THE LANDLADYRain, rain, go away ...

When Hove Civic Society wasformed during the 1960s, itwas a protest group. Inrecent years, under the

chairmanship of Helmut Lusser, thesociety is now leading the debate byproposing rather than opposing.

I have previously mentioned Hove Civic Society’s plans for a plinth forpublic art on Hove’s promenade which I very much support. I recentlymet with Helmut to discuss the society’s ongoing project to populateand, in many cases, repopulate our streets with, quite simply, trees.

The project really got going in 2012, with a study of Hove’s streets toidentify where planting might be helpful. Success was had in Decemberof that year with the planting of 12 elms in the Montpelier area. InDecember 2013, 40 trees (hornbeam and smooth-leaved elm) wereplanted near Stoneham Park. Discussions are now being held regardingBigwood Avenue and, far more ambitiously, the Church Road area.

Looking back over old photographs of Hove, it is quite clear thathundreds of trees have vanished over the past century. This is sad, asthey are hugely attractive and provide shade and a haven for wildlife. Onboulevards such as New Church Road and The Drive, they are a delight.

Trees won’t work on every street. Osborne Villas, a street that I knowwell, certainly wouldn’t be suitable. The pavements and road itself arenarrow and trees would just seem out ofproportion. Wide St Aubyns nearby hastrees and, despite the generous height ofits buildings, seems dominated by foliage.Perhaps its magnificent elms just needcutting back a bit.

Iam not normally the sort of person tolet the weather get me down, but I findmyself drowning in a sea of monotonyas the rain drums endlessly against the

window. It is a Sunday, the day whichtends to magnify tedium and boredom, asif watching paint dry under a microscope.It seems to have been raining for days. ItHAS been raining for days. I’m remindedof those interminable Sundays of mychildhood up north, where the old people

would be inharmoniously and unanimously snoring away in the livingroom, in spite of the fact that an archaic black and white movie wascrackling out of the TV at full volume.

In spite of the appalling weather, I managed a five mile run in PrestonPark first thing this morning. There is something to be said for notgoing to the pub on a Saturday night. Where normally there are fair-weather runners, there was just me and an old man (who overtook me)in a professional running vest. I was intrigued to see a travelling womanbrushing her teeth in her pyjamas in the pouring rain outside hercaravan.

I dropped in forcoffee and a littlerespite from the rainat my friend B’shouse. She answeredthe door in herpyjamas – albeitwithout a toothbrushin hand – and thenforgot to put thewater in the coffeepot before she put iton the stove. Prettyironic really, giventhat we are currentlysurrounded by the stuff.

By midday, I was bored and so decided to answer some letters that Iwas saving as a ‘Monday morning job’. The main missive was toHastings Borough Council, who recently challenged our house forreplacing a boarded-up glass front door with a UPVC one. We eitherhave to apply for retrospective planning permission, or pay out fourtimes more for a timber door. It is too late to slap a conservation orderon something that has already been destroyed, but I will do as thecouncil wish, with a certain degree of belligerence.

With my letter writing complete, I went to the pub to bid adieu to acolleague who’s off to India and South East Asia until March. So now I’mgrumpy, belligerent and jealous … nice combination.

On Wednesday 10 December, MishonMackay are holding the ‘GlennMishon Charity Golf Day’ at The Dyke

Golf Club and this year all monies raised willbe for a great local charity, Martlets.

This will be the event's third year and isheld in memory of Mishon Mackay's foundingpartner who passed away in 2012. The date isparticularly poignant to all who knew Glenn,as 10 December is his birth date. In addition,the day has particular relevance to MishonMackay staff as Glenn had been instrumentalin organising the launch event as part ofMishon Mackay's charity fundraising in 2012,to raise £25,000 in celebration of MishonMackay's 25 years in business.

When the charity committee wereorganising 2012 events in October 2011, no-one had any idea that Glenn would be

diagnosed with cancer later that year andwould not be with them to see the results ofall their hard work. Glenn would have beenreally proud of his team's success in raisingover £34,000 for three chosen charities thatyear. As part of Glenn's legacy, it was decidedthat the company should continue to workhard at its efforts to raise money for charity,and these charities should always be local, andwhere possible have a relevance to membersof staff.

Glenn's family chose the charity for thisyear's Golf Day, and Barbara Mishon felt thatGlenn would want the money raised to go toMartlets, as it was a charity he had worked withfor many years and had always been veryproud of being involved with the Martletshospice.

I’m interviewing to fill a seniorrole and one of the bestcandidates has asked if we willconsider hiring them as a self-employed contractor, rather thanas an employee. What is thedifference?The key issue in determiningwhether someone is employed orself-employed is whether theemployer or the worker hascontrol over where, when and howthe work is done. If the worker hasto do the work themselves and isperforming a function that is partof regular business, it is likely thatthey are employed rather thanself-employed.

What factors are likely to meanthat a person really is self-employed? If a person is self-employed theycan usually hire someone else to

do the work for them and they willprovide the main items ofequipment they need to do theirjob.

