YEAR IN REVIEW
The year in review can be best characterized by numbers. Between July 2018 to July 2019, the Land Department diligently carried the Park District’s mission and vision through:
Acquisition of 469 acres of new parkland and trail easements to preserve open space and secure the property rights needed to improve public recreational access.
Protection of an additional 272 acres of private open space in perpetuity through the acquisition of a conservation easement.
Public investment of approximately $10.9 million to protect and complete these threatened landscapes, including $1.5 million from outside funding sources.
Expanding our Regional Park System and Keeping our Measure WW Promises The Park District’s land acquisition successes this past year have included projects that were the culmination of years of advance work, as well as new opportunities that needed to be quickly seized upon as market demand and competition from other buyers continues to trend upward. Collectively, these projects accomplished a range of land conservation and public access objectives including acquiring private inholdings inside our parks to protect natural resources and improve the integrity of park boundaries, acquiring land and trail easements to improve recreational access to our shoreline and interior parks, and acquiring and protecting more of the open space landscapes that define the East Bay region’s natural beauty. Noteworthy acquisitions that have been completed since last year’s Land Session include the following:

Anthony Chabot/Redwood Regional Parks – The Park District acquired the Albanese and Gruenfeldt properties located along Redwood Road, the last remaining private residences within Redwood Canyon through which flows Redwood Creek, where the rainbow trout species was first classified based on fish taken from this stream system. The early 20th century cabins with their outdated septic systems that once dotted the canyon posed a threat to the long-term health of the creek system. With these two acquisitions, the Park District has removed that threat and fulfilled the promise under Measure WW to “acquire and restore Redwood Creek to protect rare native trout habitat
Deer Valley Regional Park – The Park District acquired the 72-acre Lucas property, and is in escrow to close later this month on the adjacent 120-acre Olesen-Duke property in partnership with the East Contra Costa County Habitat Conservancy. These lands have important habitat values, and their acquisition by the Park District will help prevent further fragmentation of upper Briones Valley and the surrounding ridgelines into rural ranchettes.
Doolan Canyon Regional Preserve – The Park District acquired the 160-acre Grove property, protecting the upper reaches of the Preserve’s namesake Doolan Canyon, including the headwaters of Cottonwood Creek that feeds the large reservoir that is a distinctive feature of the Preserve.
Las Trampas Regional Wilderness – The developer of the Red Hawk residential project, Ponderosa Homes, transfered through dedication 96 acres of open space to the Park District to provide a trail connection to Calaveras Ridge Trail.
Round Valley Regional Preserve – The Park District acquired the 9.24-acre Purviance
property, the final piece in a series of land purchases from the Murphy and Purviance families beginning in 1988 that assembled the Preserve as it exists today. Acquisition of the property removed a private inholding sandwiched between Round Valley and Marsh Creek State Historic Park, protects ¼ mile of the Marsh Creek riparian corridor. The homesteading and agricultural history of the property, along with its proximity to the Round Valley staging and picnic area, holds the potential to develop interpretive features and programming at the site.
Round Valley Regional Preserve – The Park District acquired a conservation easement protecting the 272-acre Nunn Marsh Creek property. Located along the northern flank of the Preserve within the scenic Canada del los Poblanos valley, the property contains an expanse of blue oak woodland and over one mile of the Marsh Creek corridor. The conservation easement was dedicated at no cost to the District as mitigation for a recently approved residential development project in the Sand Creek area of Antioch. The easement will ensure that this open space landscape is preserved in perpetuity, while the Park District will also have a land management role that will be funded through an endowment put up by the developer. This is the Park District’s first conservation easement project since

