Civil Law, term applied to a legal tradition originating in ancient Romeand to the contemporary legal systems based on this tradition.Modern civil law systems, which were originally developed inWestern European countries, have spread throughout the world. Civillaw is typically contrasted with common law, a system that evolved inmedieval England and that is the basis of law in most of the UnitedKingdom, Canada, and the United States. Civil law was the traditionfollowed by European scholars who developed the law for manynations, as well as the system of international law used worldwidetoday.

The term civil lawalso applies to all legal proceedings (whether taking

place in a civil law or a common law system) that are not criminal innature (seeCriminal Law). Under this definition laws regulatingmarriage, contracts, and payment for personal injury are examples ofcivil law.

Jurisprudence (Latinjurisprudentia, fromjus, law, and prudentia, knowledge), knowledge of the law and its interpretation, or the

science and philosophy of law. In ancient Rome the term was used inthe former sense. Those who were so skilled in the law that theycould decide a novel or doubtful case were calledjuris prudentes, whether or not they were judges, and the body of law built up by theirinterpretation was calledjuris prudentia. This development of law byinterpretation is akin to what English-speaking peoples call caselawlaw arising from a body of decided cases; in France and Spain

the termjurisprudenceis still used in that sense.
