Hillsborough County Affordable Housing Advisory Board (AHAB)

Meeting Date: June 8, 2020

On Monday, June 8, 2020, the Hillsborough County Affordable Housing Advisory Board (AHAB) held a virtual meeting, broadcasted on HTV.

Members in Attendance: Kimberly Overman; Marc Rosenwasser; Cheri Donohue; David Hollis; Cody Powell; Katherine O’Donniley; Orlando Gudes; Connie Burton; Adam Harden; Rick Lott; and Elizabeth Strom.

County Staff Present: Nancy Takemori, Assistant County Attorney; Cheryl Howell, Director, Affordable Housing Services; Willette Hollinger, Planning Division Manager; Michelle Boone, Compliance and Monitoring Manager; Natasha McDonald, Administrative Specialist

Welcome and Introductions: Chairman Overman called the meeting to order at 9:00 AM.

Public Comments:

Shawn Wilson, Blue Sky Communities, 5300 West Cypress St. announced the Preserve at Sable Park was at full occupancy.

Approval of Minutes: Councilman Gudes motioned for the approval of the March 9th minutes which was seconded by Vice Chairman Rosenwasser. The motion was carried unanimously.

Chairman’s Report:

Chairwoman Overman stated we are waiting on the Governor’s approval of the budget. In the board packet, there are two positive recommendations for the Sadowski fund budget allocations to be passed on to Hillsborough County and other counties. Also in the packet is information on House Bill 1339. The bill provides some tools to create incentives and increase the number of affordable units. The bill has provided the ability to waive some fees for affordable housing projects. It permits portions of the SAIL funds to be set aside for permanent rental housing for persons in the foster care system or aging out of foster care. She asked the board to encourage legislators to continue protecting the Sadowski fund.

Recently there were several workshops offered by the Florida Housing Coalition that covered the COVID-19 response for housing and homelessness, education on community land trusts, and fair housing planning. Chairwoman Overman encouraged the board to go to flhousing.org/past-trainings and take those trainings. Those trainings are free.

Chairwoman Overman discussed the importance of keeping existing housing stock in good condition so that residents can shelter in place during a hurricane or a pandemic. She and Ms. Howell are doing an inventory of those properties and looking at ways to stabilize those communities to avoid gentrification and also to ensure people can stay safely in their homes.

Last week the Board of County Commissioners approved developing an equity profile for Hillsborough County. They will be partnering with a variety of organizations to gather the data to see where inequality occurs in our community and address those inequalities and policies. The County is currently determining who they will partner with.

Ms. Howell discussed the community land trust subcommittee. She’s been working with the City of Tampa and the Florida Housing Coalition on how to best design a community land trust for Hillsborough County. They are looking at all available lands to see what’s usable and looking at transit and access to jobs. Ms. Burton commented that she would like to see the County build a model that

would capture more people who would not necessarily benefit in the ways in which some developers bring to the table. She stated her community has been gentrified and they are nervous about what housing opportunities will be provided to them. Councilman Gudes asked how talks have been going with the City. Ms. Howell responded that Affordable Housing was able to get a list of properties from the City but talks have been delayed due to COVID-19 activities. Councilman Gudes wanted to ensure the model helps everyone especially people in marginalized communities. Ms. Howell responded that two weeks ago Affordable Housing Services awarded 19.7 million dollars. Over 85% of those funds went towards families that are 80% and below median family income with a large portion going towards families that are 50% and below median family income.

Vice Chairman Rosenwasser, Connie Burton, Councilwoman Cheri Donahue, Cody Powell, Councilman Gudes, David Hollis, Katherine O’Donniley, and Elizabeth Strom volunteered to be on the community land trust committee. Natasha will send out an email to schedule the meeting.

Director’s Report: Ms. Howell introduced Anne Ray from the University of Florida Shimberg Center. Ms. Ray gave a presentation on the housing data and trends in Hillsborough County. She discussed housing needs and affordability in the County and how to use the information. Chairwoman Overman discussed looking at properties that are ending their affordability soon and partnering with developments getting built over the next 20 years to avoid a significant number of properties that are ending their affordability period.

