Konkani Drama and Khel Tiatr Writer

Shri Minino Mario Araujo, our pensioner

from Panaji ZSC, devoted his spare time for

scripting 'Tiatr' in Konkani language. 'Nikal'

directed by him was selected by 'Sangeet 'Natak

Academy', New Delhi, for the 'Paschim

SambhagYuvaNatyotsova' in 1993 held at Panaji,

Goa. For his dedicated service to 'GoanTiatr' for

the last 41 years, 'TiatrAkademy of Goa' bestowed

upon him "Lifetime contribution to 'Tiatr Award-

2017'.

So far, he has scripted 19 tiatrs and

presented in'All Goa Kala Academy Tiatr

competition' in Goa. Of these 7 tiatrs were

awarded 1st Prize for script and 5 had been

awarded 2nd Prize for script, besides other prizes

at various dramatic competitions at Udupi,

Mangalore and Bangalore.

He had been recently honoured by "Late

DattaramKanekarNatya Mohotsav 2018" award

at AnaleNaibhaag,Pernem on 19th April 2018.

Shri Araujo once again made history by winning

2nd prize (Rs.20,000/-) among 18 competitors for

his play write (tiatr) 'OinniMitth (Tasteless salt)' in

the competition held by 'Goa Tiatr Academy' on

the occasion of completing 125 years of its

inception.

Shri Araujo was felicitated by our Panaji

Policy-A (for members of SBI-REMBS having residual balances of Rs. 1.00 Lakh and above) hasbeen renewed w.e.f. 1st June, 2018 with United India Insurance Co. Ltd. In this connection, e-Circularbearing no. CDO/P&HRD-PPFG/19/2018-19 dated 31st May, 2018 has been issued which is attachedwith this mail.

2. List of the members who have been enrolled under the renewed policy has been placed atPensioners' Portal. Pensioners can go through the list to verify their details. The list of members hasalso been placed at FTP://10.1.16.149/ under the directory 'Group Mediclaim Policy' in the name of"REMBS_Balance_above_Rs.1.00 lakh as on 01.06.2018" for verification of details by operatingfunctionaries.

3. REMBS members having balance less than Rs. 1.00 Lakh will continue to avail facilities up to theirresidual balances as per the provisions of REMBS. A List of such members has also been placed atPensioners' Portal in the name of "REMBS_Balance_below_Rs.1.00 Lakh as on 01.06.2018"

4. All CM-HRs are advised to extract membership data pertaining to their Zone from the abovementioned Excel File and arrange for up dation of residual balance in REMBS Portal by debiting thepaid amounts as shown in the file to match the same with TPA balance.

RENEWAL OF THE POLICY WITH EFFECT FROM 1 ST JUNE, 2018

Please refer to our e-circular No. CDO/P&HRDPPFG/ 78/201617 dated 28th December, 2015advising roll out of Policy A for the existing members of SBIREMBS under the Family Floater GroupMediclaim Policy of United India Insurance Co. Ltd. The policy is due for renewal on 1st June, 2018.

2. Looking to the claims ratio and total outgo in the Policy, it has been decided to continue with theexisting terms and conditions which are detailed as under :

i. Domiciliary Limit @ 15% of Basic Sum Insured - Domiciliary Limit will continue to beavailable @ 15% of the Basic Sum Insured across all plans.

ii. Room Rent and ICCU Rent - Room Rent and ICCU Rent will be applied acrossall plans based on categorization of the centre on existing rates as circulated vide e-Circular No.CDO/P&HRDPPFG/ 17/201718 dated 30th May, 2017.

iii. Hospitalization Expenses for common ailments / procedures It has been decided to continuewith rationalization of hospitalization expenses on some common ailments / procedures withapplicability of maximum ceiling as introduced last year vide e-Circular mentioned above.

3. The Policy will continue to be available to existing members of SBIREMBS, Their spouses anddisabled child / children, if any, whose residual balances as on 31st May, 2018 are Rs. 1.00 Lakh andabove. Members with residual balances below Rs. 1.00 Lakh will continue to avail facilities as per theprovisions of SBIREMBS.