successfully obtaining reaccredidation from state regulatory authorities as an organization qualified to accept and manage conservation easements.
Supporting Capital Projects and Trails Development As part of its core function of acquiring land, easements, and other types of real property rights in fulfillment of the Park District’s mission and vision, the Land Acquisition Department provides support to the Park District’s robust Capital Projects Program that builds new trails, restores habitat, constructs new staging areas and visitor centers, and installs and upgrades infrastructure throughout the regional park system. In coordination with other departments and units within the Acquisition, Stewardship and Development Division, the Operations Division, and the Legal Department, the Land Acquisition Department pursues land rights needed to move forward with park and trail development projects. Key acquisitions in support of capital projects over the past 12 months include the following:
At Bay Point Regional Shoreline, the Park District acquired a recreational trail and shoreline access easement from neighboring McAvoy Yacht Harbor to enable the construction of a new trail from the park’s staging area out to and along an open water slough as part of the Park District’s shoreline restoration and public access project that will soon break ground. The easement will also allow the Park District to construct and operate a kayak launch at the edge of the slough that will serve as a new trailhead along the San Francisco Bay Area Water Trail.
At McLaughlin Eastshore State Park, a nine-year litigation involving the Park District’s eminent domain action to acquire 2.88 acres of the Golden Gate Fields property for the Albany Beach Restoration and Public Access Project concluded this past May with a court judgment setting the compensation to be paid to the property owners. The Albany Beach project is currently under construction and is anticipated to be completed this year.
At Point Pinole Regional Shoreline, the Park District accepted a trail easement for
a ½ mile newly constructed segment of the San Francisco Bay Trail from the developer of the former Steelcase factory property, extending the Bay Trail north from the park’s new Atlas Road Bridge entrance. The construction and grant of easement to this new Bay Trail segment has its origin in a 1996 purchase agreement between the Park District and the previous owner of lands purchased by the Park District as an addition to Point Pinole Regional Shoreline as well as the land where the business center was developed. This segment of new Bay Trail will remain closed to the public until an additional ½ mile segment is constructed and trail easement granted to the Park District as discussed below under Current Land Acquisition Pipeline.
At the Point San Pablo peninsula, an eminent domain action brought by the Park District to acquire a trail easement through the Point Castro area has tentatively been settled with the property owner. The acquisition of this easement will close

the remaining gap in right of way needed to begin construction on a 2.5-mile extension of the San Francisco Bay Trail from the Richmond-San Rafael Bridge toll plaza north to the City of Richmond’s Point Molate Beach Park.
Leveraging with Outside Grant Funding The Park District’s land acquisition program continues to take advantage of opportunities to leverage our bond-funded acquisition dollars with outside grant funding. In the past year the Park District was awarded over $1.5 million in grant funding in support of two land acquisition projects at Deer Valley Regional Park (Lucas and Olesen/Duke properties). Key funding partners that have contributed greatly to the Park District’s land conservation efforts in recent years and are expected to continue to play a vital role in leveraging this efforts include the East Contra Costa County Habitat Conservancy, the California Coastal Conservancy, the Wildlife Conservation Board, California State Parks, and the Moore Foundation. Peralta Oaks North Acquisition
A major milestone in the growth of the Park District’s capacity to deliver its mission was the purchase earlier this year of a 67,500 square-foot administrative building at 2955 Peralta Oaks Court (“Peralta Oaks North”), just across the street from the Park District’s current administrative headquarters. Funded from promissory notes issued in 2012, the purchase capped a decade long search for a suitable property to accommodate the Park District’s expanding workforce, in particular to serve as a new Public Safety Division headquarters to replace the existing facility at Lake Chabot which does not meet California’s current structural safety requirements for essential services facilities and lacks the space requirements to meet the operational needs of the Park District’s police, fire and lifeguard personnel. Once necessary improvements are completed to have the building ready for occupancy, the new location will accommodate up to 220 employees, including approximately 150 public safety personnel and the public safety vehicle fleet. The purchase of this property last March capped a nine-month intensive negotiation and due diligence period involving Land Acquisition, Design and Construction, Planning and GIS, Finance and Management Services, the Public Safety Division, and the General Manager’s Office, with close engagement and oversight from the Park District Board of Directors. CURRENT LAND ACQUISITION PIPELINE The Land Acquisition Department currently has approximately 90 active projects involving 41 parks and regional trail corridors across all three Metro Sectors within the Park District’s service area. These include projects where staff is tracking emerging opportunities, engaged in negotiations with private and public landowners, or conducting due diligence on proposed land transactions. In coordination with the Park District’s Planning/GIS Department, this also includes open space dedications by private developers,

