Why only DOP&PW, our own people must share the blame ! The war veterans whom we had been supporting for years in their struggle for one rank one pension were the first to oppose ‘Bharat Pensioners Samaj’ demand for 100% parity/one rank one pension for civil pensioners, through electronic media as well as through representations (backed by their serving HODs) to GOI, pleading that they only are entitled to this benefit and not the Civil pensioners. The final blow was delivered in the 7th meeting of feasibility committee on 17.10.2016 when, as mentioned in Para 4 of the official minutes issued vide OM No.38/37/2016-P&PW(A) GOI, Ministry of Personnel, PG and Pensions, DOP&PW dated 31-10-2016, JCM (staff side) agreed with govt’s alternative proposal. Option 1 for revision of pension denied

The struggle continues

OPTION 1 recommended by 7th CPC for the revision of Pension/Family pension of pre 2016,denied inspite of availability of service records of over 80% of old pensioners.

The alternative given vide OM dated 12.5.2017 though to some extent will benefit a % of oldpensioners, it cannot make up the lifelong loss old pensioners will suffer due to denial of option 1.Ever since Honourable Supreme Court’s land mark judgement dated 17.12.1982 in UOI vs D SNakra, in the hide and seek game with UOI for 100% parity between present & past Civil Pensioners‘Bharat Pensioners Samaj’ had this time secured Penalty Corner but the babus in DOP&PWfoiled the final hit.

Why only DOP&PW, our own people must share the blame ! The war veterans whom we hadbeen supporting for years in their struggle for one rank one pension were the first to oppose‘Bharat Pensioners Samaj’ demand for 100% parity/one rank one pension for civil pensioners,through electronic media as well as through representations (backed by their serving HODs) toGOI, pleading that they only are entitled to this benefit and not the Civil pensioners.

Ultimately the dream for restoration of fullpension in respect of PSU absorbees who haddrawn lump-sum at the time of absorption maycome True . It is understood that file withfavourable remarks has come back from FinanceMinistry Department of Expenditure and within 10to 15 days the final order may be issued for allPSU absorbees in who's case 1/3rd pension hasbeen restored. The restoration of full pension willbe w.e.f completion of 15 years from date ofcommutation.

In W.P.(C) 3035/2016 RAM PHAL versusUNION OF INDIA & ORS of August 03, 2016, HCruled that a Subedar Major retired from scale ofRs. 6500-10500 on July 31, 2002, from CPMF isentitled for Pension of Rs. 9375 in VI PC, sincepost of Subedar Major was put in PB2 in scale ofRs. 9300-34800 with GP Rs. 4800, as reflected inSection II of Part C of Revised pay structure forcertain posts in Ministries and UT as notified inGazette of India. cont’d from p-23. Recalling the discussion in the last meeting

on 6.10.2016, Additional Secretary (Pension)requested the Staff side of the JCM for theirconsidered views in regard to the alternatemethod of fixation of notional pay in eachintervening Pay Commissions for revision ofpension as on 1.1.2016, which was suggestedby the Committee in that meeting.

4. The Staff side appreciated the concernshown by the Committee for finding a viablesolution to the issue of revision of pension of Pre-2016 pensioners. They agreed that the incrementsmethod recommended by the Pay Commissionfor fixation of notional pension for revision ofpension of pre-2016 pensioners may result inlarge scale anomalies and that the method ofnotional pay fixation in each intervening PayCommission is a much more rational andscientific method. The pay fixation method wouldbenefit almost all pre-2016 pensioners and wouldensure smoother and faster revision of pension.In fact, JCM (Staff side) had, itself, suggested thepay fixation method for revision of pension to theSeventh CPC.

5. JCM (Staff side), however, mentioned thatsince the increment method recommended by theSeventh CPC has been accepted by the Cabinetsubject to its implementation being found feasibleby the Committee, a small number of pensionerswho are likely to get higher benefit by incrementsmethod (mostly retired before 1.1.1996) may feelaggrieved if their pension is not revised by thatmethod. This may lead to litigation.

6. Sh. Tanveer Ahmad, Executive Director,Railway Board mentioned that pensioners whowere promoted just before their retirement wouldbe at a disadvantageous position on implemen-tation of the Increment Method.. Chief Controller,CPAO mentioned that when large scale anomaliesare visualized even before actual implementationof the increment method, it would not be advisableto go ahead with implementation of that method.

7. Staff side suggested that both the optionsi.e. Increments Method as well as Pay FixationMethod may be offered to the pre-2016 pensionersalong with the 2.57 Fitment Method (alreadyimplemented) and they may be asked to chooseone of these options for revision of their pensionw.e.f. 1.1.2016. This may also reduce the chances

Sub :-Implementation of Government’s decisionon the recommendations of the SeventhCentral Pay Commission – Revision ofpension of pre-2016 pensioners/familypensioners, etc.

The undersigned is directed to say that the7th Central Pay Commission (7th CPC). in itsReport, recommended two formulations forrevision of pension of pre-2016 pensioners. AResolution No.38/37/2016-P&PW (A) dated04.08.2016 was issued by this Departmentindicating the decisions taken by the Governmenton the various recommendations of the 7th CPCon pensionary matters.

2. Based on the decisions taken by theGovernment on the recommendations of the 7thCPC, orders for revision of pension of pre-2016pensioners/family pensioners in accordance withsecond Formulation were issued vide thisDepartment’s OM No. 38/37/2016-P&PW (A) (ii)dated 04.08.2016. It was provided in this OM. thatthe revised pension/family pension w.e.t. 1.1.2016of pre-2016 pensioners/family pensioners shallbe determined by multiplying the pension/familypension as had been fixed at the time ofimplementation of the recommendations of the6th CPC, by 2.57.

3. In accordance with the decision mentionedin this Department’s Resolution No. 38/37/2016-P&PW (A) dated 04.08.2016 and OM No. 38/37/2016-P&PW(A) (ii) dated 04.08.2016, thefeasibility of the first option recommended by 7thCPC has been examined by a Committee headed

by Secretary, Department of Pension Pensioners’Welfare.

4. The aforesaid Committee has submittedits Report and the recommendations made bythe Committee have been considered by theGovernment. Accordingly, it has been decidedthat the revised pension/family pension w.e.f01.01.2016 in respect of all Central civilpensioners/family pensioners, including CAPF’s,who retired/died prior to 01.01.2016, may berevised by notionally fixing their pay in the paymatrix recommended by the 7th CPC in the levelcorresponding to the pay in the pay scale/pay bandand grade pay at which they retired/died. This willbe done by notional pay fixation under eachintervening Pay Commission based on theFormula for revision of pay. While fixing pay onnotional basis, the pay fixation formulae approvedby the Government and other relevant instructionson the subject in force at the relevant time shallbe strictly followed. 50% of the notional pay as on01.01.2016 shall be the revised pension and 30%of this notional pay shall be the revised familypension wef. 1.1.2016 as per the first Permutation.In the case of family pensioners who were entitledto family pension at enhanced rate, the revisedfamily pension shall be 50% of the notional payas on 01.01.2016 and shall be payable till theperiod up to which family pension at enhancedrate is admissible as per rules. The amount ofrevised pension/family pension so arrived at shallbe rounded off to next higher rupee.

