    Labour law also known as employment law is the body of laws, administrative

    rulings, and precedents which address the legal rights of, and restrictions on,

    working people and their organi%ations. &s such, it mediates many aspects of the

    relationship between trade unions, employers and employees. In other words,

    Labour law defines the rights and obligations as workers, union members and

    employers in the workplace. 'enerally, labour law covers(

    • Industrial relations ) certification of unions, labour*management relations,

    collective bargaining and unfair labour practices+• orkplace health and safety+

    -mployment standards, including general holidays, annual leave, working hours,

    unfair dismissals, minimum wage, layoff procedures and severance pay. There are

    two broad categories of labour law. irst, collective labour law relates to the

    tripartite relationship between employee, employer and union. /econd, individual

    labour law concerns employees0 rights at work and through the contract for work.

    The labour movement has been instrumental in the enacting of laws protectinglabour rights in the 12th and 34th centuries. Labour rights have been integral to the

    social and economic development since the industrial revolution.

    $onstitutional provisions with regard to labour laws

    The relevance of the dignity of human labour and the need for protecting and

    safeguarding the interest of labour as human beings has been enshrined in $hapter*

    III 5&rticles 16, 12, 37 8 39: and ; $hapter I< 5&rticles 72, 91, 93, 97, 97& 8 =9:of the $onstitution of India keeping in line with

    undamental ights and "irective >rinciples of /tate >olicy. Labour is a concurrent

    subject in the $onstitution of India implying that both the #nion and the state

    governments are competent to legislate on labour matters and administer the same.

    The bulk of important legislative acts have been enacted by the >arliament.

    Labour policy in India has been evolving in response to specific needs of the

    situation to suit re?uirements of planned economic development and social justice

    and has two fold objectives, namely maintaining industrial peace and promoting the

    welfare of labour.

    The Binistry of Labour and -mployment, a branch of the 'overnment of India, is

    the apeD body for formulation and administration of the rules and regulations and

    laws relating to labour and employment in India. The Binistry of Labour and

    -mployment works out of /hram /hakti Ahavan, afi Barg, New "elhi The main

    objectives of the Binistry of Labour and -mployment are the following( Labour

    The results of recession on employment in the eight selected sectors teDtiles

    including apparels, leather, metals, automobiles, gems 8 jewellery, transport,

    The overall employment in the eight selected sectors covered in the ?uarterly

    surveys has increased by 14.66 lakh 54.16H:. In ITGA>! sector the increase in the

    employment is maDimum 56.2 lakh: during the year 3442*14.

    ii. Labour Enforcement "fficer )Central*   The Labour -nforcement officer 5$:have been declared inspectors under all the above enactments in the industries G

    establishments in the $entral /phere. &ll officers having independent offices are

    also $onciliation officers under section 9 of Industrial "isputes &ct, 129;. They

    have also been declared supervisors of the railways employees, as per the

     provisions of the Indian ailways &ct.

    iii. -oint Chief Labour Commissioner)C*+ The Et. $L$5$: handles important

    Industrial "isputes of all India nature. @e is also appellate authority under Industrial

    -mployment 5/tanding !rders: &ct.

    iv. #eputy Chief Labour Commissioner)C* + The "y. $L$s5$:, besides,coordinating, monitoring and supervising the activities of the regional offices, also

    handle important Industrial "isputes referred to or apprehended in the %one

    effectively. "y. $L$5$:s as appellate authority under I-5/!s: &ct, dispose of

    appeals arising out of certification of standing orders by L$5$:s. The "y.$L$s5$:

    are authority for deciding cases of same or similar nature of work and condition of

    wages of contract labour under ule 3= 53:5v:5a: and 3=53: 5v: 5b: of $L58&:

    5$entral: ules respectively.

