R 400.8101 Definitions.Rule101.Asusedintheserules:(a)“Accreditedcollegeoruniversity”meansacollegeoruniversitythathasbeenaccreditedbyaregionalornationalinstitutionalaccreditingassociationrecognizedbytheUnitedStatesdepartmentofeducation.(b)“Ages”meansallofthefollowing:(i)“Infant”-birthuntil1yearofage.(ii)“Toddler”–1yearofageuntil30monthsofage.(iii)“Preschooler”–30monthsofageuntileligibletoattendagradeofkindergartenorhigher.(iv)“School-ager”–achildwhoiseligibletoattendagradeofkindergartenorhigher,butlessthan13yearsofage.Achildisconsideredaschool-ageronthefirstdayoftheschoolyearinwhichheorsheiseligible.(c)“Caregiver”meansaperson18yearsofageorolderwhoprovidesdirectcare,education,supervision,andguidanceofchildren.A17-year-oldshallqualifyasacaregiverifheorshemeets1ofthefollowing:(i)Hassatisfactorilycompletedatleast1yearofavocational-occupationalchildcareaidetrainingprogramapprovedbythedepartmentoflicensingandregulatoryaffairs.(ii)Hascompleted1yearofapprenticeshipinarecognizedchildcareapprenticeshipprogramsponsoredbytheUnitedStatedepartmentoflabor.(d)“Center”meansachildcarecenterordaycarecenterwhichisafacilityotherthanaprivateresidence,whichreceives1ormorechildrenunder13yearsofageforcareforperiodsoflessthan24hoursaday,andatwhichtheparentsorguardiansarenotimmediatelyavailabletothechildren.“Center”includesafacilitythatprovidescarefornotlessthan2consecutiveweeks,regardlessofthenumberofhoursofcareperday.Thefacilityisgenerallydescribedasachildcarecenter,daycarecenter,daynursery,nurseryschool,parentcooperativepreschool,prekindergarten,playgroup,ordrop-incenter.“Center”doesnotincludeanyofthefollowing:(i)ASundayschool,avacationBibleschool,orareligiousinstructionalclasswhichisconductedbyareligiousorganizationandatwhichchildrenareinattendancefornotmorethan3hoursperdayforanindefiniteperiod,ornotmorethan8hoursperdayforaperiodnottoexceed4weeksduringa12-monthperiod,orafacilityoperatedbyareligiousorganizationwherechildrenarecaredfornotmorethan3hourswhilepersonsresponsibleforthechildrenareattendingreligiousservices.(ii)Aspecialeducationprogramorserviceconductedundertheauthorityofarticle3of1976PA451,MCL380.1701to380.1766.(iii)Akindergartenoperatedbyalocalorintermediateschooldistrictundertheauthorityof1976PA451,MCL380.1to380.761oraspartofanonpublicelementaryschool.However,thisexemptionshallnotapplytoanonpublickindergartenoperatedaspartofacenter.(iv)Aprogramthatisprimarilysupervised,school-age-child-focusedtraininginaspecificsubject,including,butnotlimitedto,dancing,drama,music,orreligion.Thisexclusionappliesonlytothetimeachildisinvolvedinsupervised,school-age-child-focusedtraining.(v)Aprogramthatisprimarilyanincidentofgroupathleticorsocialactivitiesforschool-agechildrensponsoredbyorunderthesupervisionofanorganizedcluborhobbygroup,including,butnotlimitedto,youthclubs,scouting,andschool-agerecreationalorsupplementaryeducationprograms.Thisexclusionappliesonlytothetimetheschool-agechildisengagedinthegroupathleticorsocialactivitiesandiftheschool-agechildcancomeandgoatwill.

