CHAPTER CONSTITUTION AND BY-LAWS We, the members of the Junior Philippine Institute of Accountants-Leon Guinto Memorial College, Inc. Chapter, realizing the need for an organization to serve as a medium of expression and aspiration, to promote and protect the welfare and interests of accountancy students in our local chapter, to nurture a dynamic and a responsible local chapter and to strengthen the common tie that binds us together with other accountancy students across the country, do hereby obtain and promulgate this Constitution and By-Laws. CONSTITUTION AND BY-LAWS

We, the members of the Junior Philippine Institute of Accountants-Leon Guinto Memorial

College, Inc. Chapter, realizing the need for an organization to serve as a medium of expression

and aspiration, to promote and protect the welfare and interests of accountancy students in our

local chapter, to nurture a dynamic and a responsible local chapter and to strengthen the common

tie that binds us together with other accountancy students across the country, do hereby obtain and

promulgate this Constitution and By-Laws.

Section 1. This organization shall be known to as the Junior Philippine Institute of

Accountants-Leon Guinto Memorial College, Inc. Chapter (JPIA-LGMC Chapter),

a local administrative body of National Federation of Junior Philippine Institute of

Accountants (NFJPIA).

Section 2. This local chapter is created through the recognition of NFJPIA and the creation of

this Constitution and By-Laws is a vested power of the local chapter given by

Section 2 of Article XIV of the NFJPIA Constitution and By-Laws.

Section 1. JPIA-LGMC Chapter is a local administrative body of NFJPIA, the national

organization of accountancy students.

Section 2. JPIA-LGMC Chapter is a democratic, non-partisan, non-political, and non-profit

student organization of accountancy students in Leon Guinto Memorial College,

Inc.

Section 3. JPIA-LGMC Chapter is the only legitimate organization-counterpart of NFJPIA in

Leon Guinto Memorial College, Inc.

Section 4. LGMC Chapter shall mean Junior Philippine Institute of Accountants-Leon Guinto

Memorial College, Inc. Chapter.

Section 5. Academic year shall mean one school year and shall end on July 31 of each Fiscal

Year.

Section 6. Chapter Assembly of the local chapter shall mean the JPIA-LGMC Chapter

meetings of the officers and members.

Section 7. OIC shall mean Officer-in-Charge.

Section 8. STANCOM shall mean Standing Committees.

Section 9. LGMCians shall mean members of the JPIA-LGMC Chapter outside the school

premises.

Section 10. JPIANs shall mean members of the JPIA-LGMC Chapter inside the school

premises

Section 11. Chapter representative shall mean the elected Representative of the local chapter

and/or the President of JPIA-LGMC Chapter or other duly authorized substitute or

proxy.

Section 12. Major position in the organization shall mean any Executive Office whether

elective or appointive position.

Section 13. Majority shall mean more than 50% of the present members in the assembly.

Section 14. Quorum shall mean 2/3 of the members of the Executive Board.

Section 15. A major activity of the JPIA-LGMC Chapter shall mean Chapter program

developed for the welfare of BSAccountancy students in LGMC.

Section 17. Executive Board shall mean the officers of JPIA-LGMC Chapter

The JPIA-LGMC Chapter aims for:

Section 1. Fellowship and solidarity – to be part of NFJPIA established unity and harmonious

relationship among other NFJPIAns and other students and multi-sectorial

organization for the advancement of a nationalist-oriented student organization.

Section 2. Academic excellence – to adopt measures developed by NFJPIA and develop own

programs necessary to foster educational advancement of the accountancy program

being offered in LGMC through:

a. Seminars, symposia, workshops, conferences, congress and convention.

b. Inter-scholastic participation, and

c. Other academic services to the members.

Section 3. Socio-civic and cultural consciousness among LGMCians through social,

economic and cultural development projects.

Section 4. Moral-integrity – to promote and uphold moral values beneficial to the interest of

the accounting profession, Federation, the Local Chapter, and its members.

