Notice of Available Grant Funding from the Federal Victims of Crime Act Victim

Assistance Grant ProgramGrant funds are available from the Federal Victim Assis-

tance of Crime Act (VOCA) Victim Assistance grant pro-gram for the funding period of October 1, 2020, through September 30, 2021, to eligible applicants. The purpose of this grant program is to fund public agencies, American Indian tribe/organizations, nonprofit, community, and faith-based organizations, including underserved and culturally specific populations providing direct assistance to crime victims. For the purpose of these grant program guidelines, direct services are defined as those efforts that (1) respond to the emotional and physical needs of crime victims; (2) assist primary and secondary victims of crime to stabilize their lives after a victimization; (3) assist vic-tims to understand and participate in the criminal justice system; and (4) provide victims of crime with a measure of safety such as boarding up broken windows and replac-ing or repairing locks. A crime victim is a person who has suffered physical, sexual, financial, or emotional harm as a result of the commission of a crime.

Notice Concerning Proposed Kansas Air Quality Class I Operating Permit Renewal

Notice is hereby given that the Kansas Department of Health and Environment (KDHE) is soliciting comments regarding a proposed air quality operating permit. Airtex Manufacturing, LLLP dba Engineered Air has applied for a Class I operating permit renewal in accordance with the provisions of K.A.R. 28-19-510 et al. The purpose of a Class I permit is to identify the sources and types of reg-ulated air pollutants emitted from the facility; the emis-sion limitations, standards, and requirements applicable to each source; and the monitoring, record keeping, and reporting requirements applicable to each source as of the effective date of permit issuance.

Airtex Manufacturing, LLLP dba Engineered Air, PO Box 650, DeSoto, KS 66018, owns and operates a cus-tom heating, ventilation, and air conditioning equip-ment manufacturing facility located at 32050 W. 83rd St., DeSoto, KS 66018, Johnson County.

A copy of the proposed permit, permit application, all supporting documentation, and all information relied upon during the permit application review process are available for public review during normal business hours of 8:00 a.m. to 5:00 p.m. at the KDHE, Bureau of Air (BOA), 1000 SW Jackson, Suite 310, Topeka, KS 66612-1366 and at the Johnson County Department of Health and Envi-ronment, 11811 S. The U.S. Environmental Protection Agency has a 45-day review period, which will start concurrently with the public comment period, within which to object to the proposed permit. If the EPA has not objected in writing to the issuance of the permit within the 45-day review period, any person may petition the administrator of the EPA to review the permit. The 60-day public petition pe-riod will directly follow the EPA’s 45-day review period. Interested parties may contact KDHE to determine if the EPA’s 45-day review period has been waived.

Any such petition shall be based only on objections to the permit that were raised with reasonable specificity during the public comment period provided for in this notice, unless the petitioner demonstrates that it was im-practicable to raise such objections within such period, or unless the grounds for such objection arose after such period. Notice Concerning Kansas/Federal Water Pollution Control Permits and Applications

In accordance with Kansas Administrative Regula-tions 28-16-57 through 63, 28-18-1 through 17, 28-18a-1 through 33, 28-16-150 through 154, 28-46-7, and the au-thority vested with the state by the administrator of the U.S. Environmental Protection Agency, various draft water pollution control documents (permits, notices to revoke and reissue, notices to terminate) have been pre-pared and/or permit applications have been received for discharges to waters of the United States and the state of Kansas for the class of discharges described below.

The proposed action is to modify and reissue an existing State/NP-DES permit for an expanding facility for 27,000 head (27,000 animal units) of cattle weighing greater than 700 pounds. This permit is being modified to include construction of a new concrete bunker silo and feed storage area sediment basin. The additional 5.6 acres of runoff collected in the feed storage area sediment basin will be combined with the existing holding pond 12 drainage area. The feed storage sediment basin will have the capacity to store a 25-year, 24-hour rainfall event from the drainage area. The resulting captured runoff will be dewatered from the sediment basin in less than 10 days through an 8-inch diameter PVC transfer pipeline with flow control valve which will gravity drain into holding pond 12, bringing the drainage area to 153.6 acres. No increase of head count is proposed leaving the facility at a maximum capacity of 27,000 head (27,000 animal units) of cattle weighing greater than 700 pounds. There is no change in the permitted number of animal units from the previous permit.

