It is unnecessary to refer to the numerous cases in the English books on this subject; the doctrine as laid
down in the case of Page 41 U. S. 4! Carter v. Murcotis uni"ersally recogni#ed as the settled law on
the subject$ and is fully ado%ted and sanctioned by the courts of this country. &umerous cases of this
descri%tion ha"e come before the courts in the State of &ew 'ork$ and the %rinci%les and rules as laid
down in the case of Carter v. Murcotfully recogni#ed and ado%ted. In the case of James v. Gould,!
(ow. )*!$ the court in referring to that case$ %lace the decision u%on it$ and say$ +this is theacknowledged law of ,reat -ritain and of this state$+ and cases are referred to showing such to be the
settled law.
