Rob Weisberger - Bio

Rob's interest in the arts is both personal and professional. He has been a violinist since the

age of 6, and attended the Hartt School at the University of Hartford majoring in Violin

Performance. It is a personal goal of his to make sure that arts and culture - with a personal

focus on classical music - stay in the mainstream and, more importantly, the hearts of young

adults.

Rob is currently the Sales Manager of Hotel on North, one of the newest additions to the

revitalization of downtown Pittsfield. While his position carries with it an obvious interest in

bringing travel to the Berkshires, he has also held positions in other venues, such as the

Hampton Inn & Suites in Lenox, where during the summer he was charged with the task of

planning cultural outings for guests and gathering reviews to relay to others. Rob has also

worked for Canyon Ranch as Cultural Coordinator, where similarly he advised guests on the

events in the Berkshires and sold them tickets from a pre-purchased stock.

While the majority of Rob's interest in the arts resides in classical music, he is also particularly

interested in theater and fine arts, and is just beginning to build an appreciation for dance. His

experience in theater ranges from high school musicals and Shakespeare, to a second stage

production with Barrington Stage Company, under the direction of Julie Boyd.

Rob is a member of the Berkshire Young Professionals Steering Committee and is co-chair of

the Community Service subcommittee. He is currently enrolled at Massachusetts College of

Liberal Arts to complete a degree in Business Administration he had started at Berkshire

Community College before deciding to pursue violin performance. Recently Rob was selected

to join Sigma Alpha Pi, the National Society of Leadership and Success. He intends to further

his education by achieving his MBA.

Lindsey Struck Bio

Lindsey Struck is the general manager of Hotel on North, the new boutique hotel in Pittsfield.

Playing an instrumental role in the opening of the hotel on June 1, Struck is responsible for

providing leadership, overseeing operations, and coordinating marketing efforts.

Hotel on North is owned by David Tierney III and his wife Laurie Tierney of MM&D LLC and

managed by Main Street Hospitality Group, owner and operator of the renowned Red Lion Inn in

Stockbridge, MA, The Porches at MASS MoCA in North Adams, MA and The Williams Inn in

Williamstown, MA.

Struck brings 20 years of New England hospitality experience, serving most recently as the

director of rooms at the Ocean Edge Resort & Golf Club in Brewster, MA. Previously, she held

leadership roles at Castle Hill Inn in Newport, RI and Mohegan Sun Resort and Casino in

Uncasville, CT.

Struck resides in Pittsfield, MA. In her spare time, she enjoys spending time with family and her

dogs, is an avid photographer and paints landscapes.

AMENDING THE CODE OF THE CITY OF PITTSFIELD, CHAPTER 2, ADMINISTRATION, ARTICLE XXVII

HUMAN RIGHTS COMMISSION

Be it ordained by the City Council of the City of PillS field, as follows:

SECTION I

That the Code of the City of Pittsfield Chapter 2, Administration, Article XXVII Human Rights Commission be amended by the deletion of Sec. 2-137 in its entirety and replace with the following language in its place:

Sec. 2-137 Policy of the City of Pittsfield

(a) Purpose and Intent

It is the finding of the City of Pittsfield that no individual should be denied equal treatment or opportunity as a result of his or her age, ancestry, color, disability, family status, gender, identity or expression, military status, marital status, national origin, race, religion, sex or sexual orientation.

(b) Policy

It is the Policy of the City of Pittsfield to uphold the human rights of all persons in Pittsfield and the free exercise and enjoyment of any and all rights and privileges secured by the Constitutions, Laws, Ordinances and Regulations of the United States, the Commonwealth of Massachusetts and the City of Pittsfield. As such, actions that may deny or tend to deny to an individual equal access or opportunity in matters of housing, employment, education, municipal services, contracts, purchasing or public accommodations on basic of: age, ancestry, color, disability, family status, gender identity or expression, military status, marital status, national origin, race, religion, sex

or sexual orientation, are hereby prohibited.

PROJECT SUMMARY (1 page maximum):

The City of Pittsfield has been awarded $14,460 for its FY 2015 Emergency Management Planning Grant. We wish to make the following purchase with the grant funds if we are approved.

