WHEREAS, the Government of Kerala has published Act No. 21 of 2005, namely, the Kerala Forest (Vesting andManagement of Ecologically Fragile Lands) Act 2003, which came into effect from 2nd day of June 2000 for theconservation and management of ecologically fragile lands, minimizing the reduction of degradation of the Eco-Systemand Biological Diversity therein.

Now, it is hereby notified for the information of the public that the ownership and possession of the land as per thedetails shown in the schedule hereto, in the District of Kozhikode has been vested with the Government of Kerala freefrom all encumbrances and the right, title and interest of the owner or any other person thereon shall stand extinguishedfrom the date of commencement of the Act, i.e. 2nd June 2000.

The publication of the notification is made as required under Section 3(2) of the Kerala Forest (Vesting andManagement of Ecologically Fragile Lands) Act, 2003 as per Government Notification No. 15567/Leg. B1/01/Law dated3rd May 2005 and published in Kerala Gazette No. 929 dated 3rd May 2005.

Sealed tenders are invited from eligible approved contractors registered in Public Works Department for execution of the following Civil Work in Kerala Forest School, Walayar as shown below.

Name of work—Renovation of Association Hall Building of Kerala Forest School, Walayar during 2010-11.

Probable Amount of Contract— ` 7,00,000.

Earnest Money Deposit— 2.5%.

Cost of tender forms—` 1,400 + VAT.

Site of work proposed—Kerala Forest School, Walayar, Palakkad District.

Period of Completion of work—Three months from the date of execution of agreement.

Sealed tenders will be accepted till 3 p.m. on 28-2-2011 at Kerala Forest School, Walayar. The tender will be opened by the Principal, Kerala Forest School, Walayar or the officer authorised by him on the same day at 3.30 p.m. in the presence of tenderers who are present on the occasion. The tenders received after the specified date and time will not be accepted. The tenders should be accompanied by E.M.D. pledged in favour of the Principal, Kerala Forest School, Walayar. The same should stamps and the name of the work has to be superscribed on the cover. The tender without adequate E.M.D. will be rejected. If the tender could not be conducted on the above

mentioned date, re-tender shall be conducted on next working day at the same place and time. The opening authority reserves the right to reject any or all of the tenders for valid reasons.

The tender forms can be had from the office of the Principal, Kerala Forest School, Walayar on any working day during the office hours upto 3 p.m. on 26-2-2011. The cost of tender forms should be remitted in cash. The tender forms shall be issued by the persons in whose name it is used and the same is not transferable. The price of tender forms will not be refunded on any account.

If the work has to be entrusted to any other person due to the elusion of the original contractor or due to any other such reasons, the original contractor will be held responsible for all kinds of loss sustained to government in this regard. Such losses shall be recovered from the original contractor and for that purpose each tenderers shall enclose necessary undertaking in stamp paper worth ` 50 along with the tender schedules at the time of its submission. For receiving the tender forms, contractors have to show the original Public Works Department Registration Cards and the Registration Certificate issued from the Commercial Tax Department. If the last day fixed for submitting the tender papers happens to be public holiday, then the next working day will be considered as the last day for submission of tenders.

All the prevailing conditions of Public Works Department with regard to tenders for executing civil works will be binding for this work also. The Sales Tax, Construction Workers Welfare Fund deductions, Income Tax etc., will be recovered from the bill before making payments to the Contractor. If the tender could not be conducted on the fixed day, due to any circumstances, the same will be conducted on the next working day at the stipulated place and time.

The E.M.D. noted against each works should be paid along with the tender form by Fixed Deposit Certificates or DD drawn at any Nationalized Bank at Nemmara in favour of Divisional Forest Officer, Nemmara. A preliminary agreement in the prescribed format in Kerala Government Stamp Paper worth ` 100 should be attached with the tender. Incomplete tender or the tender without the required EMD and preliminary agreement are liable to be rejected. The Divisional Forest Officer, Nemmara reserves the right to reject any tender without assigning any reasons. All the rules and regulations regarding tender in force in Public Works Department and Forest Department are applicable to this tender also. The Divisional Forest Officer will be at his liberty to exclude any of the works mentioned in the schedule from the tender.

The successful tenderer should execute the agreement and commence the work within 15 days from the date of receipt of work order. If he fails to execute the agreement and to execute the work, the work will be re-tendered at the risk and loss of the original bidder or execute departmentally.

TENDER NOTICE

No. B1-5298/2008. 22nd January 2011.

Separate sealed tenders are invited from eligible ‘A’ / ‘B’ Class contractors registered in the Forest Department

in pursuance of G. O. (Ms.) No. 226/1981 (F) dated 16-12-1981 for working down timber as round logs and billets and firewood from the marked trees from the teak plantation mentioned in the schedule below to the depots and stacking at depot site mentioned in the same schedule.