5. It has also been decided that higher of thetwo Formulations i.e the pension/family pensionalready revised in accordance with thisDepartment’s OM No. 38/37/2016-P&PW(A) (ii)dated 04.08.2016 or the revised pension/familypension as worked out in accordance with para 4above, shall be granted to pre-2016 central civilpensioners as revised pension/family pensionw.e.f. 01.01.2016. In cases where pension/familypension being paid w.e.f. 1.1.2016 in accordancewith this Department’s OM No. 38/37/2016-P&PW(A) (ii) dated 04.08.2016 happens to bemore than pension/family pension as worked outin accordance with para 4 above, the pension/family pension already being paid shall be treatedas revised pension/family pension w.e.f. 1.1.2016.

Instructions were issued vide thisDepartment’s OM No. 45/86/97-P&PW(A) (iii)dated 10.02.1998 for revision of pension/familypension in respect of Government servants whoretired or died before 01.01.1986, by notionalfixation of their pay in the scale of pay introducedwith effect from 01.01.1986. The notional pay soworked out as on 01.01.1986 was treated asaverage emoluments/last pay for the purpose ofcalculation of notional pension/family pension ason 01.01.1986. The notional pension/familypension so arrived at was further revised with effectfrom 01.01.1996 and was paid in accordance withthe instructions issued for revision of pension/family pension of pre-1996 pensioners/familypensioners in implementation of therecommendations of the 5th Central PayCommission.

7. Accordingly, for the purpose of calculationof notional pay w.e.f. 1.1.2016 of thoseGovernment servants who retired or died before01.01.1986, the pay scale and the notional pay ason 1.1.1986, as arrived at in terms of theinstructions issued vide this Department’s OM 45/86/97~P&PW(A) dated 10.02.1998, will be treatedas the pay scale and the pay of the concernedGovernment servant as on 1.1.1986. in the caseof those Government servants who retired or diedon or after 01.01.1986 but before 1.1.2016 theactual pay and the pay scale from which they retiredor died would be taken into consideration for thepurpose of calculation of the notional pay as on1.1.2016 in accordance with para 4 above.

8. The minimum pension with effect from01.01.2016 will be Rs. 9000/- per month(excluding the element of additional pension toold pensioners). The upper ceiling on pension/family pension will be 50% and 30% respectivelyof the highest pay in the Government (The highestpay in the Government is Rs. 2,50,000 with effectfrom 01.01.2016).

9. The pension/family pension as worked outin accordance with provisions of Para 4 and 5above shall be treated as ‘Basic Pension’ witheffect from 01.01.2016. The revised pension/family pension includes dearness reliefsanctioned from 1.1.2016 and shall qualify forgrant of Dearness Relief sanctioned thereafter.

10. The existing instructions regardingregulation of dearness relief to employed/re-employed pensioners/family pensioners, ascontained in Department of Pension &Pensioners Welfare OM. No. 45/73/97-P&PW(G)dated 02.07.1999, as amended from time to time,shall continue to apply.

11. These orders would not be applicable forthe purpose of revision of pension of thosepensioners who were drawing compulsoryretirement pension under Rule 40 of the CCS(Pension) Rules or compassionate allowanceunder Rule 41 of the CCS (Pension) Rules. Thepensioners in these categories would continueto be entitled to revised pension in accordancewith the instructions contained in thisDepartment’s OM. No. 38/37/2016~P&PW(A)(ii)dated 4.8.2016.

12. The pension of the pensioners who aredrawing monthly pension from the Governmenton permanent absorption in public sectorundertakings /autonomous bodies will also berevised in accordance with these orders. However,separate orders will be issued for revision ofpension of those pensioners who had earlierdrawn one time lump sum terminal benefits onabsorption in public sector undertakings, etc. andare drawing one-third restored pension as perthe instructions issued by this Department fromtime to time.

13. in cases where, on permanent absorptionin public sector undertakings/autonomousbodies, the terms of absorption and/or the rulespermit grant of family pension under the CCS(Pension) Rules, 1972 or the corresponding rulesapplicable to Railway employees/members of AllIndia Services, the family pension being drawn byfamily pensioners will be updated in accordancewith these orders.

14. Since the consolidated pension will beinclusive of commuted portion of pension, if any,the commuted portion will be deducted from thesaid amount while making monthlydisbursements.

15. The quantum of age-related pension/familypension available to the old pensioners/ familypensioners shall continue to be as follows:-

The pension on his/herattaining the age of 85 years will be shown as(i).Basic Pension = Rs.10,000 and (ii) additionalpension = Rs.3,000 pm. 16. A few examples of calculation of pension/family pension in the manner prescribed aboveare given in Annexure-I to this OM.(see p-15)

17. No arrears on account of revision ofPension/Family pension on notional fixation of paywill be admissible for the period prior to 1.1.2016.The arrears on account of revision of pension/family pension in terms of these orders would beadmissible with effect from 01.01.2016. Forcalculation of arrears becoming due on therevision of pension/ family pension on the basisof this O.M., the arrears of pension and the revisedpension/family pension already paid on revisionof pension/family pension in accordance with theinstructions contained in this Department’s OMNo. 38/37/2016-P&PW(A) (ii) dated 04.08.2016shall be adjusted.

18. it shall be the responsibility of the Head ofDepartment and Pay and Accounts Office attachedto that office from which the Government servanthad retired or was working last before his deathto revise the pension/family pension of Pre-2016pensioners/family pensioners with effect from01.01.2016 in accordance with these orders andto issue a revised pension payment authority. The

Pension Sanctioning Authority would impressupon the concerned Head of Office for fixation ofpay on notional basis at the earliest and issuerevised authority at the earliest. The revisedauthority will be issued under the existing PPOnumber and would travel to the PensionDisbursing Authority through the same channelthrough which the original PPO had travelled.

19. These orders shall apply to allpensioners/family pensioners who were drawingpension/family pension before 1.1.2016 under theCentral Civil Services (Pension) Rules, 1972, andthe corresponding rules applicable to Railwaypensioners and pensioners of All India Services,including officers of the Indian Civil Service retiredfrom service on or after 1.1.1973. A pensioner/family pensioner who became entitled to pension/family pension with effect from 01.01.2016consequent on retirement/death of Governmentservant on 31.12.2015, would also be covered bythese orders. Separate orders will be issued bythe Ministry of Defence in regard to Armed Forcespensioners/family pensioners.

