Dear Mr. McConnell:
Crow Butte Resources, Inc. (CBR) is providing this annual report summarizing thechanges, tests or experiments made under License Condition 9.4 of SUA-1534 duringcalendar year 2007. This report is made in accordance with the reporting requirementscontained in License Condition 9.4 (E).
CBR's source material license was renewed on March 4, 1998. The renewed licensecontained Performance Based License Conditions (PBLC). In a PBLC, CBR is allowed tomake changes or conduct tests and experiments under certain conditions. These changes,tests, and experiments must be reviewed and approved by the CBR Safety andEnvironmental Review Panel (SERP). During 2007, the CBR SERP approved threechanges.
The following materials are attached to provide the required summary information anddocumentation required by License Condition 9.4 (E).
* SERP Evaluation Index, which summarizes each SERP Action and tracks anymodifications to an approved action affected by subsequent SERP actions.
" A copy of the text of each approved SERP Evaluation. These evaluations describe thechange or test approved and the safety and environmental evaluation performed bythe SERP. Supporting documentation is maintained on site for NRC review.

The Crow Butte Resources, Inc. (CBR) Safety and Environmental Review Panel (SERP)met to review and approve operation of Wellhouse 48 in Mine Unit 10 at the Crow ButteUranium Project.

Purpose of SERP Evaluation
The purpose of this evaluation by the CBR SERP was to review Mine Unit 10 andapprove Wellhouse 48 for operation.

License Condition 9.4 allows CBR to make changes in the facility or procedures orconduct tests or experiments that are not presented in the approved application if suchchanges do not:
i. Result in any appreciable increase in the frequency of occurrence of an accidentpreviously evaluated in the license application (as updated);
ii. Result in any appreciable increase in the likelihood of occurrence of amalfunction of a structure, system, or component (SSC) important to safetypreviously evaluated in the license application (as updated);
iii. Result in any appreciable increase in the consequences of an accident previouslyevaluated in the license application (as updated);
iv. Result in any appreciable increase in the consequences of a malfunction of anSSC previously evaluated in the license application (as updated);
v. Create a possibility for an accident of a different type that any previouslyevaluated in the license application (as updated);
vi. Create a possibility for a malfunction of an SSC with a different result thanpreviously evaluated in the license application (as updated);
vii. Result in a departure from the method of evaluation described in the licenseapplication (as updated) used in establishing the final safety evaluation report(FSER) or the environmental assessment (EA) or the technical evaluation reports(TERs) or other analysis and evaluations for license amendments.
viii. For the purposes of SERP evaluations, SSC means any SSC which has beenreferenced in a staff SER, TER, EA, or environmental impact statement (EIS) andsupplements and amendments.
The SERP evaluation was conducted in accordance with the instructions contained in theEnvironmental, Health, and Safety Management System (EHSMS) Volume II,Management Procedures, EHS-6, Managing Change. The SERP reviewed the Mine Unit10 Notice of Intent to Operate and preoperational monitoring data and evaluated thisinformation as compared with the requirements of the licensing basis. The SERP alsoreviewed the Wellhouse 48 startup checklists and supporting documentation andevaluated this information as compared with the requirements of the licensing basis,including the following documents:

Technical Evaluation Reports issued in support of amendments to SUA-1534.
Title 10 Code of Federal Regulations
The proposed change will have no impact on CBR's ability to meet all applicable NRCregulations.
Source Materials License SUA-1534 ReQuirements
Amendment 21 to SUA-1534 dated January 29, 2007 was reviewed for specificrequirements related to approval and operation of a new Mine Unit and a wellhouse.
License Condition 9.3: This License Condition requires that CBR conductoperations in accordance with the representations contained in the LRA. Section 3.1.3 ofthe LRA discusses construction materials, instrumentation, and monitoring requirements.Section 3.3 also discusses instrumentation, including wellhouse injection and productioninstrumentation and wet building alarms for wellhouses. Section 7.2.3 of the LRArequires that leak tests be performed on all wellfield piping before placing the systeminto production operations.
The SERP reviewed the Wellhouse Start-up Checklist for Wellhouse 48. This checklistwas developed by the Wellfield Construction staff to document completion of allrequired actions before initiating operations in a wellhouse. Some of these actions arerequired by regulatory and licensing requirements, while some were developed over thecourse of mining experience at Crow Butte. Construction activities are governed byEHSMS Volume III, Operations Manual, Procedure P-15, Installation of WellfieldPipelines. The Maintenance Superintendent reviewed these items and stated that all hadbeen completed and the appropriate controls were in place.
A copy of the Wellhouse Start-Up Checklist is attached to this SERP Evaluation.Supporting documentation in the form of pressure tests and ground continuity checks arealso attached.
License Condition 9.5: This License Condition requires that CBR maintain anNRC-approved financial surety arrangement to cover reclamation of all existingoperations and planned expansions for the upcoming year. If such expansion is notcovered in the annual update to the existing surety arrangement, an updated surety mustbe provided to NRC at least 90 days before beginning construction.
The current surety arrangement approved by NRC and NDEQ includes the operation ofthe two wellhouses in Mine Unit 10 during 2007.

License Condition 9.10: This License Condition requires that CBR conductoperations within the permit area boundaries shown in the License Renewal Application(LRA), as amended. The SERP confirmed that Mine Unit 10 falls within this permit areaboundary.
License Condition 10.2: This License Condition requires that CBR construct allwells in accordance with the methods contained in the Section 3.1.2 of the approvedLicense Renewal Application (LRA). License Condition 10.2 also requires that CBRperform mechanical integrity tests (MIT) for all injection and production wells.
The well construction methods in use for Mine Unit 10 are the same as those described inthe LRA and contained in EHSMS Volume 1T[, Operations Manual, Procedure P-25, WellInstallation. MITs were performed in accordance with EHSMS Volume IM, OperationsManual, Procedure P-23, Mechanical Integrity Test (MiT). The SERP reviewed the MITinformation contained in the Notice of Intent to Mine (NOI) submitted to the NDEQ. Thepackage in the NOI included the MITs for required monitoring wells. MITs for futurewellhouses in Mine Unit 10 cannot be reviewed since these wells have not been installed.Therefore, the SERP can only review baseline restoration wells and the monitoring wellsof Mine Unit 10 and the injection/production wells for Wellhouse 48 for compliance withthis License Condition. All MIT data sheets were contained in the Notice of Intent toOperate Wellhouse 48 (or in the original Mine Unit 10 Notice of Intent) that wassubmitted to the NDEQ. These MIT data sheets were provided by the Senior Geologistand reviewed by the SERP. The 'records indicate that all MITs performed met therequirements.
License Condition 10.3: This License Conditions contain requirements forestablishing pre-operational baseline groundwater quality including well density,sampling frequency and parameters, and determination of groundwater restoration goals.
10.3(A): A total of 32 injection or production wells are identified asbaseline restoration wells for Mine Unit 10, which comprises 128 acres. The SERPreviewed the well placement. The wells meet the density requirement of this LicenseCondition (i.e., 1 per every 4 acres) and are evenly spaced in the Mine Unit. Sampleswere collected at least 14 days apart.
10.3(B): The baseline samples were analyzed for all parameters listed inthis. portion of the License Condition.
10.3(C) Groundwater restoration goals were proposed for Mine Unit 10that were based upon the mine unit average of all baseline restoration (BLR) wells. Thegoals are an arithmetic mean of the averages for the three samples taken for each of the32 baseline restoration wells.

