Kemp Little has become the rst law rm to sign up to Oracle’s new legal global practice managementsystem, which was unveiled at the start of 2019, albeit the roll out is being delayed thanks to COVID-19.

The system selection was led by chief digital ocer and co-founder of Kemp Little Innovation, GerardFrith, with close involvement of chief operating ocer Siddhartha Mankad. Financial accountant EmmaNeary is the project lead and the rm is working with Cubix Group as its systems integration (SI) partner.Cubix provides strategy, implementation, admin and maintenance services for Oracle.

Frith joined Kemp Little in February 2019 and has been involved since then in the selection process. Hetold Legal IT Insider:

Kemp Little has been looking at a new practice management system for around two years and has lookedat Fulcrum Global Technologies and Thomson Reuters Elite 3E in detail. Frith said: "What I did last yearwas bring them all together and run against that a detailed analysis of Oracle." He adds: “It look longerthan expected but you don’t do the rst legal system without kicking the tyres hard.”

Frith says that a few things stood in Oracle’s favour but says:

We started this process a long time ago and there are lots of reasons for that. It’s Oracles' rst dealand we needed to make sure we’re getting what we need.” He adds: “Probably one of the biggestbits was going through the SI selection process. We decided on Oracle in principle a while ago andseveral SI options were open to us."

Page 8: Legal IT Insider€¦ · Top stories in this issue Kemp Little becomes rst to select Oracle's new legal PMS LawTech UK sandbox will "accelerate and embed" innovation All the latest

Another attraction was the anticipated speed of implementation, which Frith initially said would take sixmonths, however that has been extended due to the COVID-19 crisis.

Frith says that Oracle has added the legal billing functionality required including providing for counselfees and interest on client accounts. He says: “It’s a big system and there is a lot of work to congure it towhat we want,” but he adds: “We're open to changing our own processes in order to make for way forbetter best practice. We're not sweating the detail – it’s really easy to get into an argument over whatelds are called but it’s not worth getting into that nonsense.

I wanted to put us in a position where we have a strategic advantage and can leverage a bunch ofcapabilities available outside of the legal sector. Some of the best professional services rms useOracle. The fact that they are not law rms doesn’t make a dierence. Oracle is in a position toprovide the things that law must have. It has forecasting and enables new kinds of feearrangements. It has powerful data analytics and matter management capability.

There's no point in buying a top-quality system road tested by thousands of organisations if you’regoing to butcher it.

Kemp Little is a tech rm and its lawyers are more tech savvy than many if not most. But this isundoubtedly a bold move and will be closely watched by the market in terms of any disruption to billing –albeit COVID-19 will make that harder to monitor.

Frith says that the ambition is to manage the business from top to bottom with data. He says:

Oracle looked like a potential new entrant to the legal PMS market shortly after the turn of the centurywhen it teamed up with Keystone Solutions in a winning pitch to Cliord Chance. The system, selected byCliord Chance in 2002 and still in use at the magic circle giant today, integrates Keystone’s time andbilling and client management applications with Oracle’s database and nancial applications. However,Oracle didn't enter the legal ERP market as expected and its deal with Kemp Little will be regarded as atest case for the new system.

We want data to drive our decision making and every aspect of our work for clients. It’s aboutbuilding a dierent kind of engagement with fee earners. There’s a huge link with knowledgemanagement – the stu that goes with it is not just about the implementation of a new PMS butdigital transformation and new ways of thinking. We have lots of data in the PMS to understandhow a matter is done.

The legal sector has widely welcomed a new initiative between Tech Nation, the Lawtech Delivery Paneland the Ministry of Justice, to support digital transformation, including the launch of a LawTech Sandbox.

LawTechUK, which has been facilitated by investment from the UK Government last year of £2million, willfocus on increasing awareness and understanding of lawtech and fostering transformative innovation forthe legal sector.

The initiative includes the LawTech Sandbox, an SME Dispute Resolution platform, an online hub andtraining centre, and guidance and tool kits.

The Sandbox is inspired by the FCA’s Regulatory Sandbox, which was set up in 2016 to support innovativeUK nancial services rms delivering in the interests of consumers. It has been widely attributed asplaying a key role in the growth of the ntech sector.

With the COVID-19 crisis accelerating the need for change and digitisation of the legal industry, TheSandbox will bring together technologists, the legal and business community, and public bodies, tosupport more innovative legal technology coming to market.

It will be delivered in collaboration with the Solicitors Regulatory Authority, Legal Services Board,Information Commissioner’s Oce, the Ministry of Justice and others.

Whilst the pace of technology adoption in the legal sector has been slow to date, investment inUK lawtech tripled in the last two years, with starts ups and scale ups in UK lawtech now attracting a totalof £290 million in investment and employing nearly 4,500 people.

