III. INCIDENT DETAILS On 12-13-2016, at approximately 1000 hours, Enterprise Area command (EAC) officers were dispatched to 7726 Coral Cactus Court reference a family dispute between Charlene Ganigan and Edison Somera. Inside the residence were three children Ganigan and Somera had in common. Somera had recently been kicked out of the house but returned. Once inside, Somera pulled a gun on Ganigan. Their 19-year-old-son, Dustin Somera, pushed Somera away from Ganigan and Ganigan left the residence through the back door, went over the fence, and ran to a residence where she was able to call 911. The three children were also able to escape from the residence and gave information Somera was armed with a long gun and two handguns insdie the residence. Officers arrived and made contact with Ganigan and were given information about weapons in the residence, to include an assault rifle. Officers staged at the end of the cul-de-sac and observed Somera exit the residence holding a rifle. Somera entered the residence next door and took Doug Horwich and Richard Walker hostage. Horwich was able to escape, and Somera fired at Horwich as he ran down the street also in the direction of the arrived patrol officers.

Officer De Leon observed Somera as he fired at Horwich, but believed Somera was firing at him. Officer De Leon returned fire at Somera. Somera reentered the residence and a short time later came out again and fired at Officer De Leon. Officer De Leon again returned fire at Somera. Somera again reentered the residence and the officers treated the incident as a barricade. Notifications were made for SWAT and negotiators, who arrived and took over the perimeter. Negotiators were able to make contact with Somera, who later exited the residence and was taken into custody. Upon arrival of investigators, Sergeant Craig Dunn conducted a briefing. IV. BODY WORN CAMERAS (BWC) Multiple officers activated their body worn cameras during the event. Video footage captured the officer-involved shooting by Officer De Leon, and later Somera being taken into custody by SWAT officers. A summary of Officer De Leon’s video footage follows below. Beginning of the footage – Officer De Leon arrived and took over the position of Officer Walters at the southwest corner of Coral Cactus Court and Robindale Road.

1 minute and 27 seconds – Horwich ran down the street yelling for help.

1 minute and 41 seconds – Somera fired his first volley of gunshots toward Horwich and officers.

1 minute and 59 seconds – Somera fired his second volley of gunshots toward officers.

2 minutes and 6 seconds – Officer De Leon fired four rounds at Somera.

V. SCENE WALK-THROUGHS The purpose of the scene walk-through is to help investigators develop an understanding of the scene, including identifying officer location(s) at the time deadly force was used, identifying potential physical evidence, and re-creating a timeline of the incident. Officer Michale Simmons On 12-13-2016, at approximately 1856 hours, Officer Simmons provided a walk-through of the scene in the presence of the following persons: 1) Captain Lewis 2) Sergeant MacDonald 3) Detective Jex 4) Detective Leavitt 5) Director McLaughlin 6) CSA Supervisor Smink 7) LVPPA representative Officer Todd 8) LVPPA representative Officer Yant During the walk-through, which was not video or audio recorded, Officer Simmons relayed the following information: Officer Simmons responded and parked at the corner of Tiger Palm Court and Robindale Road and deployed with his rifle. He moved to 7728 Tiger Palm Court and took a position in the backyard on the north side. He saw Somera was armed with a long gun, which he broadcast over the radio, but did not observe Somera point the firearm at anyone. As Somera moved south to the neighboring residence, Officer Simmons moved to the south side of the backyard. The brick wall was taller at that section and he located a cinder block which he stood on to look over the wall. Officer Simmons observed Somera fire the rifle, but could not get a “bead” on him and only observed smoke. When Somera moved into the next door neighbor house Officer Simmons saw and heard gunfire coming from that second floor window, but never saw Somera. Officer Simmons stated he considered shooting through the stucco, but knew there was a hostage and did not want to endanger him. Officer Robert Warren On 12-13-2016, at approximately 1913 hours, Officer Warren provided a walk-through of the scene in the presence of the following persons:

They parked at the corner of Tiger Palm Court and Robindale Road. They went to 7720 Tiger Palm Court where Officer Warren took a position in the southeast corner of the backyard. Officer Warren was not able to see Somera when he heard the first rounds fired. Officer Warren then went to 7728 Tiger Palm Court and positioned himself in the southeast corner of the yard, but again he was unable to see Somera. Officer Roy Tighe On 12-13-2016, at approximately 1923 hours, Officer Tighe provided a walk-through of the scene in the presence of the following persons:

He did not see Somera, and only heard the gunshots during both volleys of fire. Officer Clarence Bowden On 12-13-2016, at approximately 1926 hours, Officer Bowden provided a walk-through of the scene in the presence of the following persons:

Court. When gunshots were fired he moved east next to the rear of the same vehicle. Officer Bowden did not see Somera during the incident. Officer Paolo De Leon On 12-13-2016, at approximately 1935 hours, Officer De Leon, provided a walk-through of the scene in the presence of the following persons:

1) Sergeant MacDonald 2) Detective Jex 3) Detective Leavitt 4) Director McLaughlin 5) CSA Supervisor Smink 6) LVPPA representative Officer Yant 7) LVPPA attorney David Roger During the walk-through, which was not video or audio recorded, Officer De Leon relayed the following information: His trainee, Officer Lopez, was driving and dropped him approximately 50 feet west of the cul-de-sac to Coral Cactus Court. Officer De Leon moved west of Coral Cactus Court and deployed with his rifle. He positioned himself at the corner of the brick wall looking south onto Coral Cactus Court. He observed Somera in between a silver car and red Xterra, both parked in the driveway of 7726 Coral Cactus Court, facing east. Somera was moving east and west up and down the driveway. Officer De Leon was in a squatted position next to the wall, which he maintained as Somera moved south toward the neighboring residence. Somera fired rounds toward Officer De Leon’s patrol car where Officer Darragh was located. Officer De Leon returned fire due to Officer Darragh being fired at, and was in fear for his own life as well as the citizens in the residences behind him. Somera then turned toward Officer De Leon and aimed the rifle at him. Officer De Leon, who was in fear for his own life, again returned fire. Officer Darren Darragh On 12-13-2016, at approximately 1950 hours, Officer Darragh provided a walk-through of the scene in the presence of the following persons:

He moved to the front passenger side of LVMPD Ford Explorer #10751 when the first gunshots were fired. When

Officer Lee Kingsley On 12-13-2016, at approximately 2001 hours, Officer Kingsley provided a walk-through of the scene in the presence of the following persons:

1) Detective Jex 2) Detective Leavitt 3) CSA Supervisor Smink 4) LVPPA representative Officer Yant During the walk-through, which was not video or audio recorded, Officer Kingsley relayed the following information: Officer Kingsley arrived and met with victim Charlene Ganigan in front of 5041 Salt River Avenue. He was at this location when he heard the first volley of gunshots fired. Officer Kingsley then moved in between 7704 and 7714 Hauck Street when the second volley of gunshots was fired. From that position he saw movement in the second floor window of 7734 Coral Cactus Court and gave radio traffic of the movement. Officer Patrick Walters On 12-13-2016, at approximately 2009 hours, Officer Walters provided a walk-through of the scene in the presence of the following persons:

1) Detective Jex 2) Detective Leavitt 3) CSA Supervisor Smink 4) LVPPA representative Officer Yant During the walk-through, which was not video or audio recorded, Officer Walters relayed the following information: Officer Walters was positioned near the west wall at Coral Cactus Court and Robindale Road. He observed Somera exit the residence with a rifle. Somera never pointed or fired the rifle when Officer Walters observed him. When the first volley of gunshots was fired Officer Walters was west of Officer De Leon along the brick wall. When the second volley of gunshots was fired he was approximately 15 yards west of Officer De Leon. VI. PUBLIC SAFETY STATEMENT (PSS) On 12-13-2016, at approximately 1708 hours, Detective Colon interviewed Sergeant Craig Dunn in reference to the Public Safety Statement he obtained from Officer De Leon. OFFICER WEAPON COUNTDOWNS On 12-13-2016, Officers Darragh, De Leon, and Simmons had their rifles counted down at LVMPD headquarters. SCSA King photographed all of the officers for appearance purposes and their rifles were photographed for identification purposes. Officer Darragh The following persons were present during the countdown: 1) Detective Jaeger 2) Peer Counselor Levy 3) SCSA King 4) LVPPA attorney David Roger Officer Darragh was dressed in the standard LVMPD tan, short sleeve patrol uniform. He wore LVMPD patches on each shoulder and an LVMPD badge on his left breast. Officer Darragh wore a black duty belt with attached tools and equipment as part of his position as a patrol officer. Officer Darragh’s handgun was carried on the right side of his body and secured in a holster Prior to countdown Officer Darragh stated he loaded 28 cartridges in the magazine placed into his rifle and kept the chamber empty. A two magazine coupler was added to the magazine inserted into Officer Darragh’s rifle, attaching a second magazine containing 28 cartridges, for a total of 56 cartridges. During the incident Officer Darragh charged his rifle chambering a round. After the incident was deemed safe and Officer Darragh returned to the command post, Officer Darragh cleared his rifle, removing the cartridge from the chamber. Officer Darragh placed the ejected cartridge into one of the two magazines. Officer Darragh did not remember in which magazine he placed the ejected cartridge.

