JUDICIAL AFFIDAVIT OF PETITIONER ELIZABETH IZRA

I, Elizabeth Izra, of legal age, married, and living at Brgy Cadagmayan, Cabatuan, Iloilo, and petitioner in this case, state under oath as follows:

PRELIMINARY STATEMENT

The person examining me is Atty. Johnny Boy Nagz with address at General Luna St., Iloilo City. The examination is being held at the same address. I am answering his questions fully conscious that I do so under oath and may face criminal liability for false testimony and perjury.

PURPOSE: This affidavit/testimony of petitioner Elizabeth Izra is being offered to prove that the respondent Romeo Izra contracted marriage twice, first with Gloria Branded on November 23, 2008, and later with the petitioner Elizabeth Izra on August 5, 2009 while the respondent’s previous marriage with Gloria Branded was still valid and has not yet legally dissolved. Petitioner will also prove that prior to her marriage with the respondent she was previously married to Gloria Branded on November 23, 2008 which marriage was still valid and subsisting at the time she contracted marriage with the respondent. The petitioner’s testimony is also offered to prove the legal basis for the declaration of nullity of the petitioner’s marriage with the respondent, the same being bigamous.

Question 1. Please state your name and other personal circumstances for the record.Answer 1. I am Elizabeth Izra, of legal age, married, and living at Brgy Cadagmayan,

Cabatuan, Iloilo, and petitioner in this case.

Q. 2. Are you the same Elizabeth Izra, the petitioner in this case?A. 2. Yes sir.

Q.3. Do you know a certain Romeo Izra?A. 3. Yes sir. He was the man I married on August 5, 2010.

Q. 4. How did you meet him?A. 4. I have met him at a disco party at Smallville 21 at Manduriao, Iloilo last April 5, 2010. He

courted me and we had several dates and finally we decided to get married.

Q. 5. Are you still living with Romeo Izra?A. 5. We have separated since September 20, 2013.

Q. 6. Do you have of proof your marriage with Romeo Izra?A. 6. Yes sir, I have a marriage contract (Exhibit “A”).

Q. 7. Do you have children with Romeo Izra?A. 7. We have one (1) child namely, Romeo Izra Jr., now two years old.

Q. 8. What is the reason for your separation?A. 8. It is because of the respondent’s infidelity and lack of sense of responsibility. He was

jobless, a drug addict and did not care to provide the needs of our family. He was dependent on me.

Q. 9. How about a certain Gloria Branded, do you know her?A. 9. Yes sir, he was the woman, whom Romeo Izra previously married on November 23,

2008.

Q. 10. Do you have proof of marriage between Romeo Izra and Gloria Branded?

A. 10. Yes sir, I have a marriage contract (Exhibit “B”).

Q. 11. What was the status of the marriage between Romeo Izra and Gloria Branded when Romeo Izra got married to you?

A. 11. His marriage with Gloria Branded was still valid and has not yet been legally dissolved when he married me.

Q. 12. Aside from marriage contracts, do you have other documents to prove Romeo Izramarried Gloria Branded and yourself?

A. 12. Yes sir, I have a Certification (Exhibit “C”) from the National Statistics Office (NSO) showing Romeo Izra’s record of having two marriages, to Gloria Branded and myself.

Q. 13. How about you, do you have previous marriage when you married Romeo Izra?A. 13. No sir.

Q. 14. Do you have pre-nuptial agreement with the respondent regarding your properties? A. 14. None Sir.

Q. 15. Do you have common properties with the respondent? A. 15. None sir.

Q. 16. Do you and the respondent have common creditors? A. 16. None sir.