The City of Pittsfield would like to use its funded amount for the purchase one (1) new gasoline powered All-Terrain Utility Vehicle for Fire Department I Emergency Management purposes. Pittsfield FD IEM currently lacks the ability to move large groups of personnel during emergency mobilizations.

Currently, when traveling into remote areas during emergencies, groups of personnel are often transported in an open pick-up truck, exposing them to the elements, but more importantly unsecured and unsafe. The open truck lacks seat belts and other intrinSically safe components which endangerthe lives of those passengers.

This new All-Terrain Utility Vehicle would allow for the safe transport of four personnel and their related equipment in a much safer environment, most importantly in a seated position with seat belts to reduce the risk of injury and death to the members.

The vehicle would have trailering capabilities (tow hitch) allowing it to tow our recently obtained Emergency Management trailer which contains traffic control cones, barrels, and a-frame barricades for scene control and security. This All-Terrain Utility Vehicle could also tow the newly acquired (CCP Grant) regional Community Emergency Response Team trailer, (Berkshire County CERT), allowing for quick deployment of CERT equipment into inaccessible areas within Berkshire County post-disaster. The All-Terrain Utility Vehicle would be equipped with communications gear which would allow it to be used as a forward incident command post. (The required radios would llilt be purchased with these grant funds.)

The remaining grant funds will be used to purchase and install a rechargeable LED hand-light for operating in low Ino light conditions.

This purchase would enhance our ability to prepare, respond and recover from all types of disasters, (natural, technical, man-made) by allowing us the ability to response in a more efficient manner with our personnel and their equipment. Prior planning and prompt response to these incidents is critical to improve the outcome as required by the National Preparedness System and its goals.

The expected outcome of this funded purchase is the enhancement of our ability to transport emergency responders in a safe and efficient manner. Public Safety personnel cannot do their jobs if they do not arrive safe and sound at the incident location. This purchase would show a commitment to our personnel that their safety is paramount to the operations of this organization. The purchase and use of a vehicle of this type would reduce risk to our community's first responders and enhance their ability to respond quickly and efficiently throughout the Western Massachusetts region.

This AU-Terrain Utility Vehicle would be beneficial to the City of Pittsfield during emergency operations within our community as well as the regional area. Healthy Housing for Healthy Aging

2. Brief description of proposed initiative, which of the three options under which it falls, and any experience your city or tawn has in implementing community-based healthy eating/active living activities.

The City of Pittsfield is applying for funding under the Healthy Aging through Healthy Community Design portion of this mini-grant and will partner with Berkshire Regional Planning Commission (BRPC) as a subcontractor to implement this proposal. The City of Pittsfield proposes an ambitious Healthy Housing for Healthy Aging Initiative. Working with its subcontractor, this effort will develop a workbook and host a Residential Aging in Place Training to better inform seniors about potential home renovations and residential best practices for aging-in-place. In addition to supporting the aging population of the Berkshires, this initiative will help to upgrade existing housing stock by creating "8 to 80" friendly housing for the region. This project will also promote the existing National Association of Homebuilders (NAHB) Certified Aging-in-Place Specialist (CAPS) program. BRPC, Pittsfield's subcontractor, will work with this group to encourage them to host a CAPS training session in Berkshire County and encourage local contractors to attend. Both Pittsfield and BRPC will collaborate with the Berkshire County Age Friendly Vision 2020 Task Force to help complete, inform, and promote this effort. This Task Force of more than 20 organizations, including municipal Councils on Aging (COA), was formed to help address the challenges of the aging population in the Berkshires. The Task Force will hold an Aging in Place Forum in early 2016 to identify the next steps to address aging in the region, the results of which will be integrated into this effort.

This effort will produce two products: 1. Residential Aging in Place Workbook

The purpose of the workbook is to detail possible home renovation elements to support aging-in-place, based on existing literature and best practices, and connect older adults with resources to support these changes. The workbook will draw on existing best practices and the Healthy Community Design Toolkit (HCDT) to outline potential renovation options and other leverage points to support Aging in Place. The workbook will provide:

• A simple checklist format to show possible age-friendly renovations in all areas of the home. • A resource guide to connect seniors to funding for home renovations, such as those provided through

the USDA and the Department of Veteran's Affairs. • A list of local contractors and design professionals who have been certified as "Aging-in-Place

Specialists" by the National Association of Homebuilders (NAHB). • A guide to better allow municipal officials to review site plans, to inspect homes, and to make informed

decisions when they refer contractors to their residents.

