MEMORANDUM

Date: December 17, 2019

RE: Council Meeting of Thursday, December 19th, 2019

REGULAR MEETING AT 6:00 P.M.

1. IEPA/Boiler Shop— IEPA has taken samples from the site, and while they have indicated

the presence of asbestos, the results of the testing are not yet available.

2. Audit—no new information since last reported.

3. IEPA/WWTP—Bock, Inc., and Chamlin Engineering finished the development of

operating procedures and a small plan for physical improvements that may enable the City

to meet the EPA requirements for chloride concentrations during low flow/dry weather

months (Due to IEPA by January 31, 2020). Staff is reviewing revisions to the plan and

once complete will forward it to you for your thoughts, after which it will be sent to the

State for their consideration.

4. Transfer Station—The transfer station scale broke, so the facility is shut down temporarily

until the repairs can be made and the scale is certified.

5. City Engineer—The candidate has accepted the City’s offer of employment and is

expected to begin work in early January, 2020.

6. Christmas Party—The City’s Christmas Party was well attend by staff who were on duty

at the time and even a few members who were off duty. Thank you to those of who took

the time to come by and let staff know that they are appreciated, and thank you to all of

you for the financial support of the party. A small group of employees did a phenomenal

job of working with the budget we had and were able to put on a great event with limited

resources.

7. Demolition—823 Columbus Ave Fast Track Demo received no bids. A new RFP was sent

out with new bid due date of January 8, 2020. This Fast Track Demo must be completed

by February 20, 2020.

8. Police Vehicle—Staff received 3 responses to the RFP for a new police vehicle, but has to

conduct more research into the vehicles before making a recommendation for your

consideration. We anticipate this matter being on the agenda for the January 13, 2020

meeting.

COUNCIL MEETING 19-23 Dec 9th, 2019

The City Council met in Council Chambers at 7:00 PM with the Mayor calling the meeting to order and the following answering to roll call:

Steve Faber Council Member Chris Colomer Council Member Michael Yaklich Council Member Michael Komnick Council Member Gary Moore Mayor

The Pledge of Allegiance was said. Mayor Moore asked for a moment of silence for our troops still fighting overseas. Mayor Moore explained that the next items were placed on the consent agenda and were considered to be routine in nature to be passed as a whole with one vote of the Council. Mayor Moore requested that any member of the Council or the audience wishing to have an item removed from the consent agenda for individual consideration to make the request and the item would be removed and considered following the approval of the remaining consent items. The consent agenda included minutes from the November 25th, 2019 Council Meeting, payroll for the pay period ending November 23rd $206,713.82, 2019 , Reports from Police and Community Development. A motion made by Council Member Faber and seconded by Council Member Colomer. Roll call showed 5 ayes, no nays. The motion passed.

Bills submitted for approval totaling $205,539.56 were approved on a motion made by Council Member Faber and seconded by Council Member Yaklich. Yaklich had a question on the Lucas device. Asked if we would be reimbursed. Chief Shook let him know that yes we would be reimbursed. Roll call showed 5 ayes, no nays. The motion passed.

Mayor Moore then asked if anyone wished to speak regarding a non-agenda item.

• Gentlemen stepped up to say thank you so much for the Viaduct. He brought his concerns up in March about the roadways and is very happy that the City took the initiative to make that project a priority

NEW BUSINESS

• Presentation by Cheryl Osbourne in regards to her commitment to helping serve the Henry County area with tourism.

• Presentation with Kevin Yepsen discussing the benefits and opportunities that we have in Solar Energy. Had some specific information for the Cities buildings and energy savings and recoup.

• Consideration of Resolution to authorize the CM to execute an easement with Peoples National Bank. Motion made by Council Member Komnick and seconded made by Council Member Colomer. Gentlemen from the bank stepped forward to explain that they have looked into other options that would eliminate using the parking spaces but too many factors where in the way. The best option was for the generator to be placed in the 2 parking spaces that the city owned. Roll call showed 5 ayes, no nays. The motion passed.

• Consideration of a Resolution to set the dates for Council Meetings for the 2020 Calendar Year. Motion made by Council Member Colomer and seconded made by Council Member Faber. Roll call showed 5 ayes, no nays. The motion passed.

