KENT FEET OF FINES

Introduction

The following pages record all feet of fines for Kent from the beginning of the reign of Henry VIII (1509). The only final concords excluded are those entered in the Kent files by mistake, or duplicates. The entries are arranged by regnal year, starting with 1 Henry VIII: 22 April 1509 to 21 April 1510. Individual fines are listed according to their order in the files (which were themselves sorted by county and law term by the Public Record Office). The great majority of fines come from the main Kent county series of fines in Public Record Office class CP 25 (2) 19/102 et sqq. The few fines found in the files of 'diverse counties', and from the county borough of Canterbury files, are entered here after the main series in each regnal year. Every fine has an entry number in this list, which precedes the entry. The P.R.O reference number for each fine can be ascertained by adding the item number, which appears in parenthesis following the entry, to the reference for each file which appears in the heading of every regnal year. The P.R.O. reference numbers for fines from the lesser series appear in full in parentheses following the entry.

The format for each entry is as follows: (1) the name(s) of the grantor(s), otherwise known as deforcients or defendants; (2) the name(s) of the grantee(s), otherwise known as querelents or plaintiffs, with the name of the actual recipient (as indicated by the phrase 'and his heirs' in the admission of right clause) in bold, when more than one plaintiff is recorded; (3) an abbreviated description of the property being conveyed, including the names of manors, the number of messuages (i.e. the site for a dwelling house and its outbuildings), the amount of land allegedly being conveyed - as conventionally recorded on fines - in acres of 'land', 'meadow', 'pasture', 'wood', 'marsh' and waste (the lastnamed in this list includes all land described as heath, furze or moor) and the parishes in which the property lies (parish names based on the Kent volumes of the 'Buildings of England' series by John Newman); where only a part of a property is being conveyed (normally described in the fines as 'two parts (or one part) of three'), they are entered here as a simple fraction (e.g. 2/3); (4) the 'sale' price of the property being conveyed as recorded on the fine, or the word 'enfeoffment' where the fine is not worded in the conventional form of a bargain and sale, and where no consideration is given. Purchase 'prices' are printed as they appear in the fine, either in pounds sterling or in marks (1 mark = two-thirds of £1, or 13s 4d). Minor place names are generally included and assigned to a parish except when they have not been identified. Surnames and the names of manors are given in their original spellings. Forenames are abbreviated and the names of parishes have been modernized. Text in brackets, including place name identifications where the full place name is not recorded on

the document, has been supplied by the editor. In general the list ignores the legal intricacies of

fines: details about warrantors, remainders and the beneficiaries of enfeoffments and uses are not included. For a full appreciation of the varied legal formulae of final concords the reader must turn to C. A. F. Meekings's Abstract of Surrey Feet of Fines (Surrey Record Society, 1946). Fines are here divided into two simple categories: those that take the form of a bargain and sale - and are likely to be real sales; and those that declare themselves not sales, which have all been described here as 'enfeoffments'.

The legal conventions - and fictions - of final concords cannot be emphasized too heavily. The numbers especially, recorded on feet of fines, must be read with great caution; they cannot be taken at face value. In particular, the reader will note that in a majority of fines the numbers given are rounded: both purchase 'prices' and the number of acres being conveyed are more often than not rounded to the nearest ten pounds, marks or acres. The 'prices' can only be read as rough, relative indicators of purchase prices. The typical messuage with ten or twenty acres was commonly assigned a price of £30 or £40, and most larger properties were priced at between £1 and £1 10s per acre. However, a minority of fines carry 'prices' which are either exceptionally low or exceptionally high compared to the trend of prices during each decade for properties of similar size (examples of abnormally high 'prices' are nos. 786, 871, 2152, 2155 and 2527; of atypically low 'prices' nos. 637, 647, 688, 694, 723 and 736). Acreages as well as prices are commonly rounded to the nearest ten or one hundred acres (only a very few fines carry acreages which appear not to have been rounded at all: nos. 2208 & 2591, for example). Not only are acreages rounded, in many cases they may be vastly overstated because they contain alleged amounts under all or most of the different types of land which are conventionally recorded in fines.