and the transfer of former military base properties through Public Benefit Conveyance. This portfolio also includes projects involving land and trail easement acquisitions through eminent domain (condemnation) actions or other litigation in coordination with our Legal Department. Negotiations are currently underway on several land and trail acquisition opportunities. Staff will review these opportunities with the Board of Directors during its Closed Session portion of today’s Board Workshop. Key land and land rights acquisitions that are anticipated to occur in 2019-2020 include the following (subject to final Board authorization as required):
Public Benefit Conveyance (PBC) of Concord Naval Weapons Station (CNWS) Land at
Concord Hills Regional Park – Initially proposed in 2000 following the deactivation of the inland area of the CNWS, the transfer of approximately 2,216 acres to the Park District is on track to occur later this year as the first phase of a PBC from the Navy through the National Park Service (NPS), the sponsor for this conveyance. The Park District Board of Directors will consider approval of the proposed transfer at its regularly scheduled meeting on July 2nd. The Park District will initially take “constructive possession” of the property from NPS, allowing us to commence land management activities in advance of the transfer of ownership to the Park District later this year.
Ground Lease from Caltrans at Judge John Sutter Regional Shoreline – The Park District is currently negotiating terms for obtaining a ground lease from Caltrans for a 10 to 15-acre area along the southern edge of the Bay Bridge touchdown that will encompass the footprint of the first phase of this new shoreline park, anticipated to open to the public early next year, including a portion of the “Key Point” area and the nearly complete observation pier constructed by Caltrans, as well as the new parking lot for the Bay Bridge Trail currently under construction and the Bridge Yard complex already leased by the Park District.
Public Benefit Conveyance (PBC) of Oakland Army Base Parcel at Judge John Sutter
Regional Shoreline – The Park District will receive approximately 17 acres of shoreline and submerged lands through a PBC of “BRAC Parcel 1” from the Army. The Army and State regulatory agencies continue discussions on remediation requirements which need to be resolved before transfer of the property to the Park District can occur.
Open Space Dedication at Sibley Volcanic Regional Preserve – Approximately 400 acres of open space will be dedicated to the Park District by the developer of the Orinda Gateway residential project. The developer is also constructing a staging area that the Park District will operate to open public access into the expanded regional preserve from the north.
Open Space Dedication at Las Trampas Regional Wilderness – Pursuant to a
settlement agreement between the Park District and the developer of the “Faria

Reserve” residential project, the developer will transfer 144 acres of open space to the Park District, establish a Community Facilities District to help fund the ongoing operation and management of the land, and construct a new staging area to provide public recreational access into the southern area of Las Trampas Regional Wilderness. The Park District is currently preparing the Southern Las Trampas Land Use Plan Amendment that proposes development of the staging area on the former Chen property to the north of the Faria Preserve project. Once the proposed staging area has been permitted for this site, the developer will be responsible for construction. Transfer of the open space property will occur once all required easements and habitat enhancement projects on the property are complete.
Dumbarton Quarry Reclamation Project at Coyote Hills Regional Park – Transfer of the
first parcel of land to the Park District will coincide with the owner’s completion of the first phase of site reclamation and construction of park improvements, currently anticipated to occur in 2020. As part of the process for readying the new campground to open to the public, the Park District is working with Caltrans to obtain the land rights needed to construct the campground entrance within the Dumbarton Toll Plaza right of way.
Acceptance of an Additional ½ Mile Segment of New Bay Trail at Point Pinole Regional
Shoreline – An additional approximately ½ mile segment of new Bay Trail is being built as part of a new warehouse facility currently under construction within the Pinole Point Business Center. This new trail segment will connect to the ½ mile of new Bay Trail accepted by the Park District earlier this year. Both these trail dedications have their origin in a 1996 purchase agreement between the Park District and the previous owner of lands purchased by the Park District as an addition to Point Pinole Regional Shoreline as well as the land where the business center was developed. In addition to the grant of a trail easement for the new Bay Trail segment, the developer will also transfer an approximately 15-acre wetland parcel to the Park District pursuant to the terms of the 1996 purchase agreement. The warehouse project and new trail construction is anticipated to be completed later this year, at which time acceptance of the trail easement and land will be brought to the Park District Board for consideration, including a determination of the suitability of opening the entire one-mile segment of new Bay Trail to the public.
LOOKING FORWARD
Reaffirming Programmatic Objectives
Looking ahead over the next year and beyond, staff recommends that the Park District’s land acquisition efforts continue to focus on three key programmatic objectives:
1. Enhancing public recreational access to our regional parks;