20 These orders do not apply to retired HighCourt and Supreme Court Judges and otherConstitutional/Statutory Authorities whosepension etc. is governed by separate rules/orders.

21 These orders issue with the concurrenceof Ministry of Finance (Department of Expenditure)vide their ID. No. 30-1/33(c)/2016-IC dated11.05.2017 and ID. No.30-1/33(c)/2016-IC dated12.05.2017.

22. In their application to the personsbelonging to the Indian Audit and AccountsDepartment, these orders issue in consultationwith the Comptroller and Auditor General of India.

23. Ministry of Agriculture etc. are requestedto bring the contents of these orders to the noticeof Heads of Department/Controller of Accounts,Pay and Accounts Officers, and Attached andSubordinate Offices under them on top prioritybasis. All Ministries/Departments are requestedto accord top priority to the work of revision ofpension of pre-2016 pensioners/familypensioners and issue the revised PensionPayment Authority in respect of all ore-2016pensioners,

No. 1-2/2016-IC.—Whereas, vide itsResolution No.1-2/2016-IC notified in the Gazetteof India, dated the 25th July, 2016, the Governmentof India accepted the recommendations of theSeventh Central Pay Commission in respect ofthe categories of employees covered in the Termsof Reference contained in its earlier ResolutionNo.1/1/2013-E.III(A) dated the 28th February, 2014.

And, whereas, the Government hasconsidered it necessary to make the followingchanges in the recommendations of the saidSeventh Central Pay Commission in respect ofthe said categories of employees, namely:—

(1) The Defence Pay Matrix, (except Military NursingService (MNS)), which has 24 stages shall beextended to 40 stages similar to the Civil PayMatrix;

(2) The Index of Rationalisation (IOR) of Level 12Aand 13 of Defence Pay Matrix shall beenhanced from 2.57 to 2.67. The Defence PayMatrix (except MNS) shall, accordingly, berevised;

(3) To rectify the factual errors appearing in Level10B and Level-12 of the pay matrix of MNSand in view of the changes in the IOR in theDefence Pay Matrix, the first stage ofcorresponding Levels of Pay Matrix of MNSshall also change. Accordingly, the Pay Matrix(MNS) shall be revised;

(4) The IOR of Level-13 of Civil Pay Matrix shallalso be enhanced from 2.57 to 2.67.Accordingly, the Civil Pay Matrix as containedin Annexure-1 mentioned in para 6 of theaforesaid Resolution dated the 25th July, 2016shall be revised. The revised Civil Pay Matrixis at Appendix-1;

(5) The provision contained in para 13 of theaforesaid Resolution dated 25th July, 2016shall be revised to the extent that the benefit ofpay protection in the form of personal pay ofofficers posted on deputation under CentralStaffing Scheme, as envisaged therein, shallbe given effect from 1st January, 2016 instead

of 25th July, 2016. Further, this benefit shallalso be extended to officers from Servicesunder Central Staffing Scheme, coming ondeputation to Central Government, on postsnot covered under Central Staffing Scheme.

(ii) The provision contained in Rule 7 of theaforesaid Rules shall be revised to the extent thatthe benefit of pay protection in the form of personalpay of officers posted on deputation under CentralStaffing Scheme, as envisaged therein, shall begiven effect from 1st January, 2016 instead of 25thJuly, 2016. Further, this benefit shall also beextended to officers from Services under CentralStaffing Scheme, coming on deputation to CentralGovernment, on posts not covered under CentralStaffing Scheme.

Therefore, it is essential for the Directoratesand all offices under their jurisdiction and NIDEM,Delhi Cantt. to immediately take necessary actionto revise the pension/ family pension of pre-2016pensioners/ family pensioners as per theprovisions of these OMs as well as any otherrelated instructions that the Government of Indiawill be issuing from time to time.

4. Let this work be taken up immediately, eitherwith existing staff, or where required by formingspecial cells and by taking staff on contract even,that all pensioners/ family pensioners are paidthe revised pensions at the earliest. Inputs maybe given to this Directorate General at monthlyintervals about the progress of this work in thevarious offices.

Based on notional pay so fixed, therevision proposal will be sent by PensionSanctioning Authority to concerned DA (P) to applynecessary checks and issue revised authorityunder the existing PPO number. To facilitatefixation of notional pay, DA (P) will provide copy ofPPO/pension papers to concerned PSAimmediately on requisition. All PSAs will maintainrecords of processing cases of retirees year-wisein Proforma 8. DA (P) will maintain data of proposalreceived and authority issued in software as hasbeen done in case of 6th CPC revision of PPOs.

4. Since there will be large number of casesfor revision, concerted efforts of all authorities willbe required to accomplish the task. It is requestedto take immediate action for revision of pension/family pension at the earliest.

The Ministries/Departments of the CentralGovernment are aware of the orders issued byDepartment of Pension and Pensioners’ Welfare(DoP&PW) contained in their OM No. 38/37/2016-P&PW(A) dated 12.5.2017 regarding revision ofpension of pre-1.1.2016 retirees.

In terms of para 4 thereof, the revised pension/family pension w.e.f. 1.1.2016 in respect of allCentral civil pensioners/family pensioners,including CAPF’s who retired/died prior to1.1.2016 may be revised by notionally fixing their

pay in the pay matrix recommended by the 7thCentral Pay Commission in the levelcorresponding to the pay in the pay scale/pay bandand grade pay at which they retired/died. The saidOM further provides that this will be done bynotional pay fixation under each intervening PayCommission based on the formula for revision ofpay. 50% of the notional pay as on 1.1.2016 shallbe the revised pension and 30% of this notionalpay shall be the revised family pension w.e.f.1.1.2016.

2.The Ministries/Departments are aware thatactual implementation of the aforesaid ordercontained in the OM dated 12.5.2017 of theDepartment of Pension and Pensioners’ Welfareinvolves a procedure for revision of pension ofsuch pensioners, which covers a number ofagencies like the Heads of Departments/Headsof Offices, under whose administrative control aparticular pensioner had worked before retirement/death, the concerned PAOs, pension accounting

organiza-tions like CPAO in case of civilpensioners and similar pension accountingorganizations pertaining to pensioners inMinistries of Railways, Defence and Departmentof Posts, etc. Therefore, a coordinated actionamongst these agencies is required to ensurethat revision of pension in such cases isprocessed expeditiously.