The proposed action is to reissue an existing pretreatment permit for an existing facility. This facility manufactures metal trailers that trans-port livestock and other agricultural products. Outfall 001 consists of wastewater from the phosphating (conversion coating) operation, once the phosphating solution has been applied to steel parts, using a pressure spray gun system. Outfall 002 would be any wastewater dis-charged from the plasma arc table, when it is emptied. The proposed permit contains pretreatment limitations for pH, total toxic organics, cadmium, chromium, copper, lead, nickel, silver, zinc, and cyanide.

Background and Purpose of ProjectThe Kansas Department of Transportation (KDOT),

The engineer must be able to perform tasks and pro-duce the deliverables as described. This person will have the primary responsibility of assisting the ITS Construc-tion Engineer with existing design and construction projects including plan review, inspection, oversee sys-tem integration, coordinate with internal KDOT staff to develop construction contract documents, and maintain ITS standards and specifications. The minimum expe-rience level of this person is that of a recent engineer-ing graduate. Some training will be provided, however more experienced engineers and licensed engineers are desirable. This person must exhibit excellent verbal and written communication skills and have an interest or ex-perience in ITS, electronics or communications systems, or construction. Some travel for KDOT training or field visits may be required. Phone, computer, routine office supplies, and cubicle will be supplied. This position re-ports at the Eisenhower State Office Building, Topeka, Kansas, excluding state holidays. The term of this work is from September 2020 through June of 2021; however, the position may be extended for two additional one-year periods.Evaluation Factors

WHEREAS, to protect Kansans, and especially those who may be members of a vulnerable population, it is necessary to allow certain drivers to renew their drivers licenses online; andWHEREAS, this Administration will do whatever it can to assist Kansans in these challenging times, including providing temporary relief from certain age restrictions concerning online renewal of driver’s licenses during the COVID-19 pandemic.NOW, THEREFORE, pursuant to the authority vested in me as Governor of the State of Kansas, including the au-thority granted me by K.S.A 48-924 and K.S.A 48-925(b), (c)(1), and (c)(11), in order to address the effects of the spread of COVID-19, I hereby direct and order the following:

1. The provision in K.S.A. 8-240(j)(2)(B) prohibiting applicants over 50 years of age from utilizing the electronic online driver’s license renewal applica-tion is suspended for the limited purpose of allow-ing all drivers under the age of 65 to use the elec-tronic online renewal system.

2. Other than as provided in paragraph 1, above, this order does not alter other laws, regulations, or rules relating to the requirements in K.S.A. 8-240 for an applicant to renew their driver’s license.

This document shall be filed with the Secretary of State as Executive Order No. 20-46. It shall become effective immediately and remain in force until rescinded, un-til July 31, 2020, or until the statewide State of Disaster Emergency extended by House Bill 2016 enacted during the June 2020 special session relating to COVID-19 ex-pires, whichever is earlier.Dated June 15, 2020.

Establishing the Court of Appeals Nominating Commission

WHEREAS, Kansas law provides that the Governor ap-points Kansas Court of Appeals judges and that such ap-pointments are subject to consent of the Senate;WHEREAS, the Kansas Court of Appeals is our state’s busiest appellate court, deciding 1,740 civil or criminal cases in 2018;WHEREAS, decisions of the Court of Appeals can af-fect our civil liberties and the safety of our communities, and impact the legal rights of citizens and businesses throughout Kansas;WHEREAS, any judicial appointment process must be transparent, above reproach, and free from undue in-fluence;WHEREAS, nominees for the Governor to appoint as justices of the Kansas Supreme Court and judges of

many district courts in Kansas are selected using non-partisan, merit-based nominating commissions, and be-fore 2013, nominees for Court of Appeals judges were selected using a similar nonpartisan, merit-based nom-inating commission;WHEREAS, nonpartisan, merit-based nominating com-missions have proven to result in the appointment of high-ly qualified, dedicated judges committed to independent, impartial interpretation and application of the law;WHEREAS, the appointment of judges from a diversity of backgrounds enhances the quality of justice dispensed by Kansas courts and encourages respect for the law and the courts;WHEREAS, because the judges who sit on our courts should reflect and understand the experiences of the citi-zens they serve, diversity—either professional or person-al—is itself a qualification for the bench;WHEREAS, while judges should have traditional quali-ties such as an excellent understanding of the law and sig-nificant expertise in the practice of law, judges should also be able to empathize with Kansans from varying back-grounds and experiences, most of whom will encounter the courts for a variety of reasons at one time or another;WHEREAS, those selected as judges in Kansas have always been well qualified, but they have not always formed a wider bench that reflected the demographic di-versity of Kansans;WHEREAS, for decades other states’ governors have issued executive orders to establish nonpartisan, merit- based judicial nominating commissions to ensure that the judicial selection process is free from undue influ-ence and identifies the best, most deserving applicants to serve as judges; andWHEREAS, after establishing the Court of Appeals Nomi-nating Commission through Executive Order 20-01, it is ap-propriate to amend the process for submitting nominations to specifically address the circumstances of an appointment that fails for lack of Senate consent or for other reasons.NOW, THEREFORE, pursuant to the authority vested in me as Governor of the State of Kansas, I hereby es-tablish the Court of Appeals Nominating Commission (“Commission”):