Officer De Leon had a mark drawn onto the magazine to indicate when the magazine was loaded to 29 rounds. Officer De Leon stated he did not count the cartridges as he was loading the magazine, but looked at the mark on his magazine to know when it was loaded with 29 rounds. During the incident Officer De Leon conducted a tactical reload and stowed the magazine removed from his rifle in his duty belt.

7696 Black River St. 7696 Black River St. was a west facing two-story residence at the corner of Black River St. and Robindale Rd. There was a block wall on the south side of the house. A landscaping retaining wall was south of the block wall. Exterior: There was a bullet strike (labeled 'A') on the top decorative cinder block of the landscaping retaining wall. Another bullet strike (labeled 'D') was located on the south side of the block wall just above the landscaping. A bullet impact (labeled 'C') was in the block wall just above a plant. There was a bullet (Item #17) embedded in the block wall at impact 'C'. A bullet hole (labeled 'B') was located higher up on the block wall. The bullet entered the block wall at 'B' but did not exit out the north side of the block wall. House: There was a bullet strike (labeled 'F') on the south wall of the residence. A bullet hole (labeled 'E') was in the west window on the south wall of the residence. The bullet exited the interior side of the window (labeled 'E1') and entered the blinds (labeled 'E2'). The bullet exited the blinds (labeled 'E3') and went through the curtains (labeled 'E4'). The bullet continued across the entryway/hallway into the south stairwell wall (labeled 'E5') and exited on the north side of the south stairwell wall (labeled 'E6'). The bullet entered the north wall of the stairwell (labeled 'E7') and exited the south wall of the garage (labeled 'E8'). A blue badminton bag was on the ground adjacent to the south wall of the garage. There was a bullet hole in the bag near the zipper (labeled 'E9). Inside of the bag, a bullet (Item #16) was found in a black glove. 7703 Coral Cactus Ct. 7703 Coral Cactus Ct. was an east facing two-story residence at the corner of Coral Cactus Ct. and Robindale Rd. A block wall was on the north side of the residence. There were six rifle cartridge cases (Items #23-28) in the landscaping rocks just on the north side of the block wall. V2 was parked facing west/southwest at the north end of Coral Cactus Ct. just east of V1. V1 was parked facing east/southeast at the north end of Coral Cactus Ct. just west of V2 and northeast of 7703 Coral Cactus Ct. There was a bullet hole (labeled 'H') in the right front quarter panel behind the right front tire of V1. A bullet hole (labeled 'G') was located in the right front door of V1. The bullet continued through the door and exited on the interior side of the right front door (labeled 'G1') and through part of the frame of the door (labeled 'G2'). The bullet continued through the right bottom side of the glove box (labeled 'G3') and struck the right side of the metal "MDT" housing (labeled 'G4'). The bullet (Item #20) then entered the front left side of the back of the right front seat (labeled 'G5') and was embedded in the foam of the seat. There were bullet fragments (Item #19) on the right front seat. A bullet fragment (Item #18) was on the right front floor board. A third bullet hole (labeled 'I') was located in the right rear door of V1. The bullet continued through the door and exited on the interior side of the right rear door (labeled 'I1'). The bullet grazed a green bag (labeled 'I2') and split entering the back of the left rear seat (also labeled 'I2'). The bullet continued through the foam of the seat (labeled 'I3') and exited the interior left side of the trunk (labeled 'I4'). A bullet fragment (Item #21) was located in the front of the trunk on the left side of the spare tire. Another bullet fragment (Item #22) was found on equipment from inside of the trunk. Cactus Ct.) south of V1. A bullet (Item #35) was underneath the front end of V1. A bullet fragment (Item #36) was on the ground underneath V1 near the left rear tire. A trajectory rod was placed in bullet hole 'G' on V1. The angle was measured to be approximately five (5) degrees in an upward angle. It was also measured to be approximately sixty-eight (68) degrees from right to left. A trajectory rod was placed in bullet hole 'I' on V1. The angle was measured to be approximately two (2) degrees in a downward angle. It was also measured to be approximately sixty-three (63) degrees from right to left. 7726 Coral Cactus Ct. 7726 Coral Cactus Ct. was a west facing two-story residence. It was the fourth house south of Robindale Rd. on the east side of the street. V3 was parked facing north in front of the residence. V4 and V5 were parked facing east in the driveway. Vehicles: V4 was parked on the north half of the driveway. There was a bullet hole (labeled 'L') in the exterior side of the left front door. The bullet continued in a southerly direction and exited the interior side of the left front door (labeled 'L1'). The bullet then struck the steering wheel (labeled 'L2') and continued south and entered the interior side of the right front door (labeled 'L3'). There was a bullet fragment (Item #37) on the left front floor board. Another bullet fragment (Item #38) was on the right front floor board. A bullet travelling south entered the left rear window (labeled 'M') of V4. The bullet exited the interior side of the left rear window (labeled 'M1') and continued southeast entering the interior side of the right front window (labeled 'M2'). The bullet exited the exterior side of the right front window (labeled 'M3'), continued southeast, and entered the exterior side of the left front window of V5 (labeled 'M4'). The bullet exited the interior side of the left front window of V5 (labeled 'M5'), struck the interior side of the left 'A' pillar of V5 (labeled 'M6'), and went through the carpet dash mat of V5 (labeled 'M7'). A bullet fragment (Item #40) was found in the dash mat just in front of the steering wheel of V5. Another bullet travelling southward entered the top of the left rear door and the frame above the door of V4 (labeled 'N'). The bullet exited the interior left side of the roof above the left rear seat of V4 (labeled 'N1'). There were three bullet fragments (Item #39) on the left rear floor board of V4. There were two bullet strikes (labeled 'R' and 'S') in the exterior left side of the windshield of V4. A bullet travelling northward entered the right front quarter panel (labeled 'Z'). No exit holes were found corresponding with 'Z'. V5 was parked on the south half of the driveway, south of V4. A bullet travelling north entered the exterior side of the right front door of V5 (labeled 'O'). The bullet exited on the interior side of the right front door (labeled 'O1') and entered the right side of the right front seat (labeled 'O2') with fragments entering the right front side of the back of the right front seat (labeled 'O3'). There was a bullet fragment on the right front seat and another bullet fragment embedded in 'O3' (Item #41). Another bullet fragment (Item #45) was located on the frame below the right front seat. Bullet fragments (Items #42-44) were on the right rear floor board. A bullet travelling northwest entered the front of the hood of V5 (labeled 'P'). The bullet exited the left side of the front of the hood (labeled 'P1'). Another bullet travelling northwest entered the front of the hood of V5 (labeled 'Q'). The bullet struck the interior left side of the hood leaving damage but no exit (labeled 'Q1'). Seven bullet fragments (Item #46) were on the left front seat of V5.