Section 5. Critical, analytical and constructive thinking- to uplift to the higher standard and

quality of education.

Section 6. Organizational Culture- to acquaint the members with the practical environment

and activities of the accountancy program in local chapter and the federation.

Section 1. a. As provided in Paragraph (a), Section 1 of Article V of NFJPIA Constitution and

By-Laws 2008, LGMC Chapter must be a member of the Federation to be duly

recognize local administrative body of NFJPIA in LGMC.

b. JPIA-LGMC Chapter is a local chapter duly recognized by the federation and

can use the name JPIA.

Section 2. The members of the JPIA-LGMC Chapter, are mandatorily members of the

Regional Council and the Federation.

Section 3. A member must pay a membership fee set by the Executive Board, these

membership fees are: (a) LGMC Chapter Membership Fee, (b) QFJPIA

Membership Fee and (c) NFJPIA R4 Membership Fee.

Section 4. Admission

a. All members shall be bonafide Bachelor of Science in Accountancy students of

Leon Guinto Memorial College, Inc.

b. All Accountancy students in LGMC shall be deemed members of JPIA-LGMC

Chapter upon enrollment but not a duly recognized member of the organization.

c. All members have taken the Oath of Membership that will be given in the first

Chapter Assembly.

d. All members have complied with the three sets of membership payments given

herein and have been oriented of rights and responsibilities of LGMCians.

Section 5. Membership in the JPIA-LGMC Chapter shall only be classified and recognized as

Regular members or those who have fully complied with all the requirements set

forth under this article, and actively performed the objectives of the organization.

Section 6. Members of the LGMC local chapter shall be recognized member of the Federation

in accordance with the status of the LGMC chapter in the Federation thus it vary

directly.

Section 7. Term of Membership. Membership in the JPIA-LGMC Chapter is for a period of

one academic year and is renewable annually.

Section 8. Termination of membership

a. Graduation – any member who has already graduated from Bachelor of Science

in Accountancy degree ceases to become a member.

b. Violation – any member who, in one way or another, has failed to uphold the

purposes, for which this Local Chapter was established, upon the discretion of

the officers and the Dean of the College of Bachelor of Science in Accountancy

in LGMC, violator will be ceased to become a member of the local chapter.

Section 1. The regular members of the JPIA-LGMC Chapter shall individually or collectively

have the right to be informed of any project and/or activity of the local chapter and

shall have the responsibility to participate in such undertaking. Neglect of

responsibility shall authorize the executive board, to call the attention of the

member. If after such notice, the member failed to comply, it shall be subjected to

remedies and sanctions under the prerogative of the executive board, set forth in

section 5 of this article.

Section 2. The regular JPIA-LGMC Chapter members shall have the following expressed

rights:

a. The right to participate in the discussion in all chapter assemblies of the JPIA-

LGMC Chapter.

b. The right to inspect the records and financial reports of the JPIA-LGMC

Chapter within and practicable time and place

Section 3. The regular JPIA-LGMC Chapter members shall have the following expressed

duties and obligations:

a. The duty to comply with the provisions of this Constitution and By-Laws and

other rules that may be promulgated by the Executive Board or may be agreed

upon by the JPIA-LGMC Chapter and other local chapters.

b. The duty to attend meetings whether general or special;

c. The duty to pay the membership fee and such other fees that may be deemed

appropriate by the Executive Board in accordance with the Constitution;

d. The duty to pay the Coin Bank set by the Executive Board that will serve as the

life and blood of the organization.

e. The duty to defend the honor, prestige, and integrity of the JPIA-LGMC

Chapter.

f. The duty to respect the other members of the JPIA-LGMC Chapter and other

Bachelor of Science in Accountancy students across the nation.

g. The duty to support all the undertakings of the organization and participate

actively in all the activities and functions of the local chapter and the Federation

as provided in Paragraph (g), Section 3 of Article VI of NFJPIA Constitution

and By-Laws 2008.

h. The duty to deepen their understanding of the concept of the JPIA-LGMC

Chapter and the Federation.

i. The duty to promote academic excellence in the local chapter.

