Legacy Park, Johnny’s Pizza, and Santa have teamed up for the fifth year to offer this popular breakfast event. It is a great time for children to meet with Santa, give him their wish lists, and enjoy a fun family breakfast. Reservations are required, and seating is limited. There are still a few spots available for the 8:30 and 10:45 seatings (9:45 is sold out). The cost is $5 per adult and $3 per child. Please fill out the reservation form and submit it with a check (payable to Legacy Park) to the HOA office as soon as possible to reserve your table. Please do this as quickly as possible so that we can begin to flesh out the structure of our program and get it active. Together we can continue to make Legacy Park a great place to live. The Town Council recently invited the Kennesaw Police Department and the resi-dents of Legacy Park to get together to discuss the formation of a formalized Neigh-borhood Watch Program. The meeting was a great success and there was a lot ofenthusiasm over the idea. Over 75 interested residents attended the first meetingand over 30 came to the Town Council meeting two nights later to go into furtherdetail and begin the process of laying out specifically what our program will looklike and what we hope to accomplish. slope makes the area ideal, but a feasibility study would haveto be done to determine if this is a viable location.

Parking Lot:This Board is considering altering our current parking lot.Safety is our first concern. We need more parking spaces,and we need to make the lot safer. If you pull in and there’sno spot, you have to back all the way out. This is dangerousbecause there are frequently children crossing the parkinglot from both ways.

The city approved our parking lot design when they approveda change to the zoning that would have allowed the club-house. This lot was estimated to cost $200,000. The revisedlot should not cost as much since the roundabout that wentdown to the building has been eliminated. Also, the paversthat were required by the city will not have to be as heavyduty since there will be no heavy trucks in this lot. Once thecost is known, the Board will have to determine if we want togo forward.

Alcohol Policy:First of all, there is not an alcohol policy in place. Wheneveralcohol is served at an HOA event (even if it’s a committee orgroup that reports to the HOA), there is liability. As a Boardwe have the responsibility to make certain that we limit ourliability as much as possible. When it comes to alcohol, wealso have to make sure that if it’s served, it’s done in a legalmanner.

We are working with our lawyer and insurance company todevelop a policy that will protect our HOA. Nothing more,nothing less. There are rumors about the Board trying to keepalcohol away from events, etc. This is simply not true. Wehave to do what’s best for the HOA as a whole.

As 2005 winds down, I’d like to update you on a few projectsand clarify some issues that seem to have gotten caught upin the rumor mill.

Security:There have been a couple of recent incidents that involveda number of juveniles who gathered within our community.These problems may be tied to youth from outside our com-munity using our amenities.

Rest assured this nuisance is being addressed in severalways.

1. The city of Kennesaw has greatly stepped up police patrolsand undercover activity.

2. A fence has been built around the basketball court, and it willbe locked unless the activities are properly supervised.

3. A gate to the parking lot is being installed, and it will be lockedwhen the amenities close for the day.

4. The Town Council is working to establish a neighborhoodwatch program. The initial meetings have taken place andplans are underway.

5. The Kennesaw Police Department has stated that one way todeter vandalism and violence is to increase the lighting in theparking lot and to install cameras to capture illegal activity.This does come with a hefty price! We are evaluating the costs,and a judgment has to be made in regard to the effectivenessof spending a large amount of money in this way.

6. We are reviewing private security and off-duty officers to de-termine the feasibility of utilizing them at the appropriate times.

We have spent less than $10,000 in vandalism repair, andthe camera system would not have captured the vandalismwe’ve had this year.

Clubhouse:The original clubhouse plan is dead. The final constructioncosts were projected by the contractor to be $1.54 million.The breakdown is as follows:

Building Structure $1.132 millionSite Development $80,000General Requirements $130,000Parking Lot $200,000

This project would have gone over the $1.13 million thatwas budgeted for the entire project. Had this project movedforward, our HOA would have encountered serious finan-cial problems, and quite possibly run out of money.