If they agree to do the job for afixed price regardless of how longthe job may take, and regularlywork for a number of differentpeople, this will indicate they areself-employed as can the fact thatthey have to correct unsatisfactorywork in their own time and at theirown expense.

What happens if we think we’vehired someone as self-employed,but we get it wrong? Getting the relationship wrong,even if by accident, can prove tobe costly, particularly for theemployer. If a relationship ofemployment is found to exist, theemployer can be foundresponsible for unpaid annual andother kinds of leave, unfairdismissal and redundancy costsas well as unpaid PAYE and NI.

As such, if there is anyuncertainty about what the natureof the working relationship is, it isalways best to check first to avoidcostly and time consumingmistakes.

Foreigners purchasing high valueproperties in the UK,particularly in London, aregreater exposed to inheritance

tax, particularly if the properties havefuture growth potential. Inheritancetax is chargeable at 40% on estateswhich exceed the ‘nil rate band’exemption (currently £325,000).

Prior to 1 April 2013, it was commonfor non-domiciled persons to acquireUK residential properties through anoffshore company, the shares of whichwere often held by an offshore trust.The tax regime introduced in March2012 curtailed ownership of high valueresidential properties by offshorecompanies.

Impending changes to the capitalgains tax regime applicable to non-residents owning UK properties usedas dwellings has introduceduncertainty as to whether offshorecompanies is the vehicle of choice tohold investment properties, as well.

Enveloped PropertiesSince 21 March 2012, companies

(and certain other corporate entities)holding high value residential propertyare now liable to 15% Stamp DutyLand Tax (SDLT) on acquisition,recurring yearly ATED charges, and alsocapital gains tax (CGT) at 28% on the‘ATED-related gain’ upon disposal ofthe property.

Previously, the gains of offshorecompanies disposing of UK residentialproperties escaped CGT.

The threshold at which the taxapplies is to be lowered to £500,000over the next two years. As from 1 April2015, the entry level for the tax is anyproperty over £1,000,000.

Reliefs apply where the property isheld as part of a business (e.g. propertyrentals and developments).

The new tax regime is a deterrent tousing offshore companies, unless thecompany is merely acting as nominee.

‘Future Gains’ of Non-residentsAdditionally, in his Autumn

Statement in December 2013, theChancellor announced that, from April2015, capital gains tax is to beextended such that ‘future gains’ on alldisposals of UK properties used as adwelling by non-residents would be

subject to the charge.It appears that non-resident

individuals and partners holding suchproperties will be caught by the newregime, as are non-resident companies.Foreign trusts may be affected. Thedetails regarding the applicable ratesand how the tax is to operate are yet tobe announced. It is anticipated that thegain may be calculated by reference toa date from which the value of theproperty has been ‘rebased’.

A consultation was held betweenApril and June 2014, and it isanticipated that the outcome of theconsultation is to be published by theend of the year.

The applicable corporate rate maybe a determining factor as to whetherto use companies for dwellings held forinvestment purposes.

December is here and Christmas isupon us! So how will we becelebrating the festive season atLatest Homes Live?

Andrew: Christmas, to me, isn't just about theactual day. It's about everything that goes on inthe run up to the 25th. And then it carries on.My family tend to have about three ChristmasDays, because there are so many people to see,to exchange gifts with, to eat, drink and bemerry with! But it all starts when I put up mytree. My absolute favourite part of the holidaysis the decorating. I just love how festiveeverywhere becomes. The lights in people'sbushes, the trees twinkling from everyone'sliving room windows, the wreaths on the

doors. It's all part of the magic of the season, asfar as I'm concerned. I always over-do it withmy tree. I am one of these people who like toreally cram as much onto it as I can! I don't goso over the top that it will buckle under theweight of the glass baubles and dangling icicles,but I do like to give it a busy look. And thisyear, I get to chop down a tree myself, withSimone. Geoff Stonebanks is taking us out of

the confines of Driftwood by Sea and to alocal nursery, where we will be having a go atbeing lumberjacks for the day. Then, we'll beback at Driftwood, making sure the treeremains fresh all throughDecember andconstructing decorationsfrom nick nacks from thegarden. What's more, we'llbe doing our thing for thelocal wildlife too. Thosebirds and squirrels mustget chilly when the frostsstart to creep in, so we'll bemaking christmassysnacks, that double up asfestive ornaments, forthem to nibble on. And totop it off we'll be makingfresh wreaths. All of this tocome in upcomingDecember episodes ofLatest Homes Live.

Christmas, to me, is about giving. Notjust giving to those in your life, butgenerally being charitable and helpingothers. It can be a sad time for many, and Ibelieve, at a time of year when you want toshow your loved ones how much they meanto you, a little extra towards someone lessfortunatecomesalongside thefestive cheer.And howgreat that wecan spreadthat messagewhilstlearningaboutpropertytoo, onLatestHomesLive!