(e)“CEU”meansacontinuingeducationunitawardedbyanaccreditedcollegeoruniversitysponsorofcontinuingeducationunitsorequivalentawardedbythestateboardofeducation.(f)“Degreesandsemesterhours”meansonlythosedegreesandhoursfromanaccreditedcollegeoruniversity.(g)“Department”meansthedepartmentofhumanservices.(h)“Developmentallyappropriate”meansageappropriateaswellasappropriatetotheindividualchild.(i)“Easilycleanable”meansthatsurfacesarereadilyaccessibleandmadeofsuchmaterialsandfinishandsofabricatedthatresiduemaybeeffectivelyremovedbynormalcleaningmethods.(j)“Fieldtrip”meanschildrenandcaregiversleavingthecenterpremisesforanexcursion,trip,orprogramactivity.(k)“Firstaidkit”meansakitcontaining,ataminimum,allofthefollowing:sterilegauzepads(assortedsizes),arollofgauze,adhesivebandages(assortedsizes),adhesiveclothtape,anelasticbandage,tweezers,andscissors.Afirstaidkitisprohibitedfromcontaininganynon-prescriptionorprescriptionmedicationsasdefinedunderR400.8152.(l)“Groupsize”meansthespecifiednumberofchildrenassignedtoacaregiverorteamofcaregiversoccupyinganindividualclassroomorwell-definedspaceforeachgroupwithinalargerroom.Twoormoregroupsmaybecombinedforcollectiveactivitiesaslongasappropriatechild/staffratiosaremaintainedintheroomorarea.(m)"Licenseedesignee"meanstheindividualdesignatedinwritingbytheboardofdirectorsofthecorporationorbytheownerorpersonwithlegalauthoritytoactonbehalfofthecompanyororganizationonlicensingmatters.(n)“Parent”or“parental”meansachild’sparent,guardian,orotherlegallyresponsibleperson.(o)“Playspace”meansapieceorpiecesofage-appropriatetoys,playequipment,andmaterialsthat1childcanuseindependentlyfor15minutes.(p)“Programcomponents”meansthedifferentservicesofferedbyacenter.Theyinclude,butarenotlimitedto,infant/toddler,preschool,andschool-agecareandeducation;nighttimecare;foodservice;swimming;andtransportation.(q)“Routinetransportation”meansregularlyscheduledtravelonthesamedayoftheweek,atthesametime,tothesamedestination.(r)“Sanitization”meanseffectivebactericidaltreatmentbyaprocessthatprovidesenoughaccumulativeheatorconcentrationofchemicalsforenoughtimetoreducethebacterialcount,includingpathogens,toasafelevel.(s)“School”meansabuildingorpartofabuildingwhichisownedorleasedby,orunderthecontrolof,apublicorprivateschoolorschoolsystemforthepurposeofinstructionasrequiredby1976PA451,MCL380.1561whichisoccupiedby6ormorestudents,andwhichisused4ormorehoursperdayormorethan12hoursperweek.(t)“Staff”meansanycompensatedemployeeofthecenter.(u)“Volunteer”meansaperson16yearsofageorolderwhoisnotacompensatedemployeeofthecenter.Volunteersmaybecountedinthecaregiver-to-childratiosoutlinedinR400.8182(3)iftheymeetthedefinitionofcaregiverasdefinedbysubdivision(c)ofthisrule.(v)“Well-definedspace”meansspacedesignedandusedexclusivelyforaspecificgroupofchildren.

R 400.8104 Rule variances.Rule104.(1)Uponwrittenrequestofanapplicantorlicensee,thedepartmentmaygrantavariancefromanadministrativeruleifthealternativeproposedprovidesclearandconvincingevidencethatthehealth,welfare,andsafetyofchildrenisprotected.(2)Thedecisionofthedepartment,includingtheconditionsunderwhichthevariancewasgranted,shallbekeptonfileatthecenter.(3)Thegrantedvariancemayremainineffectforaslongasthelicenseecontinuestocomplywiththeconditionsofthevarianceormaybetime-limited.(4)Varianceswillnotbegrantedfromstatutoryrequirements.

(5)Theactualnumberandagesofchildrenincareatanytimeshallneverexceedthenumberandagesofchildrenforwhichthecenterislicensed.(6)Achildshallonlybereleasedtopersonsauthorizedbytheparent.(7)Achildshallbereleasedtoeitherparentunlessacourtorderprohibitsreleasetoaparticularparent.Acopyoftheorderprohibitingreleaseshallbekeptonfileatthecenter.(8)Within5businessdays,thelicenseeshallnotifythedepartmentoftheseparationofaprogramdirectororacentraladministratorapprovedbyR400.8113(16)andaplanforreplacementoftheprogramdirectororcentraladministrator.(9)Thelicenseeshallcooperatewithanystateorlocaldepartmentoragencyinspectionsorinvestigationsrelatedtothechildcarelicensebybothofthefollowing:(a)Providingaccesstoallrelevantrecords,materials,andstaff.(b)Assuringinformationprovidedisaccurateandtruthful.(10)Writtenapprovalfromthedepartmentshallbeobtainedbeforemakinganychangesinthetermsofthelicense,includingbutnotlimitedto,addingusespace,changingagegroupsserved,changingprogramcomponents,changingthecapacityofthecenter,ormakingchangestoaroomorwell-definedspacethatwillresultinachangeincapacityoftheroomorwell-definedspace.(11)Therecordsrequiredby1973PA116,MCL722.111to722.128,andtherulespromulgatedundertheactmustberetainedandmadeavailabletothedepartmentuponrequestfor2years,exceptthefollowing:(a)Thename,address,andtelephonenumberforeachchildenrolledandeachemployeeforatleast2yearsafterheorshehasleftthecenter.(b)StaffandvolunteerhealthrecordsasrequiredbyR400.8128anddocumentationofqualificationsshallberetaineduntilthatpersonhasleftthecenter.(c)Thelicensingnotebookshallbemaintainedandretaineduntilthelicenseisclosed.(12)Smokingshallnotoccurinorduringeitherofthefollowing:(a)Inthechildcarecenteroronrealpropertythatisunderthecontrolofthecenteranduponwhichthecenterislocated.(b)Onfieldtripsandinvehicleswhenchildrenarepresent.