3.Accordingly, while the substantive matterpertaining to revision of pension of pre-1.1.2016Central Government retirees concernsDepartment of Pension and Pensioners’ Welfareas already provided in their aforesaid OM dated12.5.2017 and any further substantive orderthereon issued by them, there are certainprocedural actions which need to be taken by theconcerned administrative agencies in eachMinistry/Department as well as the pensionaccounting organisations like the Central PensionAccounting Office under the Ministry of Finance,Department of Expenditure; Controller General ofDefence Accounts under the Ministry of Defenceand similar pension accounting organisationsunder the Ministry of Railways and Department ofPosts etc so that appropriate implementation ofthe orders of Department of Pension andPensioners’ Welfare as per their OM dated12.5.2017 is carried out expeditiously.

4.In order, therefore, to put the proceduralissues in this regard in perspective and to providefor coordinated action amongst the concernedagencies, the following procedural points of actionare to be taken by the concerned agencies asbrought out below:

(A) Department of Expenditure, Ministry ofFinance

(i) The fitment tables for fixation of notionalpay will be worked out by the Department ofExpenditure and provided to Department ofPension and Pensioners’ Welfare for appropriateguidelines for the purpose of issue of any furthersubstantive order in the matter.

(B) Department of Pension & Pensioners’Welfare

(i) The appropriate guidelines/ instructions forrevision of pension based on fitment tables fornotional pay will be issued for use by the pensionrevising administrative authorities, PAOs andpension accounting organisations in the CentralGovernment.

(c) Pension Accounting Authorities

(i) The Central Pension Accounting Office incase of civil pensioners and similar pensionaccounting offices in the Ministry of Defence,Ministry of Railways, Department of Posts etc.,shall pass on the available and relevant data oflive pensioners to the concerned PAOs by31.05.2017, if such data is already available withthem. This action will be completed within twoweeks. In cases where the data is not available,the same will be obtained by the pensionaccounting offices from the disbursing banks andshall be passed on to the concerned PAOs. Thisaction will be taken up simultaneously andcompleted within four weeks.

(ii) The pension accounting offices, whilepassing on the data to the concerned PAOs, mayalso devise a suitable mechanism for electronicrevision, as far as possible, to enable PAOs toprocess the cases of pension revisionexpeditiously.

(iii) The central pension accounting offices likethe CPAO, at the time of passing on the data tothe concerned PAOs, shall send a few illustrativeexamples on pension revision in such cases tothe pension disbursing Banks to enable them toconsider suitable changes in the software, ifnecessary, for the purpose.

(D) Pay & Account Office (PAO)/Head of theDepartment.

(i) The concerned PAOs, on receiving datafrom the pension accounting organizations, shallimmediately, and not later than 3 days from thereceipt of data, pass on the data to the concernedadministration/establishment Branches/Heads ofthe Office (HOO)s under various Heads ofDepartment (HODs) of the Ministries/Departments. The HOOs will also check theirrecords to ascertain the actual numbers of retirees.

(ii) The concerned administration/establishment branches/Heads of Offices (HOO)under various Heads of Departments (HODs) ofthe Ministries/Departments shall take action torevise the pension in case of retirees who hadworked under their administrative control, basedon the orders issued by the Department ofPension and Pensioners’ Welfare dated12.5.2017 and any further order containing thefitment table providing for notional pay, after dueverification of the relevant records.

(iii) In cases where records are readily availablewith the HoD/DDO, the action to process revisionof pension shall be initiated forthwith and not laterthan 30 days from the date of receipt of the list ofpensioners by the PAOs from the CPAO. In suchcases, revised pension cases will be sent to thePAOs for further necessary action by the concernedadministrative Branches/HOOs, which normallyprocess the pension cases in case of employeesunder their administrative domain on theirretirement/death.

(iv) In cases where records are not readilyavailable, the concerned HOOs/HODs will ensureappropriate action for verification of such casesand ensure expeditious revision of pension as perthe prescribed procedure and passing on thesame to PAOs for further necessary action.

(v) On receipt of revised pension cases fromthe administrative/establishment branches, thePAOs shall take further appropriate actionexpeditiously and pass on the duly verified pensionrevision authorities to the pension accountingoffices like the CPAO, which will in turn take furtheraction to issue necessary instructions/authority tothe disbursing Banks without delay.

(vi) Once the revised pension authority isreceived by the Banks, they will ensure timelypayment of revised pension and arrears, if any, tothe accounts of pensioners.

5. In order to ensure effective monitoring of theprogress of pension revision based on theprocedure outlined above, a monitoringmechanism will also be followed as brought outbelow:

(i) DOP&PW will periodically monitor theMinistry-wise progress of pension revision. For thispurpose, Ministry-wise details would be madeavailable by the respective pension accountingorganisations, viz, CPAO, CGDA, etc, to theDepartment of P&PW.

(ii) The progress of pension revision at the HOD/HOO level will be monitored by the concerned Jt S(Admn) of the Ministry/Department on a weeklybasis. This will be included as one agenda in theSenior Officers Meetings in each Ministry/Department.

(iii) CPAO and similar pension accountingorganisations shall place online a dashboard ofthe progress of revision of pension cases withPAOs, CCAs, nodal authorities of Ministries/Departments and Department of Pension andPensioners’ Welfare.

(iv) In order to ensure timely action on the partof Chief Controller of Accounts/Controller ofAccounts/PAOs and Pension AccountingOrganisations, a weekly progress meeting shallbe held at the level of Chief Controller of Pensionand this shall be monitored on monthly basis byController General of Accounts, CGDA and similarlevels in the Ministry of Railways, Department ofPosts, etc.

1. Reference is invited to DP&PW OM No.38/37/2016-P&PW(A) dated 12-05-2017 regardingrevision of pension of Pre-2016 retirees under 7thCPC. As per Para 4 of this OM, it has been decidedthat the revised pension/family pension w.e.f.01.01.2016 in respect of all Central CivilPensioners/Family Pensioners, including CAPF’swho retired/died prior to 01.01.2016, may be revisedby notionally fixing their pay in the pay matrixrecommended by the 7th CPC in the levelcorresponding to the pay in the pay scale/pay bandand grade pay at which they retired/died. This willbe done by notional pay fixation under eachintervening Pay Commission based on theFormula for revision of pay. While fixing pay onnotional basis, the pay fixation formulae approvedby the Government and other relevant instructionson the subject in force at the relevant time shall bestrictly followed. 50% of the notional pay as on01.01.2016 shall be the revised pension and 30%of this notional pay shall be the revised familypension w.e.f. 1.1.2016 as per the first Formulation.In the case of family pensioners who were entitledto family pension at enhanced rate, the revisedfamily pension shall be 50% of the notional pay ason 01.01.2016 and shall be payable till the periodup to which family pension at enhanced rate isadmissible as per rules.

2. As per Para 18 of this OM, the PensionSanctioning Authority would impress upon theconcerned Head of Office [HOO) for fixation of payon notional basis and issue revised authority atthe earliest. The revised authority will be issuedunder the existing PPO number and would travel tothe Pension Disbursing Authority through the samechannel through which the original PPO hadtravelled.