We are evaluating different proposals for a clubhouse. Oneoption is to add on to the rear of the pool house. The ground

2006 AssessmentsThe HOA Board has announced that dues fornext year will be increased by $5.00. One ofthe hardest decisions every Board has to makeeach year is whether or not to increase fees.This nominal $5.00 will help to make sure that

we take in more money than we spend and that we haveenough money to fully fund our reserve.

The statements for 2006 homeowner assessments havebeen mailed. If you have not received your bill, please con-tact the HOA office. Payment is due by January 1st; late feeswill apply after January 31st.

**** 2005 Citizen of the Year Nominations ****As we enter the holiday season and think about for whomand for what we are thankful, it seems appropriate to startthe nominations for Legacy Park’s 2005 Citizen of the Yearaward. The Town Council will be accepting nominationsthrough the end of December. Please nominate a candidatewith outstanding community involvement during 2005 by themethod easiest for you -- online at www.legacypark.org, viaemail to a Town Council member (see back cover), or with aletter dropped off at the HOA office.

Homeowners will select their five (5) favorite nominees dur-ing the first couple weeks of January. Information will be dis-tributed in the January issue of the Town Herald. The TownCouncil will then select the grand prize winner from the topfive. Join the Legacy Park Election CommitteeThe LP Election Committee is seeking additional members.The purpose of the committee is to ensure that the electionprocess is in accordance with the LP covenants and by-laws, to establish dates for the election process in conjunc-tion with the HOA Board, to test and verify the accuracy ofthe voting process used to ensure a fair election, and to es-tablish an operational plan for each voting procedure, pro-cess, & practice to ensure the ethical conduct of the elec-tion. Covenant Reminder – Motorized VehiclesOperation of motorized vehicles on pathways or trails main-tained by the association is prohibited. The use of motorizedvehicles, bicycles, skateboards, rollerblades, skates, andscooters is NOT allowed on the tennis and basketball courts,on the ballfield, at the amphitheater, at pool areas, at play-grounds, and at the bandstand.

Covenant Enforcement in Legacy ParkHave you received a violation letter? Please do not use theresponse “it’s been this way for a long time” as a response toa violation letter. Window blinds, statuary, basketball goals ina cul-de-sac, etc., are easily corrected violations and need tobe addressed. The covenants have not changed. Many vio-lations were not enforced correctly in past years, but we needto pull together as a neighborhood to make our communitynot only safe but also aesthetically pleasing to the eye. If ev-eryone will take care of his own property, our neighborhoodwill be the very best it can be!

Now that it is getting cold, painting will have to be postponeduntil the spring, but please remember if you get a letter besure to respond so that you do not receive follow up lettersand fines. We do thank you for your quick responses to theletters. Remember, TOGETHER we can make this work.

Legacy Park SafetyThe Legacy Park HOA and the Kennesaw Police Depart-ment are working together to help keep Legacy Park a safecommunity for our families. The HOA has provided officespace to the Kennesaw Police Department at the main poolhouse to be used as part of their routine community policing.The Board of Directors has requested that the police en-force all state laws on Legacy Park common areas includ-ing, but not limited to, criminal trespass by non-owners whoare not guests accompanied by an owner pursuant to theGuest Policy of Legacy Park.

The HOA will also be hiring off duty police officers to assistwith the policing of our common property. Remember thatthe Association is not a provider of security and does nothave a duty to provide security on the Association’s propertyor to each owner. It is the responsibility of each owner toprotect his/her person and property.

Covenant Reminder – Holiday DecorationsHoliday displays must not create a nuisance for adjacent prop-erty owners. All holiday decorations including lighting displaysshould not attract significant or increased traffic flow. Holidayseason displays may be used from Thanksgiving throughthe weekend following New Year’s Day.

Recently Legacy Park has experienced several inci-dents of thefts from automobiles. The Kennesaw Po-lice Department asks that you take the following stepsin order to minimize your chance of becoming a victim:

• Don’t leave valuables inside your vehicle.• Always lock your vehicle.• Report anything suspicious to police immedi-

ately.• Use exterior lighting overnight if you have it.• Always lock your garage door at night or when

you’re not at home.