House: The northwest section of the house (which included the front door, the front entryway, and the stairwell) stuck out further west than the garage. There were numerous bullet holes and strikes in this section of the residence. A bullet travelling north entered the exterior side of the south wall north of the driveway (labeled 'T'). No exit for this bullet was located. A bullet travelling north entered the exterior side of the south wall north of the driveway (labeled 'U'). The bullet continued north and exited the interior side of the south wall of the stairwell (labeled 'U-1'). The bullet is fracturing and enters the interior side of the north wall of the stairwell in four different places (labeled 'U2A', 'U2B', 'U2C', and 'U2D'). 'U2C' is a bullet hole with no exit found. 'U2D' is an impact with a bullet fragment (Item #48) embedded in the wall. Another bullet fragment (Item #47) is found on the second stair from the bottom east of Item #48. Bullet holes 'U2A' and 'U2B' continue north and exit out the exterior side of the north wall. Another bullet travelling northwest entered into the exterior side of the south wall north of the driveway (labeled 'V'). The bullet continued northwest and exited out the exterior side of the west wall (labeled 'V-1'). A bullet travelling northwest entered the exterior side of the south wall north of the driveway (labeled 'W'). The bullet continued northwest and exited out the exterior side of the west wall (labeled 'W-1'). A bullet travelling northwest entered the southwest corner north of the driveway (labeled 'X'). The bullet continued travelling northwest creating a hole/strike on the exterior side of the west wall (labeled 'X-1'). The bullet (Item #49) was embedded in the west wall. An electrical box was in the front yard west of the front door. There was a bullet hole on the east side of the electrical box (labeled 'Y'). No corresponding exit hole was found. On the south side of the house, there were five bullet holes in the south wall on the second floor. Two more bullet holes were seen in the south facing window on the second floor. And a bullet impact was in the wood frame below the window. The bullet holes were too high to label and to record photographic documentation. Note: At approximately 2230 hours, Senior CSA O. Klosterman #13177 and CSA II H. Ubbens #14792 arrived and documented the interior of the house at 7726 Coral Cactus Ct. (see their Crime Scene Report for more information). 7734 Coral Cactus Ct. Exterior 7734 Coral Cactus Ct. was a west facing two-story residence just to the south of 7726 Coral Cactus Ct. A bullet travelling south entered the exterior side of the north wall north of the front door (labeled 'J'). The bullet continued south and exited the interior north wall of the stairwell (labeled 'J1'). The bullet continued south across the front entryway and entered the interior south wall of the entryway (labeled 'J2'). No corresponding exit holes were found. A small hole was cut by CSA Supervisor J. Smink #6556 near 'J2' in order to attempt to retrieve the bullet or bullet fragments. The attempt was unsuccessful. A rifle cartridge (Item #1) was in the landscaping rocks north of the front porch. Five rifle cartridge cases (Items #2-4, #6-7) were also on the landscaping rocks north of the front porch. On the front porch were eight rifle cartridge cases (Items #5, #8-13, #15). One rifle cartridge case (Item #14) was in the landscaping rocks west of the front porch and front door.

Interior Just inside the west facing front door, a sofa was on the south wall and the stairs to the second floor were on the north wall. There was a rifle cartridge case (Item #29) on the floor near the west end of the sofa. Another rifle cartridge case (Item #30) was on the floor near the east end of the sofa. A bullet fragment (Item #34) was on the floor underneath the sofa. The hallway/entryway continued east and opened up into an open kitchen/dining/living space. There were two rifle cartridge cases (Items #31 & #32) on the floor in the entrance. In the open living space, the kitchen was in the southwest corner of the room. The dining area was in the southeast corner. The dining table had been moved north and just west of the sliding glass door. The living area was in the north half of the room. A glass coffee table was just south of the television on the north wall. On top of the coffee table was an empty rifle magazine (Item #50). Outside on the back patio, near the sliding glass door, was a rifle cartridge (Item #33). A Glock 30 handgun (Item #63) was located on the fifth stair up from the landing. A 45 caliber cartridge (Item #64) was in the chamber. Inside of the handgun was a magazine (Item #65) containing nine (9) 45 caliber cartridges (Item #66). At the top of the stairs and just south was a love seat that had been pulled away from the pony wall and was partially blocking the entrance to the stairs. There was a side table and a sofa along the pony wall (or south wall of the stairs). A white envelope with various phone numbers (Item #52) was on the side table to the east of the sofa. On top of the sofa was a RomArm 7.62x39 caliber semi-automatic rifle (Item #53). A rifle cartridge (Item #54) was in the chamber. The rifle also contained a magazine (Item #55) containing nineteen (19) rifle cartridges (Item #56). Along the west wall were stacks of movies. In the northwest corner, on the floor, was a Ruger handgun (Item #57) and two Glock magazines (Items #59 and #61). The Ruger handgun contained an empty magazine (Item #58). A silver-colored metal trash can was south of the Ruger handgun. Inside of the trash can was miscellaneous trash, urine, and eight 9mm cartridge cases (Item #51). A television was on the south wall with a black cell phone on the television stand. Two bedrooms and a bathroom were south of the loft. The master bedroom and bathroom were on the east end of the second floor. There were two windows on the north wall above the stairs. The west window had five bullet holes through the blinds and the window. The east window had three bullet holes through the blinds and the window. The bullet holes correspond with the bullet holes on the south wall and window of the second floor at 7726 Coral Cactus Ct. SCSA Klosterman VEHICLE(S): 2011 Chevrolet Colorado pickup truck (white, 4dr) NV-556-YYA VIN-1GCDSCF97B8130851 GENERAL INFORMATION:

I arrived on the scene at approximately 2257hrs with Crime Scene Analyst II H. Ubbens P#14792. Upon our arrival the scene was secured with crime scene tape by uniformed patrol officers and there were many other personnel present including: Crime Scene Supervisor J. Smink P#6556, Senior Crime Scene Analyst S. Fletcher P#5221, CSA I D. Andrews P#13766, CSA II L. Cornell P#13576, Force Investigations Team (FIT) Detectives C. Jex P#5597, J. Leavitt P#5814, Sgt. J. MacDonald P#4660, and several other officers. Upon our arrival we were briefed and did a follow up Search warrant of the above listed address. SCENE

The search warrant was conducted at a two story residence on the east side of the street. There was a silver Chevrolet Cavalier (NV-34G 953) and a red Nissan Xterra (NV-809-YUR) parked in the driveway facing east. A white Chevrolet Silverado pickup truck was parked facing east in the garage (NV-556-YYA). There was an additional vehicle which was a silver Honda Civic and was parked facing north, directly in front of the residence. This vehicle was partially blocking the north portion of the driveway. The interior garage door leading from the garage into the residence was located on the middle of the north wall. There is an understairs closet located west of the door from the garage into the residence. A large black gun safe was on the floor inside the understairs closet. There were several personal items and firearms related items inside the safe including a cell phone, a tablet, a thigh holster, boxes of ammunition including a box of "R3D Army Standard" with twenty cartridges of 7.62 x 39 (Item 7), and a black plastic Ruger LCR 9mm handgun box with hand gun Serial #54959331. The front entry door to the residence was located northwest of the understairs closet. The front entry door had a damaged door frame. There was a stairway at the west portion of the residence and a hallway half bathroom located southeast of the front entry door. The living room was located at the northeast corner of the first level. There was a couch on the east wall, a television and stand on the north wall with a couch on the east wall and another couch facing the television. The couch facing the television had a black H&R 1871 Pardner Pump 12 gauge shotgun with Serial #NZ634563 which was not loaded and was lying on the floor underneath the couch. There were several pillows and blankets scattered on the floor between the couches and the television. The pantry was located on the west wall of the living room. A Christmas tree with presents was in the northeast corner and there a sliding glass door on the east wall which was open. The dining room was located at the southeast corner of the residence and had a table and chairs with one chair knocked over. The kitchen was southwest of the living room and west of the dining room. There were several cabinet doors open and there were two (2) sets of keys on the kitchen island. The second level of the residence had a loft area just at the top of the staircase with a laundry room northwest, and a hallway bathroom southwest staircase. There were two bedrooms south of the staircase with one being the southwest bedroom and one being the southeast bedroom. The master suite was located at the east portion of the second level. The southwest bedroom had a bed in the southwest corner a television on the floor along the north wall, a closet on the east wall at the southeast corner, and clothing scattered on the floor. The southeast bedroom had a bed in the southeast corner, a closet on the north wall, and clothing scattered on the floor. The master

bedroom had no bed in it and had clothing and children's items scattered throughout the room including a baby swing on the north wall. There was a set of keys on a "Green Bay Packers" lanyard which had a "Honda" key on it and was lying on the floor near the west wall. There was also a black plastic "Glock" handgun case (Item 5) and a box of fifty (50) "Gold Dot" ammunition with nineteen (19) cartridges in it (Item 6) on the floor near in the northwest corner of the bedroom. The master bathroom was located at the southeast portion of the bedroom with an iPhone with a black case on the south portion of the bathroom sink against the east wall. The iPhone had a FCCID of BCG-E3091A and IC: 579C-E3091A. The toilet room of the master bathroom was located at the northwest portion of the bathroom with the closet at the southwest portion. Trajectory The following bullet impacts were observed and labeled including:

ZZ1 – Through the lower portion of the south wall of the closet in the southwest bedroom with a bullet located on the closet floor (Item 2 or Item 3)

YY1 – Through the lower portion of the south wall of the closet in the southwest

bedroom with a bullet located on the closet floor (Item 2 or Item 3) XX1 – Through the upper portion above the closet shelf in the south wall of the closet

in the southwest bedroom and continuing through the south side of an "Xbox 360" box at XX2 and coming out the north side of the "Xbox 360" box at XX3 and a bullet (Item 1) being located inside a shoe on the upper closet shelf along the east wall

WW1 – Through the west upper portion of the south facing window of the southeast

bedroom and continues through the blinds and into the north closet wall above the shelf at WW2 with no bullet located.

VV1 – Through the east lower portion of the south facing window of the southeast

bedroom and continues through the exterior sliding closet door on the north wall at VV2 with a bullet (Item 4) located on the closet floor

Bullet holes ZZ1, YY1, & XX1 originate from the residence at 7734 Coral Cactus Ct. which is south of 7726. There are five (5) bullet holes in the north facing second level window of 7734 above the staircase with three (3) bullets entering into the residence at 7726 (ZZ, YY, & XX) and two (2) impacting the south exterior wall of 7726 but not perforating into the residence. The exterior of the residences and the second level windows at the residence of 7734 was not accessible for labeling purposes therefore the initial bullet hole letter designator begins on the interior walls of 7726 Coral Cactus Ct. Bullet holes WW1 & VV1 originate from the residence at 7734 Coral Cactus Ct. There are three holes in the north facing second level window of 7734 in the loft area with two (2) bullets entering into the residence at 7726 (WW & VV) with an additional impacting the south exterior wall of 7726 but not perforating into the residence. The exterior second level windows of the residences were not accessible for labeling purposes therefore the initial bullet hole letter designator begins on the interior walls of 7726 Coral Cactus Ct.

There were additional bullet holes located in the staircase at 7726 Coral Cactus Ct. These bullet holes were photographed and described by the CSA's who did the original scene due to them being part of a larger trajectory. Please refer to their report for any additional information. A bullet hole was located in the driver side bed of the vehicle (AA1-exterior side, AA2-interior side) with a corresponding bullet hole (AA3-interior side, AA4-exterior side) in the passenger side of the vehicle bed. 7663 Black River St. The residence was a two story east facing residence, located north of 7671 Black River St. A bullet hole was located in the east facing garage door (AA5-exterior side, AA6-interior side) of the residence. Corresponding damage was located in the frame of a storage shelf (AA7-interior front facing side, AA8-exterior rear facing side ) adjacent to the north wall of the garage; and a corresponding bullet hole was located in the interior north wall of the garage (AA9), and the exterior north facing stucco wall of the residence (AA10). NOTE: The damage to the exterior side of the above described storage shelf (AA8) was not photographed, due to it being inaccessible. 7655 Black River St. The residence was a two story east facing corner residence, located north of 7671 and 7663 Black River St. A corresponding bullet hole was located in the exterior south facing stucco wall (AA11) of the garage.

XI. INVESTIGATION Involved Officer Officer De Leon

Per LVMPD Policy 6/002.04, Post Use of Force Procedures, an involved officer may provide a recorded statement to FIT investigators. If given, involved officer statements are taken at least 48 hours after the incident unless waived by the involved officer.

On 12-14-2016, at approximately 1500 hours, Lieutenant Huddler contacted Officer De Leon. Officer De Leon declined to give a statement to FIT.

Witnesses Charlene Ganigan On 12-13-2016, at approximately 1613 hours, Detective Alsup conducted an audio recorded interview with Charlene Ganigan in his unmarked vehicle located at Robindale Road and Decatur Boulevard. Below is a summary of the interview; for complete details refer to the interview transcript. Charlene Ganigan had been in an intimate relationship with Edison Somera for the last 21 years. They had three children together and owned a home together, but were not married. Ganigan and Somera lived together at 7726 Coral Cactus Court with their three children until November 2016 when Somera moved out of the residence. According to Ganigan, she learned Somera was cheating on her in October 2016. They continued to live together while trying to mend their relationship. Somera moved into an apartment on 11-11-2016. Due to threats Somera made, Ganigan applied for and was granted a temporary restraining order, which was served in the beginning of December 2016. On 12-08-2016 Somera called Ganigan and told her he needed a ride due to his car being damaged. Ganigan agreed to give him a ride. While Ganigan was driving on the freeway Somera became angry and started punching her. Somera punched Ganigan in the right arm, right shoulder, right side of her neck, and the right side of her head. Ganigan stated Somera hit her so many times in the head she felt like she was going to, “lose it.” Ganigan also stated Somera grabbed a black and silver semiautomatic handgun from his waistband, manipulated the slide of the firearm to load a round into the chamber, and pointed it at Ganigan. While the handgun was pointed at Ganigan, Somera told her, “If I can’t have you, nobody can.” Somera told Ganigan if she told anybody about the incident he would kill her and whoever she told. The incident ended when Ganigan dropped Somera off at his apartment. Ganigan stated she was in fear for her life and felt if she tried to get away Somera would shoot her. Ganigan did not report the incident to police because she was afraid.

On 12-13-2016, Ganigan received approximately six to seven phone calls from Somera, but did not answer the phone. Ganigan told her son, Dustin Somera, that she was going to take a shower and not to let Somera into the house if he showed up there. As Ganigan was in the shower she heard Somera’s voice outside her bathroom and immediately locked the door. Ganigan got dressed and left the bedroom to speak with Somera. During the conversation, Ganigan told Somera their relationship was not going to work and they should separate. Somera became very angry and grabbed a silver and black handgun from his waistband. Somera then manipulated the slide of the handgun to load a round. Dustin pushed Somera into a wall and Ganigan ran out of the sliding glass door into the backyard, jumped over the rear brick wall, and ran to a neighbor’s house to call 911.

Dustin Somera On 12-13-2016, at approximately 1710 hours, Detective Alsup conducted an audio recorded interview with Dustin Somera in his unmarked vehicle located at Robindale Road and Decatur Boulevard. Below is a summary of the interview; for complete details refer to the interview transcript. Dustin was at home with his mother, Charlene Ganigan, seven-month-old sister,

, and a six-year-old family friend, . Charlene Ganigan went upstairs to take a shower and told Dustin not to let his father, Edison Somera, into the house if he showed up there. Shortly after that conversation, Somera knocked the door. Dustin saw Somera at the front door by monitoring a security camera. After knocking several times, Somera opened the door and walked into the house. Once inside, Somera asked Dustin where Ganigan was. Dustin attempted to keep Somera downstairs until Ganigan was out of the shower. When Ganigan came downstairs she began to argue with Somera. Somera became very angry and pulled a black semiautomatic handgun from his waist area. Dustin was afraid Somera would shoot Ganigan, so he tackled Somera into a wall near the stairs which allowed Ganigan to run from the house. Somera pulled a silver semiautomatic handgun and was holding it as well as the black handgun. Somera sat the black handgun down and Dustin was able to knock it away and onto the floor. Somera then ordered Dustin and the girls upstairs while pointing the other handgun at Dustin. Dustin stated he was afraid his dad would shoot him and that he was not free to leave. Once upstairs, Somera retrieved a black rifle from a safe. Dustin referred to the rifle as an AK-47. Dustin stated that while upstairs Somera pointed the rifle at him at least 10 times. Dustin stated that every time the rifle was pointed at him, he was afraid his father would shoot him. Somera went from bedroom to bedroom looking outside the windows. When Somera went into the master bedroom Dustin took and ran from the house. Dustin then ran down the street and found his mother.