Ms. Howell gave a report on the reopening status for Affordable Housing. The department is currently teleworking. There are some staff members that come to the office. The office calls are still being answered and invoices are being processed as normal. Ms. Howell then discussed the Department of Economic Opportunity funding. The Department of Economic Opportunity (DEO) was awarded approximately $760 million in CDBG disaster recovery funds. The DEO recently released several RFPs. Affordable Housing Services will be applying for the Facilities RFP to help people shelter in place in their neighborhoods and provide community facilities deploy efforts after a disaster. They are also looking at an infrastructure grant to help with some of the larger issues. Ms. Howell then briefly discussed the recently approved agenda items. She highlighted a $19.7 million award that went to seven different agencies. Ms. Burton noted that the County could be at the forefront of addressing systemic issues in the community and not do business as usual. Chairwoman Overman stated that the award is going to create approximately 260 units and 29% of those projects will be constructed by minority businesses. Ms. Burton requested from Ms. Howell a list of the 7 awardees. Ms. Howell responded that she would share the backup information that goes along with the recommendation for the awards with Ms. Burton. She stated that she will also bring back data collected on the businesses that received rewards and share with the board.

Willette Hollinger, Planning and Reporting Manager, gave a report on the latest RFP award. The awardees included University Area CDC, Catholic Charities, New Visions, Habitat for Humanity, New Life Village, Volunteers of America, and East Tampa Business and Civic Association. This will add 260 units to the current housing stock. Of those 260 units, 200 units will be new construction and 60 units will be rehabbed.

For the fiscal division report, Ms. Howell stated that Affordable Housing received 4.2 million dollars of CDBG-CV funding and an additional 2.1 million from HUD for the Emergency Shelter Grant. The department is working to deploy those funds. Ms. Howell reported on the federal, state, and local grant updates. She is staying up to date on the 11.2 million dollars that the County is expected to receive in SHIP funding. There has not been a final vote yet but she is hoping for the vote to come in any day now. Ms. Strom asked about the process for emergency rental assistance. Ms. Howell responded that Social Services managed the emergency rental program. The program did not use any state or federal funding. The program used local COVID-19 funds. The Social Services department will be reopening the list to accept new applicants. She is hoping the list will open back up this week. When the list is reopened, Affordable housing will email the board and any interested parties attending the meeting. Ms. Strom asked what the federal emergency grant was being used for. Ms. Howell replied the federal emergency grant funding is being used to fund the rapid rehousing program. For the rapid rehousing program you must be homeless. Many people who were transitioning out of homelessness into more

permanent housing were impacted by COVID-19 through job loss or loss of income. Ms. Burton asked how people are noticed if their request for assistance has been approved. Ms. Howell stated she believes applicants receive a letter notifying them of what they qualify for and as they move forward in the qualification process, they should receive information on whether a payment has been made to the landlord or mortgage holder. Councilwoman Donahue asked how long the process is for rapid rehousing and if some of the commercial buildings that may become empty due to remote working can be repurposed for housing. Chairwoman Overman replied that the equity profile will address shortcomings and opportunities and that turning commercial office buildings into residential space is not easy but not impossible

Future Business:

Chairwoman Overman suggested adding Councilwoman Donahue’s idea to a future business item. She then discussed the next AHAB meeting scheduled for July 13th. She stated the meeting may be virtual and that she desires to maintain virtual meetings for now. She will keep everyone informed on the equity profile.

The Florida Housing Coalition Annual conference has been scheduled. The conference will be virtual this year. AHAB members who wish to attend should email Natasha and Affordable Housing will pay for the registration.

The Planning Commission is having a meeting this evening. Mr. Powell asked if any board members had a chance to review the document that was circulated by Natasha regarding attainable housing and if there were any comments or questions that he could take back to the board. Chairwoman Overman asked where the term attainable housing is defined in our code and mission for affordable housing. Mr. Powell replied that his understanding is that it is not defined and that it’s being inserted in the code. Ms. Howell added when looking at the industry standard of the word attainable housing it almost appears as a replacement for workforce housing. She stated we don’t want to confuse people and that if there is a variation from affordable housing, it’s important to see that. Chairwoman Overman suggested to keep the language simple, clear, and consistent.