2. The conditions embodied in this notification form part and parcel of the agreement to be executed for the work tendered for.

3. Tender forms can be had from the Divisional Forest Officer, Nilambur North on payment of the Cost and Sales Tax shown in the schedule, hereto on any working day during the office hours up to 1p. m. on 17-2-2011. The tender form shall be used only by the persons in whose name it is issued and for the works specified in the schedule given below.

4. The tenderers shall fill in the tender forms purchased from this office and submit the same together with all the pages intact. Tenders should be addressed in a sealed cover with the name of the work clearly written thereon, to the Divisional Forest Officer, Nilambur North so as to reach him in his office at Nilambur before 3 p. m. on 17-2-

2011. Sealed tenders will be opened by the Divisional Forest Officer at 4 p. m. on the same day in the presence of such of the tenderers who opt to be present on the occasion.

5. If the last date fixed for the receipt of the tenders happens to be a holiday, the tenders will be received and opened on the next working day at the same time and place as per the conditions specified above.

6. The tenders received after the specified date and time, without the requisite enclosures or tenders not written up in the proper order or form, will be rejected.

7. Each tender should be accompanied by a Fixed Deposit receipt obtained from an approved bank in favour of the Divisional Forest Officer, Nilambur North as earnest money deposit for the work.

8. Tenderers should quote uniform percentage of the Departmental estimate rate at which they can take up the work specified in the schedule both in figures and words. Fraction of one percent should not be quoted.

9. All the corrections in the tender forms should be initiated by the tenderer himself. 10. In case more than one tenderer quoted the same lowest rate the successful lowest bidder will be decided in

an auction among the tenderers who quoted the same lowest rate. 11. If any of the lowest tenderer is not prepared to reduce rate in the auction without fraction of one percent it

will be opened to the confirming authority to draw the tender by lots among or between the lower tenderers. 12. The lowest tender will ordinarily be accepted, provided the character and financial status of the tenderers

are found satisfactory, but the authority competent to accept the tender reserves to himself the powers of accepting or rejecting any tender without assigning any reason therefore. There shall be no appeal against such action.

13. Rule notified as per G. O.(P) 62/1976/AD dated 23-2-1976 and published in the Gazette dated 9-3-1976

shall be binding on any person who makes a written tender for the works. 14. The tender submitted by timber merchants, sale coupe contractors and other persons who are engaged in

timber trade within the limits of the Forest Division in which working area is situated or by the adjacent Divisions will not be accepted.

15. The tenderers should have no relationship on any Government servant who is in charge of the work or who

has any direct control over the work. Relationship in this case will mean father, mother, daughter, son, brother, sister, direct uncle, nephew, father-in-law, mother-in-law and the first cousin of the officers concerned.

16. The earnest money deposit of unsuccessful tenders will be returned to them soon after opening the tenders.

17. Before submitting the tender, the tenderer, is expected to study and scrutinize all the conditions in this agreement to be executed, the draft of which can be had for perusal from the Divisional Forest Officer, Nilambur North on any working day during office hours. He should also be through about the field conditions, terrain, labour availability etc. No plea of ignorance of the agreement conditions and field conditions or no complaint regarding the said conditions received after putting in the tender shall be entertained on any account. A bonded agreement should be executed by the successful tenderer on the date of opening of tenders itself.

18. The successful tenderer shall within 15 days from the date of issue of the acceptance of tender, furnish a security deposit of an amount equal to 10% of the total contract value limited to a maximum of ` 1,00,000 (Rupees One lakh only) and execute an agreement on a Stamp Paper worth ` 100 in the approved form, the same of which can be had from the Divisional Forest Officer, Nilambur North for perusal. The security amount should be remitted in the Government Treasuries duly pledged to the Divisional Forest Officer, Nilambur North. If the security is not remitted and the agreement executed within the above said period, a further period of 15 days shall be allowed by the Divisional Forest Officer, for remittance of security and the execution of the agreement subject to realization of `10 (Rupees Ten only) per day of extension. If the tenderers remit the security within 15 days from the date of intimation of acceptance order but is not able to execute the agreement within the period, the Divisional Forest Officer may grant an extension of time for 15 days more for execution of agreement with a penalty of ` 1 per day of extension.

19. Failure to remit the security deposit and to execute the agreement, within the time specified in the condition 18 above, will lead to cancellation of the tender by the Divisional Forest Officer and forfeiture to Government of the Earnest Money Deposit and security if any, deposited by the tenderer. The work will also be got done through other agencies at the risk and loss of the defaulter. The loss if any will be treated as arrears of public revenue and will be recovered from the defaulter under the provisions of Revenue Recovery Act or by any other legal means if not paid within a reasonable time specified by the Divisional Forest Officer. The defaulter, however will not be entitled for gain, if any.