• Consideration of an Ordinance abating the tax heretofore levied for the year 2019 to pay the principal of, and the interest on $5,935,000 General obligation WATERWORKS AND SEWERAGE REFUNDING bonds (Alternate revenue source), Series 2013. Motion made by Council Member Komnick and seconded made by Council Member Yaklich. Roll call showed 5 ayes, no nays. The motion passed.

• Consideration of an Ordinance abating the tax heretofore levied for the year 2019 to pay the principal of, and the interest on, $3,640,000 General obligation WATERWORKS AND SEWERAGE REFUNDING bonds (Alternate revenue source), Series 2015. Motion made by Council Member Faber and seconded made by Council Member Komnick. Roll call showed 5 ayes, no nays. The motion passed.

• Consideration of an Ordinance abating the tax heretofore levied for the year 2019 to pay the principal of, and the interest on $3,755,000 General obligation bonds (Alternate revenue source), Series 2012. Motion made by Council Member Yaklich and seconded made by Council Member Colomer. Roll call showed 5 ayes, no nays. The motion passed.

COUNCIL COMMUNICATIONS: • Colomer wanted to thank the volunteers at Windmont and North East park for all their

hard work in the lights and Christmas decorations.

• Komnick stated the lighted parade was wonderful and he loved the spirit and the heart in Kewanee that was displayed. Also to remind everyone about the Cannabis hearing on December 16th at 6pm. Please attend and let your voice be heard.

• Yaklich wanted to make sure that out insurance was still in budget. • Faber stated the Community Choir was amazing and that if you have a chance to please

attend their next performance ANNOUNCEMENTS:

• The Kewanee Police Department would like to advice citizens that per City Code 72.10, it is Unlawful to park any vehicle upon any city public street in the cuty at any time within 12 hours after a snowfall of 3” or more has occurred or until the street has been cleared

• Remind everyone you are allowed 2 additional 32 gal bags at your normal pick up day. Please place 3 ft from you trash container and cardboard must be neatly folded in no bigger than 3x5 to fit in recycle truck.

Teaching Kids Empowering Responses

Last month, we

discussed a

framework for

understanding and

explaining “bad”

behavior to kids.

Empowering kids to

understand what is

rude, what is mean,

and what is bullying

gives them tools and

reduces the overuse

of the term bullying,

which often has a

mandated response.

In the same vein, here

are three empowering

responses to

unwelcome behavior

to teach kids. These

responses are

powerful for a number

of reasons. First and

foremost, teaching

kids how to respond

(apart from telling an

adult) is motivating,

builds self-esteem,

and is in line with all

the principles of

resilience coaching.

Kids want to be able to

handle situations

themselves - which is

what we (caring

adults) want too! This

is something I have

personally heard from

kids in Henry County;

it is also borne out by

research.

These responses have

a broad utility. They

are useful for dealing

with negative social

interactions, but also

apply to most adverse

situations. As caring

adults, we might teach

these initially when

coaching kids on

bullying or other social

situations (remember

to use the "consultant

model”), but then

review these skills

when kids come to us

with other difficulties.

Each of these

responses is more

than a tool. Each

response is in fact a

character trait to be

built over time. When

kids use these

responses and

practice these skills,

they will experience

mental states which,

repeated enough, will

become mental traits

to carry through their

lives.

Mindful means slowing

down and paying

attention to the details.

It is natural for kids to

react rather than

respond when

provoked. Being

mindful means taking

a few deep breaths

and feeling anger/fear/

sadness/etc (rather

than “being” angry/

afraid/sad/etc) and

then choosing a

response. This skill is

best practiced outside

of high-pressure social

situations so then

when the time comes,

the skill is already in

place.

Confident is

recognizing that we

don’t in fact need

anyone’s approval.

When someone is

rude, mean, or bullies,

kids can decide to be

confident about who

they are. They can

choose to simply walk

away, or even give a

neutral response, such

as “thanks for telling

me.” Confidence is

powerful and will have

a profound effect on

how kids are treated

and how they feel.

Resilient is a choice to

move into difficulties

with the attitude that

they make us

stronger. We can help

kids recognize

difficulties they have

overcome in the past

and how they grew as

a result. When new

trouble arises, this

attitude can make all

the difference. Kids

see that while they

didn’t choose this

difficulty, they can

choose how to

respond.

These three

responses make up a

balanced set of tools

for responding to

social situations. Kids

will feel they are

equipped for what

comes along, and that

preparedness is

empowering in and of

itself. As they use

these skills, kids will

grow in all these areas

until they become

second-nature.