In whole, the workbook will be a simple, easy to use guide that will allow contractors, seniors, and their families to work together to renovate homes to support aging-in-place. This workbook will also draw on the results of the Aging in Place Forum, to be held in early 2016, and will be updated with additional CAPS certified professionals as they complete required trainings.

2. Residential Aging in Place Training BRPC will host a Residential Aging in Place Training and encourage seniors, COAs, and local housing organizations to attend. The training will:

• Promote the existing NAHB CAPS program and encourage seniors to look for contractors with this certification as they examine their home renovation needs.

• Provide information about the rapidly aging population in the Berkshires and provide a summary of BRPC's recent Age Friendly Survey, which received responses from over 2300 adults aged SO and older in the region.

• Detail possible home renovations and residential best practices to support aging-in-place and provide attendees with the workbook.

• Give seniors the tools to better work with contractors by providing them with renovation options and resources to make crucial decisions regarding their home renovation needs.

Pittsfield and BRPC antiCipate that the training and workbook will be useful tools beyond the scope and timeline of this grant application. The training presentation and workbook will be made available to local COA groups and other relevant organizations so that they can train and inform their constituents. Additionally, BRPC will make the training and workbook available on its website for future use.

The activities proposed in this application will jump-start efforts to connect seniors and construction professionals to provide age friendly renovations and allow our older residents to safely age in place. Moreover, it will empower seniors, local municipalities, and COA's to make more informed decisions in referring contractors and builders to local residents.

The City of Pittsfield and BRPC have been working to address the challenge of the county's aging population, as well as develop strategies to promote healthy community design and active living for some time. However, the creation of the Task Force has brought new focus and impetus to this issue. The City of Pittsfield is a member of Mass. in Motion and a founding member of the regional Berkshire County Age Friendly Vision 2020 Task Force. Additionally, the City has developed "Healthy Pittsfield", a collaborative working to address public health issues in the community. BRPC recently participated in efforts to achieve a county level Age Friendly Community designation by the World Health Organizations (WHO), a designation usually reserved for individual municipalities. Additionally, BRPC was instrumental in developing the regional Age Friendly Task Force to address aging in the county. BRPC recently conducted a survey of older adults in the region. BRPC has also recently been involved in other projects to support aging in place, such as a recent 2015 Mass. in Motion mini-grant which examined Complete Streets improvements in the Town of Egremont.

3. A short description of need in your community and explonotion of how the proposed grant octivities will address that need.

Aging is a critical issue in the Berkshires. By 2030, nearly all communities in the Berkshires are projected to have over 40% of their population aged SO and above'. The region is unprepared for the effects of this dramatic demographic shift, though recently, several efforts have begun to address the issue. BRPC and Pittsfield helped to form the Berkshire County Age Friendly Vision 2020 Task Force, which was instrumental in the county's recent designation by the World Health Organization as an age-friendly community. Working through the Age Friendly Task Force, BRPC conducted an "Age Friendly" survey of over 2300 adults aged 50 and above. The survey revealed that overwhelmingly (98%) survey respondents deSired to remain independently in their own homes as they age, which makes issues of accessibility and livability for older adults an important issue. The same survey revealed that only 23% of respondents reported currently living in housing that was "fully accessible" (grab bars, ramps, downstairs bath/bedroom, etc.). Fifty seven percent of respondents felt their homes would need minor renovations to become fully accessible, and another 20% reported that their homes would need major renovations to achieve accessibility. Especially important is the issue of income for this vulnerable population. Results from the survey identified that older adults in the middle and higher income brackets were less likely to report living in an accessible home and more likely to need major renovations. This survey shows that there is a need for home renovations and retrofits to support aging, and that accessible housing may be more difficult to find for middle and higher income residents. This grant will help better connect seniors to qualified and certified professionals and make informed decisions to support healthy housing for aging-in-place.

