The Kansas Department of Transportation is seeking aqualified consulting engineering firm prequalified in Cat-egory 221 - Non-Standard Span Bridge Design, for recon-struction of the I-70 Lewis and Clark Viaduct project aslisted below. A PDF (1 MB maximum size) of the interestresponse must be emailed to David J. Nagy, P.E., Assis-tant to the Bureau Chief of Design/Contracts Engineer, [email protected]. Interest responses are limited to fourpages, the subject line of the email and the PDF file namemust read ‘‘70-105 KA-2130-02 - Firm Name,’’ and mustbe received by noon May 30 for the consulting engineer-ing firm to be considered.

70-105 KA-2130-02The scope of the services is to design and prepare a set

of plans for the reconstruction of a portion of the I-70Lewis and Clark Viaduct. The scope is to replace Units 1through 7 of Bridge (030) carrying WB I-70 from the stateline to just west of the Kansas River and to replace Unit3 of Bridge (173) carrying WB I-70 to northbound FairfaxTrafficway. A .pdf aerial photo showing the location ofthe bridges and units will be emailed to those who [email protected].

The Consultant Shortlist Committee will select three tofive of the most highly qualified firms expressing interestand schedule an individual interview. The consultingfirms can more thoroughly discuss their experience re-lated to the project at the interview and will be expectedto discuss their approach to this project in detail and thepersonnel to be assigned to this project. Firms not selectedto be short-listed will be notified. Categories may beviewed at www.ksdot.org/divengdes/prequal.

The Consultant Selection Committee, appointed by theSecretary of Transportation, will conduct the discussionswith the firms invited to the individual interview confer-ences. The committee will select one firm to perform theprofessional services required for completing the adver-tised project. After the selection, the firms not selectedwill be notified of the outcome.

It is KDOT’s policy to use the following criteria as thebasis for selection of the consulting engineering firm:

1. Size and professional qualifications.2. Experience of staff.3. Location of firm with respect to project(s).4. Work load of firm.5. Firm’s performance record.The firm’s accounting systems must have the following

capabilities before the firm may be awarded a contract:• Valid, reliable, and current costs must be available

within the system to support cost and pricing data.• Capability to provide a means of measuring the rea-

sonableness of incurred costs.• Capability to identify and accumulate allowable costs

by contract or project records that will reconcile withthe general ledger.

• Ability to provide supporting documentation of ac-tual expenditures for each billing, based on costs.

Emissions of oxides of nitrogen (NOx),carbon monoxide (CO), carbon dioxide equivalent(CO2e), particulate matter (PM), PM equal to or less than10 micrometers in diameter (PM10), volatile organic com-pounds (VOCs), sulfur dioxide (SO2) and hazardous air

The U.S. DHS proposes to own and operate a stationarysource located at 1980 Denison Ave., Manhattan (adjacentto Kansas State University), at which a bio-safety level-3(BSL-3) and BSL-4 research facility equipped with twocontrolled-air, double-chamber medical waste incinera-tors will be constructed. In addition, a Central UtilityPlant containing seven boilers each with maximum de-sign heat-input rating of 33.475 Million British ThermalUnits/Hour (MMBtu/hr) and seven diesel-fired emer-gency generator engines will be installed.

A public comment period has been established to allowcitizens the opportunity to express any concerns theymay have about this proposed permitting action. All writ-ten comments must be received by noon June 26 andshould be submitted to Lynelle M. Ladd, KDHE, Bureauof Air, 1000 S.W. AN ACT concerning adult care homes; relating to licensure and adultcare home administrators; amending K.S.A. 39-931a and K.S.A. 2011Supp. 39-923, 39-931 and 65-3506 and repealing the existing sections.

Be it enacted by the Legislature of the State of Kansas:Section 1. K.S.A. 2011 Supp. 65-3506 is hereby amended to read as

follows: 65-3506. (a) There is hereby established the board of adult carehome administrators. The board shall be attached to the department ofhealth and environment and shall be within the department as a partthereof. All budgeting, purchasing and related management functionsof the board shall be administered under the direction and supervisionof the secretary of health and environment. The department shall serveas the administrative agency of the board in all respects and shall per-form such services and duties as it may be legally called upon to per-form. The attorney for the board shall be an assistant attorney generalappointed by the attorney general. The office of the attorney generalshall serve as the enforcement agency for the board. All vouchers forexpenditures and all payrolls of the board shall be approved by thechairperson of the board and by the secretary of health and environ-ment.