20. The tenderer should produce valid clearance certificate of Sales Tax, Income Tax and Agricultural Income Tax to the satisfaction of the Divisional Forest Officer before the final payment is made to him in case the contract value is of and above ` 5,000 (Rupees Five thousand).

21. In the case of working down round logs and firewood the contractor shall be bound to deliver at the Depot all hardwood logs within three months, from the date of registration, softwood logs within 15 days from the date of felling and billets and firewood within 2 months from the date of registration or within the contract period whichever is earlier. If the delivery of the produce is not effected within the period originally fixed as above, the Divisional Forest Officer, may grant extension for 15 days for delivery of hardwood, 15 days for softwood and 15 days for billets and firewood subject to a realization of penalty of ` 1.75/cum for hardwood, ` 2/cum for softwood for 15 days and ` 0.50/MT for stacked billets and firewood. 15 days further extension can be granted by the Chief Conservator of Forests, Eastern Circle, Olavakkode with penalty of ` 3.50/cum for hardwood, ` 4/cum for softwood, if the periods fall within the original or the extended contract period.

All registered logs remaining undelivered after the expiry of said period will be taken charge of by the Forest Range Officer, Edavanna and the contractor shall be liable to pay a fine of ` 4/cum for such undelivered logs only and forfeit all claims to kolevila due thereon. The loss, if any, sustained by the department due to deterioration on account of belated delivery or non-delivery of the timber will be made good from the contractor as assessed by the Department. The contractor should obtain receipts for the logs delivered at the Depot from the Depot Officer when the contractor will be eligible for kolevila therefore. The contractor shall fell all the marked trees entrusted to him except those trees which have been certified by the Divisional Forest Officer after inspection as wholly defective or impossible to be felled without causing serious damages to their stems or to other trees standing nearby and collect all available timber thereof. For every marked trees left unfelled or felled but uncollected at the expiry of the contract period without proper authorization from the Divisional Forest Officer, the contractor is liable to pay a penalty of ` 200/- per tree, besides realization of value of timber of uncollected trees as per other conditions. The value of the logs at schedule rate if rendered useless or deteriorated will be realized.

22. The contractor shall ensure that the felling and collection, proceeds from the end of the coupe to the other end in an orderly and systematic manner and that all trees are felled as low as possible to the ground levels using saw at least on one side. All logs shall be cross cut with saw.

23. For all logs and billets selling at rates less than kolevila, the kolevila payable to the contractor will be limited to the sale price.

24. If the contractor fails to undertake and complete the work within the specified time or if he leaves any item of work undone, the Divisional Forest Officer, at his discretion make other arrangements for carrying out the works left undone, either Departmentally or through other agencies at the risk and loss of the defaulting contractor and the loss if any, sustained by the Department on this account will be recovered from the security deposit or from other assets of the defaulting contractor, as if such sums are arrears of Land Revenue under the provisions of Revenue Recovery Act in force in such other manner as the Government may deem fit.

25. If any amount becomes due to any workmen or mazdoor engaged by the contractor as per Workmen’s Compensation Act or as per provisions of labour or similar laws, such amounts shall be payable by the contractor.

26. The tenderers should submit a declaration with the tender that they are not related any Government servant who is in charge of or having control of the work for which the tender is submitted. Relationship for this purpose will be restricted to father, mother, son, daughter, sister, brother, uncle, nephew, father-in-law, mother-in-law, brother-in-law and first cousins of the officer. If at any stage this condition is found to have been contravened the

earnest money / security deposit of the tenderer/contractor will be forfeited to Government and the contract entered into will stand cancelled.

27. (a) The contractor shall not make any damage to bridges or roads and private properties during collection and transport and during unloading logs and billets from lorries and he shall be liable of any such damages. The decision of the Government regarding the amount of compensation payable for the damages caused shall be final and binding on the contractor and the Government shall recover such damages from the contractor.

(b) If the damage caused is in respect of any road under the control of the Kerala State Electricity Board or Public works Department, the amount of compensation payable for such damages will be assessed by the Forest Range Officer, concerned and the Assistant Engineer of the concerned Division of the Kerala State Electricity Board or Public Works Department and their decision being final and binding on the contractor. In such cases the contractor shall be liable to pay the damages to the Kerala State Electricity Board or Public Works Department and they shall recover such damages from the contractor.

28. The tenderers should give an undertaking in the tender that they undertake to carryout the work at the tendered rates quoted and to abide by the terms and conditions of the tender notice and draft agreement so on by them and also other Departmental rules and orders issued by them from time to time.

29. (a) Post offers which are not advantageous by more than 5% of the lowest rate offered for the original tender (where the total cost of the work as per tender is ` 1,00,000 (Rupees One lakh) and above and more than 10% where the total cost of the work is less than ` 1,00,000 (Rupees One lakh) will be summarily rejected. In other cases it will be considered under the following conditions:-

(i) The post offer should be made within 7 days of tender.