Brooks Gibbs visited

Cambridge High

School last

month. The Alliance

appreciates

Cambridge’s initiative,

shouldering the cost

and especially their

open invitation to

attend. Brooks

included a public

presentation with Q &

A and also worked

with students during

the school day. Brooks

is known as a leader

in the field of

resilience and anti-

bullying. Here are

some take-aways, and

some ways to apply

them to your work as a

resilience coach.

One of the first points

Brooks made was to

share what didn’t work

for him. For the first

several years of his

work with kids and

efforts to reduce

bullying, he promoted

kindness and love and

encouraged students

to be considerate and

take care of one

another. Eventually he

found this approach to

be a dead end,

and why it was a dead

end is perhaps the

most important part.

Promoting kindness as

a stand-alone remedy

for bullying creates the

expectation of

improving the social

environment around

the victim until the

bullying disappears.

It’s not a bad goal, but

it is incomplete,

especially when we

understand bullying

(dominance behavior)

as a natural part of

human interaction. It is

unlikely to disappear.

Secondly, promoting

kindness doesn’t give

the bullying victim any

tools. It teaches them

that they are

essentially passive

and at the mercy of

everyone else being

nice (or not).

Brooks outlined how to

respond after a kid has

been bullied, or treated

in any way that is

upsetting. First, show

empathy. Empathy can

unlock the “victim

mindset” and move a

kid toward problem-

solving. Because

resilience coaching

involves supporting

others as they face

difficulty, empathy is

essential. Without it

resilience coaching is,

as Brooks said, cruel.

Next, minimize the

importance of the event.

Use questions like “How

could this be worse?”

and “Why won’t this

matter in the future?” to

lower the importance of

the event and show

confidence in the child’s

ability to handle it.

Model the attitude for

the kid to adopt -

empathetic and

confident. Eventually

help the kid turn away

from the issue

altogether: “What else

could you do?” and let

The HCMHA is a not-for-profit organization composed of various organizations and agencies in the area who have an interest in and/or advocate for mental health. It was started 7 years ago by people from Henry County who were concerned about mental health and thought that a grass roots approach could help. Since its launch, the HCMHA has successfully conducted activities in all areas of our mission. It has coordinated three mental health walks, sponsored a regional mental health conference, sponsored multiple suicide prevention trainings, brought in a mental health trainer who worked with local police departments, planned and put on a Community Education Series (3 separate events), and sponsors a Family Support Group and Peer to Peer group. them choose another activity.

Finally, Brooks has distilled negative interactions into a small,

manageable number of possibilities. Anyone looking to upset

another kid is trying to: 1) bother them, 2) be funny, or 3) lash out

because of their own feelings of hurt. Understanding these

motivations leads to the right types of responses: 1) ignore and

be neutral to those trying to bother, 2) laugh with those trying to

be funny, 3) apologize to those feeling hurt.

This matrix is a great framework to memorize and draw from in

resilience coaching. You may teach it in it’s entirety or you may

use bits and pieces, tailoring what you share to the situation.

Remember to avoid lecturing and stick to the resilience principles

of letting the child own the problem and serving as a consultant.

And ensure that they feel in charge of their own choices and

responses to the situations they are experiencing.

BACKGROUND The City of Kewanee has an existing agreement expiring December 2019, with Michlig Energy for our fuel needs. Proposals were solicited from interested parties, Gold Star FS. Inc. and Michlig Energy

WHEREAS, The City of Kewanee advertised and solicited for sealed proposals for fuel delivery for calendar year 2020, and two proposals were received, and opened by Kewanee’s City Clerk at 11:00 a.m. on December 13, 2019; and

WHEREAS, The unit bids received were as shown in the table below:

WHEREAS, An extension of the unit costs shown above by the estimated quantities to be used, as indicated in the Request For Fuel Supply Bids, indicates the annual cost of fuel from Michlig Energy would be approximately $107,185.00 vs. Gold Star FS at $125,640.00; and,

WHEREAS, City staff has recommended acceptance of the bid from Michlig Energy, and the City Council finds it to be in the best interest of the City of Kewanee to accept the bid of Michlig Energy, thereby fixing fuel costs for calendar year 2020.

NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF KEWANEE THAT: Section 1 The bid of Michlig Energy is accepted, on a per unit basis, and the City Manager is

authorized to sign a contract with Michlig Energy for delivery of fuels between January 1, 2020 and December 31, 2020 to the City.