1. Membership. The Commission shall be composed of nine commissioners, each appointed by the Gov-ernor, and shall include the following: a. five residents of Kansas who are active members

of the Kansas bar or retired judges,b. four residents of Kansas who are not active

members of the Kansas bar or retired judges, andc. from each congressional district at least one per-

son appointed under subparagraph 1.a and one person appointed under subparagraph 1.b.

2. Prohibitions. No member of the Commission shall, while she/he is a member, hold any other public of-fice by appointment or any official position in a po-litical party or for six months thereafter be eligible

for nomination for the office of judge of the Court of Appeals.

3. Terms. Subject to the provisions below regarding initial appointments, commissioners shall serve terms of four years and may serve multiple terms, but no commissioner shall serve more than two full terms. For the Governor’s initial nine appointments to the Commission, first terms will be as follows:a. three commissioners shall serve initial two-year

terms and then shall be eligible to serve two four-year terms;

b. three commissioners shall serve initial three-year terms and then shall be eligible to serve two four-year terms; and

c. the remaining three commissioners will serve four-year terms under the provisions of this paragraph.

4. Chairperson. The Governor shall select one of the five commissioners appointed under subparagraph 1.a to serve as chair. A commissioner may serve multiple terms as chair, but no commissioner shall be chair for more than two four-year terms.

5. Bylaws. To govern the Commission’s proceedings and work, the Commission may adopt, by a major-ity vote, bylaws consistent with this order and rel-evant law.

6. Removal. The Commission’s bylaws may address under what circumstances a member of the Com-mission may be removed prior to the expiration of a two-year term, including for reasons such as nonparticipation or conduct unbecoming a person holding a position of public trust.

7. No Compensation. Commissioners shall receive no compensation or reimbursements for expenses and shall serve voluntarily.

8. Open Government. The Commission shall be sub-ject to the Kansas Open Records Act and the Kansas Open Meetings Act.

9. Court of Appeals Nominations. Whenever the Governor is to make an appointment to fill a vacan-cy on the Court of Appeals, the Commission shall nominate three qualified applicants from whom the Governor will choose one to appoint. The Commis-sion shall make its nominations after undertaking a robust and searching inquiry into each applicant’s qualifications that shall include but not be limited to the following tasks:a. collect and review applications, letters of refer-

ence, and other materials the Commission deems relevant and helpful;

b. inquire into the backgrounds, experiences, and qualifications of the applicant; and

c. interview the applicant.10. Nominations Based on Merit. The Commission’s

nominations should be made based on merit, con-sidering an applicant’s full range of professional, legal, and personal qualifications.

11. Publication of Applicants. To comply with K.S.A. 20-3020(a)(3), whenever the Commission stops ac-cepting applications, but not less than twelve days prior to the deadline for the Governor to make her appointment, the Commission shall forward the names and cities of residence of each applicant to the Governor’s Office for publication.

12. Timing of Nominations. The Commission should make every effort to submit the nominations to the Governor as soon as possible and at least 28 days before the expiration of the deadline for the Gover-nor to make an appointment under K.S.A. 20-3020. The Governor may establish a separate date for sub-mitting nominations for individual appointments.

13. No Lobbying. After the Commission submits nom-inations to the Governor, no commissioner shall attempt, directly or indirectly, to further influence the decision of the Governor, except in response to communications initiated by the Governor, her Chief Legal Counsel, or other staff. No attempt shall be made to comment publicly or to disclose any preference of the Commission concerning appli-cants. Commissioners shall avoid giving preferen-tial assistance to any applicant.

14. Background Investigations. The Governor’s Office will request that the Kansas Bureau of Investiga-tion conduct background investigations, pursuant to K.S.A. 75-712(d), of all nominees for Court of Appeals vacancies. As required by law, the infor-mation received from such an investigation will be confidential and not disclosed beyond the Governor or her staff as necessary to determine the nominee’s qualifications. Such investigation is in addition to and not a substitute for the Commission’s inquiry into the backgrounds, experiences, and qualifica-tions of applicants required under this order.