Section 4. By the provision of the Section 4, Article VI of NFJPIA Constitution and By-Laws

2008, LGMC Chapter accept the responsibility that the act of LGMC Chapter

representative or his proxy shall mean act of the local chapter as a whole.

Section 5. The LGMC Chapter state the fact that the act of our members discrediting the

accountancy profession, federation, and the organization shall be on his own will

and that no provisions of this Constitution and By-Laws shall be implicitly or

explicitly order him to do so.

Section 6. Violations of members;

a. Culpable Violations on any provisions of the Constitution and By-Laws.

b. Gross misconduct, dishonesty, discourtesy and disloyalty to the JPIA-LGMC

Chapter.

c. Inefficiency and incompetence in the performance of official duties.

d. Treason by means of disclosing confidential information of the competition

plans, game plans and programs needed to secure the winnings of LGMC

Chapter and its members in a competition inside or outside the academe.

Section 1. Individually and collectively filing of complaints.

a. All members of the LGMC Chapter shall have the right to file a complaint

against any member of the Federation who commit violations and shall have

the right to file a complaint against impartial treatment, incompetence and

corruption of the Executive Board or the JPIA-LGMC Chapter Officials.

b. Written complaints. All complaints should be in writing properly signed by an

identified member. Complaints received through electronic mail shall be

construed as originating from the identified owner of the e-mail address used.

c. Addressee. In case of complaint against other Federation members, an LGMC

Chapter complainant shall address the complaint to the R4 President and copy

furnished to the President of the Federation, who concurrently acts as the OIC

of the Grievance and Chapter Service Committee.

Section 2. Local Proceedings. No member shall be subjected to remedies and sanctions

without a just cause and due process.

a. The Ethics Committee of the Local Chapter shall be the committee in-charge of

determining the just cause of the complaint and performing the due process

being talked in this section.

b. The Committee Chairman shall be the presiding officer and the one who will

endorse administrative sanctions and remedies to be weigh by all of the JPIA-

LGMC Chapter Officers accordingly.

c. Determining Just Cause. The complainee shall be summoned and his side shall

be heard together with all supporting evidences that he/she may offer to the

committee. The proceeding shall be conducted in the most professional way of

debate of logic and reasoning and shall be weigh through preponderance of

evidence.

d. Due Process. Each party shall be given equal rights and treatment as members

of Local Chapter and that all sides must be heard.

e. No one shall represent the complainant and complainee except themselves and

if needed, a representative from Executive Board shall interpret the Constitution

and By-Laws for the two.

f. The Constitution and By-Laws shall not be used against itself to correct the

wrong and wrong the correct. It shall be disregarded if professional judgment

is needed if a certain Constitution and By-Laws provisions contradict the other.

g. The provisions herein are only applicable to confrontation of LGMC chapter

members against the other LGMC Chapter member, no more, no less.

Section 3. Remedies and Sanctions shall only be given by the officers of the JPIA-LGMC

Chapter with the discretion of its adviser/s and shall be bounded by the other pre-

existing standards that will be set by each committee. (Example) If the complainee

violates the standards of Committee on Finance, proceedings shall be handled by

the Ethics Committee and that the standards of Committee on Finance shall be used

as established criteria of measuring the logic and reasoning of action done and the

cause of action of the complainant.

Local Chapter Executive Board

Section 1. There shall be a chapter assembly of at least twice in an Academic Year; the time

and date of which shall be fixed by the Executive Board but it shall be done in a

semester basis: 1st is for first semester and 2nd is for second semester.

Section 2. Notice of the assembly shall be announced at least two days before such assembly

and the same shall be published in the JPIA-LGMC Chapter bulletin board.

Section 1. The Executive Board shall be the principal governing body of the local chapter.