Other expertise:IBM has employed me for over 16 years. I design and producecontent for Internet-based and distance learning education as wellcreate digital media for that education. I’ve project managed over150+ media projects during that time, with budgets ranging fromthe low thousands to over a million dollars. I work with a globalteam, interacting with individuals across a diverse spectrum. Inaddition, I have a BA in Psychology and an AAS in CommercialArt.

Previous work experience includes four years in the United StatesAir Force where I received the Honor Graduate certificate fromboth the USAF Basic Training and the USAF PhotojournalismSchool. In addition I worked in Duke University’s Medical SchoolPhotographic Education Department.

Our family is active through LakePointe Church. I’ve been a Sun-day School teacher for Middle School and High School throughthis summer. We’ve been involved with outreach programs in-cluding Shop with a Hero and Adopt a Child at Christmas. I’m anactive participant in our son’s school, Mt. Paran Christian School.I’ve led chapel service for his school, and been a guest reader forhis class a number of times. In addition, my wife and I are in thePTF organization.

Why are you interested in run-ning for a Board position?I’m interested in running for aboard position for a number ofreasons. First and foremost Iam a long-time resident whoplans on being here a lot longer.

My wife, son, and I love this community and I want to continue inmy role on the board to help to work on the following:

a) Ensure our homes values are preserved and increased, as muchas possible

b) Ensure our neighborhoods are safe and securec) Protect and preserve our park and all greenspaced) Protect and improve on our existing amenitiese) Continue to increase the “customer service” from the HOA and

its stafff) Continue to increase the community awareness regarding the

HOA’s activities

All of these are important, but I believe the preservation of homevalues, security of the neighborhoods, and the protection and up-keep of our park and amenities are the most critical items at hand.We’re currently undertaking steps to increase security measureswith more patrols and upgrades to lighting; we’re upgrading thequality of our landscaping, both in maintenance and design; andprotecting our amenities, such as the tennis courts by identifyingand resolving long-standing drainage issues. And of course weneed to make sure we are doing our best to be fiscally smart aswe continue to progress in these areas.

It’s been an honor to serve on the board these past two years.We’ve had a lot of challenges this past year. And we will continueto have challenges; that’s the nature of a diverse community thesize and scope of Legacy Park. I would kindly appreciate yourconsideration in the upcoming election to continue to serve in thisrole, working with the other board members to make this commu-nity a wonderful place to live.

Legacy Park and/or related activities:My wife and I have been residents since 1996. My current activi-ties include serving on the HOA Board, first as secretary in 2004and in 2005, as president. Past activities include serving as Vice-President on the Town Council in 2003 and coaching in the Springand Fall seasons of soccer, t-ball, and coach pitch leagues during2003-2005. Why are you interested in running for a Board position?As a mother, a wife, a professional, and a resident of Legacy Park,I have a vested interest in this neighborhood. I want to protect ourinvestments; Our investments being our family, our properties, andour lives. Being elected to the HOA Board will allow me to play anactive role in that protection. I want to make security a numberone priority in the neighborhood. I also want to work towards amore involved community.

Why are you interested in runningfor a Board position?I would like to be part of the commu-nity leadership because I believe thatLegacy Park is at a significant cross-road. The bottom line is that I’m in-terested in preserving our home val-ues, our green space, and the secu-rity of our community while being fis-cally responsible. To do this, I wouldlike to help the board continue on its

path of returning our amenities to the high quality they once werethrough repairs and upgrades. For example, continuing the highquality of landscaping that’s underway, clearing the brush aroundthe lake, correcting the drainage problems around the main pooland tennis courts, increasing the parking lot, etc. In addition, Iwould like to get a handle on our serious security problem. Through

a vigilant neighborhood watch program being initiated by our TownCouncil combined with a vigorous monitoring (electronic, resident,and police) program I believe we can reclaim our neighborhoodand restore it to a safe place for our families. If it means going tothe extreme of putting a covenant revision to a resident vote thatwill limit the number of home rentals in Legacy Park, then so be it.Other neighborhoods in the area have done just that with suc-cessful outcomes. It also includes taking measures to ensure thatLegacy Park and use of its amenities remains a private/exclusiveventure. Obviously, none of this is something 5 board memberscan do alone but the board can be a conduit to help the rest of thecommunity get involved.

