This time, the participating members will run for the cause of ‘Right to Information’. This awareness drive will be useful in promoting transparency and fostering professionalism in the country’s governance. I hope the members will join the Marathon in large numbers for this cause. Accounting, the language of business, is codified by the Accounting Standards. The Accounting Standards fortify the financial statements. While discharging the attest function, it is our duty to ensure compliance with these Standards. To enable members to learn the finer aspects of the Accounting Standards, the Society has designed an intensive study course on Accounting Standards jointly with the IMC. The Finance Ministry has started its annual exercise of formulating the Union Budget, 2007. Everybody expects the ensuing budget to be rational, fair and taxpayer-friendly. Unfair and irrational tax provisions lead to non- compliance and promote corruption. The Budget should remove various anomalies, amend the unfair provisions, adopt the theory of taxing real income, reduce the number of appeals by simplifying the law, give incentives with minimum conditions and introduce accountability in the system. The Society has submitted its Pre-budget Memorandum for the consideration of the Finance Minister. India’s growth story is visible with the rise in GDP of over 8% per annum. India is emerging as the most-preferred investment destination. India, with its young population will continue to achieve growth. But, infrastructure development and enhancing requisite skills will be the need of the hour to keep pace with the growth momentum. As Chartered Accountants, we need to look beyond the traditional areas of practice and sharpen our skills in new areas of professional interest, such as International Accounting Standards, valuation practices, international tax laws, and so on. The Society is once again participating in the ‘Mumbai Marathon — 2007’.This time, the participating members will run for the cause of ‘Right toInformation’. Who is rich and who is poorOne day a man from a very wealthy family took his son on a tripto the country-side with the express purpose of showing him how poorpeople live.

They spent a couple of days and nights on a farm of what would beconsidered a very poor family.

On their return from the trip, the father asked his son,

How was the trip ?

It was great, Dad.

Did you see how poor people live ? the father asked.

Oh yeah, said the son.

So, tell me, what you learned from the trip ? asked the father.

The son answered :

I saw that we have one dog and they had four. We have a pool thatreaches to the middle of our garden and they have a creek that hasno end . . .

. . . We have imported lanterns in our garden and they have the starsat night.

Our patio reaches to the front yard and they have the whole horizon.We have a small piece of land to live on and they have fields thatgo beyond.

. . . We have servants who serve us, but they serve others. We buyour food, but they grow theirs. We have walls around our propertyto protect us; they have friends to protect them.

The boy’s father was speechless. Then his son added, Thanks Dadfor showing me how poor we are.

Accounting Standards play avery important role in thereporting of financial resultsof companies. AccountingStandards issued by ICAI(currently AS-1 to AS-29)require detailed understandingby accountants as well asauditors to ensure that thesame are properly followed

and implemented. There is also a constant need to keep abreast withthe revisions and interpretations in these Accounting Standards beingissued, to be able to disclose and present accurate financial resultsof an enterprise.

Looking at the importance of the subject, BCAS jointly with IndianMerchants’ Chamber (IMC) has organised an intensive Study Courseon Accounting Standards issued by ICAI and the other relateddevelopments at the international level at IASB [which issues IAS andInternational Financial Reporting Standards (IFRS)]. The Study Coursewould comprise 24 sessions where eminent faculty having expertisein implementation and application of these standards will enlighten theparticipants on their nuances as well as the corresponding IAS/IFRS.

Over the years, service tax has become the ‘new milking cow’ for theCentral Government. The service tax law being at its nascent evolving(also revolving !) stage, several issues have arisen. A.P. (DIR Series) Circular No. 11, dated November 16, 2006

Investment by Mutual Funds in Overseas Securities —Liberalisation of

Presently, Mutual Funds registered with Securities & Exchange Boardof India (SEBI) are permitted to invest up to US $ 2 billion overseas.This Circular has increased this investment limit to US $ 3 billion withimmediate effect.

