Des Hudson was born in Halifax, Yorkshire and graduated in law from the University of Leeds in 1977. Three years later, he qualified as a solicitor, working in private practice until 1987. During that time, he became a salaried partner in a major pro-vincial law firm in the north west of England, specialising in crime and child protection work.

In 1987, Des joined the Yorkshire Building Society as an assistant solicitor and held a number of positions during five years there, before taking up the post of Head Of Lending at the Britannia Building Society. He became

ANDREW CAPLEN Andrew has been the Law Society

Council member for Hampshire and the Isle of Wight since 2000 and has a particular interest in access to justice. He was one of the co-authors of the Law Society’s Access to Justice Review and has written and spoken widely on access to justice and legal aid issues.

Andrew was brought up and educated in Hampshire and has worked in Hampshire throughout his legal career. He has had experience in a number of areas of law since qualification. Andrew was chair of the

TAKING CONTROL OF JUDGMENT ENFORCEMENT

High Court Enforcement Officers (HCEOs) must now send a ‘Notice of Enforcement’ letter to the judgment debtor giving them seven clear days to make payment of what they owe in full. This notice falls under the first of four new stages known as the ‘Compliance Stage’. If they pay

With the introduction of Part 3 of the Tribunals, Courts & Enforcement Act 2007 and the subsequent Taking Control of Goods Regulations 2013 on 6th April 2014, the enforcement industry received its first significant legislative change for over 10 years. Here we look at the changes to High Court enforcement.

in full within this time, they will only be charged a fixed fee of £75 plus VAT.

If the debtor cannot pay in full or makes no contact within the notice period, the Enforcement Agent (EA) attends with a writ of control, the renamed writ of fieri

facias, to take control of (seize) goods to secure the debt. This is ‘Enforcement Stage 1’ and the fees are set at £190 plus VAT and 7.5% of the sums to be recovered (the writ amount) exceeding £1,000.

The case could move to ‘Enforcement Stage 2’ if when the EA attends the debtor refuses to agree to an acceptable payment arrangement and/or sign a controlled goods agreement (walking possession). The case can also be moved to Stage 2 if the debtor breaks an agreed payment arrangement from a previous stage. The fee for this stage is a flat £495 plus VAT.

If the EA has to arrange the removal of goods, the ‘Sale or Disposal Stage’ is triggered. The fee for this stage is set at £525 plus VAT and 7.5% of the debt over £1,000. This will include the disbursements incurred for removal such as a tow truck.

Goods taken into control and removed must be held for seven clear days before sale, rather than the four days stated in the previous regulations. Locksmith,

storage and auctioneers fees are recoverable from the debtor or from the proceeds of sale. The current abortive fee of £60 plus VAT has been replaced by the Compliance Fee, set at £75 plus VAT, which is payable by the creditor if the matter is unenforceable. Days and times of attendance have changed to allow enforcement seven days a week between 06:00 and 21:00. Enforcement outside these times may be permitted if there is good reason.

HCEOs can still force entry to commercial premises. However, in residential premises, they may no longer enter through a window, just through a normal means of access such as a door. The ‘tool of the trade’ exemption rules are pretty much unchanged, except that the regulations now state that any claim can only be made for goods up to a value of £1,350. Under the new regulations, all EAs have to be certificated by a judge, in a similar way to bailiff certification, to demonstrate their knowledge of the relevant laws and that they are a fit and proper person. The Sheriffs Office are Authorised High Court Enforcement Officers, covering all of England and Wales. We are the firm featured in the award-winning BBC show ‘The Sheriffs Are Coming.’
