The recent Hamas-Fatah reconcilia-tion pact, assuming it ends Palestinian dis-unity, has not made war in the Middle Eastinevitable. But it has dealt a blow to analready moribund peace process. PresidentShimon Peres may not rule out talks withHamas. A group within the ForeignMinistry itself argues that “Palestinian unityis an opportunity, not a threat”. The left-leaning Ha’aretz newspaper writes that it isin the country’s best interests to “recognize”the new Palestinian unity government. Butfor now Benjamin Netanyahu reflects theview of most Israelis and, we might add,Jews in the Diaspora, when he tells anyonewilling to listen that there is no possibility ofa return to the negotiating table when half ofthe Palestinian power structure stillbelieves that Israel is sitting on sacredIslamic soil.

The problem for Israel, however,goes far beyond the immediate impact ofAbbas choosing the “wrong” negotiatingpartner. The Palestinians will soon be head-ing to the United Nations seeking to becomepart of the comity of the world’s nations.Israel seems have pinned its hopes entirelyon a US veto of the statehood resolution.

The Palestinians, however, everdetermined to express their national will,may have found a way around a SecurityCouncil veto. Adopted in November 1950,“Uniting for Peace” Resolution 377 statesthat if the five permanent members of theSecurity Council are deadlocked, making itimpossible for the Council to exercise its“primary responsibility for the maintenanceof international peace and security”, theGeneral Assembly can issue its own “appro-priate recommendations” to resolve the dis-pute. That is precisely what the GA did in1981 when South Africa preventedNamibian independence. While the GA’sauthority under Resolution 377 is not bind-ing, Israel’s most recent ambassador to theUnited Nations, Gabriela Shalev, warns that“those who believe that the UN GeneralAssembly’s deliberations are of a solelydeclarative importance are mistaken”.Boycotts and sanctions, along with militaryaid to the now recognized Palestinian state,are just a few of the diplomatic problemsIsrael could face.

If Israel is to prevent what DefenceMinister Ehud Barak has called a “diplo-matic tsunami”, the government ofBenjamin Netanyahu must change itsstrategy. Israel may have all the legal argu-

ments on its side. The declaration of aPalestinian state is, of course, a clear andobvious violation of the Oslo Agreements.But that will have little bearing on the deci-sion of the Security Council and/or theGeneral Assembly whose members will lookto statements made by the IMF and the WorldBank as they prepare to cast their votes.Preaching to the converted at AIPAC, or evenin the US Congress, does nothing to sway theminds of Israel’s critics.

Benjamin Netanyahu cannot justkeep telling world leaders that Israel won’tnegotiate with an entity that includes a ter-rorist faction. The leaders of Germany andFrance may acknowledge that a group thatprotested the elimination of Osama BinLaden poses a real threat to Mid-East sta-bility. But neither that, nor the fact thatAbbas has shown absolutely no flexibility, ispreventing many nations from voicing initialapproval for what they see as the solution tothe unhealed wounds of the Palestinianpeople.

We believe Netanyahu would be wiseto drop his demand that Abbas choosebetween Israel and Hamas. The prime min-ister knows full well that contact betweenIsraelis and Palestinians will continue on avariety of levels - economic, medical and evencultural. Security coordination between theIDF, Shin Bet and the Palestinians willremain in place. Indeed, during the recentNakba uprising, the calmest border was theWest Bank due in no small part, says IDFspokesman Capt. Arya Shalicar, to the coop-eration of “our Palestinian partners.” ThePrime Minister’s case would be strengthenedfurther if he silenced those Ministers in hiscabinet who see the Fatah-Hamas pact as anexcuse for Israel to annex every single out-post on the West Bank.

Benjamin Netanyahu will have toconvince seven members of the SecurityCouncil that he is willing to put the coreissues on the table. He will need to proposediplomatic initiatives that remove lingeringdoubts that Israel must be curbed of its“unlimited greedy aspirations”. He must tellthe world, as Kadima leader Tzipi Livni toldAIPAC, that “Israel is strong enough to makedecisions.” If he does not present “new ideasand formulations”, a Palestinian state withinthe 1949 armistice lines could become a real-ity. Massive support for UNGA Resolution194 on the “right of return for refugees”would surely follow. So, too, will Israel’sgrowing isolation.

Bachman told heraudience that she was horri-fied as a child when shelearned about the tragedy ofthe Holocaust and keptwondering if her mother haddone anything to prevent it.And she was appalled thatso many millions ofAmericans claimed theywere unaware until after thewar that European Jewswere being slaughtered.

