    PETITION TO DETERMINE PRESENT

    MENTAL CONDITION OF AN IMPRISONED PRISONER

    COMES NOW, the United States of America, by and through the

    United States Attorney for the Western District of Missouri, and

    moves the Court for a hearing on the present mental condition of

    ROBERT KNOTT pursuant to the provisions of Title 18, United States

    Code, Section 4245.

    SUGGESTIONS

    1. Plaintiff states there is reasonable cause to believe that

    ROBERT KNOTT is presently suffering from a mental disease or defect

    (Schizophrenia, undifferentiated type), for which he requires care

    and treatment in a suitable facility.

    2. ROBERT KNOTT is a convicted prisoner serving a life sentence

    of imprisonment. Attached hereto as Exhibit Ais a copy of

    defendant's Judgment and Commitment Order and Sentence Computation.

    Defendant is incarcerated in the Mental Health Evaluation Unit at the

    United States Medical Center for Federal Prisoners (USMCFP) in

    Springfield, Missouri. On April 19, 2002, defendant was examined by

    Richart L. DeMeir, Ph.D., Clinical Psychologist, at the USMCFP. It

    is the opinion of Dr. DeMeir that ROBERT KNOTT is presently suffering

    from a mental disease or defect for which he requires care and

    treatment in a suitable psychiatric hospital. Attached hereto as

    Exhibit B is the Psychological Report.

    3. Attached hereto as Exhibit C is an Inmate Request to Staff

    Member, which establishes that the defendant has objected to

    psychiatric treatment and has refused to be admitted to the Mental

    Health Treatment Unit at the USMCFP for psychiatric care and

    treatment.

    WHEREFORE, plaintiff moves this Court for a hearing to determine

    the present mental condition of ROBERT KNOTT for the Court's order

    finding that ROBERT KNOTT is suffering from a mental disease or

    defect for the treatment of which the defendant is in need of custody

    in a suitable facility; and, for the Court's order committing ROBERT

    KNOTT to the custody of the Attorney General for hospitalization and

    treatment in a suitable facility until ROBERT KNOTT is no longer in

    need of such care or treatment in such a facility or until the

    expiration of his sentence of imprisonment.