(b) The board of adult care home administrators shall be composedof seven members appointed by the governor, two of whom are as fol-lows:

(1) Two members shall be representatives of professions and institu-tions concerned with the care and treatment of chronically ill or infirmelderly patients,;

(2) two members shall be consumer representatives who have no cur-rent or previous involvement in the financial affairs or as a member ofthe governing body of any adult care home or any association directlyconcerned with the regulation or licensure of adult care homes in thestate,; and

(3) three members shall be licensed in Kansas as licensed adult care homeadministrators who, at the time of their appointment, are licensed bythe state and who, subject to the following requirements:

(A) (i) One such member shall be a representative of the not-for-profit adultcare home industry in Kansas. At least 30 days prior to the expiration of suchmember’s term, Leading Age Kansas, or the successor of such entity, shallsubmit at least one but not more than three names of persons of recognized

New State Laws688 Kansas Registerability and qualification to the governor, who may consider such list in makingappointments to the board under subsection (b)(3);

(ii) one such member shall be a representative of the for-profit adult carehome industry in Kansas. At least 30 days prior to the expiration of suchmember’s term, the Kansas health care association, or the successor of suchentity, shall submit at least one but not more than three names of persons ofrecognized ability and qualification to the governor, who may consider suchlist in making appointments to the board under subsection (b)(3); and

(iii) one such member shall be a representative of the professional associ-ation for the adult care home industry in Kansas. At least 30 days prior to theexpiration of such member’s term, the Kansas adult care executives association,or the successor of such entity, shall submit at least one but not more thanthree names of persons of recognized ability and qualification to the governor,who may consider such list in making appointments to the board under sub-section (b)(3);

(B) all such members shall have been actively engaged for the threeyears immediately preceding appointment and who are currently ac-tively engaged in the administration of adult care homes within the stateof Kansas for the three years immediately preceding appointment;

(C) all such members shall be actively engaged in the administration ofadult care homes within the state of Kansas; and

(D) no such members shall have had or shall have any published discipli-nary action taken by the board of adult care administrators against such mem-bers.

(c) No more than three members of the board may be licensed adultcare home administrators. Members of the board, other than the licensedadult care home administrators, shall have no direct financial interest inadult care homes. Members of the board shall serve on the board forterms of two three years or until otherwise disqualified from serving onthe board. On the effective date of this act, the current expiration date of theterm of office of each existing board member shall be extended by one year fromsuch expiration date. On and after the effective date of this act, no membershall serve more than two consecutive terms. The provisions of this act orthe act of which this section is amendatory article 35 of chapter 65 of theKansas Statutes Annotated shall not affect the office of any member of theboard of adult care home administrators appointed prior to the effectivedate of this act section. All members of the board appointed On and afterthe effective date of this act, shall be appointed by the governor. aspositions become vacant on the board, appointments shall be made ina manner so as to comply with the provisions of this section.

(c)(d) Members of the board of adult care home administrators shallmeet at such times as may be appropriate but in no case less than onceeach four months. The chairperson of the board shall be elected annuallyfrom among the members of the board. All final orders shall be in writ-ing and shall be issued in accordance with the Kansas administrativeprocedure act.

(d)(e) Members of the board who attend meetings of such board, orattend a subcommittee meeting thereof authorized by such board, shallbe paid compensation, subsistence allowances, mileage and other ex-penses as provided in K.S.A. 75-3223, and amendments thereto.

Sec. 2. On and after July 1, 2012, K.S.A. 2011 Supp. 39-923 is herebyamended to read as follows: 39-923. (a) As used in this act:

(1) ‘‘Adult care home’’ means any nursing facility, nursing facilityfor mental health, intermediate care facility for the mentally retardedpeople with intellectual disability, assisted living facility, residential healthcare facility, home plus, boarding care home and adult day care facility;all of which are classifications of adult care homes and are required tobe licensed by the secretary of aging.