Stuart Whittle, business services and innovation director at Weightmans told Legal IT Insider:

Page 13: Legal IT Insider€¦ · Top stories in this issue Kemp Little becomes rst to select Oracle's new legal PMS LawTech UK sandbox will "accelerate and embed" innovation All the latest

What’s interesting if not surprising is that innovation in technology is now being seen as a potential postCOVID-19 saviour. Asked for her thoughts on the launch of LawTechUK Dana Denis-Smith, founder andCEO of Obelisk told Legal IT Insider:

She adds: “As a female founder, obviously I hope that the community that takes part will be diverse – bothin terms of supplier diversity (SMEs not just the usual Big rms) but also from a pure D&I perspective withgender/ BAME.” And says: “It shows that it was felt we needed a more coordinated eort to drive andembed innovation so it’s a great endorsement that more not less innovation is needed as we enter thesecond decade of deregulation in the UK legal market. For those of us advocating for change – from new

As with comedy, timing is everything. In circumstances where within a matter of weeks, if not days, law rms have embraced ways of working that previously were entirely impossible and impractical, then there is a real opportunity to promote the take up of technology to support their people andprocesses.

This is great news and certainly in this age of disruption, it’s a great reminder that tech can come tothe rescue and really embed innovation.

delivery models, new ways of thinking about where and how people work and how to reimagine aprofession that hasn’t really worked for everyone – consumers and professionals alike – it is certainly agreat start for a wider conversation and an opportunity.”

This echoes comments made in a Law Society press release in which president Simon Davis said:

LawTech director Chris Grant said:

Innovation in technology is a key driver of productivity growth in the legal sector. The adoption ofnew technologies could boost the sector up from 1.3% per year to 2.7% per year – and every £1spent on legal services supports nearly £1.50 in spending across the entire UK economy. This movewill provide a huge boost to innovation by enabling start-ups and law rms to test propositionswithout falling into regulatory breach.

The Legal industry has struggled with the adoption of technology, and has been somewhat resistantto change. Recent events have brought about a shift, rms are having to try new approaches andthink about how to do things dierently but there are still hurdles to overcome. The introduction ofthe Lawtech Sandbox is a huge leap over one of these hurdles; along with new levels ofcollaboration across the ecosystem this gives an opportunity to turbo-charge the industry and bringabout real change.

New platforms

The new SME dispute resolution platform will oer an alternative, elective method to resolve latepayments and address the £11.6bn paid in litigation fees and the £50bn in late payments currently arisingeach year.

Plans also include building the Lawtech Online Hub and Training Centre, an online environment with freedigital courses on legal technology and open access data on the lawtech sector, and releasing a seriesof Lawtech toolkits addressing areas of legal uncertainty or challenges around new technologies, including on any matters arising in the Lawtech Sandbox.

Dr Anna Donovan, Vice Dean (Innovation) for the Faculty of Laws, University College London, said:

Knowledge is at the core of what we do and fundamental to the collaboration, curiosity andcondence that is necessary to support the digital transformation of the market. Now, more thanever, it is critical that the whole sector has access to reliable and multi-disciplinary education andtraining. The Lawtech Online Hub and Training Centre will meet this need by oering a single-source of authoritative information, providing substantive and skills-based training that can beaccessed remotely and for free by the whole sector.

LawtechUK is also launching a search for a technical delivery partner for the Lawtech Sandbox. Interestedparties can nd more information here. Plans will be conrmed over the coming months, asthe Lawtech Sandbox pilot is established.

Additionally, applications have opened giving the opportunity to join the Lawtech Delivery Panel, tosupport the work of LawtechUK. Of particular interest are technologists and leaders in the eldof lawtech, passionate about advancing the legal sector through technology, for the benet of all.

EMEAIn a signicant win for Linetime, leading Northern Ireland commercial practice Tughans Solicitors hassigned up as a client of Liberate System following a detailed analysis of the market.

Tughans is an iManage client and uses Intapp for time recording. In addition to the requirement that itsnew practice and case management system improves eciency, for Tughans it was key that Linetimeintegrates with those core systems. Linetime’s approach to converting data from its legacy Axxia systemsecured the decision.

Tughans’ contracts and technology partner Adrian O’Connell said: “We were impressed by Linetime’sapproach to data migration, taking control of the whole conversion process from start to nish ratherthan putting the reliance on our team or a third party to prepare the data in advance. The fact thatLinetime had also converted from the Axxia system many times previously also gave us additionalcondence.”

Linetime was acquired by PracticeEvolve in February but is continuing to operate under its own brand.

The move has proved extremely timely as the island’s Royal Court (Family division) is now activelyencouraging the use of electronic legal document bundles for all hearings. Ideally suited to the Court’sdemands, Zylpha is winning many friends and gaining huge interest amongst other local practices.

Davies said: “The decision to go with Zylpha is part of a broader programme of adopting innovation aimedat driving client service levels. Barry Nilsson has chosen legal business intelligence solution, BigHand Quantum, to underpin nancialvisibility and reporting excellence in the rm. Having dramatically expanded its national footprint inrecent years to incorporate six oces, the Brisbane-headquartered rm was in need of a robust, accurateand easy-to-use nancial reporting solution with real-time data analytics into key nancial metricsincluding protability.