(ii) The post offerer should remit double the security for the work based on the work offered by the lowest tenderer.

The remittance should be made within 7 days from the date of receipt of registered notice.

29. (b) (i) The post offerer after satisfying the conditions specified above should also execute an agreement before the Divisional Forest Officer pledging the security for the due fulfillment of the terms.

(ii) If the post offerer satisfied the conditions specified above, re-tenders will be called for after giving the usual publicity as per the rules. In the re-tender if the rates offered does not come upto what has been offered by the post offerer it will be awarded to the post offerer at the rate offered by him. If he back out, the security amount will be forfeited to Government. If however, the rate is less than what has been offered by the post offerer in the case of re-tender, the work will be awarded to the lowest tenderer and the amount remitted by the post offerer released to him.

30. The quantity mentioned in the schedule is only approximate and the contractor is bound to work down the full quantity of timber and firewood available from trees marked and entrusted to him.

31. The period of contract will be up to 31-3-2011. No extension of the contract period shall ordinarily be granted. But if however the delay in completing the work in the contract area within the period specified in the schedule attached is due to circumstances beyond the control of the contractor extension of time may be granted for 15 days each by Divisional Forest Officer and Chief Conservator of Forests, Eastern Circle respectively, but not exceeding a total period of 30 days subject to realization of penalties as mentioned below. If he fails to undertake and complete the work within the specified time, or if he leaves any item of work undone, the Divisional Forest Officer may at his discretion make other arrangements for carrying out the work left undone either Departmentally or through other agencies at the risk and loss of the defaulting contractor and loss if any incurred by the Department on this agencies at the risk and loss of the defaulting contractor and loss if any incurred by the Department on this account will be recovered from the security or from other assets of the contractor.

Penalty: (a) ` 2/cum for the quantity of timber delivered at the Depot during the first month extension granted by the Divisional Forest Officer.

(b) ` 2.50/cum for quantity of timber delivered at the Depot during the extension granted by the Chief Conservator of Forests.

(c) In the same way for billets and firewood ` 1.00, 1.25 for the extension granted by the Divisional Forest Officer and Chief Conservator of Forests, respectively.

32. The Divisional Forest Officer reserves to himself the power to eliminate any tree marked and entrusted to the contractor from felling if it is found during the course of the contract that timber obtainable from such trees have no reasonable market or by some other reasons and the contractor is not entitled to claim any compensation for such elimination.

33. Ten per cent. of each kolevila bill will be withheld as retention amount which will be released after the connected logs are sold and the liability if any in respect of these logs with the contract is settled.

33 (a) In case of works, the contract value which exceeds ` 10,000 Income Tax at the rate of two per cent. of payment made shall be deducted at each time when payments are made except in the case of non-resident contractors.

34. For working down logs, seignorage on vakka fibre calculated at one vakka drag rope, for every two cum or fraction thereof and grazing fee for one elephant for every two cubic metres or fraction thereof for timber will be recovered from the contractor on the actual quantity collected and Sales Tax on vakka charges as per the rules in force.

34 (a) All timber the contractor is under obligation to deliver at the prescribed Depots shall be transported to such Depot only along the routes specified in the transport permit. If in the course of work it become necessary to deviate from the routes specified in the schedule, the contractor may be allowed to transport timber and firewood along the deviated routes, provided the Department is satisfied of the necessity for the deviation in the routes. In the case of such deviation in routes, the contractor will be eligible to get kolevila at the rates worked for those new route minus tender reduction with prior sanction of the Chief Conservator of Forests. Quantity to be supplied to different Depots shall also be changed by the Divisional Forest Officer, with prior sanction from the Chief Conservator of Forests.

35. The contractor shall collect all timber available from the trees marked in the plantation within the said contract period as per the instructions issued by the Divisional Forest Officer, Nilambur North. If the collection is delayed the contractor will be liable to pay a penalty at the rate specified above for the timber for the belated period.

36. The contractor should achieve, show and register progress in working down timber. 37. If the rates quoted in the re-tender is more than quoted in the original tender the difference between them

and all the expenditure incidental in fixing up of re-tender including notification charges as assessed by the Divisional Forest Officer, Nilambur North will be recovered from the defaulting tenderer through any legal means including Revenue Recovery Act.

38. Further particulars can be had from the Divisional Forest Officer, Nilambur North or the Range Officer,

Edavanna on any working days during office hours. Estimate rate given is subject to the approval of Chief Conservator of Forests and exact estimate rate would be given along with the schedule in the tender form.

39. The contractor should take every care to collect as much quantity of saleable timber as possible from

marked trees.
