    LETTER TO ALL ST. ANDREWS RESIDENTSFROM THE ST. ANDREWS STRATA COUNCILLANDSCAPING - JULY 2013We receive many letters from owners relating to the Landscaping of the Common StrataProperty surrounding their units. We want to take this opportunity to clarify the Strata'sresponsibility surrounding these issues.The Strata Corporation is responsible for maintaining and/or modifying the landscapingsubjectto the budgetary restraints as approved at the Annual General Meeting. TheStrata Council does not have authority to incur additional costs for modifications to thecommon property. No requests from owners that require the Strata Corporation toincur costs in excess of the budget will be approved.We recognize that individual owners may still wish to improve the common propertysurrounding or adjacent to their units. St. Andrews Strata Council has made a decision to allow motivated owners to alter the common area landscaping under certain strictcriteria, as follows:For Hard Landscaping (e.g. river rock beds, hedges)1. The owner must sign and date an Assumption of Liability Agreement which willbe provided by Council. This Agreement stipulates that:1. the owner is responsible for all costs of labour and materials,2. all alterations must be pre-approved by council,3. the responsibility for altered areas will survive the sale or assignation of thestrata lot, and4. any resultant structural damage to the buildings, sprinkler system, orsurrounding landscaping will be the responsibility of the signing owner(s).2. The owner understands and agrees that they will not be reimbursed any fundsshould the Strata undertake similar improvements in any future year.3. The contractor will be chosen by the owner.4. The contractor will provide evidence to the Strata Council of Liability Insuranceand WCB coverage.5. The owner and/or contractor will draft a Design Application to be submitted to

    Strata Council for approval.6. No work will be contracted or implemented until such approval has beenreceived, in writing.This agreement and procedure is necessary to ensure that certain standards ofuniformity and quality of work/materials are met. It is also necessary to absolve otherowners of legal and financial liability should damage to the common area result.For Soft Landscaping (eg. flower beds)1) The owner will draft a Design Application to be submitted to Strata Council forapproval. A list of acceptable plants has been provided on the bottom of theapplication form.2) No work will be implemented until approval has been received, in writing.3) The owner agrees:

    a. not to alter the size and/or shape of the existing flower beds, andb. to be responsible for the weeding of the self-planted bedIts important for owners to reali ze that all of the common area is owned by all of theowners, even if it is adjacent to someone elses patio. As such, any owner who undertakes to change the common area does so for the benefit of the entire complex.Council strongly feels that its import ant that no individual should take it upon him/herselfto alter property that belongs to everybody without following a protocol which attempts toensure that the outcome is equitable, consistent with a defined esthetic, andimplemented to a high standard.

    Should you wish to replace a grassy area with river rock, install a hedge, or plant aflower bed at your own expense and in acceptance of these guidelines.