The SERP determined to insert a restoration goal table for Mine Unit 10 into theapproved LRA to include all parameters required by License Condition 10.3(B). A copyof the approved Table is attached to this evaluation.
License Condition 10.4: This License Condition contains requirements fordetermining Upper Control Limits (UCLs) for shallow and perimeter monitor wellsincluding well density, sampling schedule, analytes, and UCL calculational method.
10.4(A) A total of 32 shallow monitors and 31 perimeter monitor wells areidentified for Mine Unit 10, which comprises 128 acres. The SERP reviewed the wellplacement. The wells meet the density requirement of this License Condition (i.e., 1 perevery 5 acres for shallow monitor wells) and are evenly spaced in the Mine Unit.Samples were collected at least 14 days apart.
10.4(B) The samples were analyzed for all parameters listed in this portionof the License Condition.
10.4(C) The proposed UCLs for each shallow and perimeter monitor wellwere calculated as required in this License Condition.
License Condition 10.16: This License Condition specifies the spacing for allperimeter monitor wells drilled after April 1999. Perimeter monitor wells may be spacedno greater than 300 feet from a wellfield unit and no greater than 400 feet between thewells. All of the perimeter monitor wells for Mine Unit 10 meet the spacing requirementsof the License.
License Condition 11.3: This License Condition requires that CBR implement theeffluent and environmental monitoring program in accordance with the programsubmitted on March 18, 1999. The approved program requires quarterly sampling of allprivate wells within 1 km of an active wellfield. Addition of Mine Unit 10 will requirequarterly monitoring of three additional private wells (Wells 20, 21, and 66). The SERPdirected that these wells be added to the sample schedule.
The SERP concluded that all specific license requirements would continue to be met ifthis change is approved.

The SERP reviewed the contents of the Environmental Assessment (EA) prepared byNRC in February 1998 to determine whether the proposed change could causesubstantive safety or environmental impacts.
Well construction and testing as described in the EA has been completed for the wellsassociated with Wellhouse 48.
Section 3.3.1 discusses leak testing of wellfield piping. The SERP reviewed thecompletion of pressure testing for piping systems associated with Wellhouse 48 andfound that they meet the intent of the EA.
Financial Surety
The proposed change is covered in the NRC-approved financial surety maintained byCBR and approved by Amendment 21 to SUA-1534 in the amount of $22,980,913. Thesurety estimate was based on the operation of two wellhouses (Wellhouse 48 and 49) inMine Unit 10 during 2007.
Safety Evaluation Report
The Safety Evaluation Report (SER) principally provides the basis for worker safety atCrow Butte and does not specifically address the issues related to approval of Wellhouse48.
Technical Evaluation Reports
The SERP reviewed the Technical Evaluation Reports (TERs) prepared by NRC staff tosupport amendments made to SUA-1534 since renewal in 1998. None of the TERsprepared since license renewal directly address issues related to approval of a newWellhouse for operation.
NDEQ UIC Permit
The SERP reviewed the requirements of the NDEQ UIC Permit that relate to startup ofMine Unit 10.
* The NOI was submitted as required on Page 2 of the permit and approved by theNDEQ (see attached letter).
Part II A 2 of the permit, Mine Unit Limitations, allows no more than five mine unitsin the mining stage, no more than five mine units in restoration (excluding those instabilization), and no more than three mine units constructed in advance of active

mining. The SERP reviewed the current status on Mine Units 1 through 9 anddetermined the following:
1. Mine Units Restored: One (Mine Unit 1)2. Mine Units in Restoration: Three (Mine Units 2, 3 and 4)3. Mine Units in Operation: Five (Mine Units 5 through 9)
In order to meet the limitations in this section of the permit, Mine Unit 5 must be placedin restoration before mining can begin in Mine Unit 10. Part HI C 3 of the permitcontains the restoration procedure, which requires that CBR notify the NDEQ inwriting and establish post-mining water quality in coordination with the NDEQ.These steps must be completed before injection may begin in Mine Unit 10.
* Restoration goals were determined for every parameter included in Table 2.6 (Page10) as required.
* All monitor and restoration wells were installed and baseline monitoring performedas required by permit.
* All monitor wells were shown to be functionally operational as required in Part E1l B2 (Page 14).
Degradation of Essential Safety or Environmental Commitment
SUA-1534 allows CBR to make changes as long as they do not degrade the essentialsafety or environmental commitments made in the application. The SERP determinedthat safety commitments made in the LRA and discussed in the EA have been met andthat startup of Wellhouse 48 in Mine Unit 10 will not degrade the safety andenvironmental commitments.
Based upon this evaluation of the licensing basis, the CBR SERP hereby approves startupand operation of Wellhouse 48 in Mine Unit 10-