Some historians would argue that, except in fines conveying very small amounts of land, only one of the given acreages should be taken as the real or approximate acreage being conveyed: either the largest figure or the figure given as 'acres of land'; and that the amounts assigned as pasture or meadow are fictional and should be discounted altogether (e.g. W. G. Hoskins, The Midland Peasant(1957), p. 100-101). Certainly there are fines where the numbers of acres under the subsidiary headings add up exactly - and incredibly - to the acreage of 'land' per se (nos. 739, 2137, 2179 & 2585). Throughout the series, the tendency of estates to contain blocks of 'land', 'pasture, 'meadow' and 'marsh' in tidy multiples of ten acres cannot be ascribed to the inadequacies of Tudor surveyors. They are clearly the result of conveyancers' practice; the fines they were drawing up would not be invalidated by inaccuracies in the acreage of the property. Accurate, surveyed acreages would be included in another form of deed which began to be used during this period:

the indentures of bargain and sale. And older forms of conveyance - like the deed poll - were

used as commonly as final concords in the early sixteenth century, and they too were cast in legal formulae which did not always include accurate acreages of the properties conveyed. Many collections of family papers include a variety of early sixteenth century deeds, including fines. But they make it clear that final concords - which register conveyances in the court of Common Pleas - were only one among a number of alternative methods to record transactions. A typical collection in the Kent Archives Office, the Cornwallis (Mann) manuscripts, contains deed polls and indentures of bargain and sale recording numerous purchases made by John Baker of Sissinghurst, only one of which is recorded in feet of fines. (KAO U24/T288-290: an English deed of June 1545 records Baker's purchase for £28 of a 23-acre parcel of wood called North Hothes (U24/T289); the fine (item no. 2439) of 38 Henry VIII, describes the property as 6 acres of land and 40 acres of wood, for £20).

There is no way of knowing what proportion of land sales were recorded in final concords; only that conveyances via fines became more common during the course of the early sixteenth century. It must be kept in mind, however, that final concords - because they became part of the archives of state - are much more likely to have survived than most other types of title deeds. It is also not clear if the popularity of fines in the 1540s was maintained at the same level during the Elizabethan period. The numbers of Kent fines show a similar pattern of increase to that found by Meekings in his Abstract of Surrey Feet of Fines: steady but low numbers early in the reign (Kent average 1509-27 = 42 p.a.), followed by a rise in the use of fines after a decision of the common law judges in 1527 that rendered them a more secure title to property than heretofore (1528-36 average = 65 p.a.). A further jump followed the passage of the Statute of Enrolments of 1536 (27 Henry VIII, c. 16), and appears to have accelerated with the start of Crown sales of ex-monastic lands (1538-40 average = 92 p.a.). An even larger increase followed the Statute of Fines (32 Henry VIII, c. 36) which reaffirmed the doctrine stated by the judges in 1527. The last few years of Henry VIII and the early years of Edward VI witnessed a veritable flurry of fines (1541-50 average = 151 p.a.). But, whether the increase in the numbers of feet of fines represents a real growth in the land market or a change in the relative popularity of different legal instruments - or both - is unproven.

Henrician final concords survive covering property in almost all parishes of the county, but the geographical spread of fines is by no means even. There appear to be more fines than might be expected from several towns (e.g. Canterbury, Dartford, Greenwich & Maidstone), and from Wealden, Chartland and Medway Valley parishes; and somewhat fewer than might be expected from many populous north and east Kent parishes and from places with Cinque Port links (e.g. Dover, Hythe, Romney,

Sandwich and Tenterden). It appears that Cinque Port courts could produce their own final concords (see a Tenterden example in Birmingham Library, Archives Div. Baker MS. 5/7).

Whatever the geographical coverage, however, it is clear that final concords were used overwhelmingly for conveying small estates. In the case of large manors and extensive blocs of land, it is likely that the conveyance was recorded in a varied set of deeds, which could include final concords (but did not have to) and usually included detailed indentures of bargain and sale. The accompanying table shows just how popular fines were to record transfers of petty estates. In most years between 1509 and 1550 more than three quarters of final concords which apparently record bargains and sales were of property priced at under £100. A glance at any page in the following list of Kent fines confirms this. Most transactions are between quite ordinary men and women, and convey - or enfeoff - either very small farms (usually recorded on fines as a messuage, garden, barn and 10-30 acres of land) or individual parcels of a few acres of land or a tenement with little or no land. By the 1530s the volume of conveyances made by means of fines insured that even very minor property owners could afford them. Final concords provided a formal enrolment of land ownership which would be kept permanently by a central court at Westminster and which did not require the appearance of any of the parties in London. The fine was a legal 'bargain' by the end of Henry VIII's reign, and the rapidly rising number of fines is as much evidence of their attractiveness as title deeds as it is of the expanding market for small parcels of land in Kent in the mid-sixteenth century.