2. Expanding and consolidating the boundaries of our existing parks to preserve the unique landscapes in which they are located; and
3. Completing critical trail linkages throughout our regional trail system. Staff will also continue to pursue opportunities to acquire additional tracts of land in priority areas identified in the Master Plan and by the Park District Board of Directors. Guiding these efforts is the overarching goal of protecting open spaces and providing greater recreational access to our parklands and regional trails for all communities served by the Park District. Staying Responsive to Market Conditions
With the end of the recession and subsequent economic recovery, the Park District continues to experience increasing competition from other market participants. Smaller properties of interest to the Park District that may have a residence or a buildable site for a residence are receiving much greater interest in the homebuyer market than in years past. And as large-scale housing project proposals continue to emerge, particularly in East County communities, the demand for mitigation lands for these projects may compete with the Park District’s parkland acquisition objectives on specific larger acreage properties. The flip side of the strengthening economy and the uptick in development activity, however, are the increased opportunities to work with developers and public agencies to condition development approvals with the provision of open space dedications, trail linkages and staging areas that enhance park access for the surrounding communities. Land Acquisition staff will continue to work closely with the Park District’s Planning/GIS Department to achieve these objectives. Maintaining Balanced Parkland Distribution The Park District’s Land Acquisition Program strives to acquire properties and other real estate rights throughout the Park District and in every parkland unit in keeping with the Master Plan’s goal of providing a balanced system of regional parks, trails and services for all park users. Acquiring parks, open space and trail connections along our urban shorelines and within highly developed population centers, however, will continue to be among our most challenging goals. Properties and easements within these areas are particularly difficult to acquire because of the relative scarcity of supply, high level of demand, and complicated land use patterns. Nonetheless, staff is committed to focusing on key projects with realistic prospects within each of the Park District’s three Metro Sectors; keeping in mind each sector’s unique opportunities and constraints, and understanding that balanced parkland distribution is a goal to be achieved over time. Leveraging Park District Acquisition Funds A guiding strategy of the Park District’s Land Acquisition Program is to continue judiciously delivering on our commitments to the voters through acquisitions utilizing

Measure AA and Measure WW funds in accordance with the Master Plan and the Board of Directors’ priorities, while leveraging these funds wherever and whenever possible with outside funding sources. In fact, since the passage of Measure WW in 2008, the Park District has acquired over 23,500 acres of land and trail easements costing more than $147 million, of which almost $85 million or 57% was provided by third party sources.
Habitat Conservancy Partnership – A key partner in the Park District’s land acquisition program over the past eleven years is the East Contra Costa County Habitat Conservancy (Conservancy). Since 2007 with the adoption of the East Contra Costa County Habitat Conservation Plan and Natural Community Conservation Plan (HCP/NCCP), approximately 55% of the total acres acquired and conserved by the Park District were in partnership with Conservancy, which has provided over $61 million in federal and state grant funding to cover 76% of the purchase cost of those lands. Looking at the immediate future, the Conservancy currently has $2 million remaining in federal funding appropriations for land acquisition. Congress has appropriated additional federal funding for HCP land acquisition in its 2019 budget that will be awarded on a competitive basis. The Conservancy’s 2019 application for funding is currently under review by the wildlife agencies, with the timing and amount of any award uncertain.
Proposition 68 State Park Bond – A $4.1 billion State Parks bond approved by California voters in June of last year greatly enhances the Park District’s ability to leverage its land acquisition dollars to expand and improve access to parks and open space throughout its service area, but in particular within “park-poor” and disadvantaged communities. Proposition 68 also includes funding specific to NCCP’s such as the East Contra Costa County NCCP/HCP that will be awarded on a competitive basis.
San Francisco Bay Restoration Authority – Measure AA, the “Clean Healthy Bay” measure approved by voters in June 2016, is a parcel tax of $12 per year that will raise approximately $25 million annually for twenty years to fund shoreline projects to protect and restore San Francisco Bay; land acquisition projects are eligible to receive funding. Proposition 68 provides an additional $20 million for restoration grants to augment this program.
Measure FF – East Bay voters overwhelming approved Measure FF last November, extending the parcel tax created under Measure CC that was passed by voters in 2004. Measure FF includes funding for land and trail easement acquisitions to expand our regional trail network and provide urban access to parks and shorelines, including closing gaps in the Bay Trail.
Strategic Use of Measure WW Acquisition Fund Balances The Park District’s success in recent years in assembling large tracts of land to significantly expand several parks has had the corollary effect of depleting the Measure WW acquisition funds allocated to these parks, yet much work remains to be done to complete