Legacy Park and/or related activities:I’m a Legacy Park resident of nearly 10 years who has enjoyedwatching the community grow as well as a user of most of theamenities. My most recent community involvement was rallyingseveral hundred residents last year in stopping a clubhouse projectthat was ill advised from cost, location, and environmental per-spectives. This included hours of research to understand and docu-ment the facts, effectively communicating those facts to the resi-dents, and making several audio/visual presentations to theKennesaw city council and zoning board.

For the record, since this is still likely to be a hot topic. I would liketo pursue renovating and expanding the main pool house to in-clude office space, a large meeting area, and an outside deckarea overlooking the pool and court areas. I believe this can beaccomplished at a much more affordable cost than the originalproject and will not take away from properly maintaining our cur-rent amenities.

In addition to the activities described above, I have captained andplay on several Legacy Park tennis teams, and was even part ofthe LP softball team years ago. For those of you who remember,I started the Legacy Park Singles group that was very active for 3years.

Other Expertise:I’ve been in the nuclear power industry for 21 years. While achemist by trade and training, I currently train managers and su-pervisors in the art of Leadership, Teamwork, and Decision Mak-ing. Prior to this current assignment I was a chemistry departmentmanager at a nuclear power plant in the Midwest. This positioninvolved leading 27 degreed professional and bargaining unit(union) personnel. In addition, I had sole responsibility for a $5million dollar annual budget and was consistently under budget.Prior to my work at the plant, I taught high school chemistry andphysics as well as coached wrestling and softball in Illinois.

Why are you interested in runningfor a Board position?I love Legacy Park. I feel this com-munity has the potential to be ahigher scale community than it al-ready is. In order to stamp out nega-tive activity that is beginning to creepin, it will take a heavier hand than iscurrently present on the board today.

Why are you interested in runningfor a Board position?My experience over the last two yearsas Vice President of the Board, as wellas my experience as an attorney,mediator and community leader, willhelp me to continue to work effectivelyas an HOA board member, listeningto and fighting for our residents, anddealing with the important issues weface.

Through my service on the board, I have been responsible forsaving the homeowners almost $200,000 in needless expenses,by stopping various proposed projects or expenditures, including:about $10K proposed to get our computer system “up to snuff,”but was unnecessary; approximately $12K proposed to fix up thelandscaping at our front entrance, when the company we werepaying over $100K per year should have already been doing that;approximately $35K to buy a tractor we did not need; and over$100K saved by questioning why we would pay a company any-where up to $175K to fix our trails after the flooding we had, whenwe could do it ourselves for more like $50K.

Legacy Park and/or related activities:I have served as Vice President of the HOA for the last two years.Since moving to Legacy Park 8 years ago, I have volunteered atnumerous events, such as Family Campout, Teen Pool Party,Pumpkin Fest/Pet Adoption, and set-up for our Fourth of July cel-ebration. I participated for several years as a Town Council repre-sentative, and served as President for 2003. This year, my lawfirm has paid to sponsor many events in Legacy Park.

Other Expertise:It is helpful to have an attorney on the board, as I am able to re-view various documents and proposed actions of the board, with-out our having to constantly pay for the services of our HOA paidattorneys. Recently, I questioned a strict alcohol policy the boardwas considering, which included such provisions as, a residentcould not drink “before, during or after an event.” This enabled theBoard to take a more rational and reasonable approach.

Legacy Park and/or related activities:I have volunteered as a kids’ soccer coach, several PTSA activitiesand have volunteered to lead Lullwater in our new NeighborhoodWatch Program. I attend every town council meeting, and every HOABoard meeting.

Other expertise:I love talking with people as well as listening to what they desire intheir community.

