WebSphere Application Server Notice

The following terms and conditions shall apply to the WebSphere Application Server product("Program") portion of the Ascential Software product in the event the Program is installed,

and to the subcomponents of the Program to the extent such Program subcomponents are

provided with or used by the Program or the Ascential Software product. The terms and

conditions specified below are supplemental to the license terms and conditions applicable

with respect to the Ascential Software product. In the event of any conflict between the terms

and conditions applicable to the Program and the terms and conditions related to the

Ascential Software product, the terms and conditions related to the Program shall prevail with

respect to the Program and its subcomponents.

WebSphere Application Server 6.0 Terms and ConditionsYou are responsible for complying with all licenses, agreements and copyright laws for third-

party software that you use in conjunction with the Program. Nothing herein grants you any

greater right than you may otherwise have to use third-party software not distributed with this

Program.

UNLIMITED COPY COMPONENTS: You are authorized to install and use an unlimited number

of copies of the following Program components on any of your machines to support your

authorized use of the other components of the Program.

RESTRICTED USE COMPONENTS: Your use of the following Program components is limited

to the uses specified below in support of the other Program components. You may not use the

following Program components for other purposes.

1. CLOUDSCAPE COMPONENTS: You may use the IBM Cloudscape components solely for

development, testing and evaluation of applications and for production use only as a datarepository for data generated and managed by WebSphere Application Server.

Some examples of authorized production use include:

(i) provide persistence of "HTTP Session Objects" using the "session persistence" component

of the Program to support your authorized use of such component;

 

(ii) provide a data repository for the UDDI Registry component of the Program to support your

authorized use of such component;

(iii) provide a data repository for the Scheduler and EJB Timer components of the Program to

support your authorized use of such components; and

(iv) provide a data repository for the messaging engine component of the Program to support

your authorized use of such component.

No IBM Cloudscape components may be used separately from the Program, or for any other

purpose, or in support of any other programs. If you wish to license IBM Cloudscape for any

use beyond the limits of this license, please contact an IBM sales representative to obtain the

appropriate licenses.

Benchmarking

The benchmarking terms below apply to the Program or subcomponents:

You may disclose the results of any benchmark test of the Program or its subcomponents to

any third party provided that you (A) publicly disclose the complete methodology used in the

benchmark test (e.g., hardware and software setup, installation procedure and configuration

files), (B) perform your benchmark testing running the Program in its Specified Operating

Environment using the latest applicable updates, patches and fixes available for the Programfrom IBM or third parties that provide IBM products ("Third Parties"), and (C) follow any and all

performance tuning and "best practices" guidance available in the Program's documentation

and on IBM's support web sites for the Program. If you publish the results of any benchmark

tests for the Program, then notwithstanding anything to the contrary in any agreement

between you and IBM or Third Parties, IBM and Third Parties shall have the right to publish the

results of benchmark tests with respect to your products provided IBM or Third Parties

conditions may be different from the terms for the Program and Ascential Software. Your useof such components or portions thereof, as indicated, is subject to the terms of the associated

license agreement provided or referenced in this section and not the terms of the Program or

the Ascential Program Pr Software.

JACL 1.3.1. The Program includes Jacl 1.3.1, consisting of the <was_install_root>\lib\jacl.jar

and <was_install_root>\lib\tcljava.jar. IBM obtained this software code under the terms and

conditions reproduced below, and the Jacl software is provided to you under these terms and

use", you may not allow more than the maximum number of authorized users to Use the

Software concurrently.

Ownership

The Software is owned and copyrighted by HP or its third party suppliers. Your license confers

no title or ownership in the Software and is not a sale of any rights in the Software. HP's third

party suppliers may protect their rights in the event of any violation of these License Terms.

Copies and Adaptations

You may only make copies or adaptations of the Software for archival purposes or when

copying or adaptation is an essential step in the authorized Use of the Software. You must

from defects in materials and workmanship after the date of purchase for the period specified

above. If HP receives notice of such defects during the warranty period, HP will, at its option,

either repair or replace products which prove to be defective. Replacement products may beeither new or equivalent in performance to new.

HP warrants to you that HP Software will not fail to execute its programming instructions after

the date of purchase, for the period specified above, due to defects in materials and

workmanship when properly installed and used. If HP receives notice of such defects during

the warranty period, HP will replace Software which does not execute its programming

instructions due to such defects.

HP does not warrant that the operation of HP products will be uninterrupted or error free. If HP

is unable, within a reasonable time, to repair or replace any product to a condition warranted,you will be entitled to a refund of the purchase price upon prompt return of the product.

Alternatively, in the case of HP Software, you will be entitled to a refund of the purchase price

upon prompt delivery to HP of written notice from you confirming destruction of the HP

Software, together with all copies, adaptations, and merged portions in any form.

HP products may contain remanufactured parts equivalent to new in performance or may

have been subject to incidental use.

Warranty does not apply to defects resulting from:

(a) improper or inadequate maintenance or calibration; (b) software, interfacing, parts orsupplies not supplied by HP, (c) unauthorized modification or misuse; (d) operation outside of

the published environmental specifications for the product, or (e) improper site preparation or

You aregranted a royalty-free right to reproduce and distribute the HP-UX Runtime Environment,for Java provided that you distribute the HP-UX Runtime Environment, for the Java 2Platform complete and unmodified, only as a part of, and for the sole purpose of runningyour Java compatible applet or application ("Program") into which the HP-UX RuntimeEnvironment, for the Java 2 Platform is incorporated.

Java Platform Interface. Licensee may not modify the Java Platform Interface ("JPI",identified as classes contained within the "java" package or any subpackages of the "java"package), by creating additional classes within the JPI or otherwise causing the additionto or modification of the classes in the JPI. In the event that Licensee creates any Java-related API and distributes such API to others for applet or application development,

Licensee must promptly publish broadly, an accurate specification for such API for freeuse by all developers of Java-based software.

You shall not be restricted hereunder from exposing or documentinginterfaces to software components that use or access the HP-UX Runtime Environment,for the Java 2 Platform.