    v. egional Labour $ommissioner * L$5$:s are the &uthority under Binimum

    ages &ct. They decide cases of payment of wages less than minimum rate of

    wages fiDed, filed before them, as provided under sec. 34 of the Binimum ages

    &ct. They are certifying officers, under Industrial -mployment /tanding !rders &ct

    for certification of the "raft /tanding !rders, submitted under the &ct. They are the

    appellate authority under >ayment of 'ratuity &ct, 12;3 and -?ual remuneration

    &ct, 12;6. They have also been declared inspectors under all the enactments

    enumerated in column 59:, above, eDcept -?ual remuneration &ct and >ayment of

    'ratuity &ct. The L$s5$: being the head of the region is not only in charge of

    day*to*day administration but also has to discharge many statutory duties relating to

    enforcement and industrial relations, including those of $onciliation !fficer under

    the Industrial "isputes &ct.

    . Labour Courts / Industrial 0ribunals

    Bost of the labour disputes are referred to the Labour $ourtsGIndustrial Tribunals

    through the "epartment of Labour under the respective /tate 'overnment. The

     process for labour dispute starts with filing of a petition before Labour $onciliation

    !fficer and in case no compromise is possible, the said officer sends a failure report

    to the 'overnment. &fter consideration of the said report, the 'overnment may

    send a reference to the Labour $ourtGIndustrial Tribunal. In certain matters, the

    labour dispute can be directly filed in the court concerned. Labour $ourts These

    courts are found in every district and they form the courts of original jurisdiction

    under which various labour laws and rules are enforced. &ppellate Labour $ourts

    These courts hear only the &ppeals and revisions originating from the judgements

    and orders of the subordinate original labour courts and officers, under the

     provisions of various labour and related laws.

    a: hen an industrial dispute has been referred to a Labour $ourt for adjudication,

    it is the duty of the Labour $ourt to

    5i: @old proceedings eDpeditiously, and

    5ii: To submit its award to the appropriate 'overnment soon after the conclusion of

    the proceedings.

     b: @owever, no deadline has been laid down with respect to the time within which

    the completion of proceedings has to be done. Nonetheless, it is eDpected that these$ourts hold their proceedings without getting into the technicalities of a $ivil

    $ourt.

    c: It has been held that the provisions of &rticle 17; of the Limitation &ct do not

    apply to reference of disputes to the Labour $ourts. These $ourts can change the

    relief granted by refusing payment of back wages or directing payment of past

    wages too. $ourt ee No $ourt fee is payable on the petitions filed before Labour

    $ourts and Industrial Tribunals.

    Matters that fall within the $urisdiction of Industrial 0ribunals

    F. ules of discipline

    2. etrenchment of workmen and closure of establishment

    Matters that fall within the $urisdiction of Labour Courts ++++

    1. The propriety or legality of an order passed by an employer under the standing

    orders

    3. The application and interpretation of standing order

    7. "ischarge or dismissal of workmen including re*instatement of, or grant of relief

    to, workmen wrongfully dismissed.

    9. ithdrawal of any customary concession or privilege

    =. Illegality or otherwise of a strike or lock*out+ and

    6. &ll matters other than those being referred to Industrial Tribunals.

    /tages of adjudication in labour or industrial disputes**

    The first is receiving a reference from the appropriate 'overnment or filing of the

    labour dispute in the Labour $ourt. The neDt step is sending notice to the

    Banagement and after filing of the response by them, the matter is fiDed for

    adjudication. The fourth step is recording the evidence of the parties and hearing the

    arguments. The final conclusion of the dispute after hearing the parties, the Labour

    $ourtGIndustrial Tribunal decides the dispute and the said final decision is called an

    &ward. & copy of the award is to be published by the Labour "epartment as per

    rules. $opies of the same are also sent to the parties concerned.

    Eecution of wards

    In case the management does not comply with the terms of theaward, the workman may pray for its eDecution by moving an

    application before the concerned $onciliation !fficer.

    "epartment. @e also supervises Inspectorate of actories,Aoilers and orking of -lectrical Inspectorate.

    districts.