This initiative will represent strong intra-municipal cooperation between the City of Pittsfield's Health Department, Council on Aging, and Department of Community Development. These departments will coordinate with the subcontractor, BRPC, to ensure successful implementation of this proposal. Additionally, as both members and founders, Pittsfield and BRPC will partner with the Berkshire County Age Friendly Vision 2020 Task Force to help complete this effort. The Task Force will hold its Aging in Place Forum in early 2016, which will interact synergistically with this initiative to address this critical regional issue.

Cultural Districts Initiative Scope of Services and Terms' & Conditions

1. SCOPE OF AGREEMENT The Contractor agrees to perform the services set forth in the original Application for funding and Narrative Report filed by the Contractor with the Council (the "Application") in accordance with the terms and conditions of the Agreement (the "Agreemenf'). The Application and Narrative Report documents are incorporated into the Agreement by reference; the terms of the Application and Narrative Report are binding on the Contractor unless amended by a subsequent written agreement signed by both the Council and the Contractor. The Contractor represents that it is qualified to perform, and has obtained all necessary licenses and permits required to perform the services under this Agreement.

2. PAYMENT ( a) Unless otherwise agreed upon by the Council and Contractor, the Contractor will be reimbursed for expenses approved by the Council included in the budget submitted to the Council.

(b) The. Contractor will be reimbursed one hundred percent (100%) of the grant amount upou receipt of a signed Agreement. The Council shall make reasonable efforts to process payments promptly. The Council shall not be liable for any interest or penalty charges for late reimbursement.

(c) The Contractor shall raise money to match all expenses eligible for reimbursement by the Council under the Agreement. Reimbursement provided under the Agreement or other Council contracts may not be used towards this matching requirement.

3. INTELLECTUAL PROPERTY RIGHTS, PUBLICITY, PUBLICATION, REPRODUCTION, AND USE OF AGREEMENT MATERIALS

(a) The Council defines "deliverables" for this Agreement as being the Final Report. The Final Report will be owned by the Department atthe termination of this Agreement.

4. NON-DISCRIMlNATION AND ACCESS FOR PEOPLE WITH DISABILITIES The contractor agrees to abide by state and federal regulations which bar discrimination on the basis of race, gender, religious creed, color, national origin, ancestry, disability, age, or sexual orientation, and which require accessibility for persons with disabilities. The MCC expects the contractor to be in compliance with:

• The Americans with Disabilities Act of 1990 (ADA) • Section 504 of the Rehabilitation Act of 1973 (Section 504) • Title VI of the Civil Rights Act of 1964 • Other applicable state and local laws

(a) If a complaint or claim alleging violation by the Contractor of any statute, order, rule, or regulation with which the Contractor is obligated to comply is presented to the Massachusetts Commission Against Discrimination ("MCAD"), the Contractor agrees to cooperate with MCAD in the investigation and clisposition of such complaint or claim and to assume all legal fees incurred by the Contractor in connection with the defense of such claim.

(b) In the event of the Contractor's non-compliance with the provisions of this Section 4, the Council shall impose such sanctions as it deems appropriate, including but not limited to: (i) withholding of payments due the Contractor under the Contract until the Contractor complies; and (li) termination or suspension of the Contract.

(k) Donor Recognition: Any wall plaques or advertisements that acknowledge the Contractor's annual or ongoing support from corporations and/or foundations must also acknowledge the CounciL

(I) Co-sponsorship: Those programs that are "co-sponsored" will have additional, specific publicity requirements, dependent on the program at the time of negotiation. Under no circumstances maya Contractor state or imply that its programs and/or activities are "sponsored", "co-sponsored", or "presented" by the Council without expressed, written consent from the Council.

7. ADDmONAL REQUIREMENTS The Council reserves the right to negotiate additional requirements regarding credit and pUblicity on a case by case basis.

8. EVALUATION AND ANALYSIS OF SERVICES (a) The Contractor agrees to provide the Council with a written evaluation (in the form of a Financial and Narrative report provided by the Council) and analysis of the services provided under the Agreement by July 15, 2016. Failure to comply with the requirements of this Section 8 will result in the ineligibility of the Contractor to receive further funds from the Council.