Section 2 This Resolution shall be in full force and effect immediately upon its passage and

approval as provided by law. Adopted by the Council of the City of Kewanee, Illinois this 19st day of December, 2019.

MUNICIPAL CANNABIS RETAILERS’ OCCUPATION TAX

ORDINANCE NO. 3988

AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF KEWANEE

BY THE ADDITION OF CHAPTER 36 SECTIONS 20-23 IMPOSING A MUNICIPAL CANNABIS RETAILERS’ OCCUPATION TAX

WHEREAS, the City of Kewanee has the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs and that protect the public health, safety and welfare of its citizens; and, WHEREAS, this Ordinance is adopted pursuant to the provisions of the Illinois Municipal Cannabis Retailers’ Occupation Tax Law, 65 ILCS 5/11-8-23 et seq. (Act); and WHEREAS, this Ordinance is intended to impose the tax authorized by the Act providing for a municipal cannabis retailers’ occupation tax which will be collected by the Illinois Department of Revenue; NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Kewanee as follows: SECTION 1. Recitals. The facts and statements contained in the preamble to this Ordinance are found to be true and correct and are hereby adopted as part of this Ordinance. SECTION 2. Adoption of Tax. Chapter 36 of the Municipal Code of the City/Village of Kewanee shall be amended by the addition of Sections 20-23 that will read as follows: CHAPTER 36 SECTION 20 Municipal Cannabis Retailers’ Occupation Tax. 21. Tax imposed; Rate. (a) A tax is hereby imposed upon all persons engaged in the business of selling cannabis, other than cannabis purchased under the Compassionate Use of Medical Cannabis Pilot Program Act, at retail in the City of Kewanee at the rate of 3% of the gross receipts from these sales made in the course of that business. (b) The imposition of this tax is in accordance with the provisions of Sections 8-11-23, of the Illinois Municipal Code (65 ILCS 5/8-11-23). 22. Collection of tax by retailers. (a) The tax imposed by this Ordinance shall be remitted by such retailer to the Illinois Department of Revenue (Department). Any tax required to be collected pursuant to or as authorized by this Ordinance and any such tax collected by such retailer and required to

be remitted to the Department shall constitute a debt owed by the retailer to the State. Retailers may reimburse themselves for their seller's tax liability hereunder by separately stating that tax as an additional charge, which charge may be stated in combination, in a single amount, with any State tax that sellers are required to collect. (b) The taxes hereby imposed, and all civil penalties that may be assessed as an incident thereto, shall be collected and enforced by the Department. The Department shall have full power to administer and enforce the provisions of this article. 23. Severability. If any provision of this Ordinance, or the application of any provision of this Ordinance, is held unconstitutional or otherwise invalid, such occurrence shall not affect other provisions of this Ordinance, or their application, that can be given effect without the unconstitutional or invalid provision or its application. Each unconstitutional or invalid provision, or application of such provision, is severable, unless otherwise provided by this Ordinance. Effective Date. This Ordinance shall be in full force and effect from and after its passage and approval and publication as required by law, provided, however, that the tax provided for herein shall take effect for all sales on or after the first day of July, 2020. Copies of this Ordinance shall be certified and sent to the Illinois Department of Revenue prior to April 1, 2020. AN ORDINANCE AMENDING SECTION 155.003 DEFINITIONS ESTABLISHED IN THE CITY OF KEWANEE CODE OF ORDINANCES, AND DECLARING THAT THIS IS ORDINANCE IS IN FULL

FORCE AS PROVIDED BY LAW. WHEREAS, The City of Kewanee has previously established definitions within section 155.003 of

the City Zoning Code; and

WHEREAS, The State of Illinois enacted the Cannabis Regulation and Tax Act (Act), which pertains to the possession, use, cultivation, transportation and dispensing of adult-use cannabis, which became effective June 25, 2019; and

WHEREAS, The City Council has found that adding definitions pertaining to Cannabis are needed.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KEWANEE, ILLINOIS, IN COUNCIL ASSEMBLED, AS FOLLOWS: Section 1 The City Council hereby amends Chapter 155.003 of the City Code by inserting

CANNABIS BUSINESS ESTABLISHMENT: An adult-use cannabis cultivation center, craft grower, processing organization, infuser organization, dispensing organization or transporting organization.