the footprint of these parks, including: Black Diamond Mines and Clayton Ranch Regional Preserves, Byron Vernal Pools Regional Preserve, Deer Valley Regional Park, Las Trampas Wilderness Regional Preserve, Pleasanton Ridge Regional Park, Point Pinole Regional Shoreline and Wildcat Canyon Regional Park. Going forward, funds from the General Fund, other Measure AA and WW park allocation areas, WW earned interest, or other sources may need to be utilized to complete critical acquisitions within these parks. LAND ACQUISITION AT THE PARK DISTRICT The business of acquiring land and land rights to conserve open space and expand public recreational opportunities throughout the Park District’s diverse system of regional parklands and trails is accomplished through the collaboration and contributions of staff across the agency. Three departments in particular are instrumental in leveraging the efforts of the Land Acquisition Department:
Planning/GIS Department – Through its SAGE (“Strategic Actions of Governmental Entities”) Program, the Planning/GIS Department monitors and analyzes the activities of other government agencies and organizations in the East Bay and helps determine the appropriate response or engagement in order to achieve the land acquisition, planning, development and resource conservation goals set forth in the Park District’s Master Plan. This program has been tremendously effective in early identification of potential impacts to our regional park system from proposed urban development projects, and in creating opportunities to engage with developers and local jurisdictions to obtain dedications of open space, trail easements, conservation easements, buffers, and other property rights, monetary endowments to help cover the costs to maintain dedicated lands, and even the provision of new staging areas or trailhead improvements as part of the development project.
Grants Department – The Park District leverages its own bonds or other revenue
sources by obtaining grants and other funding from a variety of federal, state, local and private sources. The General Manager’s Office, Legislative Affairs staff and the Grants Department has been successful in promoting, influencing and securing grant funds for the Park District. Obtaining grants for projects can be competitive, with specified uses, deadlines and matching fund requirements. The Grants Department continues to be very active in applying for, securing, and managing grant contracts that provide funding for a wide range of Park District projects including land acquisitions. Since 2000, the Grants Department has succeeded in securing 55 grants from 16 distinct funding programs totaling $32,176,444 in support of land acquisition projects across our regional park system.
Legal Department – The Park District’s Legal Department is a “full service” legal team that works closely with land acquisition staff in negotiating the terms of real estate agreements and assisting in the preparation of all manner of real property instruments and transactional documents. The Legal Department helps to

interpret and defend property rights held by the Park District, and plays a crucial role in resolving encroachment and other property rights disputes. The Legal Department initiates litigation authorized by the Board of Directors to protect the integrity of our regional park system, and coordinates the condemnation process in those instances where the Park District must exercise its power of eminent domain to acquire a property or property right that is critical to the Park District’s mission.

Balanced Parkland Distribution: Funding Utilization 1989 to 2018
The Park District will continue to acquire, develop, and operate parkland and facilities and provide programs and services with the primary goal of achieving a long-term geographic balance in
investment throughout the park system. The Park District will continue to allocate resources based on the populations projected for the West, South, and Diablo Metro sectors. The Park District also
endeavors to take advantage of opportunities that can help to supplement or otherwise make the most of residents’ tax dollars. For example, as seen in the funding chart above, outside funding sources have been used to leverage Park District land acquisition funding in each sector over the years.

right of way conveyances nor do they incorporate capital improvement project dollars within each metro.)

