    TherearetwomaincategoriesofcriminallawcourtsinEnglandandWales.Theseare:

    1. MagistratesCourts2. CrownCourts

    1.MAGISTRATESCOURTS

    ThemajorityofdefendantschargedwithacriminaloffencearetriedinaMagistratesCourt.(TherearehundredsofMagistratesCourtsaroundthecountry).TrialsinaMagistratesCourtareheardinfrontofmagistrates.Mostmagistratesarenotlegallyqualified(i.e.arelaypersons).Theyarehoweverassistedincourtbyacourtclerkwhoisoftenlegallyqualifiedasasolicitororbarrister.LawyersincourtusuallyaddressamagistrateasYourWorshiporSirorMadam.

    MagistratesCourtsgenerallyhearcasesinvolvingrelativelylessseriouscriminaloffences.SomecriminaloffencesareonlytriableinMagistratesCourtsandthesearetermedsummaryoffences.(Thesebeingcasesinvolvingrelativelyminorcriminaloffences).MagistratesCourtsmayalsohowevertrymoreseriouscriminalcharges,knownasoffencestriableeitherwayalthoughthedefendantchargedwithanoffencetriableeitherwaymayalternativelyelectfortrialinaCrownCourt(seebelow).AnappealfromaMagistratesCourtdecisionmaybemadetoaCrownCourt.

    2.CROWNCOURTS

    CrownCourtshearcasesconcerningthemostseriousofcriminaloffences(includingforinstancemurder).Suchoffencesareknownasoffencestriableonlyonindictmentorindictableoffences.CrownCourttrialsareconductedbyajudgeandareheardinfrontofajury.Itisthejudgesroletodirectthejuryonthelawwhereasthejurysfunctionistomakefindingsoffact(includingdecidingwhethertheaccusedpersonisinnocentorguilty!).AppealsfromaCrownCourtdecisionaremadetotheCriminalDivisionoftheCourtofAppeal.ThefinalUKcourtofappealfromMagistratesandCrownCourtdecisionsistheHouseofLords(onapointoflawonly).
