April will now have more for attendees and vendors with theaddition of recovery agents to the week’s events. We are addingthe Repo Expo by Flacars, the Florida repo association. TheHilton at Disney remains the host hotel and as before we havethe Holiday Inn for additional space. The recovery agents willalso be using nearby hotels for meetings and events. This will

give everyone more to see and do in Orlando.Be sure to make your hotel reservations early — this will be a great show and

rooms will fill fast. With free food, drinks, entertainment and demos, the FloridaTow Show is the best of the year to have fun, learn and check out our huge displayof vendors. The Finesse of FuelDiesel fuel — a necessary evil towers wish they did not have to purchase. As

prices rise, everyone is looking for ways to save fuel but many forget about thefilters. Today’s injectors are expensive and easily damaged. Diesel fuel is not cleanand must be filtered; all filters are not the same. Be sure to check the engine specsbefore purchasing filters — some may allow impurities through that damage theinjectors. Cheap may not be better in the long run when you spend thousandson repairs. Without freezing weather, some fuel additives are a waste of moneyso be sure to do your research before buying additives — their ads sound goodbut only a few will really give results.

Towers are now starting to revert back to gas engines since the price of gas isless than diesel, and companies that impound may have access to free gas beforejunking cars. Once again filters are important when using unknown fuel fromsalvage vehicles. Be sure to properly store gas in approved containers and dis-pensers.

Voter Purge on HoldFlorida’s Supervisors of Elections have

stated that they are “on hold” in terms ofmoving forward with a proposed voterpurge because of the time it will take for thestate and federal government to enter into aMemorandum of Agreement with regard tothe use of a federal database to identify in-eligible voters. The Supervisors have alsonoted that they need backup documenta-tion to verify the information contained inthe database, which is not currently avail-able to them. According to elections offi-cials, it can take up to two months to removea potential ineligible voter from the rolls, be-cause there must be notice and an opportu-nity to prove eligibility. Because of the tighttimeline, this cannot occur before the Au-gust 14 primary.

LEGISLATIVE ISSUESRepresentative Nelson and Senator RichterRelease White Paper on Prop-erty Insurance

Representative Bryan Nelson (R –Apopka) and Senator Garrett Richter (R –Naples) released a white paper they believeemphasizes the hidden risks insurance pol-icyholders would face if Florida were to ex-perience an extreme storm event. The

Florida Hurricane Catastrophe Fund (CATFund) and Citizens Property Insurance Cor-poration (Citizens) are in the best financialshape they have been in years. However, thepaper released by Nelson and Richter indi-cates that this masks the true vulnerabilityof these programs and the risks to policy-holders.

There has been considerable discus-sion and debate in the Legislature pertain-ing to the artificially low rates for citizenspolicyholders and concern about the vul-nerability of the CAT Fund. However, solu-tions have not proven easy to find andcritics argue that this is not a true crisis, butone being manufactured by private insur-ance companies. Consumer advocate andinsurance attorney Sean Shaw responded tothe white paper by saying, “These are moreridiculous scare tactics coming straightfrom the insurance rate hike dream team.”

The white paper states that a stormcosting citizens more than $13 million couldresult in a doubling of premiums for Citi-zens policyholders the following year. Shawresponded that the odds of this are about 1in 100, and that raising rates too high willmake Florida’s economic recovery more dif-ficult.

This all points to another long, pro-tracted debate on insurance issues next ses-sion, with no clear solutions in sight.

GamingRecent media reports indicate that

Genting Group may be considering a dualstrategy for introducing destination resortsto Florida by continuing a push for legisla-tion and also testing ballot language andconducting focus groups geared toward apotential constitutional amendment. How-ever, in spite of these reports, it is doubtfulthat Genting is launching a serious effort toseek a constitutional amendment. Addi-tionally, House and Senate leadership haverecently stated that they intend to take aglobal look at gaming in Florida through leg-islation next session, which is likely to in-clude the Seminole Compact.

Dear Fellow Towers,

This president’s letter will be covering multiple issues, so please bear with me.

First, I would like to say the American people are going to haveto make a decision on the future of this country. It does not matter what party youbelong to, you are going to have to vote on behalf of your future and that of your chil-dren and grandchildren. Talk to your friends and family and push everyone you knowto vote on November 6. The guy who is running the country now, I can’t even call himPresident, never worked for anybody, never owned or operated a business and neverhad to worry about payroll or writing a check. I am telling you from the bottom of myheart, if he gets re-elected he will change our lives forever and I don’t mean in a goodway. There are two more things I would like to add before I move on – gun rights andSupreme Court Justices. He will take away your Second Amendment rights – gunownership and that is just part of the problem.