PARK AND TRAIL ACQUISITION CRITERIA FROM THE 2013 MASTER PLAN
The Park District acquires land or the right to operate land through purchases, gifts, bequests, or dedication (as part of a land development or subdivision approval). It acquires rights to use land owned by others through easements, license agreements, operating agreements, special permits, or any other mutually agreed upon arrangement that permits the District to carry out its policies and programs in keeping with the Master Plan. In deciding whether to acquire land for parklands or trails, the District must consider whether a specific acquisition is consistent with the District’s plans and policies, as set forth in the Master Plan and if so, whether the timing, price and conditions of the acquisition are acceptable. The factors to be considered can vary widely, depending on the size and location of the property, the rights acquired, owner’s requirements or interests and funding sources. The District seeks to acquire parklands and trails so that, over time, it maintains an equitable distribution of facilities and programs throughout the District. Each park or trail is generally composed of several acquisitions made over the years. Various parcels may have different attributes that work together for optimum public use. Potential acquisitions are considered with respect to the features they contribute, which may include natural resources, opportunities for recreation or for enjoying open space, historic or cultural resources, interpretive and educational opportunities, scenic value, access and transportation, or, in the case of trails, a needed link in the regional system. Many acquisitions offer several of these features. Some acquisitions are made because they serve important operational or land management needs. For example, an acquisition may provide a logical, more manageable park boundary, protect trail or wildlife corridors, link properties, or eliminate an operational problem such as poor access, thus reducing costs. It may provide a buffer to protect important resources or prevent visual intrusion on parklands and open space. In some cases, also, an acquisition may be important as part of a coordinated program with another agency. The District usually acquires property that is contiguous to existing holdings, but it may acquire non-contiguous lands if doing so is consistent with implementation of the Existing and Potential Regional Parks and Trails Map. The timing of an acquisition may be affected by such considerations as the availability of funding, especially from grants or outside sources, needs or desires of the seller, coordination with other agencies, the need to prevent the loss of an important site to development, or the opportunity to take advantage of favorable real estate market conditions.
MASTER PLAN POLICY ACQ1: The District will acquire property in
accordance with the Master Plan, giving careful consideration to
operating and program needs, the District’s financial position, timing
factors that affect the sale of the property and opportunities provided
under Measure WW and any subsequent funding measures.

GLOSSARY OF REAL ESTATE TERMS
Fee simple
Absolute ownership, unencumbered by any other interest or estate; the highest real estate ownership interest.
Dedication The offering by the owner and acceptance by a public agency of real property for public use, in accordance with statute or common law. No compensation is paid.
Easement A nonpossessory interest held by one person in the property of another where the first person is accorded partial use of the property for a specific purpose. An easement restricts but does not nullify the fee owner’s rights to use and enjoy the property.
Conservation
Easement
A restriction that limits future property use to conservation or preservation.

Scenic Easement An easement for protection and/or development of views and natural features.
Right of Way The right to pass across the lands of another, or an interest in land or property for transportation purposes (e.g., roads, public transport, utilities, etc.)
Access Rights The right of ingress to and egress from one's property to a public road. The right may be actual or implied. Access is a private right as distinguishable from the public’s rights.
Encroachment
An improvement (e.g., structure, sign, wall, or fence) that illegally intrudes on another’s property.
Grant Deed A written document by which the ownership interests in real property are transferred from one party to another.
Quitclaim Deed
A deed conveying, without warranty, any right, title, or interest the grantor may have in the property conveyed.
Final Order of Condemnation
The closing order of a court in a condemnation action. Made after the requirements of the final judgment have been satisfied. It passes property title to the condemnor.
Escrow
A procedure whereby a neutral third party controls the legal documents and funds on behalf of a seller and buyer.
Title Report A report showing the condition of title on a property (liens, easements, deeds of trust, etc.) before a sale.
Public Benefit
Conveyance
Acquisition by state or local public agencies or communities of former military bases under Base Realignment and Closure Acts (BRAC) for the purpose of parks, recreation and protection of resources.