Adjournment: Councilwoman Donahue motioned to adjourn the meeting, seconded by Vice Chairman Rosenwasser. The meeting was adjourned at 11:36 am.

Staff's Recommended Board Motion: Approve the request to apply for Community Development Block Grant-Mitigation (CDBG-MIT) Program funds from the Florida Department of Economic Opportunity (DEO), and authorize the County Administrator or the Chairman to sign the grant application and related documents with the approval of the County Attorney's Office. No matching funds are required for the CDBG-MIT grant and there is no fiscal impact to submit the application.

Financial Impact Statement: There is no fiscal impact associated with this agenda item.

Background: The U.S. Department of Housing and Urban Development (HUD) announced that $633 million in first-of-its-kind funding would be available to the state of Florida for disaster mitigation projects in areas impacted by presidentially declared disasters in 2016 and 2017. These funds are available through HUD's newly created Community Development Block Grant - Mitigation (CDBG-MIT) Program, as administered by the Florida Department of Economic Opportunity (DEO), and will be used to fund disaster mitigation programs to better protect Florida from future disasters.

One of the CDBG-MIT programs offered by DEO is the Rebuild Florida Critical Facility Hardening Program, which allocates $75 million of the total CDBG-MIT funding to assist local governments and state agencies to harden critical buildings that serve a public safety purpose for local communities.

Affordable Housing Services (AHS) worked with Procurement Services to retain Innovation Emergency Management (IEM) for $5,000 for the purpose of preparing and submitting an application to the DEO under the Rebuild Florida Critical Facility Hardening Program (CFHP) by the June 30th, 2020 deadline.

During the process, IEM will work with the County to identify eligible projects, prepare a detailed budget and to develop an implementation plan.

IEM has been at the forefront of supporting the nation's most significant disaster preparedness, mitigation, and recovery efforts over the last 35 years. As a national, federal, and state grant management firm, IEM's work centers around disaster recovery, protection, response, etc. IEM has provided technical support for several hundred communities across the nation ranging in size, with experience in assisting states, territories, small local governments, as well as large metropolitan areas.

IEM's scope of work will include: 1) Prepare and submit the County's application to DEO under the CFHP. 2) Gather needed data, work closely with County departments to prepare the application. 3) Assist the County in identifying eligible community centers and/or critical public facilities and assessing eligible hardening improvements. 4) Prepare project description, community value, capacity plan, and implementation plan. 5) Ensure Hillsborough County's application meets DEO two-phase review process and overall low-moderate income benefit requirement. 6) Prepare detailed project budget for eligible CFHP grant funding and any leveraged sources. 7) Ensure program project compliance with all HUD and DEO program requirements.

The approval of this agenda item will authorize the Chairman or County Administrator to sign off on the grant documents for submittal to DEO.

Background: The Hillsborough County Board of County Commissioners provided Community Development Block Grant (CDBG) Program funding to Hillsborough Association for Retarded Citizens, Inc. (HARC) for the development and construction of a group home for very-low and low income special needs individuals, Dusty Road Group Home, on November 6, 1997. Upon the sale of the property on January 31, 2013 to Regional Properties, Inc., as operated by Sunrise Community Inc., an Agreement and Consent to Sale, and the Amended and Restated Declarations of Covenants and Restrictions (LURA) were executed and recorded to ensure the proper eligible use period was met in accordance with the regulations of the CDBG Program.

The LURA created a requirement to benefit 6 developmentally disabled individuals for the duration of the LURA term. The owners of the facility have requested an amendment to allow for expansion of the facility to serve additional clients. The project has been monitored by the County since funding was originally provided to ensure compliance with federal regulations. The expansion is consistent with the eligible use requirements and will continue through the duration of the LURA term.

Background: On June 9, 2019, Hillsborough County entered into a State Housing Initiatives Partnership (SHIP) Program and Local Housing (HOPE Act) funding agreement with Blue Broadway 2 LLC, for the construction of a Phase II of a multi-family affordable housing development (BOCC Doc. 19-0676) known as Sabal Place. Phase II of the project will consist of forty seven (47) one-bedrooms, thirty seven (37) two-bedrooms and twenty eight (28) three-bedrooms. This affordable multi-family development will be located north of E. Broadway Avenue in unincorporated Hillsborough (folios: 065718-0050 and 065848-0100).