3. Reference is also invited to Ministry ofFinance (Deptt. of Expenditure) OM No.1(13)/EV /2017 dated 23-May,2017 mentioning proceduralpoints of action to be taken by concerned agenciesincluding Pension Accounting Authorities & PAOs.

4. To facilitate early revision of pension andmonitoring timely progress in this regard asrequired by aforesaid OM, course of actions arebrought out below:

i.) List of all the live cases available in CPAO

along with details of last pay [wherever available]due for pension revision under 7th CPC will beprovided to the Pay and Account 0fficers (PAOs) intheir logins under CPAO website www.cpao. nic.inby 31st May, 2017 to provide the details toconcerned Head of Offices within 3 days andcoordinate with them for getting the revised pensioncases at the earliest. PAOs/HOOs may also checktheir records to verify actual number ofcases.

ii.) In the meanwhile, since all the servicerecords/details of the pensioners are available withthe respective HOOs from where they retired/died,HOOs are required to check their records and startrevising the pension in terms of Para 4 of the aforementioned OM of the DP&PW forth-with. Pr. CCAs/CCAs /CAs/AGs/Administrators of UTs may monitornumber of such cases received at PAOs andsubmit a report to CPAO by 31st May,2017.

iii.) For the expeditious revisions of thesepension cases, CPAO has developed an e-revisionutility which has facility of sending online revisionauthorities from PAOs to CPAO under the digitalsignatures of PAOs. PAOs are required to revisepension cases through e-revision utility. Sinceunder this utility, revision authorities would be sentunder the digital signatures, pension processingPAOs are urgently required to arrange digitalsignatures and their registration on PFMs, if notdone so far. In unavoidable circumstances to avoiddelay, PAOs may process the pension casesmanually as hitherto and send the paper basedrevision authorities to CPAO in the format given atAnnexure.(for annexure visit our website)

iv.) The list as mentioned at (i) above will alsobe provided under the logins/dashboard of chiefcontroller of accounts and joint secretary (Admn)/Admn in charge of the Ministries/Departments onCPAO website. Joint Secretary (Admn)/Admn incharge may also distribute the list of pension casesto the HOOs falling under their administrativecontrol and monitor the progress of Pensionrevisions at HOOs level. similarly, Pr.CCAs/CCAs/CAs/AGs/Administrators of UTs may keep a watchon the progress of the revision of cases receivedfrom HOOs to PAOs.

v.) To facilitate effective monitoring of progressof revision at each level i.e. CCA/JS(Admn)/PAO,

relevant progress reports would be available onCPAO website under logins/dashboards ofrespective authorities. On the basis of thesereports, periodical review meetings may be held atthe Ministry/Deptt./Organization level.

vi.) In those cases, where 2.57 multiplicationmethod of pension fixation is beneficial underDP&PW OM No.38/37/2016-P&PW (A) (ii) dated 4/08/2016, revised pension authority under 2.57multiplication methods will also require to beissued by HOOs/PAOs for updation of records atCPAO & Banks as well as for information ofpensioners by CPAO. However, HOOs/PAOs whilerevising the pension may prioritize the cases whichare beneficial to the pensioners under pay fixationmethod. To cover large number of cases, in lesstime Pr.CCAs/CCAs/CAs/AGs/Administrators ofUTs & JS(Admn) of Ministries/Deptts./Organizationmay identify the cases where revisions may beeffected easily without involving multiple stepse.g.revisions of pension of those pensioners whoretired/died during the period from 1.1.2006 to31.12.2015 and whose pension is already fixedunder 6th CPC.

vii.) Pr.CCAs/CCAs/CAs/AGs/Administrators ofUTs may nominate a Nodal Person/Key ResourcePerson (KRP) to coordinate with CPAO regardingany issues related with pension revisions and useof e-Revision utility. In case of any difficulty in theuse of e-Revision utility Sh.Davinder Kumar,Technical Director, NIC, CPAO may be contactedon Telephone No.011-26715338 and [email protected]. If required, officials ofMinistries/Departments/PAOs may also visit CPAOon every Wednesday to resolve their issues relatedwith pension revisions.

In view of the above, Pr.CCAs/CCAs/CAs/AGs/Administrators of UTs are requested to follow theabove guidelines and issue necessaryinstructions to their PAOs for early revision of Pre-2016 pension cases under 7th CPC. They arefurther requested to Coordinate with theirJS(Admn)/Admn in charge/HODs for timelysubmission of revised pension cases by the HOOsto PAOs and monitor the progress in this regard.

Sub: Grant of Disability Element to ArmedForces Personnel who were retained inservice despite disability attributable toor aggravated by Military Service andsubsequently proceeded on premature/voluntary retirement prior to 01.01.2006.

The undersigned is directed to refer to thisMinistry's letter No. 16(5)/2008/ D(Pen/Policy)dated 29th September 2009 wherein disabilityelement/ war injury element have been allowedto such Armed Forces Personnel who wereretained in service despite disability and retired/discharged voluntary or otherwise in addition toretiring/ service pension or retiring/ service gratuity,subject to condition that their disability wasaccepted as attributable to or aggravated by militaryservice and had foregone lump sumcompensation in lieu of that disability.

2. In terms of Para- 3 of the above referredletter the provisions stated above are applicableto the Armed Forces Personnel who were retired/discharged from service on or after 01.01.2006.Armed Force Tribunal (Principal Branch) NewDelhi in CA No. 336 of 2011 vide their order dated07.02.2012 have struck down Para-3 of thisMinistry's above letter.

3. The issue of extension of above benefit tothe Pre-2006 retired/ discharged Armed ForcesPersonnel, who were retained in service despitedisability attributable to or aggravated by militaryservice, was under active consideration ofGovernment. Pension.

Guidelines on “Restoration of CommutedPortion of Pension after 15 years of retirement”and “Payment of Additional Quantum of Pension/Family pension to Pensioners /Family Pensionersof 80 years of age and above” has already beenissued vide this office Circular No. 165 dt.22.02.2013 are reiterated as under:

1. Restoration of Commuted Portion of

Pension after 15 years of retirement:-

(i) Where the commutation of pension is/wassimultaneous with the retirement, the commutedportion of pension shall be restored after expiry of15 years with effect from the date of retirement, ifpayment of commuted value of pension is madeduring the first month of retirement leading toappropriate reduction on account of commutationin first pension itself.

(ii) Where commutation of pension is appliedand notified after the date of commencement ofpension and commuted portion leads to areduction in pension in second or subsequentmonth, the 15 year period for restoration ofcommuted portion will be reckoned from the dateof payment of commuted value i.e. from the dateon which reduction in pension on account ofcommutation become effective.

