnocostfortheinitialcard,however,replacementcardscost $20.