“I tell you the story”,Bachmann continued,“because I think in our dayand time, there is no analogyto that horrific action. But

When reporting inthe closed societies of thebroader Middle East, jour-nalists are being vigilantlywatched, harassed, andabused by authoritarianregimes, secret police, andmedia manipulators whowork for terror proxies.

Their work and theirsafety are always at risk.Constantly intimidated andcensored from reporting thetruth, reporters languish inprisons or are murdered tosilence a story and toremove a vital witness toimportant events.

In 2003, then CNNnews executive, EasonJordan, revealed that CNNknew about scores of atroc-ities that Saddam Hussein’sregime had perpetrated butthat “could not be reportedbecause doing so wouldhave jeopardized the lives ofIraqis, particularly on our(CNN’s) Baghdad staff.”

As a result of state-sanctioned violence andthreats against journalistsby ruthless thugs, present-day media often timesrepress a narrative for fearof persecution, detention, ordeath. When the mediaignore the growing intimida-tion of their own colleaguesand don’t report it to thepublic, that silence becomescomplicity.

According to the2010 Press Freedom Indexproduced by ReportersWithout Borders, out of 178countries ranked, the fol-lowing Mideast, Arab, and

North African nations sawjournalists face what itdescribed as "very serious "and "difficult situations"with Iran ranked as the175th worst offender, Syria173, Libya 160, SaudiArabia 157, Palestinian ter-ritories 150, Afghanistan147, Bahrain 144, Iraq 130,Egypt 127, Qatar 121, andJordan at 120.

In Libya, underMoammar Gaddafi's ruth-less thumb, Western andArab journalists are regu-larly imprisoned. Sky Newsreporters were intentionallyshot at, and WashingtonPost journalists describeworking under conditions of"luxury imprisonment."Other media professionalsare used as human shieldsand are subjected to mockexecutions by pro-Gaddafisoldiers. This regime, alongwith other Arab autocraticcountries, has also fordecades reportedly bribedArab journalists from docu-menting the lack of humanrights in their own respec-tive countries.

In Gaza and theWest Bank, PalestinianAuthority and Hamas goonssystematically intimidateand abuse Palestinian andWestern journalists, confis-cating and destroying theirequipment. Gaza's Hamas"cops" are reviled for usingbeatings and stun guns onfemale journalists. Hamascontinued this trend ofintimidation recently by

President BarackObama and his supportershave defended U.S. militaryaction in Libya by invokingAmerica’s failure to respondto mass murder in Rwanda,Bosnia, and even theHolocaust. Do those experi-ences indeed offer usefullessons for the current cri-sis?

In his nationaladdress on March 28, thepresident pointed out that“when people were beingbrutalized in Bosnia in the1990s, it took the interna-tional community morethan a year to intervenewith air power to protectcivilians.” White HouseMideast adviser DennisRoss reportedly said at abriefing for foreign policyexperts on March 23 thatthere was a danger in Libyaof a “Srebrenica on steroids”- referring to the 1995 mas-sacre of 8,000 BosnianMuslims by Serb militia-men.

National SecurityCouncil official SamanthaPower, who reportedlyplayed a major role in theU.S. decision to intervene inLibya, has described herunsuccessful attempt (as ayoung journalist) to alertthe world about the immi-nent attack on Srebrenica

as one of the formativeevents in her life.

Washington Postcolumnist Richard Cohencited the Evian conference,in 1938, at which theUnited States and othercountries refused to opentheir doors to Jews fleeingNazi Germany. “Lives wereclearly at stake [in Libya]and something had to bedone,” Cohen wrote. “Theworld could not simplyshove its hands in its pock-ets and stand by as somemadman had his way withpeople in his grip - in spirit,a reprise of the Evian con-ference.”

“We learned a lot inthe 1990s,” Secretary ofState Hillary Clinton hassaid in her comments onthe Libya action, referring tothe importance of notrepeating the world’s slowresponse to the killings inBosnia and Rwanda.

The people of Libyaundoubtedly appreciatethat they are the beneficia-ries of the current adminis-tration’s effort to learn fromAmerica’s past mistakes. Ofcourse, the people ofBahrain or Syria may bewondering what disqualifiesthem from U.S. militarysupport. Secretary Clinton’s

This is because sincethe start of the peaceprocess, the Arab stancetoward negotiations - includ-ing the Egyptian -Israeli andthe Jordanian -Israeli nego-tiations - always started andended on the considerationthat the 1967 borders arethe basis of negotiations.However, the surprise is thatObama has considered thisprinciple from now on to bethe basis of US policy in theissue of the Middle Eastpeace process.

