Message from the EVP

Dear NOAA Member,

Welcome to summertime.

The key award judging is upon us. None of this could happen without your participation as entrants, drivers and judges.

We have representation from more companies this year than ever before. The Toledo Chapter is weighing in with more involvement and we appreciate them, not only for entering, but providing us with both judges and drivers.

Ryan and Jacqui are organizing all new details as we will begin our day at Hummingbird Apartments. We are ever grateful to Wanda and Nate for allowing their beautiful community room to become our home away from home.

It has been an eventful year for NOAA on many fronts. Special thanks to Jason DeStafanis, Carrara, for developing a thoughtful and thorough maintenance assessment tool that has been given to over 750 maintenance techs from our association, to date.

Jason is helping us set up the continuing training schedule for maintenance training. Classes will begin in late summer. He has organized many new partners to assist in the teaching of this program. Contact Ryan at the NOAA office if you would like to participate in these sessions. More details to follow.

Welcome to our new NOAA President, Dan Ross, The Landmark Companies. Many ideas are coming along with Dan for NOAA. He arranged for Mr. DJ LaVoy, REAC’s top man at HUD, to visit northern Ohio and give a compelling three hour session on upcoming changes to REAC. 80 people crowded into Carrara Cafe and were held at rapt attention to the information given. A lengthy Q&A followed. Hopefully we can bring DJ back in the fall.

Please join me in welcoming the Wood County Apartment Association into NOAA, known now as the Bowling Green Chapter of NOAA. Thanks to Chris Ostrowski and Ryan Holley for believing in us and we look forward to serving the members of the BG Chapter.

Thanks also to Chuck Schulman for his past two years as president. We are appreciative and ever grateful for all you do.

Greater Cleveland Fair Housing Seminar - Woodside Event Center

Vicki Sharp presented three Fair Housing seminars to a total of over 350 Greater Cleveland area NOAA members. A three-hour session for maintenance, a one-hour lunch-and-learn for Associate members and a three-hour session for office staff that provided three continuing education credit hours with the Ohio Division of Realestate.Bill Willis, attorney at law, presented an interactive Fair Housing seminar for the Greater Toledo area members that also provided attendees with three CEC hours.

1. Applying oil over latex paintNever use oil paints on a surface previously painted with latex. Oil-based paints tend to get brittle as they age. Latex paints are typically soft and flexible. The movement of the latex underneath can cause premature failure of the oil topcoat. Cracking is the most common.

2. Skimping on surface prepNever skimp on surface prep. Eighty-plus percent of most complaints are due to poor or lack of surface prep. Paints are made to go over clean, dry, dull and sound substrates.

3. Not using primers when neededPrimers are not always needed, but it is important to not skip this step when a primer is specified. Primers in most cases promote adhesion, or block stains, fill porous surfaces like concrete block, or resist alkali and efflorescence … and on and on.

4. Using the wrong application toolsOK, so you bought the most expensive paint, but you are going to use the dollar-special roller cover to put it on. Bad idea. Cheap covers or brushes will cause top quality finishes to not hide as well. They show tracking, fuzz, streaks and brush marks. Match high quality finishes with quality tools. Using the recommended brush and roller from the manufacturer will give you the ideal finish. You will see a difference.

5. Over applying the productOver brushing or rolling in most cases will cause poor hiding or stippling of the finish. Over applying the product can also cause severe stippling, dry time issues and even cracking of the paint film.

On April 4, 2016, the Department of Housing and Urban Development (HUD) issued new guidelines on the use of criminal records in evaluating a prospective tenant for an apartment. That action titled “Office of General Counsel Guidance on Application of Fair Housing Act Standards to the Use of Criminal Records by Providers of Housing and Real Estate-Related Transactions” can be found online at:https://www.hud.gov/sites/documents/HUD_OGCGUIDAPPFHASTANDCR.PDF

The Fair Housing Act (FHA) prohibits discrimination in the sale, rental, or financing of dwellings and in other housing-related activities on the basis of race, color, religion, sex, disability, familial status or national origin. It is not in and of itself illegal under the FHA to reject leasing applicants who have criminal records, but a blanket rejection of applicants based on criminal history may constitute a violation of the FHA if, without any justification, persons of any one race, color or national origin are rejected more frequently as a result of such policies. In other words, a policy that has a “discriminatory effect” may violate the FHA, even if it was unintentional. Intentional conduct, like treating applicants with similar or comparable criminal histories differently because of their race, color, national origin or other protected characteristics, also remains a violation of the FHA. For example, rejecting an African-American applicant having a criminal record while approving a white applicant having a comparable criminal record is what is referred to as “intentional discrimination” discrimination. “Disparate treatment” discrimination results when a policy that appears to be neutral on its face, (like not renting to convicted felons), has a disproportionate impact on members of a protected class as applied. Intentional and disparate treatment discrimination are both prohibited by the FHA.