Section 2. The general management of the JPIA-LGMC Chapter and its business transactions

shall be exercised by the Executive Board.

Section 3. The Executive Board shall hold office for one academic year or until their

successors have been duly elected.

Section 4. The Executive Board shall be composed of all the executive officers of JPIA-

LGMC Chapter.

Section 6. The Executive Board shall have the power to choose the chairpersons and co-

chairpersons of all the STANCOMs of the JPIA-LGMC Chapter as this

Constitution so provides.

Section 7. Regular meeting. The Executive Board shall hold regular meetings at least twice in

an academic year on such time, place and date as may be agreed upon.

Section 8. Special meeting. Special meeting of the Executive Board shall be called at any time

by the President or by a written request of majority of the Executive Board and shall

be held at such a place, time as may agree upon.

Section 9. Transition meeting. There shall be a transition meeting of the previous and

incumbent Executive officers after 1 day of the local chapter election, for final

accounting and turnover of records, reports and financial matters.

Section 10. Notice of the meeting. Whenever a regular or special meeting is to be held, the

President shall direct the Secretary-General to notify the members of the Executive

Board. A notice of special meeting shall state the time and place thereof and the

purpose/s for which it is called.

Section 11. Quorum. Whenever there is no quorum, no business may be transacted. A majority

of quorum shall decide in every question of matters submitted to the executive

board at any such meeting.

Section 12. Presiding Officer. The President or in his absence or incapacity, the Local Chapter

Vice President for Academics, shall preside over all meetings of the Executive

Board.

Section 13. Authority. In general. The Executive Board shall safeguard all properties, interests,

businesses and responsibility which include, but is not limited to the following:

a. To create adhoc committees, to choose the chairperson and to prescribe from

time to time their duties and authorities.

b. To study, devise and adopt policies, criteria and guidelines as maybe

necessary and convenient to carry out, effectuate and implement in the most

effective and economical manner, the purposes and objective of the local

chapter.

c. The authority to suspend or impeach any officer while sitting en banc by a

majority vote of the Executive Board; and

d. The authority to impose sanctions under each grounds and proceedings this

constitution provides.

Section 14. The Appointed Officers by virtue of being appointed shall have no voting powers

but is a deemed member of the Executive Board.

Section 1. Composition. The following shall be the Executive Officers of the Junior Philippine

Institute of Accountants-LGMC Chapter:

a. JPIA-LGMC Chapter President

b. JPIA-LGMC Chapter Vice-President for Academics

c. JPIA-LGMC Chapter Vice-President for Non-Academics

d. JPIA-LGMC Chapter Vice-President for Membership

e. JPIA-LGMC Chapter Vice- President for Finance

f. JPIA-LGMC Chapter Vice-President for Public Communication

g. JPIA-LGMC Chapter Vice-President for Audit

h. JPIA-LGMC Chapter Vice-President for Internal Affairs

i. JPIA-LGMC Chapter Vice-President for External Affairs

j. JPIA-LGMC Chapter 1st Year Representative

k. JPIA-LGMC Chapter 2nd Year Representative

l. JPIA-LGMC Chapter 3rd Year Representative

m. JPIA-LGMC Chapter Secretary General

Section 2. Term of Office. All officers shall hold office for a term of one academic year

starting from August 1 of the present year to July 31 of the following year or until

such time the successors have been duly qualified and elected.