After a period of sustained growth, it became apparent that the rm’s current nancial reporting solutionwas not t for purpose, with various challenges around accurate nancial reporting, especially onprotability.

Andrew Price, chief operating ocer at Barry Nilsson explains, “We changed our PMS provider recentlyand needed a way to surface the data for accurate nancial reporting, and to help us make informed,data-driven business decisions. Having reliable, timely nancial data is now vitally important, not only forthe nance teams, but also for lawyers, and to better understand and engage with clients.”

“We chose to swap our current reporting tool for BigHand Quantum as we could see the time savings itwould bring to our nance teams by reducing manual tasks. It was clear that the solution was an easy wayto provide our lawyers with the key nancial data they need. The winning factor was how quick theimplementation process is, and that the solution is fully scalable for future growth of the rm.”

UK businesses spend £1.59m and14 years annually on DSARsAn independent survey amongst 100 DataProtection Ocers (DPOs) has exposed thesignicant burden placed on UK businesses ofcomplying with Article 15 of the GDPR. The research, commissioned by British data privacy expertsGuardum, revealed in May that UK businesses arespending £1.59 millioni  and 14 person yearsannually on completing Data Subject AccessRequests (DSARs), which requires data controllers toprovide data subjects with a copy of their personaldata within 30 days, or risk a ne of €20 million or4% of turnover from the ICO.

The independent research, conducted by SapioResearch among 100 DPOs from companies with250 or more employees between 29th April and 5thMay 2020, also highlights the challenges ofmaintaining compliance during lockdown. Seventy-ve percent of DPOs polled admit struggling to meetdata compliance obligations while working remotelyand 30% fear they will be overwhelmed by a post-pandemic DSAR storm fuelled by requests fromfurloughed or sacked employees. Three in ve DPOsare fearful that they will not have the resources todeal with an uptick in requests following the returnto work.

Settlement reached in rst everEnglish Technology andConstruction Court Zoom trialThe rst ever entirely remote Technology andConstruction Court trial in English legal history hasreached a conclusion, having been conducted acrossvideo-conferencing platform Zoom.

The settlement resulted in liability for Barnet Councilof over £3m following the repeated ooding of afamily home. The case was brought by theconstruction law specialist Barton Legal, alongsidePeters & Peters and two members of 39 EssexChambers. Having taken four years to reach trial, theHonourable Mrs Justice Jeord, DBE, rejected thedefendant’s application to adjourn the case, infavour of Zoom.

With evidence supplied to the court virtually, andwith Paul Darling OBE QC’s cross examinationconducted by video, the cyber-secure video streamwas open for public viewing, with up to 40 people, including journalists and members of the public, watching at a time – an unusually high number for acase of this kind.

Rob Westmacott, co-founder of Guardum said: “Thisresearch graphically illustrates the huge burden thatdata privacy professionals are shouldering tomaintain data compliance. The Covid-19 pandemichas tipped an already dire situation into a potentialmelting pot of requests, with fears that the return towork and the ensuing post-mortem by furloughedand sacked workers will overwhelm data complianceteams.”

Where Skype for Business has previously been used, this is not only the rst time a complex constructioncase has been conducted entirely remotely, but isalso amongst the rst where Zoom has been usedfor a trial of this nature.

Bill Barton, Director of Barton Legal, commented:

The signicance of the case is huge.Technology is powering what could be one ofthe biggest shifts in English courtroom history. This is about more than how the trial wasconducted: empowering people around theworld to view cyber-secure, open trials, cuts tothe very core of the principle that justiceshould be seen to be done. The law is amongstthe world’s oldest professions; of course it istime it embraced change.

Every aspect of the case went o without ahitch. Screen sharing allowed evidence to beviewed easily; the defendant saw its mainwitness repeatedly challenged over video; andeven the intimacy of the traditional courtroomremained. Hopefully, even after the lockdownis lifted, we return to a new, digital normal.

Paul Darling OBE QC, Barrister at 39 EssexChambers, commented:

Amongst the principal concerns when it comesto remote trials is the loss of visual cues. Anybarrister will tell you that body language isinvaluable in cross examination. What the trialhas proved beyond reasonable doubt, however, is that none of the intimacy of thephysical courtroom is in fact lost with a remotetrial. Rather, video sharing can in fact heightenour ability to dissect testimony, whilst openingup proceedings to the public

Tikit partners with viuTikit has announces a new partnership with client engagement platform provider, viu, to oer improvedclient relations to law and accountancy rms.

viu facilitates client engagement by capturing client sentiment through feedback at key points ofinteraction, specically focusing on what the client wants to say, rather than what the rm wants to hear.Feedback is delivered directly to those most involved in the transaction to allow action to be taken bythose most appropriate to do so. Now more than ever, a rm’s relationship with its clients’ needs to be strengthened and developed.