(iii) Further, where the commuted value is paidin more than one stages, the reduction in amountof pension in such cases shall be made from therespective dates of payment and commutedportion of pension of such pensioners will alsobe restored in stages by pension disbursingauthorities on completion of 15 years from thedate of reduction in pension.

4. Implementation of these orders is expectedto be arduous and challenging. Documents likeMedical Board proceedings, retention of thepersonnel in service despite disability, option ofindividual foregoing lump sum compensation andnon-payment of lump sum compensation wouldbe required in all cases which may not be availableat the end of Pay Accounting Authorities/ Recordoffices and Pension sanctioning authoritiesreadily. In such cases, pensioners/ familypensioners may be asked to produce the copiesof relevant documents to the Executive authoritiesin support of their claims.

5. The claim for grant of disability element/war injury element in affected cases will besubmitted to the PSA concerned by PCDA(O)Pune/ NPO/ AFCAO/ Record office along-with copyof medical board/ fresh medical boardproceedings showing extent of disabilityapplicable as on date of effect of this letter inrespect of Commissioned officers/ JCOs/ ORs. Itwill be responsibility of PCDA(O) Pune/ NPO/AFCAO and Record office to confirm payment/non-payment of lump sum-compensation in lieuof disability element to Commissioned officersand JCOs/ ORs. A sanction showing extent ofdisability and its attributability/ aggravation due toMilitary service in terms of MOD letter No. 4684/DIR(PEN)/ 2001 dated 14.08.2001 would beissued by the Service HQrs in case ofCommissioned Officers and sanction would beissued by OI/C Record office in case of JCOs/ORs.

6. The corrigendum PPOs granting disabilityelement/ war injury element in all affected caseswill be issued by respective Pension SanctioningAuthorities.

7. The provisions of this letter shall take effectfrom 01.01.2006.

8. Pension Regulation of all the three serviceswill be amended in due course.

9. This Issues with the concurrence of FinanceDivision of this Ministry their vide letter I.D.No.10(3)2012/FlN/PEN dated 19th May 2017.

2. Payment of Additional quantum of pension/

family pension to pensioners/family pensioners

of 80 years of age and above:

(i) The procedure for payment of additionalquantum of pension/ family pension to oldpensioner/family pensioner has been providedin this office circulars No.57 dt. 27.9.2008, 68 dt.28.7.2009, 72 dt. 24.9.2009, 75 dt. 25.11.2009,83 dt. 12.10.2011, 397 dt.18.11.2008, 417 dt.02.09.2009, 441 dt. 01.10.2010 and 470dt.27.9.2011.

According to these, the additional quantum ofpension/family pension on attaining the age of 80years and above would be admissible at the belowmentioned rates :-Age of pensioner/familypensionerFrom 80 years to lessthan 85 yearsFrom 85 years to lessthan 90 yearsFrom 90 years to lessthan 95 yearsFrom 95 years to lessthan 100 years100 years or more

(ii) In cases where exact date of birth ofpensioner/family pensioner is available in thePPO, the additional quantum of pension/familypension on attaining the age of 80 years and above,would be payable at the above mentioned ratesfrom the first day of the month in which his/herdate of birth falls.

(iii) However, in case the exact date of birth isnot available either in the PPO or in the officerecords, but an indication regarding the age ofpensioner/family pensioner is available, theadditional quantum of pension/family pensionshall be paid from the 1st January of the yearfollowing the year in which the pensioner / familypensioner has completed the age of 80 years andabove, based on the PPO/Office records. For

example if the records show that the pensioner/family pensioner has already completed the ageof 80 years/ 85 years as on 1st January 2008, he/she shall be allowed additional quantum ofpension/family pension from 1st January 2008.No corrigendum PPO is required to be issued insuch cases.

(iv) In case neither the exact date of birth northe age is available either in the PPO or in theoffice records, the PDA will request the pensionerfamily pensioner to submit four copies of any ofthe following documents duly attested by aGazetted officer/MLA to the PDA.

(a) PAN Card

(b) Matriculation Certificate (containing the information regarding date of birth)

(c) Pass Port

(d) CGHS/ECHS Card

(e) Driving license (if it contains date of birth)

(f) Election ID Card

(g) Aadhaar Number UIDAI

A. If the document submitted by the pensioner/ family pensioner contains the informationregarding exact date of birth, the additionalquantum of pension/ family pension will bepayable from the lst day of the month in which his/her date of birth falls. However, in case the exactdate of birth is not available on the documentssubmitted by the pensioner / family pensioner butan indication regarding the age of pensioner /family pensioner is available therein, theadditional quantum of pension/family pensionshall be paid from the lst January of the yearfollowing the year in which the pensioner / familypensioner has completed the age of 80 years, 85years etc. based on the documents submitted bythe pensioner / family pensioner.

B. The PDA will make the additional quantumof pension/family pension, on provisional basis,up to a period of six months from the month inwhich the proof of date of birth/age is submittedby the pensioner/family pensioner. In all suchcases, the PDA will immediately send one copyof each documents submitted by the pensioner /family pensioner to the Service HQrs / RO / HOOin r/o commissioned officers / PBOR / Defence

Civilians respectively for verification andsubmission to concerned Pension SanctioningAuthorities for formal notification of date of birth/age through corrigendum PPO.

C. The PDA Will make payment of additionalquantum of pension/family pension beyond aperiod of six months only on receipt of acorrigendum PPO notifying the date of birth/ageof pensioner / family pensioner.

D. In case, the pensioner / family pensioner isunable to submit any of the documents mentionedin para 2(iv) above, but claims additional pensionbased on some other documentary evidence,such cases will be submitted by the PDA to theAdministrative Ministry through service HQrs(forCommissioned Officers)/Record Office (forPBOR)/HOO(for Defence Civilians) as the casemay be. If Administrative Ministry is satisfied aboutthe claim of the pensioner/family pensioner thesame Will be authorized through corrigendumPPO. No. additional pension will be released bythe PDA until the corrigendum PPO is issued bythe Pension Sanctioning Authorities.

However, representations/complaints fromvarious agencies are still being received on boththe subjects stating that PDA is not restoringcommuted portion of pension even aftercompletion of 15 years or not making payment ofadditional quantum of pension/ family pension toold aged pensioners/family pensioners.Accordingly, there is a need to develop amechanism by the PDAs to restore the commutedportion of pension automatically after expiry of 15years of retirement/reduction in pension onaccount of commutation become effective or forpayment of additional pension automatically onattaining the age of 80 years or above asmentioned.

It is, therefore, requested that a mechanismmay be established to restore the commutedportion of pension automatically after expiry of 15years of retirement/reduction in pension onaccount of commutation become effective and forpayment of additional pension automatically onattaining the age of 80 years or above asmentioned above.