So what is new and what is not? The legal principles on which the guidelines are based are not new and have been in place for many years. However, the update to the guidelines suggests a renewed

focus on this issue and the possibility of increased enforcement actions. Somewhere between 70 and 100 million U.S. adults, roughly one-third of the population, have some sort of criminal record. African-Americans and Hispanics are arrested, convicted, and incarcerated at higher rates than other population groups. Due to these facts, HUD has found that refusals to lease apartments based on a criminal records constitutes a barrier that has a disproportionate impact on minorities.

In light of the well-documented inequities in the criminal justice system for persons of color, a policy that automatically rejects all housing applicants based on criminal history poses a real risk of creating an unintentional discriminatory effect. A landlord can violate the FHA if their seemingly neutral policies or practices have a discriminatory effect, even if the landlord did not actually have an intent to discriminate. The one exception is that landlords may continue to automatically reject leasing applicants who have been convicted of the manufacture or distribution (but not simply possession) of illegal drugs, as this conduct is specifically excepted from the FHA discrimination statutes.

So what is a landlord to do in this environment? As an initial matter, blanket policies that automatically reject prospective tenants with a felony conviction (other than drug offenses as discussed above) should be avoided. Instead, those policies should be replaced with a policy that reviews individual criminal histories on a case-by-case basis. Landlords should provide an applicant a chance to explain any offense and consider those explanations as part of their determination, including taking into account how long ago the conviction occurred, what it was for, and any evidence of rehabilitation. A landlord must also remain mindful to avoid treating individuals with the same or similar criminal background differently based on sex, race, color or national origin, even if they had no discriminatory intent. As the process can be time-consuming, you may want to wait to the end of the application process to evaluate an applicant’s criminal history.

Lastly, when running background checks on applicants, a landlord must also comply with the Fair Credit Reporting Act (FRCA). The FCRA generally requires a person obtaining background information to: have a legitimate purpose to seek that information, only use that information in furtherance of that legitimate purpose, and requires consent and notice from the person whose background is being checked. Leasing is specifically recognized as a legitimate purpose for performing background checks under the FCRA, but rental applications should contain

provisions notifying applicants that you intend run a background check as part of the application process, and that the applicant expressly consents to your authority to do so.

Industry Work: I worked my way up over 24 years as a Leasing Representative, Assistant General Manager to General Manager.

Education: Bachelors degree in Education (Infants to 8th Grade) from University of Dayton Experience: Zero. I Was asked to "Help". I started by computerizing suite & resident information, met with all the residents, learned leasing (by going to NOAA seminars), learned maintenance by doing it with them, started a preventative maintenance inspection program, a recycle program, learned the business end (loans, insurance, etc.). I learned how to run a successful business! I believe I have made my dad and grandfather proud! About 200 West: I am the 3rd Generation in my family to run the business. 200 West was built from 1969-1971, 10 story, 176 suite building with indoor swimming pool, gas grills, party room, game room. The laundry room & fitness room was added in the 90's. My Dad & Grandfather taught me to always put back into the business. I was always a big fan of preventative maintenance. Every year we look for a project to do or an area to upgrade. You will not find anything original from the 70's in any of the common areas, amenities or suites! Last year the outdoor deck/grill area was replaced, this year...Our party room will get an upgrade! We are starting to plan for our 50 anniversary in 2021!

Favorite NOAA Event: The educational seminars! (Fair housing) I always learn something new! Personal: I enjoy sewing, photography, painting, bird watching, boating, fishing, traveling, spending time with my husband, children, family & friends.

I celebrated my 25th wedding anniversary with my high school sweet heart last year. My son, Andrew, is graduating from Eckerd College in Marine Biology. My Daughter, Carlie, is studying Exercise Science at Bowling Green and my 95 year old Grandmother lives with us.

We hosted a student from Kosovo for a full school year, then went to Kosovo for 10 days to meet his family.

We are a pet friendly family but last year we lost our dog after 13 years & bunny after 10 years. We are still caring for our children's birds & lizard while they are away at college.

Other Memberships: I Served on and was the President of the Fairview Park Chamber of Commerce or 2 years. I am also a Girl Scout Troop Leader and donate time for the Fairview Park Hunger Center.