Doug Horwich On 12-13-2016, at approximately 1722 hours, Detective Penny conducted an audio recorded interview with Doug Horwich at Robindale Road just east of Hauck Street. Below is a summary of the interview; for complete details refer to the interview transcript. Horwich lived at 7734 Coral Cactus Court and was inside of his home. Horwich stated he was upstairs working in his home office and his friend, Rick Walker, was downstairs watching television. Horwich stated he heard loud yelling outside of his home, and shortly thereafter he heard two different male voices downstairs. Horwich had a repair appointment with Cox Communications scheduled and assumed it was the technician talking to Walker. Upon walking downstairs he was confronted by his neighbor, Edison Somera. Somera was armed with an AK-47 and was alternately aiming the rifle at Horwich and Walker. Somera ordered Horwich to move towards Walker while continuing to aim the rifle at both of them. Horwich stated he tried to reason with Somera in an attempt to calm him down, but he was unsuccessful. Somera told Horwich and Walker to go into the dining room, get on their knees, and put their hands on top of their head; they complied. While Horwich and Walker were in the dining room Somera closed the window blinds. Horwich believed this was done so no one could see inside of the home. Horwich continued attempting to calm Somera down, but Somera told Horwich if he did not shut up he would be shot. Somera then questioned Horwich about anyone else being inside of the home. Horwich insisted no one was upstairs, and it was just Walker and him in the home. Somera then ordered both men upstairs. Horwich stated he got up and walked towards the stairs, Walker was eight to 10 feet behind him, and Somera was last. As Horwich entered the hallway and approached the stairs, he saw Walker turn around and walk back towards Somera. Horwich said Somera’s view of him was blocked and felt he could escape, so he unlocked the front door and ran outside screaming for help. Once outside, Horwich was met by officers who got him to safety. Horwich stated during the entire encounter inside of his home Somera aimed the AK-47 at Walker and him and continuously threatened to shoot them. Somera also had a semiautomatic handgun tucked into his waistband. At one point Somera drew the handgun with his left hand and aimed the AK-47 and handgun at Horwich and Walker. Horwich stated he was in fear for his life during the incident prior to escaping. Horwich stated he had prior contact with Somera approximately four months prior to this incident. Horwich stated Somera kept caged dogs inside of the garage and they would constantly bark. Horwich talked to Somera outside and asked about the barking dogs, and Somera immediately got in Horwich’s face and became aggressive. Somera told Horwich if he reported him to the HOA he would come to Horwich’s door and “check his ass.”

Horwich also stated he had a home surveillance camera inside of his living room through Cox Security Suite. Horwich stated he believed the camera was video only; however, where it was positioned it would have recorded much of the encounter with Somera. Horwich stated the video was uploaded to a cloud and there was no physical hard drive at his residence. Richard Walker On 12-13-2016, at approximately 1725 hours, Detective Kowalski conducted an audio recorded interview with Richard Walker at the 5000 block of Robindale Road. Below is a summary of the interview; for complete details refer to the interview transcript. On 12-13-2016, at approximately 1000 hours, Walker was inside the residence at 7734 Coral Cactus Court when he heard someone pounding on the rear glass sliding door. Walker looked out and observed Edison Somera standing outside holding an AK-47 rifle. Walker described Somera as a Filipino male, approximately 5’6”, medium build, heavily tattooed, and wearing a black shirt. Somera pointed the rifle at Walker and ordered him to open the door. When Walker did not immediately open the door, Somera continued to yell. Fearing he would be shot if he did not comply, Walker unlocked the door and Somera entered the house.

Somera told Walker that he was going to kill him. Somera was upset and said something about his wife and children and police helicopters overhead. Somera ordered Walker to sit down at a chair at the dining room table and Walker complied. Walker tried to communicate with Somera to calm him down, but everything he said continued to agitate Somera.

Somera ordered Walker to go upstairs and asked who else was inside the residence. At the same time, the owner of the residence, Doug Horwich, came down from the upstairs of the residence. When Somera saw Horwich, he ordered him into the dining room and sat him down across the table from Walker. Horwich tried to talk and reason with Somera, but it only made Somera angry.

Somera ordered Walker and Horwich to go upstairs and continued to ask who else was in the residence, believing someone else was upstairs. As they walked upstairs, Horwich was in the lead with Walker behind him and Somera trailing them. They approached the stairs and Walker lagged behind the other two. When Somera turned towards Walker, Horwich ran towards the front door of the residence. Walker blocked Somera’s view as Horwich unlocked the door and ran from the residence.

Somera pushed Walker out of the way and ran towards the front door. Somera opened the door and stood in the doorway. Somera pointed a semiautomatic pistol, which Walker believed to be a Glock, at Walker with his right hand and held the AK-47 rifle in his left. Walker believed Somera fired multiple times at Horwich as he ran from the residence.

Somera closed the door and was angry at Walker for blocking him. Walker tried to calm Somera, but was unsuccessful. Somera ordered Walker back to the dining room and told him he was going to die. Somera had Walker block the door to the residence with a couch and the windows with a table. Somera ordered Walker upstairs while pointing the AK-47 at his back. Somera continued to hold the pistol in his right hand. Somera also had a second pistol in his waistband and Walker believed he possibly had a third pistol on his person.

Somera had Walker open all the doors in the upstairs of the residence to confirm no one else was inside with them. Walker was ordered to sit on the floor. Somera told Walker that day was “going to be his last day” and to “get ready.” Somera said that when the police rushed the residence, he was going to kill Walker and then himself. Somera pointed the handguns at Walker’s head, swapping them in and out of his waistband. This occurred for an undetermined amount of time. Walker continued to try and calm down Somera.

Somera called relatives on his cell phone. Walker overheard Somera’s first name was Edison, learned he was angry due to his wife leaving him, and he was losing his three children. Somera stated he had exchanged gunfire with the police and thought he was going to spend his life in prison. Somera did not want to go to prison and could not surrender. Somera would not go alone and would take Walker with him.

Somera called the operator at the California Hotel and Casino, where he worked, and spoke to his supervisor. His lieutenant, Scott, spoke with Somera and was able to calm him down somewhat. Somera passed the phone to Walker who then spoke with Scott.

Somera ordered Walker to look out the back windows to see where the police were positioned. Somera told Walker if the police were to shoot they would hit Walker instead of him. Walker held the curtains back so Somera was able to look out the window. At one point during the incident, Somera fired seven times out the window. Walker did not know at who or what Somera was firing.

Later in the incident, a phone was provided to Somera by LVMPD hostage negotiators to facilitate communication. Negotiators spoke to both Somera and Walker during the incident. Somera was convinced to surrender to police. Walker agreed to walk out with Somera to surrender to police. Somera put his firearms down in one of the upstairs rooms and they walked out of the residence. SWAT officers ordered Walker to stand at the door with his hands up while they called Somera back to their location. Somera was taken into custody and then Walker was called back. Walker was vetted by SWAT officers and stood by to speak with detectives. Edison Somera On 12-13-2016, at approximately 1800 hours, Detective Jaeger conducted an audio-visual recorded interview with Edison Somera at LVMPD headquarters in interview suit #11. Somera was advised of his Miranda rights which he acknowledged. Somera requested to speak to an attorney before questioning, so all questioning was stopped. Officer Robert Warren On 12-13-2016, at approximately 2030 hours, Detective Colon conducted an audio recorded interview with Officer Warren at LVMPD headquarters. Also present for the interview were LVPPA representatives Officers Grammas and Todd. Below is a summary of the interview; for complete details refer to the interview transcript. Officers Warren and Simmons responded to the call at Coral Cactus Court. Upon arrival to the area, Sergeant Sabino instructed them to respond to Tiger Palm Court, one street west of the target address of 7726 Coral Cactus Court, and watch the front door.