(2) ‘‘Nursing facility’’ means any place or facility operating 24 hoursa day, seven days a week, caring for six or more individuals not relatedwithin the third degree of relationship to the administrator or owner byblood or marriage and who, due to functional impairments, need skillednursing care to compensate for activities of daily living limitations.

(3) ‘‘Nursing facility for mental health’’ means any place or facilityoperating 24 hours a day, seven days a week, caring for six or moreindividuals not related within the third degree of relationship to theadministrator or owner by blood or marriage and who, due to functionalimpairments, need skilled nursing care and special mental health serv-ices to compensate for activities of daily living limitations.

(4) ‘‘Intermediate care facility for the mentally retarded people withintellectual disability‘‘ means any place or facility operating 24 hours aday, seven days a week, caring for six four or more individuals notrelated within the third degree of relationship to the administrator orowner by blood or marriage and who, due to functional impairmentscaused by mental retardation intellectual disability or related conditions,need services to compensate for activities of daily living limitations.

(5) ‘‘Assisted living facility’’ means any place or facility caring forsix or more individuals not related within the third degree of relation-ship to the administrator, operator or owner by blood or marriage and

who, by choice or due to functional impairments, may need personalcare and may need supervised nursing care to compensate for activitiesof daily living limitations and in which the place or facility includesapartments for residents and provides or coordinates a range of servicesincluding personal care or supervised nursing care available 24 hours aday, seven days a week, for the support of resident independence. Theprovision of skilled nursing procedures to a resident in an assisted livingfacility is not prohibited by this act. Generally, the skilled services pro-vided in an assisted living facility shall be provided on an intermittentor limited term basis, or if limited in scope, a regular basis.

(6) ‘‘Residential health care facility’’ means any place or facility, ora contiguous portion of a place or facility, caring for six or more indi-viduals not related within the third degree of relationship to the ad-ministrator, operator or owner by blood or marriage and who, by choiceor due to functional impairments, may need personal care and may needsupervised nursing care to compensate for activities of daily living lim-itations and in which the place or facility includes individual living unitsand provides or coordinates personal care or supervised nursing careavailable on a 24-hour, seven-days-a-week basis for the support of res-ident independence. The provision of skilled nursing procedures to aresident in a residential health care facility is not prohibited by this act.Generally, the skilled services provided in a residential health care fa-cility shall be provided on an intermittent or limited term basis, or iflimited in scope, a regular basis.

(7) ‘‘Home plus’’ means any residence or facility caring for not morethan 12 individuals not related within the third degree of relationshipto the operator or owner by blood or marriage unless the resident inneed of care is approved for placement by the secretary of the depart-ment of social and rehabilitation services, and who, due to functionalimpairment, needs personal care and may need supervised nursing careto compensate for activities of daily living limitations. The level of careprovided to residents shall be determined by preparation of the staffand rules and regulations developed by the department on aging. Anadult care home may convert a portion of one wing of the facility to anot less than five-bed and not more than 12-bed home plus facility pro-vided that the home plus facility remains separate from the adult carehome, and each facility must remain contiguous. Any home plus thatprovides care for more than eight individuals after the effective date ofthis act shall adjust staffing personnel and resources as necessary tomeet residents’ needs in order to maintain the current level of nursingcare standards. Personnel of any home plus who provide services forresidents with dementia shall be required to take annual dementia caretraining.

(8) ‘‘Boarding care home’’ means any place or facility operating 24hours a day, seven days a week, caring for not more than 10 individualsnot related within the third degree of relationship to the operator orowner by blood or marriage and who, due to functional impairment,need supervision of activities of daily living but who are ambulatoryand essentially capable of managing their own care and affairs.

(9) ‘‘Adult day care’’ means any place or facility operating less than24 hours a day caring for individuals not related within the third degreeof relationship to the operator or owner by blood or marriage and who,due to functional impairment, need supervision of or assistance withactivities of daily living.

(10) ‘‘Place or facility’’ means a building or any one or more com-plete floors of a building, or any one or more complete wings of a build-ing, or any one or more complete wings and one or more complete floorsof a building, and the term ‘‘place or facility’’ may include multiplebuildings.