An Excel file of eligible Policy A members has been placed at Pensioners' Portal along with afile containing list of members having residual balances below Rs. 1.00 Lakh. Additionally, these fileshave also been placed at FTP site ftp://10.1.16.149/ under the folder named 'Group Mediclaim Policy'.All Zonal functionaries are advised to extract membership data pertaining to their Zone and arrangeupdating of residual balances of members in REMBS Portal to match the same with Third PartyAdministrators (TPAs).

4. The e-Medical ID Cards under Policy A will be uploaded within one week in the TPAs Portal. Softcopies of Medical ID Cards will also be available in the Broker's (Anand Rathi Insurance BrokersLtd.) website. Hard copies of Medical ID Cards will be sent to registered addresses of the memberswithin 15 days by the concerned TPAs. However, undelivered Cards will be handed over to CMHRof concerned Zonal Office who will arrange for delivery of the same by finding out correct address ofthe member. Any delay in receiving the same by the members may be advised to concerned ZonalOffices for immediate action. However, cashless treatment would not be held up for want of MedicalID Card. In cases where Medical ID Cards have not been received by the members and there is aneed for hospitalization, Zonal Office / Pension Paying Branch will contact the TPA for immediatehospitalization.

**************************************************************************************Customer Protection – Limiting Liability of Customers in

Unauthorised Electronic Banking Transactions

Please refer to our circular DBOD.Leg.BC.86/09.07.007/2001-02 dated April 8, 2002 regardingreversal of erroneous debits arising from fraudulent or other transactions.

2. With the increased thrust on financial inclusion and customer protection and considering therecent surge in customer grievances relating to unauthorised transactions resulting in debits to theiraccounts/ cards, the criteria for determining the customer liability in these circumstances have beenreviewed. The revised directions in this regard are set out below.

Strengthening of systems and procedures

3. Broadly, the electronic banking transactions can be divided into two categories :

(i) Remote/ online payment transactions (transactions that do not require physical paymentinstruments to be presented at the point of transactions e.g. internet banking, mobilebanking, card not present (CNP) transactions), Pre-paid Payment Instruments (PPI), and

(ii) Face-to-face/ proximity payment transactions (transactions which require the physicalpayment instrument such as a card or mobile phone to be present at the point of transactione.g. ATM, POS, etc.)

4. The systems and procedures in banks must be designed to make customers feel safe aboutcarrying out electronic banking transactions. To achieve this, banks must put in place :

(i) appropriate systems and procedures to ensure safety and security of electronic bankingtransactions carried out by customers;

(ii) robust and dynamic fraud detection and prevention mechanism;

(iii) mechanism to assess the risks (for example, gaps in the bank’s existing systems) resultingfrom unauthorised transactions and measure the liabilities arising out of such events;

(iv) appropriate measures to mitigate the risks and protect themselves against the liabilitiesarising therefrom; and

(v) a system of continually and repeatedly advising customers on how to protect themselvesfrom electronic banking and payments related fraud.

Reporting of unauthorised transactions by customers to banks

5. Banks must ask their customers to mandatorily register for SMS alerts and wherever availableregister for e-mail alerts, for electronic banking transactions. The SMS alerts shall mandatorily besent to the customers, while email alerts may be sent, wherever registered. The customers must beadvised to notify their bank of any unauthorised electronic banking transaction at the earliest after theoccurrence of such transaction, and informed that the longer the time taken to notify the bank, thehigher will be the risk of loss to the bank/ customer. To facilitate this, banks must provide customerswith 24x7 access through multiple channels (at a minimum, via website, phone banking, SMS, e-mail,IVR, a dedicated toll-free helpline, reporting to home branch, etc.) for reporting unauthorisedtransactions that have taken place and/ or loss or theft of payment instrument such as card, etc.

Banks shall also enable customers to instantly respond by "Reply" to the SMS and e-mailalerts and the customers should not be required to search for a web page or an e-mail address tonotify the objection, if any. Further, a direct link for lodging the complaints, with specific option toreport unauthorised electronic transactions shall be provided by banks on home page of their website.The loss/ fraud reporting system shall also ensure that immediate response (including auto response)is sent to the customers acknowledging the complaint along with the registered complaint number.The communication systems used by banks to send alerts and receive their responses thereto mustrecord the time and date of delivery of the message and receipt of customer’s response, if any, tothem. This shall be important in determining the extent of a customer’s liability. The banks may notoffer facility of electronic transactions, other than ATM cash withdrawals, to customers who do notprovide mobile numbers to the bank. On receipt of report of an unauthorised transaction from thecustomer, banks must take immediate steps to prevent further unauthorised transactions in the account.