Cub Scouts Thank Legacy ParkLegacy Park’s Cub Scout Pack 002 would like to extend abig thank you to LP residents and the HOA for their sup-port this fall. We had a very successful Popcorn SalesDrive this year, as usual, thanks to the generosity of theneighborhood. The Pack sold more popcorn than ever,and the scouts are excited to deliver the popcorn and earntheir prizes. The money raised from the popcorn sale helpsthe Pack pay its day-to-day expenses and provide awardsand supplies for the scouts throughout the year.

This fall, the Pack also ventured into a new enterprise:selling concessions during the LP youth soccer games. Itwas a great success, thanks to the many parents andscouts who volunteered and to the Brackens who madethe project possible in the first place. Most of all, we oweour thanks to the many people who purchased coffee, hotchocolate, candy, and sodas during the games. We planto be back again next season, so look for us on the TownGreen this spring! The money raised by the concessionstand is helping to defray the costs of our Pack trip thisFebruary to attend Space Camp in Huntsville, Alabama.

Legacy Park Woman’s ClubThe LPWC is finishing up the year in a major way. We would like to thank the participants in this year’s Oktoberfest for their generous donations.Thanks to you, we were able to present the Kennesaw Police Department with a check for $1,000.00 towards their fundraising efforts for theSpecial Olympics. We have also been able to once again grant holiday wishes to abused or neglected Cobb County senior citizens who areunder the protection of DFCS. The Woman’s Club spent $250.00 on gifts. We also enjoyed our time out on the Town Green during the Chili

Cook-off in November while providing a craft table for the children. Wemade handprint turkeys and pine cone birdfeeders. There will be manywell fed birds this year!

The LPWC wishes everyone a happy holiday season. December’s meet-ing will be our holiday social. Current members, please watch your emailfor the time and date. In November, the scouts of Legacy Park’s Cub Scout Pack 002 participated in the annual CubScout Turkey Shoot, an event organized by the district (Kennesaw and Acworth area Packs).Scouts are given the opportunity to shoot bb guns as well as bows and arrows in a structured, safeenvironment. The scouts learn range etiquette, safety rules, how to shoot from a prone position,and how to knock and shoot a bow and arrow. Frozen turkeys are awarded to the best shooters. Noactual turkeys are harmed during the event!

Highcroft’s FirstAnnual Fall Fest

On October 16th, Highcroftheld its First Annual Fall Fest,which was a great success!Neighbors and friends gath-ered at the park on a beautifulday to enjoy hot dogs andhamburgers, fresh off the grill.Everyone brought deliciousside dishes and desserts toshare. While the adults mixedand mingled, the kids paintedor carved pumpkins and en-joyed having their facespainted. The group had somuch fun that they are alreadytalking about organizing aSpring Fest!

Landscape CommitteeHaving chosen a vendor to plant our fall flowers, the landscapecommittee is still in the process of reviewing prospective vendorsfor upgrading and maintaining our landscape, as we continue towork on the contract and landscape budget. We hope to makeour selection by December.

Upon approval of the new vendor and budget, the committee an-ticipates that the redesign process and the upgrading of neigh-borhoods and Legacy Park entrances will begin in January.

The fall season of ALTA tennis came to an end in November,and for the first time we had three teams go all the way to CityFinals! The Thursday Ladies’ C-1 team and the Men’s B-2 teamare City Champions, and the Men’s A-3 team is the respectablerunner-up in the quest for the big plate! It takes lots of talent andhard work to go that far, and we applaud the outstanding effortsof all the players! We’ve even run out of room on our “Hall ofFame Fence” on courts 8 and 9, and we’ll have to start anotherone to fit all the winner signs from this year’s USTA and ALTAseasons.

Another huge highlight of the fall tennis season in Legacy Parkwas a special day clinic with Luke Jensen. Luke is best knownfor winning the 1993 French Open with his brother Murphy. Dur-ing his career he beaten many tennis greats including PeteSampras, Andre Agassi, Ivan Lendl, and John McEnroe. Lukegave group lessons and drills for both kids and adults on Satur-day, October 29th. Everyone agreed that it was great fun to beout on the court with Luke. We are planning for him to return foranother clinic in the spring and will let everyone know when theycan sign up.

