INSTRUCTIONS TO BIDDERS GENERAL INSTRUCTIONS:
1. The bidders are requested to familiarize themselves with the use of the e-
Tendering portal of Government of Maharashtra well in advance.
2. To view- Tender Notice, Detailed Time Schedule, Tender Document for this
Tender and subsequently purchase the Tender Document and its supporting
documents, kindly visit following e-Tendering website of Government of
Maharashtra: https://maharashtra.etenders.in
3. The Contractors participating first time for e-Tenders on GoM e-tendering
portal will have to complete the Online Registration Process for the e-
Tendering portal. A link for enrollment of new bidders has been provided on
https://maharashtra.etenders.in
4. All bidders interested in participating in the online e-Tendering process are
required to procure Class II or Class III Digital e-Token having 2 certificates
inside it, one for Signing/Verification purpose and another for Encryption/
Decryption purpose. The tender should be prepared & submitted online using
individual’s Digital e-Token.
5. e-Tendering Tool Kit for Bidders (detailed Help documents, designed for
bidders) has been provided on e-Tendering website in order to guide them
through different stages involved during e-Tendering such as online procedure
for Tender Document Purchase, Bid Preparation, Bid Submission.
6. Bidders will have to pay cost of Tender Document through online modes of
payment such as Net Banking, Debit Card and Credit Card during Tender
Document Download stage. This payment will not be accepted by the
department through any offline modes such as Cash, Cheque or Demand Draft.
7. Similarly, Bidders will have to pay Earnest Money Deposit through online
modes of payment such as Net Banking, Debit Card, Credit Card and
NEFT/RTGS during Bid Preparation stage. This payment will not be
accepted by the department through any offline modes such as Cash, Cheque
or Demand Draft.
8. The interested contractors / bidders will have to make online payment (using
credit card/debit card/net banking) of Rs. 1063/- (inclusive of all taxes) per bid
per tender to online service provider of e-Tendering system (Sify NexTenders)
at the time of entering Online Bid Submission stage of the tender schedule.

For a bidder, online bidding process consists of following 3 stages:
1. Online Tender Document Purchase and Download
2. Online Bid Preparation .
3. Online Bid Submission
All of 3 stages are mandatory in order for bidders to successfully complete
Online Bidding Process.
PURCHASE AND DOWNLOADING OF TENDER FORM:
The tender document is uploaded / released on Government of Maharashtra, (GOM)
e-tendering website https://maharashtra.etenders.in. Tender document and
supporting documents may be purchased and downloaded from following link of
Shri Vitthal Rukmini Mandire Samiti, under Law & Judiciary department on
e-Tendering website of Government of Maharashtra, https://lajd.maharashtra.etenders.in
by making payment through Online Payment Modes i.e. Net Banking, Debit
Card and Credit Card.
If for any reason a bidder fails to make this payment through online modes, system
won't allow the bidder proceed further for next stage resulting in his/her
elimination from Online Bidding Process.
This payment will not be accepted by the department through any offline modes
such as Cash, Cheque or Demand Draft.
The Tender form will be available online only. Tender forms will not be sold /
issued manually from Shri Vitthal Rukmini Mandire Samiti, Pandharpur office.
The bidders are required to download the tender document within the pre-scribed
date & time mentioned in online tender schedule. After expiry of the date and time
for tender document download, Samiti will not be responsible for any such failure

on account of bidders for not downloading the document within the schedule even
though they have paid the cost of the tender to the Samiti. In such case the cost of
the tender paid by the bidders will not be refunded.
PREPARATION & SUBMISSION OF BIDS
Both the Bids (Technical as well as Commercial) shall have to be prepared and
subsequently submitted online only. Bids not submitted online will not be
entertained.
Online Bid Preparation
EARNEST MONEY DEPOSIT (EMD)
Bidders are required to pay Earnest Money Deposit (if applicable) through
Online Payment modes i.e. Net Banking, Debit Card, Credit Card and
NEFT/RTGS during Bid Preparation Stage.
This payment will not be accepted by the Samiti through any offline modes
such as Cash, Cheque or Demand Draft.
If for any reason a bidder fails to make this payment through online modes,
system won't allow the bidder to complete Bid Preparation stage resulting in
his/her elimination from Online Bidding Process.
In case EMD is mandatory to all the bidders for a tender, offers made without
EMD shall be rejected.
In Bid Preparation stage, bidders get access to Online Technical and
Commercial Envelopes where they require uploading documents related to
technical eligibility criteria and quote commercial offer for the work / item in
respective online envelopes.