In an exclusiveinterview with Asharq Al-Awsat Helal said thatPresident Barack Obama'sstatement is the first timethat the United States hasadopted an interpretation ofthe UN Resolution 242,which is considered the"cornerstone" in the Arab-Israeli negotiations. Thisresolution was issued inEnglish and French; theEnglish text stipulates thereturn of "territories" occu-pied in 1967, while theFrench text stipulates thereturn of "the territories"occupied in 1967. The Arabside always demanded thereturn of all the Arab terri-tories occupied in 1967, asit happened in the cases of

Egypt and Jordan, whilethe Israeli side says that itis prepared to return occu-pied territories, but not"all the territories." Helaladds: "Actually and practi-cally, what Obama hassaid about the 1967 beingthe basis of the negotia-tions is completely differ-ent from the Arab andPalestinian stance, whichsays that the 1967 bordersis what should be the con-clusion of the negotia-tions."

Circumcision ofmale infants is a religiousrequirement in Judaismand many experts say that

a ban would be a violationof the 1st Amendment pro-hibition against governmentinterference with an individ-ual’s religious practices.

Should the bill passin San Francisco, and notbe found in violation of the1st Amendment, circumci-sion would be prohibitedamong males under the ageof 18. Conceivably Jewishparents could be fined up to$1000 or be sentenced toone year in prison.

Jewish ownership. FourPalestinian families wereevicted from homes theyhad lived in for over fivedecades and Jewish familiesmoved in. Nahalat ShimonInternational, a Jewishorganization that boughtthe land from its originalowners – the JewishSephardic community,which had acquired theland in the late 19th centu-ry - gave the young Jewishfamilies the right to takeover the homes.

The Ghawi andHanoun families didn’t giveup. They set up a tentacross the street from theirformer homes and campedout for six months. TheJerusalem municipalityconfiscated the Ghawi fami-ly tent 17 times, fining thefamily 430 shekels ($125)each time for erecting anillegal structure.

The dispute over thehomes isn’t a simple prop-erty dispute, even if thecourt related to it that way.Jerusalem’s eastern halfwas taken by Israel duringthe 1967 Six-Day War andannexed by it shortly there-after. In the decades follow-ing, Israel was content tosolidify its control over thecity by establishing neigh-borhoods on empty land atthe city’s outer edges.

But in the lastdecade, right-wing Israelis –often financed and encour-aged by American Jews –have sought to reclaimneighborhoods inhabited byPalestinians in and aroundthe city’s historic core.Sheikh Jaarrah/ShimonHatsadik is one. Othersinclude Silwan, the MuslimQuarter and the Mount ofOlives.

The settlement drivehas prompted strongPalestinian opposition and –because Israel’s control ofthe city is not accepted bythe international communi-ty – foreign concerns aswell. When Israel’s Supreme

Court upheld the claim ofJewish ownership, interna-tional condemnationensued, calling the evictionof Palestinians "appalling"(UK) and "totally unaccept-able" (UN).

And as much as thecompound is a dispute overproperty and politics, it alsorepresents a deeper conflictover history and historicalrights. Sheikh Jarrah is arashomon in which threenarratives collide - that ofthe Palestinians, of theJewish settlers and of theSheikh Jarrah SolidarityMovement, comprised mostly

"The PalestinianAuthority undertook everyeffort to uproot all Jewishremnants from eastJerusalem," Yossef tells TheMedia Line. "Their agenda isbased on a lie. They have nohistoric connection to thecity, or at least none thatprecedes the Jewish con-nection. History is not ontheir side, it's on ours."

Yossef says 21Jewish families and ninesingle men live in the neigh-borhood. He adds that thereis a waiting list of 70 Jewishfamilies yearning to inhabitthe neighborhood homes. Incontrast to the Al-Kurds’neighbors, most of the fam-ilies belong to the modernorthodox community andhave served in the Israeliarmy.

Yossef insists that ifthere is any violence in theneighborhood, it is instigat-ed by the Palestinian resi-dents, or leftist Jewishprovocateurs.

