Appellant’s Concerns
• Proposal not consistent with “smart growth”
– Staff response: The proposal is consistent with the Growth Management Plan (GMP) because it helps to ensure that the existing land use pattern is preserved and enhanced, while supporting appropriate infill development.
• GMP Future Land Use Objective 1.5 addresses smart growth
• GMP Future Land Use Policy 1.1.2 addresses land use patterns in the Traditional City

• Proposal is too complicated and it will become difficult to build a marketable duplex
– Staff response: The proposal provides flexibility for duplex design. Staff will work with applicants to address design challenges, and applicants may apply for a design variance.
• GMP Urban Design Element 5.2 calls for the City to adopt design standards for duplex development.

Appellant’s Concerns
• Proposal will negatively impact housing quality and affordability
– Staff response: The proposal is intended to improve the quality of housing by helping it fit better with existing development. The number of duplex units built each year is too small to impact overall market affordability.
• In 2015, 2182 dwelling units were built, including 22 duplexes (1% of the market).

• The proposal is consistent with the public interest, because it preserves positive elements of the streetscape
• The proposal improves land use compatibility by including design criteria that help new buildings fit into existing neighborhoods
• The proposal allows for orderly development by providing consistent, clear development standards
• The proposal meets the standards of state and local law by providing due public notice and a hearing

Review process • Staff has conducted research, had extensive
public outreach, and made recommendations based on principles found in the GMP
• MPB has had several public hearings, weighed the evidence, and made a recommendation for approval
• Next step is to hold a public hearing to allow all parties, not just the appellant, to share their thoughts with the City Council

• Deny the appeal, and ask staff to prepare an ordinance.
• Request changes, and remand the case back to the MPB.
– Staff concern: MPB has already had 3 meetings on this topic.
• Uphold the appeal, and withdraw the case.
– Staff concern: No opportunity for any public comment except from the appellant.

Staff Recommendation
• Staff finds that the appellant has not shown good reason to delay or deny a public hearing.
– Request for ending the process today would not give due notice or opportunity to comment for others who may want to provide input
• Staff recommends moving forward with a hearing for an ordinance consistent with the MPB recommendation to approve LDC2014-00363.