Section 1. The JPIA-LGMC Chapter President shall be the Chief Executive Officer of the

Executive Board of the LGMC Chapter. Aside from those, which have been

assigned by the Executive Board, his authorities and duties shall include the

following:

a. To take active supervision and control over properties, interests, business

transactions and affairs of the JPIA-LGMC Chapter.

b. To preside in all meetings of the Executive Officers, Executive Board, and

chapter assembly/ies;

c. To supervise, direct and control subordinate officers in the discharge of their

duties and authorities;

d. To lead the members in carrying out the activities and objectives of the local

chapter and enforce the provisions of this Constitution and By-Laws, and all the

rules and regulations enacted in the assembly;

e. To delegate to any officers any of his authorities and duties whenever in his

judgment such as delegation is expedient and practicable.

f. To authorize expenditures necessary in carrying out the local chapter’s activities

and programs;

g. To render annual report of the local chapter’s activities for internal and external

users;

h. To act as one of the signatories in all cash disbursement from the bank account

credited to the local chapter;

i. To act as the OIC of the Ethics Committee;

j. To act as the representative of the LGMC Chapter in the Quezon Federation of

Junior Philippine Institute of Accountants (QFJPIA) and shall act with the

discretion of the JPIA-LGMC Chapter Executive Board in the QFJPIA and NFJPIA

assemblies; and

l. To perform other duties inherent to the position.

Article XII Authorities and Duties of the Executive Officers

Section 2. The JPIA-LGMC Chapter Vice-President for Academics shall have the authorities

and duties, which include the following aside from those assigned by the Executive

Board.

a. To perform and discharge the powers and duties of the President in the latter’s

absence or inability.

b. To supervise the implementation of academic project of the local chapter;

c. To act as the OIC of the Education and Research Committee;

d. To perform other duties inherent to the position.

Section 3. The JPIA-LGMC Chapter Vice-President for Non-Academics shall have the

authorities and duties, which include the following side from those, assigned by the

Executive Board;

a. To supervise and execute the complementary role curricular and extra-curricular

by integrating and coordinating cultural, spiritual, and sports activities and

incorporate these in the general activities of the local chapter whether be it inside

or outside the accountancy program and federation events.

b. To coordinate with other VP for non-academic of other local chapters and the

federation necessary for the non-academic programs of the local chapter.

c. To act as the OIC of the Culture and Sports Committee; and

d. To perform other duties inherent to the position

Section 4. The JPIA-LGMC Chapter Vice-President for Membership shall have the

authorities and duties which include the following aside from those assigned by the

Executive Board.

a. To keep a complete and up-to-date list of names of all accredited members and

their directories;

b. To register the JPIA-LGMC Chapter to the Quezon Federation of Junior

Philippine Institute of Accountants (QFJPIA) and National Federation of Junior

Philippine Institute of Accountants Region 4 (NFJPIA-R4)

d. The act as the OIC of the Membership Committee; and

e. To perform other duties inherent to the position.

Section 5. The JPIA-LGMC Chapter Vice-President for Finance shall have the authorities and

duties, which include the following aside from those assigned by the Executive

Board;

a. To authorize together with the President the use of funds and properties

b. To handle and safeguard all funds and properties

c. To keep all original documents pertaining to cash receipts and disbursements;

d. To prepare the semi-annual financial statements within 15 days from the end of

1st and 2nd semester of academic years;

e. To act as the OIC of the Finance Committee; and

f. To perform other duties inherent to the position.

Section 6. The JPIA-LGMC Chapter Vice-President for Public Communications shall have

the following authorities and duties, which include the following aside from those

assigned by the Executive Board;

a. To act as the OIC of the Public Relations and Communications Committee ;

b. To perform other duties inherent to the position

Section 7. The JPIA-LGMC Chapter Vice-President for Audit shall have the following

authorities and duties, which include the following aside from those assigned by

the Executive Board;

a. To monitor all receipts and disbursements of the local chapter every month

b. To audit the financial statements prepared by the Vice-President for Finance

semiannually within 10 days from the date of the report.

c. To render a reasonable assurance as to the fairness of the financial statements

under audit. In any case the auditor cannot attest to the fair presentation, the reasons

shall be stated in the auditor’s report

d. To perform other duties inherent to the position.

Section 8. The JPIA-LGMC Chapter Vice-President for Internal Affairs shall have the

following authorities and duties, which include the following aside from those

assigned by the Executive Board;

a. To be responsible for the proper acknowledgement of letters of appreciation

and other modes of communication which are outside of those entrusted to the

secretary.

b. To perform duties inherent to the position.

