    SUBJECT: CSX TRANSPORTATION, INC. FACILITY ENROACHMENT AGREEMENT FOR MCKAIG ROAD IMPROVEMENT PROJECT, PHASE II

    RECOMMENDATION: That Council authorizes the Director of Public Service and Safety to enter into an Encroachment Agreement with CSX Transportation, Inc. related to the McKaig Road Improvement Project, Phase II.

    BACKGROUND: The City has contracted for the construction of the McKaig Road Improvement Project, Phase II. The project includes a new storm sewer crossing under the CSX line. In order to complete this boring, CSX is requiring that the City execute a Facility Encroachment Agreement. The City entered into such agreements associated with the Deltech Water Line Project and Water line Project No.4 (Governors Road crossing under the CSX line).

    REQUESTED ACTION: It would be appreciated if you would assign to a Committee of Council authorizing the Director of Public Service and Safety to enter into a Facility Encroachment Agreement with CSX Transportation, Inc. related to the McKaig Road Improvement Project, Phase II. We are requesting consideration of emergency legislation so that the agreement can be executed as soon as any details are worked out.

    SUBJECT: CSX Facility Encroachment Agreement

    The street reconstruction project on McKaig Avenue includes a new storm sewer crossing under the CSX line. In order to complete this boring, CSX is requiring the Encroachment Agreement from the City of Troy. This is a standard agreement that we have used previously in another railroad crossing.

    Staff is requesting that legislation be prepared to allow the Director of Public and Safety to enter into the Facility Encroachment Agreement with CSX. Staff is also requesting that this be performed as an emergency so to allow the City to proceed with the construction project as quickly as possible.