CANNABIS CRAFT GROWER: A facility operated by an organization or business that is licensed by the Illinois Department of Agriculture to cultivate, dry, cure and package cannabis and perform other necessary activities to make cannabis available for sale at a dispensing organization or use at a processing organization, per the Cannabis Regulation and Tax Act, (P.A. 101-0027), as it may be amended from time-to-time, and regulations promulgated thereunder.

CANNABIS CULTIVATION CENTER: A facility operated by an organization or business that is licensed by the Illinois Department of Agriculture to cultivate, process, transport and perform necessary activities to provide cannabis and cannabis-infused products to licensed cannabis business establishments, per the Cannabis Regulation and Tax Act, (P.A. 101-0027), as it may be amended from time-to-time, and regulations promulgated thereunder.

CANNABIS DISPENSARY: A facility operated by an organization or business that is licensed by the Illinois Department of Financial and Professional Regulation to acquire cannabis from licensed cannabis business establishments for the purpose of selling or dispensing cannabis, cannabis-infused products, cannabis seeds, paraphernalia or related supplies to purchasers or to qualified registered medical cannabis patients and caregivers,

CANNABIS PROCESSOR: A facility operated by an organization or business that is licensed by the Illinois Department of Agriculture to either extract constituent chemicals or compounds to produce cannabis concentrate or incorporate cannabis or cannabis concentrate into a product formulation to produce a cannabis product, per the Cannabis Regulation and Tax Act, (P.A. 101-0027), as it may be amended from time-to-time, and regulations promulgated thereunder.

CANNABIS TRANSPORTER: An organization or business that is licensed by the Illinois Department of Agriculture to transport cannabis on behalf of a cannabis business establishment or a community college licensed under the Community College Cannabis Vocational Training Pilot Program, per the Cannabis Regulation and Tax Act, (P.A. 101-0027), as it may be amended from time-to-time, and regulations promulgated thereunder.

AN ORDINANCE ESTABLISHING THE ANNUAL TAX LEVY FOR 2019 PAYABLE IN 2020 FOR THE CITY OF KEWANEE, ILLINOIS, AND DECLARING THAT THIS ORDINANCE SHALL BE IN FULL FORCE IMMEDIATELY, AS PROVIDED BY LAW. WHEREAS, it is necessary for the proper management and operation of the City of Kewanee

to levy taxes on the property contained within the City; and WHEREAS, the State of Illinois allows municipalities to levy for certain taxes; and, WHEREAS, the aggregate levy for calendar year 2019 payable in 2020, as defined in the Illinois

Truth in Taxation Law, is less than 5% greater than the aggregate levy in the preceding year.

THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF KEWANEE THAT: Section 1 A tax for the following sums of money, or as much thereof as may be authorized

by law to defray all expenses and liabilities of the City of Kewanee, and the same is hereby levied for the purposes specified against all taxable property in the City of Kewanee for the year 2019.

Section 3 The City Clerk shall make and file with the County Clerk of Henry County, Illinois,

a duly certified copy of this Ordinance and that the amount levied by this Ordinance is the minimum required by the City of Kewanee for the proper management and operations of our municipal government. The amounts levied are reflective of the real cost associated with our previously recorded appropriation and debt service ordinances, and such levies should be extended upon the appropriate tax books for the calendar year beginning January 1, 2019 and ending December 31, 2019. Further, the County Clerk is hereby authorized to add an extra factor for the inevitable loss of some funds resulting from non-payment of taxes, as based on previous and historic tax collection in Kewanee, and in accordance with law.

Section 4 The amounts contained herein have been found to be less than 105% of the

amounts previously levied for calendar year 2018, and therefore are not subject to the requirements contained in the Truth in Taxation Act (35 ILCS 200/18-55, et seq.).

Section 5 If any section, subsection, sentence, clause, or part of this Ordinance is for any

reason held invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance.

Section 6 This Ordinance shall be in full force and effect immediately upon its passage and

approval as provided by law.

RE: Proposed property tax levy

As requested, I have prepared the following documents for the proposed property tax levy for 2019 taxes payable in 2020. The purpose of this memo is to provide information for your review prior to action at the December 19th Council Meeting. State law requires us to file a tax levy with the County Clerk by the fourth Tuesday of December.

First, some background information.

UNDERSTANDING PROPERTY TAXES

A tax levy extension is the amount of dollars a taxing district — e.g., a city or village, school district, county, township — intends on collecting. The overall tax levy is comprised of smaller levies that go toward specific purposes.