Section 9. The JPIA-LGMC Chapter Vice-President for External Affairs shall have the

following authorities and duties, which include the following aside from those

assigned by the Executive Board;

a. To be responsible for the proper acknowledgement of letters of appreciation

and other modes of communication which are outside of those entrusted to the

secretary.

b. To perform duties inherent to the position.

Section 10. The JPIA-LGMC Chapter Secretary-General shall be appointed by the President.

He or she shall have the authorities and duties, which include the following aside

from those assigned by the executive board;

a. Keep accurate minute of all the meetings of the Executive Board;

b. Disseminate all notices required to be given by this Constitution and By-Laws

c. Be the custodian of all records, documents and papers of the local chapter and to

certify all records of the local chapter noted by the President.

d. To coordinate with the STANCOMs chairpersons for record keeping purposes;

e. Perform other duties inherent to the position.

Section 11. The JPIA-LGMC Chapter Representatives shall have the following authorities and

duties, which include the following aside from those assigned by the Executive

Board;

a. To properly informed all the members from their year levels about the different

announcements that they should be aware of.

b. To serve as the communication channel of the members from their year levels

regarding their concerns and issues concerning the organization.

c. To perform duties inherent to the position.

Section 12. The outgoing executive officers shall have the duty to efficiently turnover all

pertinent records of the local chapter within fifteen days after the Chapter Elections.

Section 1. The Local Chapter Adviser/s shall serve as the “consultant” of the JPIA-LGMC

Chapter Executive Board and shall serve as the link of the organization to the

management of the school.

Section 2. They shall serve as the official voice of the JPIA-LGMC Chapter in the PICPA.

Section 3. They shall have the right to be informed of all activities and projects of the local

chapter.

Section 4. They shall have the right to attend the meetings of the Executive Board and give

their opinions in all matters pertaining to the local chapter but the final decision

should rest on the Executive Board.

Section 5. The Local Chapter Adviser/s shall serve for one academic year.

Section 1. The following shall be the standing committees referred to as STANCOMs with

their respective Executive Officers as Liaison Officer;

a. Ethics Committee – JPIA-LGMC Chapter President

b. Education and Research Committee – JPIA-LGMC Chapter Vice-President for

Academics

Section 2. The STANCOM shall make committee suggestions and recommendations to the

Executive Board for deliberation and shall implement the latter’s final decision.

Section 3. A committee chairman shall head each STANCOM

Section 4. Authorities and duties of a committee chairman are:

a. To ensure the proper implementation of their respective activities;

b. To preside over all meetings of their respective committees;

c. To conduct elections or appoint persons as may be designated to discharge

functions of their respective committees after consultation with the Executive

Board; and

d. To report to their respective OICs for proper coordination.

Section 5. All Bachelor of Science in Accountancy Students in Leon Guinto Memorial

College, Inc. can be appointed as committee members and shall be appointed by

the Committee Chairman.

Section 6. Functions of the STANCOMs are:

a. Ethics Committee:

1. To serve as the link on the members and the objectives of the

organization and hear on impartial treatments and improper acts

committed by the members and officers.

2. To channel and address all the grievances of the local chapter directly

to the President or to the Regional Council and require them of

immediate action.

3. To respond to the specialized needs of the local chapter; and

4. To develop a Code of Ethics that will serve as the fundamental character

of a local chapter member in LGMC.

5. To perform such other functions as may be assigned by the Executive

Board.

b. Education and Research Committee

1. To organize and coordinate academic activities and projects with regards

to current events and issues on the accounting profession;

2. To develop program that will enhance the academic activities of the local

chapter members.