(b) Reinstatement of the Contractor's eligibility is pending until submission of said reports are reviewed and approved by Council staff.

This correspondence requests your attention and requires an action, on your part, to allow for your receipt of grant funding for the purpose of deployment and training of the Mass Decontamination Unites) assigned to your department.

For this grant funding period, the Office of Preparedness and Emergency Management (OPEM) at Massachusetts Department of Public Health (DPH) will be providing funding in support of the Mass Decontamination Unites). Your fire department will receive payment of $2,000 for each Mass Decontamination Unit (MDU) assigned to your department and through your commitment to the completion of five tasks identified in the enclosed scope of work of our contractual agreement with your department.

This payment will be supported by the FFY2015 award to DPH from the federally supported Hospital Preparedness Program (HPP).' This fourth and final annual allocation of grant funding under the current contractual agreement is now being made available to you.

In FFY2011, a multi-year contractual agreement was effectuated and our agreement remains in effect through to June 30, 2016. The contractual agreement was awarded and effectuated via Notice ofIntent and Waiver of Competitive Procurement # 21916. For your reference a copy of this multi-year contractual agreement and scope of work are enclosed.

For you to receive this annual allocation of awarded funding for this year, please sign and return the enclosed invoice (Form PV) as prepared internally by the DPH. The authorized signatory must sign in the grey shaded box at the top of the enclosed form, labeled, "vendor certification. " By returning this originally signed document your department will be eligible to receive a fourth

payment of $2,000 per MDU assigned to your department, to be made. Please know this allocation of funding must be expended by June 30, 20 16.

The signed Form PV, with the required original signature affixed as specified, must be returned on or before, but not later than February 10,2016. SUBJECT: Tyler Street - Dunkin' Donuts proposal

Project History In August 2015, Cafua Realty Trust LVII, LLC submitted a special permit application under Section 7.839 of the Zoning Ordinance to construct a new Dunkin' Donuts restaurant with a drive-through window for property located at 665 Tyler Street, the site of the former st. Mary the Morning Star campus owned by the Roman Catholic Diocese of Springfield. The proposal would result in the demolition of the rectory and convent buildings and the construction of an approximately 2,100 square foot restaurant with drive-through. The former church and school buildings would remain.

In September 2015, the City Council authorized the requirement of project review fees under City Council Rule 39 and requested Department of Community Development staff to retain outside consultants to assist the Council in its review of the special permit application. On September 23, 2015 staff requested fees from the applicant based on quotes received for review services related to traffic, neighborhood planning and character, and legal counsel, for a total sum of $14,200. The applicant objected to the requirement of fees for legal counsel and neighborhood planning and character. After limited communication for several months, staff met with the applicant in January 2016. After internal discussion, staff agreed to amend its request for fees to provide outside legal counsel, which was agreeable to the applicant, as was the addition of fees for stormwater management review recommended by the City Engineer. On January 27, 2016, staff provided an updated request for project review fees totaling $12,000 for services related to traffic, stormwater management, and neighborhood planning and character. At this time the applicant objects to providing review fees for neighborhood planning and character.

As it did in September, staff believes that third party review in relation to neighborhood planning and character is warranted. The City has multiple related efforts in progress on Tyler Street that require consideration in relation to the proposed development, including: a revitalization plan for the Tyler Street area made possible through MassDevelopment's Transformative Development Initiative, with the focus of developing short term and long term goals and objectives for the neighborhood; streetscape design work that is anticipated to begin later this year; and pedestrian improvements through the Bicycle and

Pedestrian Program through the Massachusetts Department of Transportation. Staff believes that these are also concerns of the City Council.

Other Related Information In addition to the special permit described above, the project requires the approval of a special permit from the Zoning Board of Appeals to allow for the extension of the General Business (B-G) district up to 50 feet into the High Density Multi-family Residence (R-M) district. The applicant submitted an application for the special permit from the Zoning Board of Appeals in September 2015. The public hearing for the application was recently continued by the Zoning Board of Appeals to their February 24, 2016 meeting.