Property tax bills are calculated by applying tax rates to the equalized assessed value of one’s property. What those rates are depend on how much the levy is and how much assessed value there is to tax (Tax levy = Tax Rate x Equalized Assessed Value).

Below are some definitions of terms you will see on your tax bill and how they apply to what you pay.

Fair cash value: The amount for which a property can be sold in the due course of business and trade, not under duress, between a willing buyer and a willing seller.

Assessed value: The value placed on property for tax purposes and the basis for determining what portion of the overall tax burden each property owner will bear. Assessed value is calculated at 1/3 of fair cash value. (Example: A home worth $150,000 on the open market would have an assessed value of $50,000.)

Equalization factor or multiplier: The equalization factor (sometimes called a multiplier) is the tool used to bring all property to a uniform level of assessment, either bringing values up or down if assessments are determined to be too high or low, whatever the case may be, from one taxing district to another.

Equalized assessed value: The equalized assessed value, or EAV, is the result of applying the state equalization factor to the assessed value of a parcel of property. Tax bills are calculated by multiplying the EAV (after any deductions) by the tax rate.

Exemption: The removal of property from the tax base. An exemption may only be a portion of the equalized assessed value, such as a homestead exemption, or for the complete amount of the equalized assessed value, such as a church building used exclusively for religious purposes.

Tax rate: The amount of tax due, stated in terms of a percentage of the tax base. (Example: $6.81 per $100 of equalized assessed valuation (equal to 6.81 percent). You can obtain this percentage by dividing the levy for a fund by the equalized assessed value for the taxing district. Some funds have a maximum statutory tax rate that may not be exceeded. The sum of the fund rates equals the total district rate.

Annually, the City Council establishes a dollar amount needed from the property tax extensions by the County Clerk. This amount is then aggregated with other taxing districts resulting in individual tax bills on individual property. The City should receive the majority of the money collected from this levy in June and September 2020.

Public Act 096-1495 requires Police and Fire Pension Funds to make annual contributions with a goal of attaining a 90% funding ratio by 2040. Eligible employees are required by law to contribute 9.91% and 9.455% of their base salary to the Police Pension Fund and Fire Pension Fund respectively. The City is required to contribute the remaining amounts necessary to fund the administrative costs and benefit payments of these funds as actuarially determined by an enrolled actuary. The City has financed its annual contributions to the pension funds with the property tax levy. In the past, the City has hired an independent actuary to calculate the annual required contribution. This calculation is specific to the fund and is based on the demographics of all retired and current employees. Integral to the calculations are assumptions regarding investment rate of return, salary increases, retirement age, employee turnover, mortality rates and disability probabilities. The actuary gives the City options based on achieving a 90% funding ratio (as required by state law) or a 100% funding ratio (as recommended by GFOA’s best practices). Last year the City was notified by our auditors that the actuary we had been using had been publicly reprimanded. It was later discovered that Mr. Sharpe’s membership in the American Academy of Actuaries had been suspended for a period of two years and he was unable to perform actuarial services. Due to the late notice, the City used the Department of Insurance’s actuarial valuation reports last year. This year the City sent out RFQ’s for actuarial services and the actuarial valuation reports were prepared by Nyhart.

The recommended property tax levy for the Fire Pension Fund and Police Pension Fund have been received from Nyhart. Historically the City has treated its pension fund levies very conservatively, and thus, they are the first to be funded by the City’s property tax levy. As these two obligations have consistently grown over the years, there is less and less property tax revenue available for general operating purposes. As a result of the City maintaining a static levy for property owners in recent years, both the percentage of the City’s operating budget attributed to property tax and the dollars available to general operations has drastically been reduced. This approach was aimed at providing stability to residents and businesses. However, this approach cannot continue and in deciding the appropriate property tax levy, the Council needs to consider balancing the needs of the community and those of City operations for all departments.

Next is a table showing the percent funded for Kewanee Fire Pension, Kewanee Police Pension and State-wide IMRF Funds. One can see since FY 2012 the Fire and Police Pension Funds have been decreasing in funding status despite respectable returns on investments. The only exception being IMRF, whose funding status has been fairly static or increased slightly each year until this year. The funding status for both the Fire and Police Pension Funds decreased again this year.