(11) ‘‘Skilled nursing care’’ means services performed by or underthe immediate supervision of a registered professional nurse and ad-ditional licensed nursing personnel. Skilled nursing includes adminis-tration of medications and treatments as prescribed by a licensed phy-sician or dentist; and other nursing functions which require substantialnursing judgment and skill based on the knowledge and application ofscientific principles.

(12) ‘‘Supervised nursing care’’ means services provided by or un-der the guidance of a licensed nurse with initial direction for nursingprocedures and periodic inspection of the actual act of accomplishingthe procedures; administration of medications and treatments as pre-scribed by a licensed physician or dentist and assistance of residentswith the performance of activities of daily living.

(13) ‘‘Resident’’ means all individuals kept, cared for, treated,boarded or otherwise accommodated in any adult care home.

(14) ‘‘Person’’ means any individual, firm, partnership, corporation,company, association or joint-stock association, and the legal successorthereof.

(15) ‘‘Operate an adult care home’’ means to own, lease, establish,maintain, conduct the affairs of or manage an adult care home, except


New State Laws 689Kansas Registerthat for the purposes of this definition the word ‘‘own’’ and the word‘‘lease’’ shall not include hospital districts, cities and counties whichhold title to an adult care home purchased or constructed through thesale of bonds.

(16) ‘‘Licensing agency’’ means the secretary of aging.(17) ‘‘Skilled nursing home’’ means a nursing facility.(18) ‘‘Intermediate nursing care home’’ means a nursing facility.(19) ‘‘Apartment’’ means a private unit which includes, but is not

limited to, a toilet room with bathing facilities, a kitchen, sleeping, livingand storage area and a lockable door.

(20) ‘‘Individual living unit’’ means a private unit which includes,but is not limited to, a toilet room with bathing facilities, sleeping, livingand storage area and a lockable door.

(21) ‘‘Operator’’ means an individual who operates an assisted liv-ing facility or residential health care facility with fewer than 61 resi-dents, a home plus or adult day care facility and has completed a courseapproved by the secretary of health and environment on principles ofassisted living and has successfully passed an examination approvedby the secretary of health and environment on principles of assistedliving and such other requirements as may be established by the sec-retary of health and environment by rules and regulations.

(22) ‘‘Activities of daily living’’ means those personal, functional ac-tivities required by an individual for continued well-being, includingbut not limited to eating, nutrition, dressing, personal hygiene, mobility,and toileting.

(23) ‘‘Personal care’’ means care provided by staff to assist an in-dividual with, or to perform activities of daily living.

(24) ‘‘Functional impairment’’ means an individual has experienceda decline in physical, mental and psychosocial well-being and as a re-sult, is unable to compensate for the effects of the decline.

(25) ‘‘Kitchen’’ means a food preparation area that includes a sink,refrigerator and a microwave oven or stove.

(26) The term ‘‘intermediate personal care home’’ for purposes ofthose individuals applying for or receiving veterans’ benefits means res-idential health care facility.

(27) ‘‘Paid nutrition assistant’’ means an individual who is paid tofeed residents of an adult care home, or who is used under an arrange-ment with another agency or organization, who is trained by a personmeeting nurse aide instructor qualifications as prescribed by 42 C.F.R.§ 483.152, 42 C.F.R. § 483.160 and paragraph (h) of 42 C.F.R. § 483.35,and who provides such assistance under the supervision of a registeredprofessional or licensed practical nurse.

(28) ‘‘Medicaid program’’ means the Kansas program of medical assistancefor which federal or state moneys, or any combination thereof, are expended,or any successor federal or state, or both, health insurance program or waivergranted thereunder.

(b) The term ‘‘adult care home’’ shall not include institutions op-erated by federal or state governments, except institutions operated bythe Kansas commission on veterans affairs, hospitals or institutions forthe treatment and care of psychiatric patients, child care facilities, ma-ternity centers, hotels, offices of physicians or hospices which are cer-tified to participate in the medicare program under 42 code of federalregulations, chapter IV, section 418.1 et seq., and amendments thereto,and which provide services only to hospice patients.

(c) Nursing facilities in existence on the effective date of this actchanging licensure categories to become residential health care facilitiesshall be required to provide private bathing facilities in a minimum of20% of the individual living units.