TECHNICAL BID
Following documents should be uploaded in Online Technical Envelope (T1) in PDF format, if required can be zipped as well and then uploaded during Online Bid Preparation stage.

this purpose (in Appendix 4 format) in Online Commercial Envelope (C1), during
Bid Preparation stage).
Any bidder should not quote his offer anywhere directly or indirectly in Technical

Envelope (T1), failing which the Commercial Envelope (C1) shall not be opened and
his tender shall stand rejected.
Note: During Online Bid Preparation stage, bidders are allowed to make any changes
or modifications in the bid data uploaded by them in Technical (T1) as well as
Commercial (C1) envelope.
Towards the end of Bid Preparation, once verification of EMD payment is successful,
bidder completes the Bid Preparation Ladu stage by generating the Hash Values for
T1 and C1. Post this, system won’t allow him/her to make any further changes or
modifications in the bid data.
Online Bid Submission
In this stage, bidders who have successfully completed their Bid Preparation Ladu
stage are required to transfer the data, already uploaded by them during Bid
Preparation stage, from their custody to department’s custody.
Note: During this stage, bidders won’t have any capability to make any kind of
changes or editing into technical as well as commercial data.

TERMS AND CONDITIONS
1. Incomplete bids are not accepted.
2. In the price of each item shall be clearly mentioned against each item in the
column of the bid. Price applied to be justified against the weight of the items
mentioned. Once the E-Tender is opened Bidder is not permitted to correct it
or reform it.
3. This bid is valid from 01-10-2017 to 30-09-2018 but the successful bidder has
to supply the Pashukhadya till next E-Tender come into force.
4. Online tenders are invited in ‘Two Envelope System’. (Technical Bid &
Commercial Bid). Envelop No. 1- (Technical bid) : At the time of opening of technical bid the
bidder should bring all original documents that have been listed below and have
been uploaded in the Online Technical Envelop so that the same will be verified
at the time of opening of the technical bid.
5. If the Bidder is organization which is working for Women development such
as “Mahila Aarthik Vikas Mahamandal” or “Mahila Mandal”, then the
Documentary proof about the Registration of their organization with
Competent Authority.
6. The recent Income tax returns certificate for the last three years (2014-15,
2015-16 & 2016-17) should be submitted.
7. GST Registration Certificate from the Competent Authority. If bidder is
exempted from paying GST, the bidder should provide exemption certificate
from Competent Authority.
8. Registration certificate under Bombay Shops and Establishments Act, 1948.
9. Experience certificate for working with other institutions with the name and
addresses of institutions.
10. Earnest Money Deposit (EMD) should be submitted through online process.
11. Information required in appendix 2 should be compulsory submitted on
Rs.100/- stamp paper.
12. Information required in appendix 3 should be compulsory submitted.
13. Pan Card details.

14. Cattle feed analysis Lab Testing Report-.
Envelop No. 2 (Commercial bid)- Bidders should submit separate Commercial bid for each item along with envelop No.2. 1. The price quoted must be in figures and in words, as per appendix 4.
2. The price quoted must be inclusive of supplying of the items to Shri Vitthal
Rukmini Mandire Samiti, Goshala Vibhag, Ganesh Nagar at Pandharpur with
the same price mentioned in the Bidder’s application (Envelop No.4). The
Bidder has to make transportation arrangement for supplying the items to the
Goshala Vibhag. No transportation charges, no labour charges will be paid for
loading and unloading of the items in the institutions and no octroi charges and
any other such charges will be paid by Samiti.
3. The selected bidder should be in a position to supply the items within six days or
earlier from the date of placing the orders.
4. The Executive Officer, Shri Vitthal Rukmini Mandire Samiti, Pandharpur or the
Manager reserves the right to inspect the items supplied to the Goshala Vibhag
and has right to reject the items if the quality of the supplied item is not up to the
mark.
5. It is the responsibility of the bidder to take back Earnest Money Deposit (EMD)
after finalization of the tender. No interest will be paid at any cost on Earnest
Money Deposit, provided that there should not be any complaint against the
successful bidder as far as supply of goods are concerned.
6. The Executive Officer, Shri Vitthal Rukmini Mandire Samiti, Pandharpur,
reserves the right to reject any part or whole tender, or all tenders without
assigning any reason.
7. The bidders have liberty to remain present or to authorize their representatives at
the opening of technical or commercial envelope at the time and date specified.
Dates quoted for opening of technical and commercial envelope are subjected to
changes in case there is any holiday abruptly declared by the Government or
under certain unavoidable circumstances.
8. The Executive Officer, Shri Vitthal Rukmini Mandire Samiti, Pandharpur does
not pledge himself to accept the lowest or any tender and reserves to himself the
right of accepting the whole or any part of the tender or portion quantity offered
against any item and bidder should supply the same at the rate quoted.