Limited Liability of a Customer

(a) Zero Liability of a Customer

6. A customer’s entitlement to zero liability shall arise where the unauthorised transaction occursin the following events :

(i) Contributory fraud/ negligence/ deficiency on the part of the bank (irrespective of whetheror not the transaction is reported by the customer).

(ii) Third party breach where the deficiency lies neither with the bank nor with the customer butlies elsewhere in the system, and the customer notifies the bank within three workingdays of receiving the communication from the bank regarding the unauthorised transaction.

(b) Limited Liability of a Customer

7. A customer shall be liable for the loss occurring due to unauthorised transactions in the followingcases :(i) In cases where the loss is due to negligence by a customer, such as where he has shared thepayment credentials, the customer will bear the entire loss until he reports the unauthorised transactionto the bank. Any loss occurring after the reporting of the unauthorised transaction shall be borne by thebank.(ii) In cases where the responsibility for the unauthorised electronic banking transaction lies neitherwith the bank nor with the customer, but lies elsewhere in the system and when there is a delay (offour to seven working days after receiving the communication from the bank) on the part of thecustomer in notifying the bank of such a transaction, the per transaction liability of the customer shallbe limited to the transaction value or the amount mentioned in Table 1, whichever is lower.

Further, if the delay in reporting is beyond seven working days, the customer liability shall bedetermined as per the Bank's Board approved policy. Banks shall provide the details of their policy inregard to customers' liability formulated in pursuance of these directions at the time of opening theaccounts. banks shall also display their approved policy in public domain for wider dissemination.The existing customers must also be individually informed about the Bank's policy.

8. Overall liability of the customer in third party breaches, as detailed in paragraph 6 (ii) andparagraph 7 (ii) above, where the deficiency lies neither with the bank nor with the customer but lieselsewhere in the system, is summarised in the Table 2 :

The number of working days mentioned in Table 2 shall be counted as per the working schedule of thehome branch of the customer excluding the date of receiving the communication.

Reversal Timeline for Zero Liability/ Limited Liability of customer

9. On being notified by the customer, the bank shall credit (shadow reversal) the amount involvedin the unauthorised electronic transaction to the customer’s account within 10 working days from the

date of such notification by the customer (without waiting for settlement of insurance claim, if any).Banks may also at their discretion decide to waive off any customer liability in case of unauthorisedelectronic banking transactions even in cases of customer negligence. The credit shall be value datedto be as of the date of the unauthorised transaction.

10. Further, banks shall ensure that :(i) a complaint is resolved and liability of the customer, if any, established within such time,

as may be specified in the bank’s Board approved policy, but not exceeding 90 daysfrom the date of receipt of the complaint, and the customer is compensated as perprovisions of paragraphs 6 to 9 above;

(ii) where it is unable to resolve the complaint or determine the customer liability, if any, within90 days, the compensation as prescribed in paragraphs 6 to 9 is paid to the customer;and

(iii) in case of debit card/ bank account, the customer does not suffer loss of interest, and incase of credit card, the customer does not bear any additional burden of interest.

Board Approved Policy for Customer Protection

11. Taking into account the risks arising out of unauthorised debits to customer accounts owing tocustomer negligence/ bank negligence/ banking system frauds/ third party breaches, banks need toclearly define the rights and obligations of customers in case of unauthorised transactions in specifiedscenarios. Banks shall formulate/ revise their customer relations policy, with approval of their Boards,to cover aspects of customer protection, including the mechanism of creating customer awarenesson the risks and responsibilities involved in electronic banking transactions and customer liability insuch cases of unauthorised electronic banking transactions. The policy must be transparent, non-discriminatory and should stipulate the mechanism of compensating the customers for the unauthorisedelectronic banking transactions and also prescribe the timelines for effecting such compensationkeeping in view the instructions contained in paragraph 10 above. The policy shall be displayed onthe bank’s website along with the details of grievance handling/ escalation procedure. The instructionscontained in this circular shall be incorporated in the policy.