Facilities to NRIs/PIO and Foreign Nationals — Liberalisation

Presently, remittances out of balances in Non-Resident Ordinary (NRO)

accounts of a Non-Resident Indian (NRI)/Person of Indian Origin (PIO)pertaining to sale proceeds of immoveable property are subject to alock-in period of 10 years in certain cases. This Circular has dispensedwith this lock-in period of 10 years. As a result, remittances out ofbalances in NRO accounts, including sale proceeds of immoveableproperty, will be permitted without any lock-in period within the limitof US $ one million per financial year.

Issue of Bank Guarantee on behalf of service importers

This Circular permits issue of guarantee by Category-I banks on behalfof their customers importing services, provided :

(a) The guarantee amount does not exceed US $ 100,000.

(b) The bank is satisfied about the bona fides of the transaction.

(c) The bank ensures submission of documentary evidence forimport of services in the normal course.

(d) The guarantee is to secure a direct contractual liability arisingout of a contract between a resident and a non-resident.

Foreign Exchange Management Act (FEMA), 1999 — CurrentAccount Transactions — Liberalisation

G.S.R. No. 412 (E) — Notification dated July 10, 2006

This Circular has deleted Item 16 of Schedule III to the ForeignExchange Management (Current Account Transactions) Rules, 2000pertaining to obtaining of prior approval of RBI for drawing of foreignexchange “for remittance for purchase of trademark or franchise inIndia”. As a result, drawing of foreign exchange for trademark orfranchise in India can be undertaken without obtaining approval fromRBI.

Seventh Intensive Study Course onDouble Taxation Avoidance Agreement

We are pleased to announce the 7th Batch of the Study Course on‘Double Taxation Avoidance Agreement’ (DTAA) to be held fromDecember 21, 2006 to February 10, 2007. This is an intensive coursefor beginners and will be conducted in a classroom style. There willbe about 28 lectures in all, covering each article of DTAA and withspecial emphasis on features like force of attraction, most favourednation and triangular cases, including a test. The UN Model Conventionon DTAA will form the basis of the course. (a) Corporates can avail additional ECB up to US$ 250 million withaverage maturity of more than 10 years under the approvalroute. Prepayment, etc. of such ECB will not be permitted upto a period of 10 years.

(b) Prepayment of ECB up to US $ 300 million, as against thepresent limit of US $ 200 million, will be permitted without priorapproval of RBI.

Establishment of Office Abroad

This Circular has increased the limits for remittance of initial andrecurring expenses for the purpose of normal business operations offoreign branch/office/representative and also liberalised the provisionsfor acquisition of immoveable property by it, as under :

Initial Expenses — Remittance up to 15% of the last two financialyears’ average annual sales/income/turnover or up to 25% of networth, whichever is higher.

Recurring Expenses — Remittance up to 10% of the last two financialyears’ average annual sales/income/turnover.

Acquisition of Immoveable Property — A company incorporated inIndia and having overseas office, can acquire immoveable propertyoutside India for its business and for residential purpose of its staffout of funds remitted for initial and recurring expenses.

The Right to Information Clinic (RTI Clinic) is headed by Mrs.Hema Sampat, a research scholar on the subject of RTI. The Clinichas two RTI activists, Mr. Kewal Semlani and Mr. Shailesh Gandhi,as advisors. Mr. A. K. Asher, Advocate, also assists in the workingof the Clinic.

The Clinic provides help and guidance to BCAS members as alsoto non-members, i.e., all citizens, for making applications under theRTI Act and also assists in resolving any related difficulties on thesubject of RTI.

The Clinic will operate from BCAS office — 11 a.m. to 1 p.m.

Yes, after a gap of several years, we are back with the wonderfulNature Walk.

Right in the middle of the concrete jungle of Mumbai and in thepristine environment of the Sanjay Gandhi National Park and very nearthe glamorous Film City, lies a huge patch of forest which very fewof us are aware of.

The Bombay Natural History Society which is doing a great job ofenvironment protection and preservation has a Conservation EducationCentre right in the middle of this forest.

We invite you to join us for a walk in this beautiful forest.

However, we must caution you — this walk is only for those who areserious about relaxing and about leaving their worries behind at homesand offices.

No cell phones will work in the forest and you will not hear theconstant honking of car horns there. Only the chirping of birds thatyou may have never seen before. And yes, lots of trees and plantswith lovely flowers and leaves.