9. In the event of the order being placed against any of the tenders and if such
bidders fails to supply any item according to specifications or the terms and
conditions of Acceptance of Tender or fails to replace any items rejected by The
Executive Officer, Shri Vitthal Rukmini Mandire Samiti, Pandharpur or the
Manager on his behalf within such time as may be stipulated The Executive
Officer, Shri Vitthal Rukmini Mandire Samiti, Pandharpur reserves the right to
purchase such items from any other sources and at such price as The Executive
Officer, Shri Vitthal Rukmini Mandire Samiti, shall in his sole discretions thinks
fit.
If action as stipulated above is taken
(i). The offer of the defaulting bidder will not be considered. OR
(ii). The defaulting bidder will be penalized to the extent of the differences in the
rates or 10% of the value of the earlier orders whichever is higher. OR
(iii). If the defaulting bidder fails to pay penalty he will be permanently delisted
from the list of approved bidders of Samiti and the security deposit of the
bidders will be forfeited to the Samiti.
10. In case of no delivery and or delayed delivery against an order placed after
Acceptance of tender the Executive Officer, Vitthal Rukmini Mandire Samiti,
reserves to himself the right to impose such penalty in his sole discretion as he
thinks fit.
(a). Successful Bidder will be required to pay security deposit of 3% of
estimated tender cost and to enter in to an agreement for the performance of
the contract.
(b). Bidders convicted or involved in any criminal offence shall be considered
ineligible for awarding contract.
11. As soon as is apparent that contract dates cannot be adhered to, an application
shall be sent to the Executive Officer, Vitthal Rukmini Mandire Samiti,
Pandharpur.
12. Without prejudice to foregoing rights, if such failure to delivery in stipulated
time as aforesaid shall have arisen from any cause, which the Executive Officer,
Vitthal Rukmini Mandire Samiti, Pandharpur may admit as a reasonable ground
for an extension of the time (and his decisions shall be final). However the
decisions taken by the Executive Officer, Vitthal Rukmini Mandire Samiti,
Pandharpur will be final.
13. Provided always that any failure or delay on the part of the bidders shall not be

admitted as a reasonable ground for any extension of time or for exempting the
bidder from liability for any supply of poor quality items, as aforesaid and
provided further that no extension shall be allowed unless applied for and if
shall, in the opinion of the Executive Officer, Vitthal Rukmini Mandire Samiti,
Pandharpur, have been made and in his opinion, are justified.
14. Any statutory increases or decreases as an Act of State or the Central
Government relating to GST and other taxes shall be to the account of the
bidder. The rates quoted of food items must be inclusive of all taxes, wages,
transportation charges etc.
15. Items should be dispatched at bidder’s risk failing which they should be properly
covered by transit insurance with Government insurance fund. However, the
supplier will be responsible till entire ordered items arrive in good condition at
destination. The samiti will not be responsible for any loss of goods items of the
bidder / supplier, due to theft, natural calamity, accident etc.
16. Samples of goods weighing about 100 gm be brought at the time of finalizing
the bid.
17. Orders will be placed by the Executive Officer with the successful bidder and it
is binding on the bidder to supply the items as per the order placed.
18. The quoted price for the items should be against the weight shown in your price
chart including all taxes. When these items supplied with packages or in jute
bags, the package materials and bags will not be returned to suppliers.
19. If there is increase in the rate of any goods item, then the decision of Executive
Officer, Shri Vitthal Rukmini Mandir Samiti, Pandharpur will be final in this
matter.
20. If more than one bidder found to be successful in supplying the items for the
same price then the bidder will be selected on supplying capacity and can be
divided among bidders. In this case decision of the Executive Officer, Shri
Vitthal Rukmini Mandir Samiti, Pandharpur will be final.
21. The successful bidders shall submit an affidavit on stamp paper of Rs.100/-
mentioning that the bidder is prepared to supply the items to above said
institutions.
22. The successful bidders have to submit security deposit calculating 3% of the
value of approximate tender cost.
23. The successful bidder cannot stop supplying goods items to the Samiti quoting
the cause of paying of pending bills from the Samiti.
24. Pashukhadya should be tested from recognized laboratory & these testing