2. The issue has been examined and it isfound that Chapter-III of Income Tax Act-1961,which provides, vide section 10 (18) inserted bythe Finance Act-1999 wef 01.04.2000 thatincomes which do not form part of total incomefor the purpose of Income Tax includes thefollowing:-

(i) pension received by an individual who hasbeen in the service of the Central Government orState Government and has been awarded “ParamVir Chakra” or “Maha Vir Chakra” or “Vir Chakra”or such other gallantry award as the CentralGovernment may, by notification in the OfficialGazette, specify in this behalf:

(ii) family pension received by any member ofthe family of an individual referred to in sub-clause(i).

3. In view of the above all Pension DisbursingAuthorities are advised to allow the benefit ofexemption of Income Tax to the pensioners/familypensioners mentioned at 2(i) & (ii) above.

PNI/ 12 dated 02.02.2010 and 18.03.2010 videwhich clarifications have been issued for correctinterpretation of Vth CPC scale of pay and VIthCPC pay band & grade pay in the revised PPOs,particularly in the case of pensioners retired priorto 01.01.1996 from pre-revised IVth CPC payscale of Rs. 1400-2300/- and to adhere to theinstructions issued by Department of Pension &Pensioners’ Welfare (DOP&PW) for revision ofpension/family pension of pre-2006 retirees.

Consequent upon issue of the aforesaidclarifications, Zonal Railways re-fixed the pensionand started recovering the over-paid amount ofpension. The issue of stoppage of recovery ofwrong/excess payments from Railwaypensioners is under examination in consultationwith Department of Pension & Pensioners(DOP&PW) and a reference is being made toDepartment of Expenditure-(Ministry of Finance)for stoppage of recovery of wrong/excesspayments from Railway pensioners.

In view of above, it has been provisionallydecided by the Board that recovery from suchpensioners may be stopped till further advice fromBoard which will be issued on receipt ofinstructions from Department of Expenditure.

Pensioners donate fund for martyrs

In a noble and humane gesture, elder citizens from among the pensioners donated fund formilitary and paramilitary martyrs to Union Minister of State (Independent Charge) for Developmentof North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances, Pensions, AtomicEnergy and Space, Dr Jitendra Singh.

Led by Secretary General of "Bharat Pensioners Samaj", Shri S.C. Maheshwari, the senior,superannuated citizens met Dr Jitendra Singh here yesterday and handed over to him a cheque ofthe amount collected by them through donations by different pensioners. They said, they werecontributing this amount to the Prime Minister’s Relief Fund for the specific purpose of welfare andcare of the families of the martyrs from the military and paramilitary forces, who were sacrificingtheir lives in anti-terrorist operations.

The letter accompanying the cheque stated that “Bharat Pensioners Samaj”, a conglomerateof 725 pensioners associations, reiterates its resolve to stand solidly behind the government andurges that those who insult our men in uniform or hamper the army operations against terrorists,should be dealt with an iron hand.

Appreciating the gesture, Dr Jitendra Singh said, regardless of the amount donated by thesenior citizens, the matter of fact is that the value of the amount is many times more than itappears to be, for the simple reason that it has been collected with a sense of impeccable patriotismand it has been contributed from the most hard-earned pension drawn by some of our seniorcitizens.

Dr Jitendra Singh said, we are proud of the Indian Army which is among the best forces in theworld and we are also eternally indebted to the supreme sacrifices made by our army personnel.The sacrifices of a soldier, he said, cannot be compensated by any amount of money, but yet, agesture like this is only meant to reaffirm our commitment to the motherland and to those braveheartswho laid down their lives so that we could live.

1. It has been noted with concern whilescrutinizing claims of an Eye Centre that ECHShad been billed more than the hospital rates. Itwas also observed that for ocular investigationsthe hospital was billing ECHS at twice the CGHSrates (stating that the CGHS rates are for oneeye). It has been clarified the CGHS rates forOphthalmology investigations are for both eyesunless specified”.

2. As per provisions of MOA and para 4(b)(x)of Gol, MOD letter NO.24(8)/03/US(WE)/D(Res)dated 19 Dec 2003, the hospital cannot bill ECHSmore than the hospital rates. It should be ensuredby Regional Centre’s that the rate list of thehospital is taken whenever MOA is being renewed.The rate list attached with MOA should not have arate more than CGHS rate/Hospital rate. whereverthe hospital rate is below CGHS rate it should bereflected with an asterisk (*) on the rate listattached with MoA.

3. BPA to check the claims of such hospital(including settled claims) which have not beenprocessed correctly and the excess amount paidpost implementation of CGHS 2014 rates if anywould be recovered from the pending claims ofthe hospitals.

4. The RCs are directed to ensure noadditional charges/extra charges than CGHS/ECHS or actuals whichever is less to be paid tothe hospital. It is also requested RCs toaccordingly review the pending claims (i.e notsettled claims) of the hospitals not restricted toophthalmic claims and those with observationsbe returned to BPA for correct processing.

Reg : Injustice done to Railway’s Loco running staff retired between 2004-2006

With effect from 1.1.2004, 50% DA wasconverted as Dearness pay. On this DP, DA aswell as 30% running allowance also wasadmissible to Railway’s Loco running staff.

For revision of pension as per 6th CPC,Dearness pay was considered as DR i.e to 24%DR as on 1.1.2006, 50% DP was added to bring itto 74%. To this 12% element of DR on DP wasadded to make it 86%. After adding 40% fitmentbenefit, multiplication factor of 2.26 was arrived atfor updating existing pension of 5th CPC to 6th CPCas on 1.1.2006.

Though because of treating 50% DP as DAno disadvantage occurred to Civil Pensionersother than Loco running staff of Railways as DRelement of 12% was accounted for. Unfortunately,Railway’s Loco Running Staff Pensioners retiredafter 1.1.2004 but before 1.1.2006 suffered lifelongloss of 15% in their pension/family pension aselement of running allowance on DP was notconsidered. In their case the multiplication factorfor revision of Pension as per 6th CPC acceptedrecommen-dations should have been 2.41instead of 2.26 i.e. 2.26 +15% element of runningallowance on Dearness Pay.

In the light of above explained facts, BharatPensioners Samaj Federation of PensionersAssociations appeal to you to direct concernedauthorities in Railway Board to review and dojustice to Railway’s Loco running staff Pensioners.

Fitment Tables/Ready recknors are issued andpending issue of revised PPOs, PDAs arerequested to pay revised pension with referenceto LPD given in the PPO on the basis of whichPDA initially started payment of Pension. Thiswill avoid hardship/ harassment to pensioners,minimizing chances of corruption and ensurespeedy compliance as issue of revised PPOsespecially by the Department of Post and theMinistry of Railways may take years.