R 400.8113 Program director qualifications; responsibilities.Rule113.(1)Asusedinthisrule:(a)“Child-relatedfield”foranearlychildhoodprogramdirectormeanselementaryeducation,childguidance/counseling,childpsychology,familystudies,andsocialwork.(b)“Child-relatedfield”foraschool-ageprogramdirectormeansearlychildhoodeducation,elementaryeducation,secondaryeducation,physicaleducationandrecreation,childdevelopment,childguidance/counseling,childpsychology,familystudies,socialwork,humanservices,andyouthdevelopment.(c)“Childcareadministration”meanschildcareadministration,educationadministration,orbusinessadministration.(d)“Childdevelopmentassociatecredential(CDA)”meansacredentialawardedbythecouncilforprofessionalrecognitionorsimilarcredentialapprovedbythedepartment.(e)“Earlychildhoodprogramdirector”meanstheprogramdirectorofacenterservingchildrenofallages.(f)“Hoursofexperience”meansexperienceservingtheagesanddevelopmentalabilitiesofchildrenforwhichthecenterislicensed.

(g)“Montessoricredential”meansacredentialissuedbytheassociationMontessoriinternationale(AMI),AmericanMontessorisociety(AMS),oranyMontessoriteachingtraininginstitutionrecognizedbytheMontessoriaccreditationcouncilforteachereducation(MACTE)thatmeetsorexceeds270hoursofacademictraining.(h)“Michiganschool-age/youthdevelopmentcredential”meansacredentialissuedbytheMichiganafterschoolassociationorsimilarcredentialapprovedbythedepartment.(i)“School-ageprogramdirector”meanstheprogramdirectorofacenterservingonlyschool-agechildren.(2)Beforehiringanewprogramdirector,acentershallsubmitthecredentialsoftheproposedprogramdirectortothedepartmentforreviewandapproval.(3)Aprogramdirectorshallbepresentinthecenterinthefollowingmanner:(a)Fulltimeforprogramsoperatinglessthan6continuoushours.(b)Atleast50%ofthetimechildrenareincarebutnotlessthanatotalof6hoursperdayforprogramsoperating6ormorecontinuoushours.(4)Allprogramdirectorsareresponsibleforthegeneralmanagementofthecenter,includingthefollowingminimumresponsibilities:(a)Developing,implementing,andevaluatingcenterpoliciesandprogram.(b)Administeringday-to-dayoperationsincludingbeingavailabletoaddressparent,child,andstaffissues.(c)Monitoringstaff,includinganannualevaluationofeachstaffmember.(5)Aprogramdirectormayalsoserveasacaregiver,providedthatroledoesnotinterferewithmanagementandsupervisoryresponsibilities.(6)Ifabsentfromthecenter,theprogramdirectorshalldesignateastaffmembertobeinchargewhoatleastmeetsthequalificationsofcaregiver.(7)Asubstituteprogramdirectorshallbeappointedforaprogramdirectorwhohasleftemploymentorhasatemporaryabsencethatexceeds30consecutiveworkdaysuntilreturnorreplacement.Asubstituteprogramdirectorshallatleastmeetthequalificationsofleadcaregiver.Thedepartmentshallbenotifiedwhenasubstituteprogramdirectorisappointed.(8)Allprogramdirectorsshallhaveallofthefollowingqualifications:(a)Beatleast21yearsofage.(b)HaveearnedahighschooldiplomaorGED.(9)Earlychildhoodprogramdirectorsshallmeet1ofthefollowingqualifications:
