LIQUOR PERMIT INFORMATION AND RESOURCE DIRECTORY OHIO DEPARTMENT OF COMMERCE DIVISION OF LIQUOR CONTROL As a liquor permit holder, it is your responsibility to know the state liquor laws and the rules of the Ohio Liquor Control Commission that apply to the operation of your business. The Division of Liquor Control has prepared this “Liquor Permit Information and Resource Directory” to serve as a helpful guide for understanding many of the laws and rules (the number of the statute or rule is noted so you can refer to the specific law). The directory is not, however, a complete guide. We suggest that you consult with your attorney on any matters that involve your business and that you refer to, or obtain a copy of, the complete set of the liquor laws and rules as addressed under Chapters 4301 and 4303 of the Ohio Revised Code, Chapters 4301and 4303 of the Ohio Administrative Code, as well as pertinent sections in several other chapters of the Ohio Revised Code and Ohio Administrative Code. www.com.ohio.gov/liqr

Responsible for the enforcement of the majority of Ohio’s liquor laws andrules and conducting investigations at licensed and non-licensed locationsthroughout the state. The unit also has responsibility for enforcing USDAfood stamp laws and investigating allegations of criminal misconduct in-volving food stamps, and has the authority to investigate tobacco salesviolations throughout the state.

Please contact this unit for information on the laws relating to advertising,after-hour sales, drugs, food stamps, gambling, happy hour promotions,improper conduct/entertainment, sales to intoxicated persons, Sunday sales,underage sales, tobacco sales, etc.

Enforcement agents from the Department of Public Safety issue adminis-trative citation notices to liquor permit holders for alleged violations ofOhio’s liquor laws and rules. These administrative citation charges areheard before the Ohio Liquor Control Commission (see explanation be-low). Enforcement agents can also criminally charge individuals observedbreaking liquor laws or other related offenses. They either arrest themand take them into custody or, more commonly in lieu of arrest, issue asummons to appear in court. Criminal charges are heard in local courtand individuals found guilty are subject to fines or imprisonment. Criminalcharges against individuals under age 18 are heard in juvenile court andare subject to punishment as ordered by the juvenile court judge.

The Liquor Control Commission, which is a neutral and independent agencycomposed of three members appointed by the Governor to six-year termswith the advise and consent of the Senate, serves both judicial and legis-lative functions.

The Commission hears citation cases concerning alleged violations of Ohio’sliquor laws and rules. The Commission considers the merits of each caseand has the authority to suspend or revoke the liquor permit if it finds thepermit holder guilty. The Commission can also impose a monetary fine inlieu of suspension depending upon the permit holder’s prior citation record.In addition, the Commission hears appeals from permit applicants or leg-islative authorities concerning actions or orders of the Department of Com-merce, Division of Liquor Control, as well as appeals on the non-renewalof liquor permits for failure to pay sales taxes. Commission decisions aremailed within 45 days after the hearing, and may be appealed to the FranklinCounty Court of Common Pleas.

The Commission also has general policy-making powers, and promul-gates rules under the Ohio Administrative Code regarding liquor produc-tion, sales restrictions, minimum sales mark-up, liquor advertising and othermatters related to the manufacture, distribution and sale of beer, wine andspirituous liquor.

Responsible for the prosecution of all violation/citation cases before theLiquor Control Commission. This unit sends questionnaires to the citedpermit holder asking whether the permit holder intends to admit or denythe charges at the Commission hearing. The Liquor Unit schedules allhearings before the Commission, and sends the hearing notice to the per-mit holder, as well as to permit holder’s counsel. In addition, this unit willsubpoena any witnesses required to attend the Commission hearing.

This unit represents the Division of Liquor Control on any appeals ofDivision decisions before the Commission, and represents the Commis-sion on any appeals of Commission decisions through the court system.

Responsible for processing the civilian identification/fingerprint cardsof all liquor permit applicants to check for criminal records.