15. Governor’s Selection Process. After the Commis-sion submits nominees for the Governor’s consid-eration, the Commission’s application file for each nominee, including any letters of reference, will be transferred to the Governor’s Chief Legal Counsel. Additional letters of reference or recommendation from interested Kansans may be sent to the Gover-nor’s Office. The Governor’s Chief Legal Counsel, the Director of Appointments, and other staff as appropriate will conduct first-round interviews of each nominee either in person, by phone, or via vid-eo conference. The Governor and Chief Legal Coun-sel will then interview each nominee. The Governor or her staff may require additional documentation or information from any applicant beyond that sub-mitted to the Commission and may make additional inquiries into the qualifications of a nominee.

16. Appointment. After reviewing the nominees’ ap-plication files, completing the interviews, and con-ducting any additional inquiries into the nominees’ qualifications, the Governor will appoint the nom-inee who will best serve the interests of the State of Kansas and submit the appointment to the Senate for consent pursuant to K.S.A. 20-3020.

17. Additional Nominee. If an appointment fails for lack of Senate consent or due to the withdrawal of the appointee or for any other reason, the Com-mission shall submit to the Governor an additional nominee, selected from the applicants for that va-cancy, for consideration along with the two nomi-nees previously submitted for that vacancy.

18. Governing Law. Nothing in this order is intended to conflict with or contravene any relevant statute or regulation regarding the appointment of Court of Appeals judges.

Notice of Hearing on Proposed Administrative Regulations

A public hearing will be conducted at 1:00 p.m. Thurs-day, September 3, 2020, in Memorial Hall Auditorium, 120 SW 10th Ave., 2nd Floor, Topeka, Kansas, to consider the adoption of proposed rules and regulations, K.A.R. 16-14-1, 16-14-10, 16-14-11, of the Office of the Attorney General, on a permanent basis.

This 60-day notice of the public hearing shall constitute a public comment period for the purpose of receiving written public comments on the proposed rules and reg-ulations. All interested parties may submit written com-ments prior to the hearing to the Office of the Attorney General Derek Schmidt, Scrap Metal Unit, 120 SW 10th Ave., 2nd Floor, Topeka, KS 66612 or by email to [email protected]. All interested parties will be given a reasonable opportunity to present their views orally re-garding the adoption of the proposed regulations during the public hearing. 2019 House Bill 2248 (HB 2248) delayed enforcement of most parts of the Scrap Metal Theft Reduction Act until July 1, 2020, thereby making it necessary to amend the following regulations to conform with the statutory changes.

K.A.R. 16-14-1. Fees. The proposed amendment chang-es the annual scrap metal dealer registration fee to $350.00 per registered location.

K.A.R. 16-14-10. Submission of Required Information. The proposed amendment removes submission require-ment language that is incompatible with the new statu-tory changes.

K.A.R. 16-14-11. Definitions. The proposed amend-ment amends the definition of “Database” to mean the

central repository approved by the Kansas bureau of investigation.

Economic Impact. 2019 HB 2248 allows the Attorney General’s Office to charge an annual fee for scrap met-al dealer registration starting July 1, 2020. The proposed permanent K.A.R. 16-14-1 will set the new fee at $350.00 per registered location.

Each of the following terms, wherever used in this article of the board of regents’ regu-lations, shall have the meaning specified in this regulation: (a) “Degree-seeking undergraduate student” means a student who has formally indicated to the state edu-cational institution the intent to complete a program of study that is designated by the United States department of education as a program that is eligible for federal fi-nancial aid.

(b) “Dependent” means a student’s unmarried child under the age of 19 who is not self-supporting.

(c) “Employer contribution” means the amount paid by a state educational institution for the coverage of a student employee that equals 75 percent of the cost of student-only coverage.

(d) “State board” means the state board of regents.(e) “State educational institution” has the meaning

specified in K.S.A. 76-711, and amendments thereto, except that for purposes of this article of the board of regents’ regulations, the university of Kansas medical center shall be considered a state educational institution separate from the university of Kansas, Lawrence, and its campuses.