1.) Nitrate was reported by the lab as NO 3 + NO 2 instead of NO3 as required in the permit. However,
only two samples, well 4024 collected 6/09/06 and well CM8-6 collected 5/02/02, were above the
detection limits. The restoration value is 10.0 mg/I while the average is 0.1 mg/l. Therefore, including

The Crow Butte Resources, Inc. (CBR) Safety and Environmental Review Panel (SERP)met to review and approve operation of Wellhouse 47A in Mine Unit 9 at the Crow ButteUranium Project.

Purpose of SERP Evaluation
The purpose of this evaluation by the CBR SERP was to review and approve Wellhouse47A for operation.
License Condition 9.4 allows CBR to make changes in the facility or procedures orconduct tests or experiments that are not presented in the approved application if suchchanges do not:

ii. Result in any appreciable increase in the likelihood of occurrence of amalfunction of a structure, system, or component (SSC) important to safetypreviously evaluated in the license application (as updated);
iii. Result in any appreciable increase in the consequences of an accident previouslyevaluated in the license application (as updated);
iv. Result in any appreciable increase in the consequences of a malfunction of anSSC previously evaluated in the license application (as updated);
v. Create a possibility for an accident of a different type that any previouslyevaluated in the license application (as updated);
vi. Create a possibility for a malfunction of an SSC with a different result thanpreviously evaluated in the license application (as updated);
vii. Result in a departure from the method of evaluation described in the licenseapplication (as updated) used in establishing the final safety evaluation report(FSER) or the environmental assessment (EA) or the technical evaluation reports(TERs) or other analysis and evaluations for license amendments.
viii. For the purposes of SERP evaluations, SSC means any SSC which has beenreferenced in a staff SER, TER, EA, or environmental impact statement (EIS) andsupplements and amendments.
The SERP evaluation was conducted in accordance with the instructions contained in theEnvironmental, Health, and Safety Management System (EHSMS) Volume II,Management Procedures, EHS-6, Managing Change. The SERP reviewed the Wellhousestartup checklists and supporting documentation and evaluated this information ascompared with the requirements of the licensing basis, including the followingdocuments:

The proposed change will have no impact on CBR's ability to meet all applicable NRCregulations.
Source Materials License SUA-1534 Requirements
Amendment 21 to SUA-1534 dated January 29, 2007 was reviewed for specificrequirements related to approval and operation of a wellhouse.
Mine Unit 9 was previously approved by the CBR SERP (see SERP 03-05 dated October23, 2003). Therefore, no review of monitor well location, installation or baselinesampling and Upper Control Limit determination is required for approval of Wellhouse47A.
License Condition 10.2: This License Condition requires that CBR construct allwells in accordance with the methods contained in the Section 3.1.2 of the approvedLicense Renewal Application (LRA). License Condition 10.2 also requires that CBRperform mechanical integrity tests (MIT) for all injection and production wells.
The well construction methods in use for Wellhouse 47A are the same as those describedin the LRA and contained in EHSMS Volume EIl, Operations Manual, Procedure P-25,Well Installation. MITs were performed in accordance with EHSMS Volume III,Operations Manual, Procedure P-23, Mechanical Integrity Test (MiT). All MIT datasheets were contained in the Notice of Intent to Operate Wellhouse 47A (or in theoriginal Mine Unit 9 Notice of Intent) that was submitted to the NDEQ. These MIT datasheets were provided by the Senior Geologist and reviewed by the SERP. The recordsindicate that the MITs performed in Wellhouse 47A met the requirements.
License Condition 9.3: This License Condition requires that CBR conductoperations in accordance with the representations contained in the LRA. Section 3.1.3 ofthe LRA discusses construction materials, instrumentation, and monitoring requirements.Section 3.3 also discusses instrumentation, including wellhouse injection and productioninstrumentation and wet building alarms for wellhouses. Section 7.2.3 of the LRArequires that leak tests be performed on all wellfield piping before placing the systeminto production operations.
The SERP reviewed the Wellhouse Start-up Checklist for Wellhouse 47A. This checklistwas developed by the Wellfield Construction staff to document completion of allrequired actions before initiating operations in a wellhouse. Some of these actions arerequired by regulatory and licensing requirements, while some were developed over thecourse of mining experience at Crow Butte. Pipelines. The Maintenance Superintendent reviewed these items and stated that all hadbeen completed and the appropriate controls were in place.
A copy of the Wellhouse Start-Up Checklist is attached to this SERP Evaluation.Supporting documentation in the form of pressure tests and ground continuity checks arealso attached.
Environmental Assessment
The SERP reviewed the contents of the Environmental Assessment (EA) prepared byNRC in February 1998 to determine whether the proposed change could causesubstantive safety or environmental impacts.
Well construction and testing as described in the EA has been completed for the wellsassociated with Wellhouse 47A.
Section 3.3.1 discusses leak testing of wellfield piping. The SERP reviewed thecompletion of pressure testing for piping systems associated with Wellhouse 47A andfound that they meet the intent of the EA.
Financial Surety
The proposed change is covered in the NRC-approved financial surety maintained byCBR and approved by Amendment 21 to SUA-1534 in the amount of $22,980,913.
Safety Evaluation Report
The Safety Evaluation Report (SER) principally provides the basis for worker safety atCrow Butte and does not specifically address the issues related to approval of Wellhouse47A.
Technical Evaluation Reports
The SERP reviewed the Technical Evaluation Reports (TERs) prepared by NRC staff tosupport amendments made to SUA-1534 since renewal in 1998. None of the TERsprepared since license renewal directly address issues related to approval of a newWellhouse for operation.
Degaradation of Essential Safety or Environmental Commitment
SUA-1534 allows CBR to make changes as long as they do not degrade the essentialsafety or environmental commitments made in the application. The SERP determined

that safety commitments made in the LRA and discussed in the EA have been met andthat startup of Wellhouse 47A in Mine Unit 9 will not degrade the safety andenvironmental commitments.
Based upon this evaluation of the licensing basis, the CBR SERP hereby approves startupand operation of Wellhouse 47A in Mine Unit 9.

The Crow Butte Resources, Inc. (CBR) Safety and Environmental Review Panel (SERP)met to review and approve the temporary release of the Restoration Room forunrestricted use.

Purpose of SERP Evaluation
The purpose of this evaluation by the CBR SERP was to review and approve thetemporary release of the Restoration Room for unrestricted use.
License Condition 9.4 allows CBR to make changes in the facility or procedures orconduct tests or experiments that are not presented in the approved application if suchchanges do not:

iii. Result in any appreciable increase in the consequences of an accident previouslyevaluated in the license application (as updated);
iv. Result in any appreciable increase in the consequences of a malfunction of anSSC previously evaluated in the license application (as updated);
v. Create a possibility for an accident of a different type that any previouslyevaluated in the license application (as updated);
vi. Create a possibility for a malfunction of an SSC with a different result thanpreviously evaluated in the license application (as updated);
vii. Result in a departure from the method of evaluation described in the licenseapplication (as updated) used in establishing the final safety evaluation report(FSER) or the environmental assessment (EA) or the technical evaluation reports(TERs) or other analysis and evaluations for license amendments.
viii. For the purposes of SERP evaluations, SSC means any SSC which has beenreferenced in a staff SER, TER, EA, or environmental impact statement (EIS) andsupplements and amendments.
The SERP evaluation was conducted in accordance with the instructions contained in theEnvironmental, Health, and Safety Management System (EHSMS) Volume II,Management Procedures, EHS-6, Managing Change. The SERP reviewed the alphasurvey results and evaluated this information as compared with the requirements of thelicensing basis, including the following documents:

Source Materials License SUA-1534 Requirements
Amendment 4 to SUA-1534 dated April 22, 1999 was reviewed for specific requirementsrelated to changes in the restricted area boundaries.
The NRC staff concluded that 10 CFR 20.1402 adequately defines criteria for thelocation of restricted area boundaries. Therefore, it can be the responsibility of thelicensee to determine if the location of restricted area boundaries meet the requirementsof 10 CFR 20.
A copy of the alpha survey results are attached to this SERP Evaluation.
Safety Evaluation Report
The Safety Evaluation Report (SER) principally provides the basis for worker safety atCrow Butte and specifically that a radiation area boundary be marked. License condition9.14 stated that the boundaries of the restricted areas shall be those identified in thesubmittal dated April 22, 1996. This condition was deleted with Amendment 4 datedApril 22, 1999.
Technical Evaluation Reports
The SERP reviewed the Technical Evaluation Reports (TERs) prepared by NRC staff tosupport Amendment 4, dated April 22, 1999. None of the TERs prepared since thislicense amendment directly address issues related to changes to restricted areaboundaries.
Degradation of Essential Safety or Environmental Commitment
SUA-1534 allows CBR to make changes as long as they do not degrade the essentialsafety or environmental commitments made in the application. The SERP determinedthat safety commitments made in the LRA and discussed in the EA have been met andthat the temporary release of the Restoration Room for unrestricted use will not degradethe safety and environmental commitments.
Based upon this evaluation of the licensing basis, the CBR SERP hereby approves thetemporary release of the Restoration Room for unrestricted use.

On April 22, 1999 License Amendment No. 4 to SUA-1534 was issued. As a result ofthe amendment, CBR is now allowed to change restricted area boundaries in accordancewith performance-based License Condition 9.4, which allows CBR to make changes inthe facility, process, or procedures based on evaluations and determinations made by theCBR Safety and Environmental Review Panel (SERP). This amendment eliminates theneed for CBR to request a license amendment every time a change is made in theRestricted Area, as identified in the License Renewal Application.
On September 24, 2007 the plant Restoration Room was surveyed for alpha surfacecontamination to temporarily release it for unrestricted use. The purpose of the release isto allow installation of new ion exchanges columns with associated plumbing. Byreleasing the room from restricted status and keeping it as a "clean area" during theconstruction, contactors will be able to access the area more freely and it allows them toutilize their own tools and equipment. Once the construction is completed and the newcolumns are placed in production the room will return to the restricted area.
In preparation for the survey all tanks, piping, and equipment were removed from theroom. The walls and the floor were power washed and the sump was emptied andwashed out. The sump was then isolated covered with a plywood lid. An alpha surveywas then performed on the floor and the three existing walls.. The fourth wall area is notsheeted and required no survey.
A grid for each approximately I m2 square was laid out for each of the four areassurveyed. The columns on the grids were designated by letters of the alphabet and therows were designated by consecutive numbers. The floor grid started in the SW comer(A-I) and the first row was on the top of the concrete curb. For the wall grids the firstrow of each wall was on the horizontal sheeted surface (the top of the finished wall). Theremainder of the rows went down the surface of the walls. The A-1 grid square for thenorth wall was in the NW comer, the A-I grid square for the east wall was in the NEcomer, and the A-1 grid square for the south wall was the SE comer.
The center of each grid area for each of the four survey areas was surveyed for totalalpha contamination (instrument survey). Release limits for the areas were in accordancewith the NRC guidance document Annex B Guidelines for Decontamination of Facilitiesand Equipment Prior to Release for Unrestricted Use or Termination of Licenses forByproduct, Source, or Special Nuclear Material. If the results of the instrument survey forany of the grid squares exceeded 1000 dpm/100 cm2, which is the Annex B limit forremovable contamination, a smear sample for removable contamination was collected.Results of all of the total alpha surveys and removable alpha surveys collected in the areawere below the Annex B requirements. After the surveys were completed, boundary chairs were placed on all of theperimeters of the room. Signs were hung on all of the chains stating "Do Not Enter" anda note was left in the operator logbook instructing employees not to enter the room frominside the plant. The designated entrance point into the room is from the outside since nosurvey meter has been placed at the door from the plant. The room will be maintained asan unrestricted area until construction of the unit is complete.