3. To perform such other functions as may be assigned by the Executive

Board

c. Culture and Sports;

1. To plan and coordinate activities for the development of social, physical

and cultural awareness of the members; and

2. To perform such other functions as may be assigned by the Executive

Board

1. To keep a complete list of names and directories of the members of the

local chapter;

2. To issue notices of all regular and special meetings of the local chapter;

3. To monitor the attendance, performance and the degree of participation

of member schools in the local chapter meetings and functions; and

4. To keep the LGMC local chapter registered in the Quezon Federation of

Junior Philippine Institute of Accountants (QFJPIA) and National

Federation of Junior Philippine Institute of Accountants.

5. To perform such other functions as may be assigned by the Executive

Board.

e. Finance Committee

1. To devise effective methods of generating funds for the local chapter;

2. To devise a financial reporting standard and financial reporting control

that will be used as established criteria of the audit committee in making

opinion as to the fairness of the financial report and recommending more

appropriate financial reporting control.

3. To be responsible to the other committees regarding financial matters;

4. To be responsible for the records of the local chapter funds;

5. To be responsible for the recording of the collections and disbursement

of the local chapter; and

6. To perform such other functions as may be assigned by the Executive

Board.

f. Public Relations and Communications Committee

1. To inform the members of the activities of the local chapter, the QFJPIA

and NFJPIA together with the other activities of other local chapters;

2. To handle all publicity, advertisements and such promotions of an activity

and/or functions of the local chapter;

3. To print hand-outs, minutes of the meetings, financial report and an

annual report to be posted in the bulletin board.

5. To perform such other functions as may be assigned by the Executive

Board.

g. Audit Committee

1. To devise effective procedures on auditing financial statements

2. To attest the financial statement that will be released by the finance

committee.

3. To recommend more appropriate financial reporting control for a more

effective financial reporting.

4. To assist the Vice-President for Audit in carrying out his duties and

obligations; and;

5. To perform such other functions as may be assigned by the Executive

Board

h. Records and Documentations Committee

1. To maintain the pertinent documents of the organization including the

minutes of chapter assembly whether be it general or special.

2. To be the sole responsible of the papers that will be needed by the

organization in its chapter programs and events and;

3. To perform such other functions as may be assigned by the Executive

Board.

i. Committee on Property

1. To be in-charge of the existing organization properties and to maintain

an up-to-date record of the current status of such properties and;

2. To perform such other functions as may be assigned by the Executive

Board.

Section 7. Committees may be created by the Executive Board as may be deemed necessary,

proper and convenient for the interest of the local chapter, defining the authorities

and duties and delegating them such as may lawfully be delegated. Its duration shall

be under the direction of the Executive Board.

Section 1. Vacancies in the Executive Board by reason of incapacity, resignation,

impeachment or death shall be filled upon by appointment by the Executive Board.

Section 2. Vacancies by resignation. Any officer with valid reason or cause may resign from

office in the local chapter by a written notice submitted to the Executive Board. If

a fixed date for resignation is indicated, such shall not be effective until acted upon

by the Executive Board seven (7) days from the receipt of the officer’s notice of

resignation.

Section 3. Vacancies by impeachment.

a. Any elected officer shall be removed for a just cause and due process on any of

the following grounds:

1. Gross violation of this Constitution and By-Laws, internal rules and

regulations of the JPIA-LGMC Chapter;

2. Grave abuse of authority;

3. Immoral acts;

4. Gross negligence of duties and responsibilities;

5. Gross insubordination;

6. Guilt of acts involving moral turpitude;

7. Failure to enroll in the semester during his term; and

8. Lack of independence

b. The following procedures shall be observed for impeachment:

1. A letter of complaint should be filed by any member to the Executive

Board to the local chapter President or local chapter Adviser

2. The Executive Officers shall consider the complaint and notify the

correspondent of the schedule of appearance before the Executive Officers

3. Within seven (7) days after the appearance, the Executive Officers who

are not subject for impeachment should issue its decision

4. Within seven (7) days after the issuance of the decision, the defendant

may file his/her appeal before the Executive Board

5. The Executive Board shall calendar the appeal before its presence

immediately after the request

6. Seven (7) days after the appeal, the Executive Board sitting en banc, by

2/3 vote of its members, excluding the officer/s under impeachment, as the

case may be, shall decide on the impeachment. The decision shall be final

and not subject for appeal.