The pension levies, (one could include the Social Security tax levy in the discussion too), shape the entire two million dollar non-bond property tax levy. With IMRF, the City has to contribute the specified amount, 11.84% of wages in calendar year 2020. In the case of Fire and Police, State of Illinois law requires a full levy as specified by an actuary. In Illinois, Fire and Police pension funding

has plagued many municipalities. The funding shortfall is a combination of lower than expected returns on investments, changes to pension provisions, greater frequency of disability pensions and other plan related factors. In addition, many municipalities fund an amount that is less than the actuarial required amount. Kewanee has historically funded its pensions at the actuarial requirement with property tax dollars. The combination of under-funding by many municipalities and the recessionary market losses against a 2033 amortization period posed a serious problem a few years ago. As a result, the State of Illinois passed Public Act 096-1495 to reset the amortization period to 2040 and establish 90% as the required funding target. These changes were designed to provide some relief, especially to municipalities such as Kewanee that honored the funding obligation. The best situation for any pension fund is to be fully funded, with 100% of accrued liabilities covered by assets because it means that the plan is doing a good job of maintaining intergenerational equity with current taxpayers appropriately paying the cost of current public employees’ benefits. There is no official industry standard or best practice for an acceptable funded ratio other than 100%. Undercharging current taxpayers only means a need for higher taxes later. In an attempt to force municipalities to appropriately fund pensions, the Act stipulates that any City that does not levy the full actuarial amount, the Legislature has given the pension boards the ability to apply to the State and have shared income tax or sales tax revenue diverted from the municipality to the pension board to make up for any shortfall in the levy. More information on the specific line item levies is shown in the line by line summary later in this memo. The table below shows the levy history, and what is proposed for tax year 2019 payable in 2020.

First step in preparation of the tax levy is the EAV projection from the Assessor’s office (Item A). There are seven property types that contribute to the EAV. Residential, commerical and industrial are the three statistically significant property types.

• Residential EAV increased $459,467, (+0.80%) to $57,930,560.

• Commerical EAV increased $1,013,686, (+4.63%) to $22,888,858.

• Industrial increased $47,253, ( +1.29%) to $3,700,813.

Adding in a (8.01%) increase in farm EAV and no change in State Railroad EAV, the total EAV is anticipated to increase $1,548,289 (1.83%) from $84,589,065 to $86,137,354. By percent of EAV: Residential parcels 67.3% Commercial 26.6% Industrial 4.3% Railroad 1.4% Farm 0.4% Please recall that these EAV figures are not final until the Henry County Property Tax Board of Appeals makes the books final in March of 2020. Please refer to Item B for a graphic depiction of EAV since the mid-1990’s. This is the fourth year in a row that the EAV has increased slightly. Item C shows the same information in a different format with year-to-year changes. The EAV increased 1.83% for 2019 payable in 2020. One hopes that a fourth year of increases is a sign of EAV starting to regain some of the value lost in the last decade. A declining EAV contributes to a higher property tax rate. The property tax levy amounts were intentionally set to keep the increased payment by the property owner to as little as possible. The aggregate levy of all taxes increased 4.18% from last year. Factoring in the increase in EAV, yields an increase in the property tax rate of 2.37%. With this being the proposed rate, it is well under the 5% threshold of the Truth in Taxation Act, thus a hearing will not be required and no special notice will have to be published. Based on the current EAV information for the 2019 tax levy, the estimated property tax rate per $100 for the City will be approximately $2.9971 or .06950 cents higher than the 2018 tax levy rate. Items labeled A through F are attached with details on the proposed property tax levy along with the actuarial valuation reports for the Fire & Police Pensions. The table below provides comments on the proposed levy for each of the specific line items in the levy. Please remember this is a draft, and can be changed before the December 19th Council meeting at which it will be an action item.

The Corporate levy is the only levy with no specified use. The Corporate levy goes into the General Fund. It has been intentionally unchanged this year to allow the needed increase in the Police & Fire Pension levies. Since about 75% of all pension obligations arise from employees paid from the GF, it is logical to keep this levy at the current level to offset the increases in the Police & Fire Pension levies. It results in a de facto transfer of funds from GF to the pension funds.

As a result, there will need to be more than $220,000 transferred in the FY2021 budget from other funds to cover the difference between the levy and actual costs. All of the fund balance was used last year to offset the $113,000 decrease in the 2018 levy. Transfers from other funds totaled $116,500 in the FY2020 budget. I recommend the transfers be apportioned across the funds related to departmental payroll costs again this year.