(d) Facilities licensed under the adult care home licensure act on theday immediately preceding the effective date of this act shall continueto be licensed facilities until the annual renewal date of such license andmay renew such license in the appropriate licensure category under theadult care home licensure act subject to the payment of fees and otherconditions and limitations of such act.

(e) Nursing facilities with less than 60 beds converting a portion ofthe facility to residential health care shall have the option of licensingfor residential health care for less than six individuals but not less than10% of the total bed count within a contiguous portion of the facility.

(f) The licensing agency may by rule and regulation change thename of the different classes of homes when necessary to avoid confu-sion in terminology and the agency may further amend, substitute,change and in a manner consistent with the definitions established inthis section, further define and identify the specific acts and serviceswhich shall fall within the respective categories of facilities so long asthe above categories for adult care homes are used as guidelines to de-fine and identify the specific acts.

Sec. 3. On and after July 1, 2012, K.S.A. 2011 Supp. 39-931 is herebyamended to read as follows: 39-931. (a) Whenever the licensing agencyfinds a substantial failure to comply with the requirements, standards

or rules and regulations established under this act or that a receiver hasbeen appointed under K.S.A. 39-958, and amendments thereto, it shallmake an order denying, suspending or revoking the license after noticeand a hearing in accordance with the provisions of the Kansas admin-istrative procedure act, K.S.A. 77-501 et seq., and amendments thereto. Anyapplicant or licensee who is aggrieved by the order may appeal suchorder in accordance with the provisions of the Kansas judicial reviewact, K.S.A. 77-601 et seq., and amendments thereto.

(b) Except as provided in subsection (c), whenever the licensing agencydenies, suspends or revokes a license under this section, the applicant or licenseeshall not be eligible to apply for a new license or reinstatement of a license fora period of two years from the date of denial, suspension or revocation.

(c) (1) Any applicant or licensee issued an emergency order by the licensingagency denying, suspending or revoking a license under this section may applyfor a new license or reinstatement of a license at any time upon submission ofa written waiver of any right conferred upon such applicant or licensee underthe Kansas administrative procedure act, K.S.A. 77-501 et seq., and amend-ments thereto, and the Kansas judicial review act, K.S.A. 77-601 et seq., andamendments thereto, to the licensing agency in a settlement agreement or othermanner as approved by the licensing agency.

(2) Any licensee issued a notice of intent to take disciplinary action by thelicensing agency under this section may enter into a settlement agreement orother manner as approved by the licensing agency, with the licensing agency,at any time upon submission of a written waiver of any right conferred uponsuch licensee under the Kansas administrative procedure act, K.S.A. 77-501 etseq., and amendments thereto, and the Kansas judicial review act, K.S.A. 77-601 et seq., and amendments thereto.

(d) No person shall operate an intermediate care facility for people withintellectual disability of five beds or less, as defined by subsection (a)(4) ofK.S.A. 39-923, and amendments thereto, within this state unless such person:

(A) Is issued a license by the licensing agency on or before January 1, 2012;or

(B) participated in the medicaid program as an intermediate care facilityfor people with intellectual disability of five beds or less, on or before January1, 2012.

Sec. 4. On and after July 1, 2012, K.S.A. 39-931a is hereby amendedto read as follows: 39-931a. (a) As used in this section, the term ‘‘person’’means any person who is an applicant for a license to operate an adultcare home or who is the licensee of an adult care home and who hasany direct or indirect ownership interest of 25% or more in an adultcare home or who is the owner, in whole or in part, of any mortgage,deed of trust, note or other obligation secured, in whole or in part, bysuch facility or any of the property or assets of such facility, or who, ifthe facility is organized as a corporation, is an officer or director of thecorporation, or who, if the facility is organized as a partnership, is apartner.