In connection with the development of the project, Blue Broadway 2, LLC is requesting to enter into a bulk cable agreement with Spectrum Sunshine State, LLC to provide cable for the residents of the property. The Joinder and Consent to the Grant of Easement provides the consent of the County, as mortgagee, to the execution and recordation of that certain Grant of Easement in favor of Spectrum Sunshine State, LLC.

Background: On June 3, 2020 the Board of County Commissioners approved a Substantial Amendment to the Annual Action Plan for the Community Development Block Grant Program. Included in the Substantial Amendment was $3,572,750 for the East Tampa Business and Civic Association for the acquisition and rehabilitation of a twenty eight (28) unit multifamily townhome complex located at 702 East 113th Ave. Tampa, FL 33612..

With the combined Community Development Block Grant (CDBG) and State Housing Initiatives Partnership (SHIP) program funding provided under this Agreement, East Tampa Business and Civic Association, Inc. will purchase and rehabilitate a twenty eight (28) unit townhome complex. This property is located less than a mile away from public transit and a ten minute ride in peak traffic to major

employers such as USF Morsani, the VA Center on Bruce B. Downs, and Tampa Industrial Park. It is also located less than a mile away from shopping and restaurants, access to I-275, and a 15 minute ride to beautiful downtown Tampa. The property shall be leased at affordable rent to income eligible applicants who are designated as low or very low income per the federally published income limits, thereby creating twenty eight (28) additional affordable units in Hillsborough County. The contract expenditure deadline is May 30, 2021.

This Agreement is being funded with $3,000,000 from the CDBG program and $572,750 from the SHIP program.

For the period of May to date, the compliance team is completing desk audits for all multi-family

properties and single family rehab/construction agencies. Due to COVID, all site visits have been cancelled

until further notice.

Land Use Restriction Agreements (LURA) will be been released for one Multi-Family properties due to

meeting the Affordability period. Units will remain affordable through other funding sources.

We are working continuously with the Public Service Agencies and THHI to provide on-going technical

assistance for any expenditure and performance measure issues. New funding agreements are in place

for the FY2020 year.

Assistance

Currently there are 43 active projects managed by the Contracts team including, but not limited to:

twenty one (21) Public Facility Renovations that include Group Homes, Children’s Education Center,

Community Park, Adult Special Needs Day Care Center, Homeless Family Solutions Center, Education

and Workforce Opportunity Center, and Foster Care facilities. Three (3) Multi Family Rehabilitation

projects that will add 138 units to the affordable housing stock in the County. Five (5) Single Family

Housing Rehabilitation Projects which will benefit approximately 72 low income home owners. One (1)

Single Family construction project, one (1) New Construction multi-family housing project that will add

an additional 112 units of affordable housing stock, three (3) land acquisition projects that will result in

an affordable housing end use, six (6) Urban County Partner infrastructure projects with the City of

Temple Terrace and Plant City and one (1) Down Payment Assistance Project.

ensure the projects are running smoothly, are completing on time and within the approved budget.

SERVICES CHILDREN’S CENTER RENOVATIONS

Sunrise Children’s Services Inc. renovated and made

improvements to a 3,600 s.f. Children’s Day Care Center,

known as Sunrise Children’s Services (Formerly United

Cerebral Palsy of Tampa Bay, Inc.) This facility administers

an Early Childhood Education Program for low to

moderate income families with children ranging from

infancy to ages five years old. The ECEP is an early

intervention program that is designed to help in the

overall stages of development. The ECEP provides the

children with multiple methods of therapy, including:

occupational, physical, speech, and medical therapy. The

ECEP offers individual support to children diagnosed with

speech delays, neurological disorders, and developmental

disabilities.

Affordable Housing Services contributed $540,065 in

Community Development Block Grant (CDBG) funding for

the renovations that included the complete rehabilitation

of interior and exterior building and site work and the

addition of two modular classrooms and a playground.