Burden of Proof

12. The burden of proving customer liability in case of unauthorised electronic banking transactionsshall lie on the bank.

Reporting and Monitoring Requirements

13. The banks shall put in place a suitable mechanism and structure for the reporting of the customerliability cases to the Board or one of its Committees. The reporting shall, inter alia, include volume/number of cases and the aggregate value involved and distribution across various categories ofcases viz., card present transactions, card not present transactions, internet banking, mobile banking,ATM transactions, etc. The Standing Committee on Customer Service in each bank shall periodicallyreview the unauthorised electronic banking transactions reported by customers or otherwise, as alsothe action taken thereon, the functioning of the grievance redress mechanism and take appropriatemeasures to improve the systems and procedures. All such transactions shall be reviewed by thebank’s internal auditors.

1 I.14.1 Banks/ NBFCs should set up internal control systems 4to combat frauds and actively participate in fraudprevention committees/ task forces which formulatelaws to prevent frauds and take proactive fraudcontrol and enforcement measures.

2 II.7.(viii)(c) 7. Terms and conditions for issue of cards to customers : 5(viii) (c) The terms shall put the cardholder under anobligation to notify the bank immediately after becomingaware :- of the loss or theft or copying of the card or the means which enable it to be used;- of the recording on the cardholder’s account of any unauthorised transaction; and- of any error or other irregularity in the maintaining of that account by the bank.

3 II.7.(viii)(d) (viii) (d): The terms shall specify a contact point to whichsuch notification can be made. Such notification can bemade at any time of the day or night. 5

4 II.7.(x) The terms shall specify that the bank shall be responsiblefor direct losses incurred by a cardholder due to a system 6 & 7malfunction directly within the bank’s control. However, thebank shall not be held liable for any loss caused by atechnical breakdown of the payment system if thebreakdown of the system was recognizable for thecardholder by a message on the display of thedevice or otherwise known. The responsibility of the

bank for the non-execution or defective execution ofthe transaction is limited to the principal sum and theloss of interest subject to the provisions of the lawgoverning the terms.

5 II.9.(i) The bank shall ensure full security of the debit card.The security of the debit card shall be the responsibility 4, 6 & 7of the bank and the losses incurred by any party onaccount of breach of security or failure of the securitymechanism shall be borne by the bank.

6 II.9.(iv) iv) The cardholder shall bear the loss sustained up tothe time of notification to the bank of any loss, theft 6 & 7or copying of the card but only up to a certain limit(of fixed amount or a percentage of the transactionagreed upon in advance between the cardholderand the bank), except where the cardholder actedfraudulently, knowingly or with extreme negligence.

7 II.9.(v) Each bank shall provide means whereby his customers 5may at any time of the day or night notify the loss, theftor copying of their payment devices.

8 II.9.(vi) On receipt of notification of the loss, theft or copying of 5the card, the bank shall take all action open to it to stopany further use of the card.

Shri I.H. Dias, Secretary Panaji ZSC advised that the 20th AGM of Panaji ZSC took place on8th April 2018 and the report is as under :

"The 20th Annual General Meeting of ZSC, Panaji ZSC, was held at SBLC, Panaji, on 8th April2018 at 10.00 a.m. More than 200 members including Associate members and family pensionersattended the Meeting. Shri Suyash Asthana, DGM (B&O), SBI ZO, Panaji, was the Chief Guest of thefunction. The other dignitaries who attended the AGM include Shri Surendra Nayak, AGM (RBO-II)SBI ZO, Panaji, Shri Madhur Kant Chaturvedi, AGM SBLC, Panaji, Shri Ramrai Ananth Mahadik,Chief Manager, Human Resources, SBI, ZO, Shri R.K. Chhabria, Secretary, Navi Mumbai, ShriSahebrao Desai, President SBIPA, ZSC, Aurangabad, Shri C.P. Kulkarni, President, SBIPA, Pune,Shri P. A. Lopes, representing SBIPA, Mumbai Circle, Shri Rameshwar Kubal, Dy. Manager (HR)from SBI, ZO, Panaji.