(b) Pursuant to K.S.A. 39-931, and amendments thereto, the licens-ing agency may deny a license to any person and may suspend or revokethe license of any person who:

(1) Has willfully or repeatedly violated any provision of law or rulesand regulations adopted pursuant to article 9 of chapter 39 of the KansasStatutes Annotated and acts amendatory of the provisions thereof orsupplemental amendments thereto;

(2) has had a license to operate an adult care home denied, suspended,revoked or limited, has been censured or has had other disciplinary action taken,or an application for a license denied, by the proper licensing authority ofanother state, territory, District of Columbia or other country, a certified copyof the record of such action of the other jurisdiction being conclusive evidencethereof;

(3) has failed or refused to comply with the medicaid requirements of titleXIX of the social security act, or medicaid regulations under chapter IV of title42 of the code of federal regulations, a certified copy of the record of such actionbeing conclusive evidence thereof;

(4) has failed or refused to comply with the medicare requirements of chap-ter 7 of title 42 of the United States code, or medicare regulations under chapterIV of title 42 of the code of federal regulations, a certified copy of the record ofsuch action being conclusive evidence thereof;

(5) has been convicted of a felony;(3)(6) has failed to assure that nutrition, medication and treatment

of residents, including the use of restraints, are in accordance with ac-ceptable medical practices; or

(4)(7) has aided, abetted, sanctioned or condoned any violation oflaw or rules and regulations adopted pursuant to article 9 of chapter 39of the Kansas Statutes Annotated; or

(5)(8) has willfully admitted a person to a nursing facility in viola-tion of K.S.A. 39-968, and amendments thereto.

HOUSE BILL No. 2562

AN ACT concerning public health; relating to emergency care or assis-tance at the scene of an emergency or accident; concerning certaincontracts by the board of healing arts with persons licensed to prac-tice the healing arts; amending K.S.A. 2011 Supp. 65-2878 and re-pealing the existing section.

Be it enacted by the Legislature of the State of Kansas:New Section 1. Any person who is not a health care provider pur-

suant to K.S.A. 2011 Supp. 65-2891, and amendments thereto, who ingood faith without compensation renders emergency care or assistanceto a person, including a minor without first obtaining the consent of theparent or guardian of such minor, at the scene of an emergency or ac-cident shall not be held liable for any civil damages for acts or omissionsother than damages occasioned by gross negligence or by willful orwanton acts or omissions by such person in rendering such emergencycare.

Sec. 2. K.S.A. 2011 Supp. 65-2878 is hereby amended to read as fol-lows: 65-2878. (a) The board shall appoint an executive director, subjectto confirmation by the senate as provided in K.S.A. 75-4315b, andamendments thereto. Except as provided by K.S.A. 46-2601, and amend-ments thereto, no person appointed as executive director shall exerciseany power, duty or function as executive director until confirmed bythe senate. The executive director shall be in the unclassified serviceunder the Kansas civil service act and shall receive a salary fixed by theboard and approved by the governor. The executive director shall not

be a member of the board. Under the supervision of the board, theexecutive director shall be the chief administrative officer of the boardand shall perform such duties as may be specified by the board and asmay be required by law. The executive director shall be the custodianof the common seal of the board, the books and records of the boardand shall keep minutes of all board proceedings.

(b) The board may employ an administrative assistant. The admin-istrative assistant shall be in the unclassified service under the Kansascivil service act and shall receive a salary fixed by the board and ap-proved by the governor. Under the supervision of the executive director,the administrative assistant shall assist the executive director in the per-formance of the duties of the executive director.

(c) The board may employ such clerical and other employees, whoshall be in the classified service under the Kansas civil service act, as itconsiders necessary in order to administer and execute, under the su-pervision of the executive director, the provisions of this act or otherstatutes delegating duties and responsibilities to the board, except thatany attorney employed by the board shall be in the unclassified serviceunder the Kansas civil service act and shall receive a salary fixed by theboard and approved by the governor.

(d) As necessary, the board shall be represented by an attorney ap-pointed by the attorney general as provided by law, whose compensa-tion shall be determined and paid by the board with the approval ofthe governor.

(e) The board may contract with one or more persons who are li-censed to practice the healing arts in this state and who are not membersof the board to provide such advice and assistance as necessary on:Licensure matters including review, investigation and disposition ofcomplaints; clinical and patient care matters; and the ethical conductand professional practice of licensees; or to perform other duties as as-signed by the executive director or the board. For the purposes of con-tracting with such persons, the board shall be exempt from the provisions ofK.S.A. 75-3739, and amendments thereto.

Sec. 3. K.S.A. 2011 Supp. 65-2878 is hereby repealed.Sec. 4. This act shall take effect and be in force from and after its

publication in the Kansas register.