Section 4. Vacancies due to failure of elections:

a. In case of any candidate who failed to get the required number of votes in order

for him to be elected, a special election shall be called upon.

b. In case there are no candidates, a special election is deemed necessary.

Section 5. The resigned or impeached officer shall have the duty to efficiently turn over all

pertinent records of the local chapter within 15 days after the proclamation of his

replacement.

Section 6. The local chapter shall have the right to exhaust all legal and extra-legal means to

recover documents, records and financial matters against erring officer.

Section 1. The funds shall emanate from the membership fee of the JPIA-LGMC Chapter

members and inflows from all other fund raising activities not contrary to public

laws, morals and customs.

Section 2. The collection of the fund shall be imposed during the yearly renewal of

membership on or before the end of the first six months of the academic year.

Section 3. The fund shall be deposited in a bank of good repute and wherein the signatories

shall be the President and Vice President for Finance. The passbook must be under

the safekeeping of the Vice President for Finance. ATM (Automated Teller

Machine) access to the funds is strictly prohibited.

Section 4. Withdrawals shall only be allowed through the authorization and signatures of the

President and Vice President for Finance and shall be appropriated for legitimate

purposes only.

Section 5. Audited Financial reports shall be submitted:

a. by the audit committee and its counterpart finance committee that will be

approve by the local chapter president and adviser before disclosing to the

bulletin board of JPIA.

b. containing the unaudited financial statements duly signed by the Finance

Committee Chairman and two members for reporting and documentation

purposes.

c. containing the recommendation of the audit committee on the improvements of

the financial reporting if any.

Section 6. It shall be the imposed duty of the members and right of the organization to levy

tax in the form of coin bank that will serve as the fuel funding of the organization

of which it will be reasonable to the payer and shall be based on the budgeted

expenses for the academic year.

Section 1. All JPIA-LGMC Chapter members can be elected as Executive officers provided

that he/she attended the election to be conducted by the incumbent executive

officers.

Section 2. The Local Chapter President, Vice President for Finance, and Secretary General

should be coming from the higher level.

Section 3 Members present during the election have the capacity to vote.

Section 4 The aspirants in the election who garnered the highest number of votes shall be

declared winners.

Section 5 Special Elections. Special Elections shall be called upon in cases stated Article XV,

mainly failure of elections and no candidacy in a position if agreed by the majority

of the Local Chapter Executive Board.

Section 1. The Executive Board may create a special committee on Chartered Amendments

and Revisions who shall submit proposed changes on the Constitution and By-Laws

within thirty (30) days of JPIA-Local Chapter Convention.

Section 2. The committee on Chartered Amendments and Revisions shall be composed of a

Chairman, a Vice Chairman, and five (5) members appointed by the Executive

Board.

Section 3. The committee on Chartered Amendments and Revisions shall serve for one (1)

academic year.

Section 4. Proposed amendments and revisions shall be valid and shall form an integral part

of this Constitution and By-Laws and when presented and ratified by the majority

of the Executive Board present in the assembly called for such purpose.

Section 5. There shall be no amendments or revisions to this constitution within one (1) year

from its last ratification.

Section 1. This Constitution and By-Laws shall take effect fifteen (15) days from the date of

ratification and after all local chapter members have been duly notified.

This Constitution and By-Laws of the Junior Philippine Institute of Accountants – Leon Guinto

Memorial College, Inc. Chapter was ratified on October 4, 2020 during the 1st Local Chapter

Executive Board Meeting of JPIA-LGMC Chapter for the federation year 2020-2021.

Therefore, be it resolved that the above Constitution and By-Laws is ratified and shall be effective

beginning the Federation Year 2020-2021.