reports should be submitted by the successful bidder on demand by Executive
Officer.
25. The Pashukhadya items should be of good quality. If required, any of the
Pashukhadya will be sent to laboratory for testing.
26. The successful bidder should not supply Pashukhadya after expiry date. If he is
found providing Pashukhadya after expiry date & if there is any case of food
poisoning to any animal, then his supply of Pashukhadya will be stopped &
disciplinary and criminal action will be taken against him / her.
27. If the successful bidder is supplying poor quality of Pashukhadya against the
order placed it is binding on the bidder to replace the same with good quality as
soon as the complaint received. In case if the bidder fails to replace with good
quality of Pashukhadya items then the Samiti is having right to impose fine of
10% of value of the items or Rs.10000/- whichever is high per each event. Also
the Samiti is having right to purchase the same quantity of Pashukhadya items
from the open market but the concerned successful bidder has to pay the bills for
these items purchased from open market.
28. It is binding on the successful bidder to supply the Pashukhadya items as per the
price mentioned by him in the bid and in case if the bidder is arranging to supply
the items through sub-supplier then in this case his/her will be cancelled and
EMD will be forfeited.
29. Because of supply of poor quality of items supplied if it affects severely on the
health of animals of Goshala, criminal case will registered with the Police
against such bidder.
30. Whatever the terms and conditions mentioned in E-Tender the bidder shall not
go to any Court against the terms and conditions. The bidder has to sort out their
doubts with the Samiti.
31. After successful tender process, TDS calculation 2% of the total bill submitted
by the supplier will be deducted.
32. The successful bidder should make agreement with samiti considering all the
terms & conditions of this tender.

Envelop No. 2 (Commercial bid)- Bidders should submit separate Commercial bid for each item along with envelop No.2. INSTRUCTION TO BIDDERS FOR ONLINE BID PREPARATION & SUBMISSION Bidders are required to pay Earnest Money Deposit (if applicable to them) through Online Payment modes i.e.Net Banking, Debit Card, Credit Card and NEFT/RTGS during Bid Preparation for PASHUKHADYA Stage. If for any reason a bidder fails to make this payment through online modes, system won't allow the bidder to complete Bid Preparation for PASHUKHADYA stage resulting in his/her elimination from Online Bidding Process. Hence, it is strongly recommended to bidders to initiate this payment well in advance prior to expiry of Bid Preparation for Rajgira stage in order to avoid elimination from Online Bidding Process on grounds of failure to make this payment. During the activity of Bid Preparation, bidders are required to upload all the documents of the technical bid by scanning the documents and uploading those in the PDF format. This apart, bidders will have to quote commercial offer for the work / item, for which bids are invited, in an online form made available to them in Commercial Envelope. This activity of Bid Preparation for should be completed within the pre-scribed schedule given for bid Preparation After Bid Preparation, the bidders are required to complete Bid Submission activity within pre-scribed schedule without which the tender will not be submitted. Interested contractors / bidders will have to make online payment (using credit card/debit card/net banking/Cash Card) of Rs. 1063/- (inclusive of all taxes) per bid per tender to online service provider of e-Tendering system (Sify NexTenders) at the time of commencing Online Bid Submission stage of the tender schedule. Non-payment of processing fees will result in non-submission of the tender and Department will not be responsible if the tenderer is not able to submit their offer due to non- payment of processing fees to the e-tendering agency. Payment Options) has been provided under E-Tendering Toolkit for Bidders section of https://maharashtra.etenders.in . The date and time for online Preparation for Pashukhadya followed by submission of envelopes shall strictly apply in all cases. The tenderers should ensure that their tender is prepared online before the expiry of the scheduled date and time and then submitted online before the expiry of the scheduled date and time. No delay on account of any cause will be entertained. Offers not submitted online will not be entertained. If for any reason, any interested bidder fails to complete any of online stages during the complete tender cycle, department shall not be responsible for that and any grievance regarding that shall not be entertained. Any amendment to the tender will be placed on sub portal of the Department, who have invited the bids, on e-tendering portal of the Govt. of Maharashtra. The tenderer will not be communicated separately regarding the amendment. OPENING OF BIDS: The bids that are submitted online successfully shall be opened online as per date and time given in detailed tender schedule (if possible), through e-Tendering procedure only in the presence of bidders. Bids shall be opened either in the presence of bidders or it’s duly authorized representatives. The bidder representatives who are present shall sign a register evidencing their attendance. Only one representative per applicant shall be permitted to be present at the time of opening the tender. TECHNICAL ENVELOPE (T1): First of all, Technical Envelope of the tenderer will be opened online through e-Tendering procedure to verify its contents as per requirements. At the time of opening of technical bid the tenderer should bring all the original documents that have been uploaded in the Online Technical Envelope (T1) so that same can be verified at the time of opening of technical bid. If the tenderer fails to produce the original documents at the time of opening of technical bid then the decision of the committee taken on the basis of document uploaded will be final and binding on the tenderer. If the various documents contained in this envelope do not meet the requirements, a

note will be recorded accordingly by the tender opening authority and the said tenderer’s Commercial Envelope will not be considered for further action but the same will be recorded. Decision of the tender Executive Officer shall be final in this regard. The commercial bids shall not be opened till the completion of evaluation of technical bids. The commercial Bids of only technically qualified Bidders as mentioned above will be opened.