(f)(1) “Student” means any individual who meets the following conditions:

(A) Is enrolled at a state educational institution, except as provided in paragraph (f)(1)(C)(iv);

(B) is not eligible for coverage under K.A.R. 108-1-1; and

(C) meets one of the following conditions:(i) Is a degree-seeking undergraduate student who is

enrolled in at least six hours in the fall or spring semes-ters or at least three hours in the summer semester or is participating in an internship approved or sponsored by the state educational institution;

(ii) is a master’s degree student who is enrolled in at least three hours each semester;

(iii) is an individual with J-1 or other nonimmigrant status;

(iv) is an individual with nonimmigrant status who is engaged in optional practical training or academic train-ing, even though the individual is not enrolled:

(v) is a doctoral student;(vi) is a master’s or doctoral student who is participat-

ing in an internship approved or sponsored by the state educational institution; or

(vii) has been appointed as a postdoctoral fellow.(2) “Student” shall not include either of the following:(A) Except as provided in paragraph (f)(3), any individ-

ual who is enrolled exclusively in any of the following:(i) One or more semester-based internet courses;(ii) one or more semester-based television courses;(iii) one or more home study courses; or(iv) one or more correspondence courses; or(B) a concurrent enrollment pupil, as defined in K.S.A.

72-11a03 and amendments thereto.(3) The limitations of paragraph (f)(2)(A) shall not ap-

ply to any student employee whose official workstation is on the main campus of a state educational institution. On and after August 1, 2020, the limitations of paragraph (f)(2)(A) shall not apply during any semester for which a state educational institution suspends or substantially modifies its in-person attendance requirements.

(4) Each individual who meets the criteria for being a “student,” as specified in this subsection, at the time of application for coverage under the student health insur-ance program shall remain eligible for coverage through-out the coverage period.

(g) “Student employee” means a student who meets one of the following conditions:

(1) Is appointed for the current semester to a gradu-ate assistant, graduate teaching assistant, or graduate research assistant position that is at least a 50 percent ap-pointment; or

(2) holds concurrent appointments to more than one graduate assistant, graduate teaching assistant, or grad-uate research assistant position that total at least a 50 per-cent appointment.

(h) “Student health insurance program” means the health and accident insurance coverage or health care services of a health maintenance organization for which the state board has contracted pursuant to K.S.A. 75-4101, and amendments thereto. (f) “Loteria” is a two part symbol match game. The first part consists of a grid with 16 “LOTERIA” play symbols covered with translucent material and the second part consists of a “CALLER CARDS” with 14 play symbols. The player will remove the scratch-off material to re-veal 14 “CALLER CARDS” symbols. For each “CALLER CARDS” symbol, the player will find the corresponding grid symbol and scratch only that square. If the player uncovers four contiguous play symbols in a straight hor-izontal line in the grid, or four contiguous play symbols in a straight vertical line in the grid, the player wins the prize amount shown for that line.

Article 19.—SPECIFIC PLAYER LOYALTY CLUB RULES

111-19-87. K-State Football Gameday Experience drawing. (a) The Kansas lottery may conduct a draw-ing entitled “K-State Football Gameday Experience” in which 20 Kansas lottery players will win tickets and a parking pass for the Kansas State University football game at Bill Snyder Stadium in Manhattan, Kansas on October 3, 2020 or November 7, 2020. The Kansas lottery will accept entries into the drawing beginning at 12:01 a.m. on July 1, 2020. Entry deadline for the drawing will be at 11:59 p.m. on August 23, 2020. The drawing will be conducted sometime after entry into the drawing has closed but before noon on August 27, 2020, at which time the winners will be announced.

(b) Only registered Kansas Lottery PlayOn (“PlayOn”) members may enter the drawing. PlayOn members must enter themselves into the drawing according to the terms and conditions of PlayOn. Entries shall not be accepted that are submitted by any method other than through PlayOn.

(c) A total of 334 player loyalty club points are required for a PlayOn member to enter once in the drawing. A player may enter the drawing as many times as his or her points allow, but may win only one prize package in this promotion.

(d) The procedures set forth in K.A.R. 111-18-5 for se-lecting winners and alternate winners shall be followed. The Kansas lottery shall award the first 10 players select-ed suite tickets for two people and a parking pass to the Saturday, October 3, 2020 Kansas State University foot-ball game. The next 10 players selected will receive suite tickets for two people and a parking pass to the Saturday, November 7, 2020 Kansas State University football game. Each winner and guest will also receive a game program and food and non-alcoholic beverages while in the suite. State and federal mandatory income withholding taxes on the prize will be paid by the Kansas lottery. Each prize package is valued at approximately $2,347.00.

(e) The procedures set forth in K.A.R. 111-18-5 for con-tacting winners and the claiming of prizes shall be fol-lowed, except as follows: in this promotion the 10-day deadline for the winners to return their claim forms shall be 10 business days and commence with the date of the announcement of the winners. The Kansas lottery is not responsible for electronic malfunction or player error.

(f) In the event any prize awarded for this drawing is postponed, changed, or canceled in whole or in part, no cash prize substitutions or other compensation shall be provided.