The PWOF will be holding its last Board Meeting of 2012 October 13 in DaytonaBeach. Nominations will include the entire Executive Board – President, 1st, 2nd and3rd Vice Presidents, Secretary/Treasurer and four Directors at Large. I have to saythese positions are real jobs. There is not a day where I do not get at least two to threecalls regarding our industry. It is not uncommon at a Board meeting for the ExecutiveBoard to be in session for seven to eight hours. It takes three weekends a year and aweek at the tow show to be part of the Executive Board. There are over 30 other regularBoard Members such as Area Chairman and Regional Directors, most of them comefrom all parts of the state and some try to help at the annual tow show each year. Soif you plan on running for an office or a position, please make sure you understandthe commitment required. You must show up for meetings and you must participate.

I have another subject I would like to address - one that I really feel stronglyabout. In recent months we lost two seasoned tow truck operators: one on the westcoast and one on the east coast. They had families and we miss them. I understandthat both of these accidents were due to front wheel blowouts. They were both oper-ating ultra heavy-duty units. Without going into the specifics, i.e.: year/ make/ model,I did some research of my own. I too have an ultra heavy-duty unit with new floaterfront wheels. The manufacturer says that these floater front tires are not to exceed 55mph. What I did not know is that as you go faster on these tires, the tire rating de-creases capability. I urge you to research this on your own with your tire representa-tive. I performed a little experiment. I was on I-95 with a speed limit of 70 mph. Beingin a T800 Kenworth so high off the ground with cars passing me, I thought maybe Iwas not doing the speed limit. But in reality I had exceeded the set speed limit. WhatI came to realize is that because of the height of the truck and trying to keep up withtraffic flow, it was very easy to forget how fast I was really going. In the past six years,if memory serves me right, we have had four major accidents from front wheelblowouts, three of which ended in fatalities. All four were ultra heavy-duty units andnot loaded. So please take some time and talk to your managers and drivers, educatethem if you will, about the hazards we face every day with these big trucks.

indicating that Florida’s unemployment rate continues to fall, but mostly because workers areleaving the workforce rather than finding jobs. The current unemployment rate is 8.3%, but ifadjusted for workers who have left the workforce, it would be 9.5% according to the report. Thereport also indicates that Florida foreclosures are up 23% for the first six months of 2012 ascompared to 2011, giving Florida the fifth highest foreclosure rate in the nation. Florida’s per-sonal income is up 0.7%, ranking Florida 38th nationally. The report concludes that Floridacould benefit from lower home prices, which might attract baby boomers as they retire, butthat the economic recovery will be slow.

The Revenue Estimating Conference met this week to discuss Florida’s economy. Stateeconomists expect that economic woes in Europe will mean fewer international tourists. Thereal estate market has begun to improve, but job growth remains sluggish. Previous forecastswere adjusted slightly, but remain largely unchanged. Tourism is expected to decline by up to2 percent in the next 12 months before picking up again slightly by 2014. Significant growth inthis sector is not expected until 2015.

State BudgetAlthough state revenues are strengthening, Governor Scott has asked state agencies to de-

velop budget requests that reflect a 5% cut over this year. To achieve this, the Legislature willlikely have to look toward further reductions in the workforce and services. In the past two years,the Legislature has reduced the state workforce, cut pension benefits, closed prisons and re-duced reimbursement rates for hospitals and nursing homes. However, this is an improvementover last year, when agencies were asked to cut 10% from their budgets. Also, the agency budgetrequests do not reflect the final budget, which must be negotiated by the legislators during thelegislative session.

School GradesThe Miami Herald recently reported that state education administrators omitted a portion

of the formula used in calculating school grades. After the error was corrected, 48 schools in SouthFlorida had higher grades, including 31 in Miami-Dade County. Miami-Dade Superintendent Al-berto Carvalho was openly critical of the system of accountability currently in place, saying, “Ihave lost confidence in an accountability system that is not only ever-changing but fails to accu-rately depict student learning and the effectiveness of teachers.” The Florida School Boards As-sociation passed a resolution in June stating that Florida’s high-stakes testing structure has had anegative effect on economic development and called for a revised accountability system that in-cludes data from multiple sources, with a limited emphasis on standardized testing.

Supreme Court Upholds Federal Affordable Care ActThe United States Supreme Court recently upheld the federal Affordable Care Act. Gover-

nor Rick Scott’s office announced that Florida will opt out of spending about $2 billion more toexpand Medicaid and will not create insurance exchanges. Scott said that Florida will followthe law, and anything that is required of states will be done. However, he also noted that sub-stantial portions of the law are not effective until 2014 and nothing is required of the states be-fore the 2012 election. Presidential candidate Mitt Romney has pledged to repeal the Act if heis elected. In recent days, Republicans in Florida have argued that the expansion of Medicaidcalled for in the Act would be a “job-killer” while Democrats have argued that the expansionwould bring Florida 65,000 jobs.