As we continue to improve the tennis program in Legacy Park,we encourage new players to come join us. Our tennis directorand pro, Adam Grandstaff, has worked hard to build a programthat has something for everyone, so come out and see what funtennis can be!

The funny thing about tennis is that much of the time on court – while playing a match– is spent NOT hitting balls. The time in between points and during changeovers isjust as important as the time spent actively playing. These breaks in play allow youthe chance to work out exactly what’s happening in the match. Unfortunately, the flipside is that they also allow you plenty of time to lose concentration or to start lettingnegative thoughts enter your mind! Most players try and combat these problems byhaving a routine between points and games on which they can focus.

Lleyton Hewitt is a very good example. When you watch him play, you’ll notice that healways does the same things to combat distraction both between serves and betweenpoints. He almost always works with his strings, shirt, and cap before he plays thenext point. As another example, many players always bounce the ball the same numberof times before serving.

So to try and help you stay in the present and stop your mind from wandering betweenserves, points, and games, think about trying to put together a routine which worksfor you. If you’re playing doubles, it’s a great idea to always communicate with yourpartner in some small way between points.

Experiment, then try to stick with your routine regardless of the situation. Remember:you only have the ability to think about one thing at a time, so try to make sure thatduring a match your thoughts are always focused positively on the game!

A great year for theNorth Cobb High School Marching Band!

Legacy Park is represented by quite a few members of the North CobbHigh School Marching Band, who recently wrapped up another great year.The band’s theme this year was Images of Egypt. The band played at halftime at the varsity football games, and competed in three other events. Thefirst event was held in Murray County, where the band won GOLD for “OverallEffect, Most Entertaining”. The Percussion section also took home theGOLD. The Georgia Invitational Grand Championship in Hiram was thenext challenge for the band. The Brass and Woodwind sections wereawarded FIRST PLACE and the band won GRAND CHAMPION for thesecond year in a row. The final competition for the band was held nearAshville, North Carolina. The event was the Blackhawk Classic in honor ofJohn Perko. The cheers were many, as the band was awarded BEST inDrum Major, Drum line, Color guard, Music and Marching. Voting by thejudges was extremely competitive, but in the end, North Cobb was namedGRAND CHAMPION!! Congratulations to all of our outstanding musicians,color guard members, and band administration for a year to remember.Special thanks to the band parents who spent endless days shuttling theband members to and from practices, football games, events, and helpingset up and take down the performances and to corporate sponsors of theband for their support.

Kennesaw Charter School 1st Annual Fall Family Fun RunOn October 22, students and families of Kennesaw Charter School tied on their running shoes for the school’s First Annual Fall FamilyFun Run. Giving children and their families a chance to learn about the importance of exercising as a family was a special mission forJason Cook, race director of the event and a Legacy Park resident. The school’s PTA chose this event as yet another way to bring thefamilies of the school closer together this year.

Approximately 30% of America’s children and adolescents are overweight. Mr. Cook pointed out that “by teaching the children in thismanner they learn that activities like running can not only be fun, but can also be crucial to a healthy lifestyle.” The physical educationinstructors at KCS also incorporated this idea into their class instruction prior to the run. The fun run’s route was a one-mile loop thatstarted in front of the school on Lockhart Drive. KCS also hosted a post-run celebration at the school honoring all participants and itssponsors. “Our hope is that this Fall Family Fun Run will be the first of many for our students and families, as well as the community, toenjoy. By bringing together the families and students, we are fostering a greater chance that many of these families that have notpracticed running as a family hobby will see the greater value, including having quality family time together,” said Mr. Cook.

The event was a tremendous success.With over 75 student participants andalmost 200 parents and friends there tocheer on the runners and participate inthe run as well as the post-run celebra-tion, everyone had a great time and can’twait for next year’s run. The school hasplans to advertise throughout Georgianext fall as they add a 5K (3.1 mile)course to the event.