The officers parked approximately three or four houses south of Robindale Road. Officer Simmons deployed his rifle and Officer Warren deployed his handgun. The officers took a position in the south end of a backyard on Tiger Palm Court facing east, looking through the backyard with a view of the target residence’s front door. Approximately 10 to 20 minutes later, Officer Warren heard gunshots fired from the area of the target residence. Officer Warren believed gunshots were fired at officers who had posted north of the target residence. Officers broadcast Somera had an AK-47, and had moved north and made entry into the neighbor’s house at 7734 Coral Cactus Court, where a male [Horwich] ran out of the house towards Robindale Road yelling, “Home invasion!” Officers Warren and Simmons moved to the north end of the backyard they were in to gain a visual of the neighbor’s house. Officer Warren heard a second volley of gunshots come from the second floor of the target residence. Officer Warren was not able to see Somera, but saw glass break and smoke come from the second story window. Officer Warren stated he did not fire any gunshots because he was not able to see Somera from his vantage point. Officer Warren and Officer Simmons remained at their location until relieved by SWAT officers. Officer Michale Simmons On 12-13-2016, at approximately 2048 hours, Detective Colon conducted an audio recorded interview with Officer Simmons at LVMPD headquarters. Also present for the interview was LVPPA representative Officer Todd. Below is a summary of the interview; for complete details refer to the interview transcript. Officer Simmons and his partner, Officer Warren, responded to a domestic disturbance call at 7726 Coral Cactus Court. The details explained Edison Somera had a firearm and had threatened Ganigan. As Officer Simmons arrived, Sergeant Sabino advised him to respond to Tiger Palm Court and obtain a visual of the front door of 7726 Coral Cactus Court. The Air Unit directed Officer Simmons to Tiger Palm Court and instructed him to go four houses south of Robindale Road to gain a visual of the target residence. Officer Simmons deployed his rifle while Officer Warren deployed his handgun. The officers gained access to the backyard of the fourth house south of Robindale Road, and while looking east were able to see the front door of 7726 Coral Cactus Road. Officer Simmons observed the front door open and heard screaming and someone run northbound from the front door. Officer Simmons heard gunshots and knew they were fired in the direction of officers who had posted at the corner of Coral Cactus Court and Robindale Road. Officer Simmons heard the gunshots and saw smoke, but was unable to see Somera. Officer Simmons heard a male voice yell, “Help me! Help me!” A radio broadcast advised Somera had made entry into one house to the north, 7734 Coral Cactus Court, and had a hostage.

Officers Simmons and Warren moved to the north side of the yard and gained a visual on the neighbor’s front door. Officer Simmons observed gunshots, which appeared to the north, come from the upstairs window. Officer Simmons was unable to see Somera and did not discharge his rifle. Officers Simmons and Warren remained at their location until relieved by SWAT officers. Officer Clarence Bowden On 12-13-2016, at approximately 2049 hours, Detectives Alsup and Kenton conducted an audio recorded interview with Officer Bowden at LVMPD headquarters. Also present for the interview was LVPPA representative Officer Grammas. Below is a summary of the interview; for complete details refer to the interview transcript. Officer Bowden was working dayshift patrol in EAC when he heard a broadcast of a high priority domestic disturbance. Officer Bowden advised Dispatch that he would be en route and responding Code 3. Officer Bowden then activated his body worn camera and responded to the area. Officer Bowden arrived in the area and obtained visual surveillance on the residence while Officer Kingsley made contact with the female who called 911. Due to the fact that the suspect [Edison Somera] was possibly armed with a rifle, Officer Bowden became a spotter for Officer Darragh when he arrived. Officers Bowden and Darragh took cover behind two patrol vehicles and kept visual contact of the front door of the residence. During the incident officers learned children were still inside the residence. A short time later the front door of the residence opened and three juveniles exited from the house and moved toward officers. The juveniles were a male in his teens carrying an infant and an approximately six-year-old female. After leaving the residence, the juveniles ran north on the street and were escorted by an officer. Shortly after the juveniles exited the residence, a white male, Horwich, ran north on the street toward officers. Officer Bowden observed Horwich was wearing pajamas. As Horwich approached the officers, Officer Bowden heard a series of gunshots and heard the rounds skipping off the ground and striking one of the vehicles near them. Officer Bowden believed he and Officer Darragh were being targeted by Somera and was in fear for his life. Due to the rounds impacting close to their location, Officers Bowden and Darragh moved locations. After moving, Officer Bowden heard another volley of gunshots and learned Somera had made entry into another residence on the street. Officer Bowden heard a third volley of gunshots a short time later. Officer Bowden was relieved of his position by SWAT officers shortly after this series of events.

Officer Lee Kingsley On 12-13-2016, at approximately 2111 hours, Detective Colon conducted an audio recorded interview with Officer Kingsley at LVMPD headquarters. Also present for the interview was LVPPA representative Officer Todd. Below is a summary of the interview; for complete details refer to the interview transcript. Officer Kingsley responded to a domestic disturbance call at 7726 Coral Cactus Court. The details explained Edison Somera had a firearm and had threatened Ganigan. Officer Kingsley was instructed to respond the 7661 Hauck Street where Ganigan had fled. Officer Kingsley made contact with Ganigan who advised him she had been in a relationship with Somera for 21 years and had three children in common. Ganigan showed Officer Kingsley visible bruises on her arms, head, and shoulder where Somera had punched her the week prior. Ganigan explained she had been trying to break up with Somera and he threatened to kill her because of it. Ganigan advised earlier that day Somera pulled a gun on her, at which time her 19-year-old son with Somera, Dustin Somera, pushed Edison, which allowed her to run to a neighbor’s house where she called 911. A short time later Dustin, a six-year-old, and seven-month-old child were observed running from 7726 Coral Cactus Court. Dustin was carrying the seven-month old. Officer Kingsley made contact with Dustin Somera, who advised his father was armed with a rifle and possibly two pistols. Dustin explained he hid a shotgun in the house from Somera. Officer Kingsley heard approximately 15 to 18 gunshots. Officer Kingsley learned Edison Somera had taken a hostage at 7734 Coral Cactus Court. Officer Kingsley and two other officers posted in the backyard of 7704 Hauck Street where they were able to see the rear of Edison Somera’s location. Officer Kingsley heard a second volley of gunshots, but was unable to determine from where they were coming. Officer Kingsley remained at that location until relieved by SWAT officers. Officer Roy Tighe On 12-13-2016, at approximately 2111 hours, Detectives Alsup and Kenton conducted an audio recorded interview with Officer Tighe at LVMPD headquarters. Officer Tighe was riding with Officer Darragh. Officers Tighe and Darragh heard a radio broadcast of a domestic disturbance with a male with a firearm threatening a female. By the time they arrived other units had already arrived. Two LVMPD patrol vehicles were blocking the street leading to the residence. Officer Darragh went back to his vehicle to retrieve his rifle, and Officer Tighe stayed with another group of officers that were with Sergeant Sabino.