Shri Suyash Asthana, Dy. General Manager (B&O), SBI ZO, Panaji, inaugurated the Bank's Meetwith its Pensioners by lighting the traditional lamp along with other dignitaries.Short prayers to theAlmighty were recited in unison, one in Sanskrit and another in English.Shri M.Y. Desai, President,SBIPA, ZSC, Panaji, extended warm welcome to Shri SuyashAnthana, other Bank's representatives,other dignitaries including special invites and all the pensioners present at the Bank's Meet. A minute'ssilence was observed to condole death of all such pensioners who expired prior to last AGM but wasreported to us this year. Shri. Anthony Azavedo, Member of the Committee, compered the proceedings.He welcomed and introduced our Chief Guest Shri Suyash Asthana to the audience.

i) In his speech, the DGM expressed happiness at the large presence of pensioners attending theMeeting. He said that our happily retired staff are a great trained, experienced and helpful resource tobring banking business to the Bank due to their valued connection and relationship with the potentialcustomers. He also referred to various medical, since enhanced, schemes brought out by the Bank,covering retired staff.Shri I.H. Dias, Secretary, conveyed gratitude and thanks to Shri. Suyash Asthana,DGM, for extending all assistance to the Pensioners as also immediately attending to the grievancesby prioritising inspite of his busy time schedule. He also thanked all the Bank functionaries for theiroperation. He thanked Shri Madhur Kant Chaturvedi, AGM of SLBC and his team for lending the venuefor our Annual Meet as also for meetings organised on other occasions and for stating arrangements.

ii) Shri. M.K. Chaturvedi, AGM of SLBC, in his speech highlighted the importance of making effortsby the retired pensioners to keep physically fit as also mentally fit by exercises and such opportunitiesare plenty provided you devote time and healthy attitude to maintain the same.

iii) At the moment of winding up of Bank's Meet with its pensioners, as a gesture of love and affection,Shri Suyash Asthana, DGM, personally handed over to each of the pensioners, a fresh rose. A beautifuland useful gift was also given to the pensioners who attended the Meeting.

After concluding the Bank's Pensioners' Meet, the proceedings of the 20th AGM commenced.The minutes of the last Annual General Meeting held on 2nd April 2017 were confirmed by the members.

As duly notified, the biennial elections for the period 2018-2020 for electing new CommitteeMembers were duly conducted by the Election Officer, Shri Rupi Sawant, who did excellent work inholding the elections in an orderly manner.(The election results have already been declared in 'Samvad' for May 2018.)

a. In the open forum, Shri R.K. Chhabria spoke on latest legal position obtaining in the matter ofCourt cases.Shri Sahebrao Desai spoke about the various benefits that the Association have obtainedfor the retired SBI staff and that efforts will continue with full support from its members.SarvashriAllenVaz, V.N. Mordekar,also raised some issues. Shri K.P.M. Rajan wanted a Resolution to be passedthat elections should be conducted on the basis of one candidate contesting for 1 post and not onecandidate contesting for all available posts. Shri K.P. M.Rajan raised a very important point at thismeeting in respect of Superannuation and Revised Medical Facilities, a welfare measure introducedby State Bank of India, vide Circular No. CDO/P&HRD-IR/107/2017-18 dated 21st March 2018. Hesaid that the word 'Superannuation' as indicated in the Circular covers "All employees of State Bank ofIndia on superannuation from the Bank or those who have taken VRS after attaining 58 years of andtheir spouses and disabled children , if any, shall be covered under the scheme". The Bank has made aprovision of 30 years contribution/deduction from salary to the pension fund to be eligible to retire withfull pension. Therefore, the term "on reaching superannuation" could also mean "on completing 30years contribution" to pension fund and eligible to draw full pension as applicable". He advised that theAssociation take up the matter with the appropriate authorities so the scheme coverage is extended to"employees who have contributed to the pension fund for 30 years or more and receiving full pension onretirement". The members unanimously agreed to this Resolution and requested the Association totake up the matter with the President and General Secretary of Mumbai Circle for effective representationat their level. Shri. Anthony Azavedo, Committee member, proposed vote of thanks. He thanked SBIfunctionaries, Shri Shivaji Shedge and team for excellent catering arrangements and the Security Stafffor helping the guests and the team. Finally, he thanked the Managing Committee Members whoworked hard to make the event successful, specially Shri Rupi Sawant, Election Officer, and the teamthat helped him. He thanked all the pensioners for making the atmosphere lively and memorable.