Proposed Recommended Action At this time, the primary consideration of the City Council relates to whether it chooses to continue the public hearing. Staff recommends that the City Council continue the public hearing to the March 22, 2016 meeting to allow for the applicant to provide the required fees and the commencement of project review. If the fees are not provided by that time, the City Council may then decide to open the public hearing, receive testimony, and begin its deliberation of the project. It is worth noting that failure to provide the project review fees are grounds for denial of the special permit.

The northern portion of the subject property is zoned High-Density Multifamily Residence (R-M), wbich requires that the applicant receive a special pennit under Section 3.406 of the Zoning Ordinance from the Zoning Board of Appeals to allow for the extension of the General Business (B­G) district up to 50 feet into the R-M district. The applicant submitted an application for the special pennit under Section 3.406 in September 2015.

The applicant requested that the Community Development Board postpone its review of the project until the special pennit from the Zoning Board of Appesls is obtained. The Zoning Board of Appeals has scheduled a public hearing on this proposal for its meeting on November 4,2015.

It is also word! noting that the Council authorized Department of Community Development staff to seek project review fees from the applicant to assist with the review of this project. The requested fees have not been received and the applicant has given no indication of when the City can anticipate receiving the fees to allow for the commencement of the third party review.

Proposed Recommended Aetion As of the date of this memorandum, the City Council has not received a request from the applicant to continue the public hearing. The City Council should open and continue its public hearing on this project to a future date to allow for the Zoning Board of Appeals and Community Development Board to complete their review, as well as to allow the applicant to provide the project review fees authorized by the City Council and requested by Department of Community Development staff. We suggest that the public hearing be continued to the December 8, 20]5 City Council meeting.

Be it onJained by the City Council of the City of Pittsfield, as follows: Section I.

That the Code of the City of Pittsfield, Chapter 2, Administration, Article XLIX, Ordinance Re­view Committee shall be amended by striking the ordinance in its entirety and replacing with the following langnage:

The Ordinance Review Committee is a multi-member body as defined in Article I , Section 1-7 of Chapter 72 of the Acts of 2013. III accordance with both Ar­ticle 2, Section 2-10 of Chapter 72 of the Acts of2013 and Article 3, Section 3-3 of Chapter 72 of the Acts of2013, each member shall be appointed by the Mayor and sub­ject to City Council Approval. The Ordinance Review Committee shall comply with the procedural requirements as set forth in Article 10, Section 10-6 of Chapter 72 of the Acts of2013.

Section 2-288.1. Membership, terms. duties and compensation. The Ordinance Review Committee shaH consist of five (5) members, all of whom milst be registered voters of the City of Pittsfield. One member shall serve a term of one (I) year; another member shall serve a term of two (2) years; another member shall serve a term of three (3) years; an­other member shall serve aa term offour (4) years; and the last member shall serve a term of five (5). After the first cycle has expired, each member shall subsequently serve a term of five (5) years. The duty of the committee shall be to perform periodic reviews of the Pittsfield City Code as specified in Article 10, Section 10-4 of Chapter 72 of the Acts of 20 13. Each member shall serve without compensation.

Section 2-288.2. Removal and Vacancy. A member may resign at any time during the course ofhis/her term, and the Mayor shaIl fill the vacancy as soon as practicable. Any member appointed in order to fill such a vacancy shall serve for the remainder of the de­parting member's tenn. The Mayor may remove a member subject to City Council ap­proval; in which event, the Mayor shall fiIl said vacancy as ~qon as practicable. Any member appointed in order to fill such a vacancy shall serve for the remainder of the de­parting member's term.

Section 2-288.3. Re,port. The Ordinance Review Committee shall deliver there report within two (2) years after commencement of each periodic review. The Committee members may, by a majority vote, extend the time period within which to submit their periodic reports; provided that the time period for such extension cannot exceed one (1) year.

Location - Holmes Road. Set one (I) jointly owned pole (343173M) to be located on the westerly side of Holmes road at the intersection with Shetland.

Reason - To remove an inaccessible loop feed for Shetland Drive from the railroad right-of-way.