Officer Tighe observed three juveniles run northbound from the target house. A short time later Officer Tighe heard multiple gunshots and knew they were impacting close to his location and also Officer Darragh’s location. Officer Tighe observed Officer De Leon discharge his rifle. Officer Tighe and the other officers moved to another position because they believed the suspect [Edison Somera] had determined their location. Officer Tighe observed a male [Horwich] run northbound towards his location and later learned Somera had made entry into Horwich’s house. Officers made contact with Horwich and escorted him out of the area. Officer Tighe then heard another volley of gunshots followed shortly by a third volley of gunshots. The officers were then relieved by SWAT officers and escorted out of the area. Officer Darren Darragh On 12-13-2016, at approximately 2130 hours, Detectives Alsup and Kenton conducted an audio recorded interview with Officer Darragh at LVMPD headquarters. Officer Darragh was riding with Officer Tighe. The officers heard a broadcast of a domestic disturbance involving a male with a firearm. Upon arrival Officer Darragh was directed to retrieve his rifle by Sergeant Sabino. Officer Darragh retrieved his rifle and took cover behind a patrol vehicle. Officer Bowden joined Officer Darragh as his spotter. Officer Darragh covered the front door of the target residence. After some time the front door of the residence opened and a male [Edison Somera] wearing a black shirt, black pants, and holding a rifle exited the residence and let three juveniles exit the residence. After the kids ran away from the house, Somera went back into the residence. A short time later a male [Horwich] ran north up the street and yelled something about a home invasion. As Horwich made contact with other officers, Officer Darragh heard gunshots. Officer Darragh heard the rounds go over his head and heard them impact the pavement and a vehicle near him. Officer Darragh believed the rounds impacted about 12 feet away from him and believed he was being targeted by Somera and was in fear for his life. When the gunshots ended, Officers Darragh and Bowden moved to another position of cover. On two other occasions Officer Darragh heard gunshots, but was unable to determine from where the gunshots had come. Officer John Lopez On 12-13-2016, at approximately 2131 hours, Detective Colon conducted an audio recorded interview with Officer Lopez at LVMPD headquarters. Also present for the interview was LVPPA representative Officer Todd. Below is a summary of the interview; for complete details refer to the interview transcript. Officers Lopez and De Leon responded to Robindale Road and Decatur Boulevard to assist with a domestic disturbance. Upon arrival they heard Sergeant Sabino broadcast, “He’s got a 413!” Sergeant Sabino requested arriving units respond to Robindale Road and Coral Cactus Court. Officer Lopez was instructed to park his patrol vehicle along with another arriving unit at the corner of Robindale Road and Coral Cactus Court to help create cover for officers. Officer De Leon deployed his rifle and took a position behind a block wall on the northwest corner facing south. Officer De Leon requested Officer Lopez to be his spotter. As Officer Lopez peaked around the block wall, Somera fired multiple gunshots toward them. Officer Lopez quickly retreated behind the wall and fell backwards. Officer Lopez believed Somera was firing at him as well as the officers around him. Officer Lopez observed shell casings on the ground next to Officer De Leon and realized he had returned fire. Officer Lopez was unsure if it was before or after the gunshots, but a civilian ran toward the officers and informed them Somera had an AK-47. Officer Lopez escorted the civilian to a safer location. Officer Lopez remained on Tiger Palm Court and made contact with another officer. While there, Officer Lopez heard a second volley of gunshots, but was unable to see from where they had come. SWAT officers responded and took over his position. Officer Travon Chambers On 12-13-2016, at approximately 2151 hours, Detective Alsup conducted an audio recorded interview with Officer Chambers at LVMPD headquarters. Also present for the interview was LVPPA representative Officer Grammas. Below is a summary of the interview; for complete details refer to the interview transcript. Officer Chambers was riding with Officer Mullins when they heard a broadcast of a domestic disturbance involving a man armed with a firearm who had threatened a female and was still in the residence with children. Officers Chambers and Mullins responded to the area. Officers learned through previous events that several firearms were in the residence. Upon arrival Officer Chambers became part of the Immediate Action Team and was separated from Officer Mullins. Officer Chambers heard other officers yell something about a gun and observed children running down the street. A short time later another male ran down the street, and Officer Chambers heard gunshots he believed were coming from an AK-47. Officer Chambers stated the rounds were striking the ground approximately 15 to 20 feet from him. When the rounds impacted the ground and vehicles he was scared for his safety. Officer Chambers was later relieved by SWAT officers and returned to the command post. Officer Patrick Walters Oh 12-13-2016, at approximately 2156 hours, Detective Kenton conducted an audio recorded interview with Officer Walters at LVMPD headquarters. Below is a summary of the interview; for complete details refer to the interview transcript. Officer Walters was assigned to a domestic violence call at 7726 Coral Cactus Court. Per the details of the call, the subject [Edison Somera] had a firearm. Officer Walters drove Code 3 to Robindale Road and Coral Cactus Court. He parked his vehicle on the west side of the intersection and exited his vehicle. Officer Walters deployed his shotgun and took a position of cover against a wall on the west side of Coral Cactus Court and Robindale Road. Other officers joined Officer Walters. He gave his position away to Officer De Leon due to Officer De Leon having a rifle. A short time later Officer Walters observed Somera and three children exit the front door of the residence. The three children ran away from the residence. Officer Walters observed Somera was wearing a black shirt, blue jeans, and had a rifle in his right hand. He did not see Somera point the weapon. Somera then reentered the house. Officer Walters heard five to eight gunshots from a rifle and observed what he believed to be the bullets hit the ground approximately 10 feet from his location, in the direction of officers. He did not see who fired the shots. Officer Walters stayed in his position of cover. He witnessed Officer De Leon fire two rounds from his rifle. An unknown amount of time passed when a male in pajamas [Horwich] ran towards officers from the area of the residence. Horwich told officers Somera broke into his house. Officer Walters escorted Horwich to a safer area out of range of the shooting. Horwich told him that his roommate [Walker] was still inside the residence. During this time Officer Walters heard an unknown number of gunshots. He stated the gunshots sounded like they were fired inside a residence. He also believed that they were possibly from a different smaller caliber firearm. Officer Walters returned to the west side of Coral Cactus Court and maintained that position until he was relieved by SWAT officers. Officer Timothy McAteer On 12-13-2016, at approximately 2159 hours, Detective Colon conducted an audio recorded interview with Officer McAteer at LVMPD headquarters. Cactus Court. Officer McAteer posted on the west corner and Sergeant Sabino posted on the east corner. A teenaged boy holding a baby, along with a young girl, ran toward the officers. Officer McAteer assisted carrying the small child to safety. A few minutes later Officer McAteer heard multiple gunshots fired and believed they were directed at two officers who were posted behind vehicles parked at the corner of Robindale Road and Coral Cactus Court. Officer McAteer observed Officer De Leon, who had deployed with his rifle, return fire. A man [Horwich] ran towards officers yelling, “Help! Help! Home Invasion!” Officers escorted him to a safe location. Somera fired another volley of gunshots. SWAT officers responded and took control of the scene. Sergeant Craig Dunn On 12-13-2016, at approximately 2214 hours, Detective Jaeger conducted an audio recorded interview with Sergeant Dunn at LVMPD headquarters. Also present for the interview was LVPMSA representative Sergeant Wood. Below is a summary of the interview; for complete details refer to the interview transcript. On 12-13-2016 Sergeant Dunn was working in EAC. Sergeant Dunn was assigned to a traffic accident in the area of Fort Apache Road and Cactus Avenue when he heard a broadcast of a domestic violence call where the suspect [Edison Somera] was armed with a firearm. Sergeant Dunn assigned himself to the call and went en route Code 3. While en route the call was updated with Somera’s information and that he was armed with a gun. Sergeant Dunn arrived at the call with multiple other officers. Once Sergeant Dunn was on scene he observed Officer Kingsley make contact with Ganigan. Officer Kingsley talked to Ganigan and learned Somera was armed with a handgun. Somera had racked the handgun chambering a round, and pointed the gun at Ganigan and stated he was going to kill her. Ganigan also informed Officer Kingsley there were two other occupants still in the residence with Somera; Dustin Somera, and six-month-old baby Taylor Somera. Ganigan stated Somera had access to other firearms inside the residence. Based on this information the incident was deemed a hostage situation and officers were not going to approach the residence. A perimeter was established, and Sergeant Dunn was assigned as the incident commander and coordinated the outer perimeter of the incident. Moments later Dustin Somera ran out of the house carrying Taylor. Dustin informed officers Somera was inside the residence loading other firearms. Rounds were fired from the target residence towards the inner perimeter officers and officers returned fire. Sergeant Dunn coordinated a downed officer rescue team and other resources to contain Somera if he became mobile. Somera exited his residence and fired a second volley of rounds and entered a second residence.