It is, therefore, earnestly requested that :

i) Scale-wise Fitment Tables/Ready reckonersmay be issued early in case of Pensioners retiredduring the regime of various Pay Commissionssuch as 4th, 5th& 6th ; (ii) A dedicated Software maybe provided to all PSAs for the Revision ofpension/family pension of pre-2016 pensionersand for expeditious issue of revised PPOs; & (iii)Ministry of Railways and the department of Postmay be requested to expedite digitalisation of allPPOs and to make these available online as hasbeen done by CPAO.

However, as the reasons for the decision,that the Option-1 as recommended by the VIICentral Pay Commission is not feasible forimplementation is not convincing to thePensioners and the Pensioners’ Associations.undersigned appeal to your honor to cause areview to permit Option1 also as one of theoptions.

2. Sir, the VII Central Pay Commissionsrecommendations as well as the benefit of revised‘Dearness Relief’ have not been implemented inrespect of Pensioners retired from the CentralGovernment autonomous bodies under variousCentral Ministries of Govt of India undertakingsand Public Sector undertaking who are eligible toreceive Pension under CCS (Pension) Rulesfrom the Govt. of India . Kindly order the earlyrevision of their Pension with Dearness Relief atthe revised rates.

3. The VII Central Pay Commission hasrecommended the extension of CGHS benefitsto Postal Pensioners as well as the takeover ofremaining Postal Dispensaries. The VII CentralPay Commission also recommended theintroduction of comprehensive Health InsuranceScheme for the Central Govt employees andPensioners. These recommendations remainunimplemented so far. The excessive revision ofCGHS subscriptions also causing hardships tothe Pensioners . The Hon’ble Minister may kindlyorder the examination of these issues and orderremedial measures at his earliest convenience.

This is our candid appeal to your honorholding such a coveted position in the PMO, tohelp us fulfilling the genuine need of the aged& retired Railway pensioners and theirdependent family members, specifically thosewho are settled in the  suburban areas like DelhiNCR & other metropolitan cities throughoutIndia. The suburbs of the metropolitan citiesare generally located quite far away from theestablished Railway Health Institutions and it’sa real challenge for any  aged pensioner  tovisit the Railway Hospital  for  getting his/hermedical treatment &get  diagnostic checkupfor their  ailments due to aging  and during emergency  due to long distances (25-30 kmseach way) , travel  time  and the hassles onaccount of traffic snarls  and the meagre supportsystem at their end  It is ironical that the retiredRailway Board officials including  RDSO arebeing considered at par with any other retiredcentral govt. employees  and  get full benefit ofCGHS and RELHS  schemes for their medicaltreatment. But this facility is denied to the retiredemployees from Zonal Railways and other unitsof IR. Since the Railway Budget is now mergedwith the country’s General Budget, the RailwayMinistry is now like any other ministry of GOIfor such off-line activities and therefore, thefacilities of health services (CGHS) asapplicable to retired Railway Boardofficials and other retired central Govt,employees must be made available to theretired Railway employees from Zonal Railwaysand other units also and at least to thoseretired railway employees who desire toopt for the same due to the aforesaidreasons

Railway though a biggest civilian employerand considered an ideal employer of thecountry, is badly failing in this aspect as notproviding the requisite health care facilities underRELHS to the pensioners  akin to other retiredcentral govt. employees & Ex-service personnelsettled in far flung areas as covered underCGHS and ECHS respectively who are able to get easily  the required medical facilitiesthrough various empaneled private hospitals/diagnostic centers on CGHS/ECHS schemelocated near their homes.  Both the abovehealth care services are considered far superiorwhen compared to Railway health careservices(RELHS), for the reasons that Railwayhospital are not easily approachable due to theirlocation being far away from the suburbs. Apartfrom this they are already over stressed due tothe load of serving employees of the Railwaysand PSUs.  The medical facilities as neededby the retired railway employees are thus notbeing granted by the Railway administration dueto hard attitude taken by the Medical andFinance department, despite making repeatedrequests to make CGHS applicable to theretired pensioners

Though recently Railway Board hasventured to issue instructions under RailwayBoard’s letter No. 2014/H/28/1/Smart Card/PartA dated 14-7-2016 laying down thecashlesstreatment scheme in emergency(CTSE) only in empaneled hospitals by theRailways (and not in all empaneled hospitalsby CGHS) in 4 metropolitan cities (Delhi NCR,Mumbai, Kolkata and Chennai) and that too onexperimental basis for one year, for retiredemployees and their dependent familymembers.  It is, however, submitted that theproposed CTSE in its present form would notserve the intended purpose of providing timelymedical attention in case of emergency due tostringent procedures laid down. While it shouldhave been more aged pensioners friendly andthe facilities as tagged with CGHS scheme,

should have been made applicable with thisSmart Card so that the same could also beutilized in non-emergent cases to meet withthe medical services in the private hospitalsempaneled on CGHS scheme. This Railway’sscheme, though designed to meet theEmergency sickness for the retired employeessettled in Delhi NCR & other Metropolitan citiesthroughout India, could not be implemented asyet though one year has already passed sinceits notification but there is no sign of itsimplementation on the ground due toolackadaisical approach & red-tapism of theRailway administration.

Further It will not be out of context tosubmit to your honor that our aforesaid viewshave been validated by the 7th CPC in theirrecommendations as enumerated in para9.5.18(iii). It is thus our humble submission thatas a step forward in this direction, the CGHSscheme should be made applicable to theretired railway employees, which form themajor chunk of the civilian retired employees,and immediately to at least to those who desireto opt for it, by paying the requisite amount ifconsidered necessary, even as already paidby them the one-month salary against RELHSat the time of retirement.

           Sir, we shall be ever grateful for yourbenevolent action should our above grievanceis addressed at your level being a noble causeto uphold the right to live with dignity for theretired Railway employees at the fag end oftheir lives.Thanking you

Genl secy FCGPO- Basudeb Sengupta was the chief guest and ex- viceprez (EZ)/BPS - R N Dutta was guest of honour. Afterinaugural song, Jt secy Tapas Kr Mukherjee read namesof 39 departed members and house paid homage to themby observing one minute silence. Prez welcoming allappealed to younger retirees to take active part in theactivities of the assn to avoid jeopardising of the assn inthe years to come. Jt secy Bejoy Gopal Sinha read theproceedings of the 21st AGM followed by reading of secy'sreport by Jt secy Kamalesh Bose. Org secy Mihir BaranChatterjee presented accounts for 2016 alongwith BE for2017. All were passed unanimously. Prez and chief guestfelicitated 48 octogenarian members each with a shawl,flask, two books, Manpatra and a sweet packet. Chiefguest in his address drew attention of all to the plight ofpensioners and apprised about the latest recommendationsof 7th CPC. Guest of honour sought whole-heartedparticipation of pensioners in running the assn. Meetingended with a vote of thanks preceded by distribution ofsweet packets to all.