"I have debriefed theguys not to raise an arm orthrow a stone. This hasnever happened and willnever happen. Cases of vio-lence come from the out-side, from visitors whoweren't debriefed and wereduped by provocations ofB’tselem,” he says, referringto an Israeli human rightsorganization.

Hillel Ben-Sasson, a32-year-old doctoral stu-dent in philosophy at TheHebrew University, is thespokesman for the SheikhJarrah Solidarity move-ment, a group of mostlyJewish protesters who havebeen demonstrating nearthe homes every Fridayafternoon ever since theeviction in August 2009.

For Ben-Sasson, thestruggle isn’t betweenPalestinians and Israel orbetween Jews and Muslims.It is over the character ofIsraeli society and its demo-

Ben-Sasson says hisorganization has carriedout round-the-clock sit-inswith Palestinian neighbor-hood residents for over ayear. As a result, he says,the neighborhood – whichhad started becomingJewish – has nowreclaimed its Palestiniancharacter.

"Our tactic is non-violent struggle and ourstrategy is ending theregime of privileges inIsrael," Ben-Sasson says.“The Zionist revolution hassucceeded and now we needto create a completely egali-tarian democratic society,not a closed Jewish ethniccommunity."

His movement hasrecently expanded itsactivity to protest Israeliland confiscation in otherparts of the country. OnLand Day, which is markedevery March 30 by IsraeliArabs to highlight theirclaims to equal rights toland, they demonstratedalongside the Arab resi-dents of Lod, a mixedJewish and Arab city nearTel Aviv.

"The youngstersthere were shouting 'withblood and spirit we willredeem you, O Palestine!'but I know they will settlefor simple equality asIsraelis," Ben-Sassonsays.

And last but notleast, Iran, described as the“world's worst jailer of thepress” alongside China andTurkey, imprisoned 34 jour-nalists in 2010 alone. Let’snot forget about ZahraKazemi, the Canadian-Iranian photojournalist whoin 2003 was arrested whiletaking photographs outsideIran`s notorious Evinprison. Kazemi died twodays following her detentionafter being tortured andraped by her captors. Thenthere’s the case of MaziarBahari, a Canadian-Iranianjournalist at Newsweekmagazine, who was held ina Tehran jail for 118 days in2009 for filming scenes ofIran's militia shooting atprotestors. Iran also sen-tenced HosseinDerakhshan, the Iranian-Canadian "blogfather" ofTehran, to 19½ years inprison for writing dissentingopinions about the Iraniangovernment and for trainingothers to blog and podcast.Derakhshan was temporari-ly released on bail this pastDecember.

Helal doubts thepossibility of resuming thepeace talks between theIsraeli and Palestinian sidesat the current time. Theabsence of governmentson the Arab side who are

prepared to put theirweight behind the peaceprocess makes it more dif-ficult to find regional sup-port for the peace efforts.The climate in the Arabcountries in general is hos-tile to the United Statesand Israel. I believe thatthe mistake is not in whatPresident Obama has said,but it is in its timing,because had he adoptedthis stance immediatelywhen he assumed thepresidency, this wouldhave been better than hisinsistence of halting thesettlement activities. Thisis because halting the set-tlement activities during atransitional period inwhich peace has not yetbeen achieved is somethingthat no Israeli prime minis-ter has agreed to as aresult of the domestic pres-sure. Moreover, this hasnot been a demand or acondition stipulated by thePalestinian side, even dur-ing the period of signingthe Oslo Accord."

Helal stresses thatthe loser in this battle willnot be Israeli Prime MinisterBenjamin Netanyahu, butthe loser will be the USPresident. This is becauseof many reasons, the first ofwhich is that the USCongress is not in thehands of the Democrats,but it is in the hands of theRepublican Party, which isprepared to understand theIsraeli situation, and tosupport the Israeli primeminister. The second reasonis that, so far, there is noArab country that is pre-pared to support the UnitedStates publicly, and engageas a fundamental partner inpushing forward the peaceprocess.

TheUnited States' acceptanceor rejection of this resolu-tion will depend on the lan-guage of the draft resolutionpresented for voting, i.e. ifthe Palestinian demand atthe UN General Assembly iscompatible in all its articleswith the stances and poli-cies of the United States(especially after Obama'sannouncement specifyingthe pre-1967 borders as abasis for the negotiations)this will make it difficult forthe United States to rejectsuch a resolution.Nevertheless, generallyspeaking, a vote in the UNGeneral Assembly in favorof the Palestinians will notlead to the establishment ofthe State of Palestine."