SWAT was notified and arrived on scene, and Sergeant Dunn briefed the SWAT commander and negotiators. One of the hostages escaped from the house and informed Sergeant Dunn his roommate was being held hostage by an armed gunman. The SWAT commander took control of the scene and Sergeant Dunn was moved to the staging area. Sergeant Victor Sabino On 12-13-2016, at approximately 2242 hours, Detectives Colon and Alsup conducted an audio recorded interview with Sergeant Sabino at LVMPD headquarters. Also present for the interview was LVPMSA representative Sergeant Wood. Below is a summary of the interview; for complete details refer to the interview transcript. Sergeant Sabino was partnered with Officer McAteer when Dispatch broadcasted a domestic disturbance. The details were a male [Edison Somera] with a gun had threatened a female [Ganigan]. Ganigan escaped to a neighbor’s house where she called 911. Three children were still in the residence. Dispatch updated officers that Somera had access to other weapons including a shotgun and AK-47. Sergeant Sabino responded and made contact with Sergeant Dunn. Sergeant Sabino set up the inner perimeter and an Immediate Action Team behind a block wall on the west side of Robindale Road and Coral Cactus Court. Sergeant Sabino assigned Officers Darragh and Bowden to post behind two patrol sport utility vehicles parked at the intersection of Coral Cactus Court and Robindale Road. He assigned two officers to post one street to the west on Tiger Palm Court to obtain a visual of Somera’s front door. Sergeant Sabino posted on the west side of Robindale Road and Coral Cactus Court behind a block wall with Officers Chambers, Lopez, De Leon, Tighe, and Walters. Sergeant Sabino observed Ganigan’s children run towards officers. Sergeant Sabino heard officers yell, “413! 413! He has a long gun.” Officers escorted the children to a safe location. Sergeant Sabino requested SWAT respond and spoke with Lieutenant Melton, the SWAT commander, who advised they would respond. Officers yelled that a male wearing pajamas [Horwich] was running toward officers. Sergeant Sabino then heard multiple gunshots fired and moved to cover behind the block wall. Sergeant Sabino heard another round of gunfire and noticed Officer De Leon had returned fire. Officer De Leon advised Somera’s description as a light skinned male wearing a dark green shirt, short dark hair, and armed with a long gun. Sergeant Sabino briefly interviewed Horwich. Howich reported Somera was armed with a rifle and handgun and had kicked in the door to his residence. Horwich advised he was able to escape, but his roommate [Walker] was still in the house with Somera. Sergeant Sabino realized it had turned into a hostage situation and updated SWAT. SWAT responded and took control of the scene.

Investigation Follow-up On 12-14-2016, at approximately 1000 hours, Detectives Jex and Leavitt, and SCSA Jeff Smith returned to the OIS scene to obtain same time photographs of the scene and area. Perspective photographs were taken of Officer De Leon’s location to where he observed Somera, and from Somera to Officer De Leon’s location. The other officers’ locations and perspectives were also taken. Scott Shinotsuka On 12-16-2016, at approximately 0850 hours, Detectives Jex and Leavitt conducted an audio recorded interview with Scott Shinotsuka at the California Hotel and Casino. Below is a summary of the interview; for complete details refer to the interview transcript. Shinotsuka was Somera’s security supervisor at the California Hotel and Casino and Main Street Station Hotel and Casino and Brewery. Shinotsuka stated he was in the security dispatch area of the California and the dispatcher, Johna Byrd, received a phone call from Somera who had called in to report he was not going to be going in to work that day. Shinotsuka was in the next room, but in earshot of the conversation. Byrd got the attention of Shinotsuka and told him Somera was on the phone making his final call in to work. Shinotsuka asked for the call to be transferred to the phone at the desk where he was sitting. Shinotsuka talked to Somera and stated Somera seemed to be agitated and stated his family had betrayed him. Shinotsuka believed Somera was possibly suicidal and tried to calm Somera. Somera told him he had already shot at police officers and there was no way out of the situation. Somera stated he was not going to spend the rest of his life in prison, and that it was all over now, he had a hostage. Shinotsuka asked Somera if he could talk to the hostage. Somera put Walker on the phone and he and Shinotsuka had a brief conversation. Walker told Shinotsuka he was Somera’s next door neighbor and Somera had come into his house. Somera then took the phone from Walker and continued talking with Shinotsuka. Shinotsuka told Somera with the right lawyer he could get the help that he needed. Somera asked how long Shinotsuka thought he would have to be in prison. Again, Shinotsuka told Somera he would need the right lawyer. Shinotsuka stated the phone then disconnected. Crisis Negotiation Team Intelligence Report On 12-13-2016 LVMPD crisis negotiators were dispatched to the incident and conducted operations to make contact with Somera, his friend, and relatives. This was done to assist in communicating with Somera and eventually convince Somera to surrender peacefully. For full details of the crisis negotiators’ involvement, refer to the report.

XII. TIMELINE The below timeline is a reconstruction of events which transpired on Tuesday, 12-13-2016, in relation to the non-fatal officer-involved shooting that occurred at 7726 Coral Cactus Court.

On 03-02-2017 Forensic Scientist Kathy M. Geil, P# 15650, submitted the Firearms & Toolmarks Report with the following results: Results and Conclusions:

Firearms and Magazines The Rock River Arms rifle was examined, test fired and found to be operational with no noted malfunctions. The rifle has a barrel length of approximately 17 7/16 inches, an overall length with the stock fully collapsed of approximately 32 1/2 inches, an overall length with the stock fully extended of approximately 36 1/4 inches and a trigger pull of 3 3/4 – 4 pounds. The submitted magazine (Lab Item 2) has a capacity of thirty-one cartridges.

The Romarm rifle was examined, test fired and found to be operational with no noted malfunctions. The rifle has a barrel length of approximately 17 1/8 inches, an overall length of approximately 35 3/16 inches, and a trigger pull of 3 1/4 – 3 1/2 pounds. The submitted magazine (Lab Item 23) has a capacity of thirty-one cartridges.

The Ruger pistol was examined, test fired and found to be operational with no noted malfunctions. The pistol has a barrel length of approximately 3 1/2 inches, an overall length of approximately 6 15/16 inches, and a trigger pull of 6 – 6 1/4 pounds. The submitted magazine (Lab Item 27) has a capacity of ten cartridges. The Glock pistol was examined, test fired and found to be operational with no noted malfunctions. The pistol has a barrel length of approximately 3 13/16 inches, an overall length of approximately 7 inches, and a trigger pull of 6 – 6 1/4 pounds. The submitted magazine (Lab Item 61) has a capacity of ten cartridges.

Comparisons

Bullets and bullet jacket fragments The submitted bullets and bullet jacket fragments were examined and microscopically compared to the test fired bullets from the submitted firearms.

The four bullets (Lab Items 31-34) were identified as having been fired by the Ruger pistol.

The two bullets (Lab Items 35 and 43) and one bullet jacket fragment (Lab Item 56) were identified as having been fired by Romarm rifle.

The three bullet jacket fragments (Lab Items 41, 44 and 55) had similar general rifling characteristics as the Romarm rifle; however, due to damage and lack of microscopic detail, a conclusive identification to or elimination to the Romarm rifle could not be determined. The three bullet jacket fragments were eliminated as having been fired by the other submitted firearms.

The remaining bullet, bullet jacket fragments and the metal fragments are of no value for comparisons

Cartridge cases The evidence cartridges cases (Lab items 16, 20 and a cartridge case from Lab item 24) were microscopically compared to the test fired cartridge cases from the submitted firearms.

The cartridge case (Lab Item 16) was identified as having been fired by Romarm rifle. The cartridge case (Lab Item 20) was identified as having been fired by Rock River

Arms rifle. A cartridge case from Lab Item 24 was identified as having been fired by the Ruger

pistol. The remaining evidence cartridge cases were examined in conjunction with the test fired items from the submitted evidence firearms. Based on these examinations, the following associations were made:

Seventeen cartridge cases (Lab Items 3-15 and 57-60) are associated with the submitted Romarm rifle.

The seven remaining cartridge cases from Lab Item 24 are associated with the submitted Ruger pistol.

These associations are not conclusive identifications and are based on general characteristics with the consideration of only the firearms submitted under this event number.
