FOF No. 1: Plaintiff is the Susanville Indian Rancheria, a federally recognized Indian tribe

(“Tribe”). The Tribe’s headquarters are located at 745 Joaquin Street, Susanville,

in Lassen County, California.

FOF No. 2: The Tribe provides health care services to eligible Indians in its service area in

rural Northeastern California through a Tribal health clinic known as the Lassen

Indian Health Center (“LIHC”).

FOF No. 3: Defendant Michael O. Leavitt is the Secretary of the United States Department of

Health and Human Services ("DHHS"). As such, he has overall responsibility for

carrying out all the functions, responsibilities, authorities and duties of DHHS,

including provision of health services to American Indians and Alaska Natives

and negotiating and entering into agreements with Indian Tribes and tribal

organizations under Titles I and V of the Indian Self Determination and Education

Assistance Act, 25 U.S.C. §§450 et seq (“ISDEAA”). His office is located in

Washington, D.C. He has been sued in his official capacity.

FOF No. 4: Defendant Charles W. Grim is the Director of the Indian Health Service (“IHS”),

a component of DHHS. As such, he has overall responsibility for carrying out all

the functions, responsibilities, authorities and duties of the IHS, including the

provision of health services to American Indian and Alaska Natives and

negotiating and entering into compacts and funding agreements with Indian tribes

and tribal organizations under the ISDEAA. His office is located in Rockville,

Maryland. He has been sued in his official capacity.

FOF No. 5: Defendant Margo Kerrigan is the Area Director of the IHS California Area. As

such, she has overall responsibility for carrying out all the responsibilities,

functions, authorities, and duties of the IHS within the IHS California Area,

including provision of health services to American Indians in California and

negotiation and entering into Compacts and Funding Agreements with Indian

tribes and tribal organizations under the ISDEAA. Her office is located in

Sacramento, California. She is sued in her official capacity.

FOF No. 6: ISDEAA was originally enacted in 1974 as Public Law 93-638 (codified at 25

U.S.C. § 450 et seq.). Title V was added to ISDEAA in 2000 as Public Law 106-

260, establishing the procedures and standards pursuant to which tribes could

enter into self-governance compacts and funding agreements with the Secretary of

DHHS to plan, conduct, consolidate, and receive full tribal share funding of

certain programs, services, functions, and activities (“PSFAs”) carried out by

DHHS (codified at 25 U.S.C. § 458aaa-(1) –(18)).

FOF No. 7: The Tribe has been providing health care services at LIHC to Tribal members and

other eligible beneficiaries since 1986 under a series of self-determination

contracts and Annual Funding Agreements (AFA) with the IHS pursuant Title I of

the ISDEAA.

FOF No. 8: Since at least 1995, the contracts and/or AFAs have included pharmacy services

as one of the PSFAs provided by the Tribe. See Stipulated Exhibit A, Title I Self-

Determination Contract and Annual Funding Agreement for CY 2006 between the

Tribe and IHS.

FOF No. 9: Early in 2006 the Tribe was admitted to the ISDEAA Title V self-governance

program by the IHS and several months later it began negotiating with the IHS to

reach agreement on an ISDEAA Title V self-governance Compact and FA for

Calendar Year 2007.

FOF No. 10: The Tribe adopted a Pharmacy Policy, which requires certain eligible

beneficiaries to pay (a $5.00 dispensing fee plus the acquisition cost of the

medicine) for pharmacy services. The Policy exempts from this payment

requirement those Native Americans and Alaska Natives permanently residing in

the Tribe’s service area whose income is equal to or less than 125% of the Federal

Poverty Guideline as published by the United States Department of Health and

Human Services. See Stipulated Exhibit B, Tribe’s Pharmacy Policy, Section 2,

page 1, “Indigent Eligible Participants” (which sets out the requirements and

process for this exemption).

FOF No. 11: During negotiations with IHS representatives over the proposed Title V self-

governance compact and FA, the Tribe was orally told by IHS negotiators that the

IHS would likely not agree to inclusion of the Tribe’s proposed language for its

pharmacy services program in the self-governance FA because it was IHS’

position that tribes do not have the legal authority to charge eligible Indians for

services provided through ISDEAA.

FOF No. 12: The Tribe refused to accept either of the two options presented by IHS regarding

the Tribe’s pharmacy services, thus leading to the “final offer” stage of Section

507(b) of the ISDEAA, which provides that “In the event the Secretary and a

participating Indian tribe are unable to agree, in whole or in part, on the terms of a

compact or funding agreement (including funding levels), the Indian tribe may

submit a final offer to the Secretary.” 25 U.S.C. §458aaa-6(b).

FOF No. 13: Except for one other item, which is not at issue in this suit and which the Tribe

has conceded, the Tribe and the IHS had reached agreement on all other issues in

the Title V Compact and FA aside from the question of billing for pharmacy

services.

FOF No. 14: The Tribe submitted its “final offer” to IHS on December 15, 2006 by letter. See

Stipulated Exhibit C, Tribe’s Final Offer Transmittal Letter, and Stipulated

Exhibit D, Tribe’s Final Offer of Title V Self-Governance Compact and Funding

Agreement. The Tribe’s “final offer” included pharmacy services in the proposed

FA and did not include an express statement that the Tribe would not charge

eligible beneficiaries for pharmacy services.

FOF No. 15: Since the existing Title I contract and AFA were set to expire on December 31,

2006, and under the ISDEAA the IHS had 45 days to respond to the Tribe’s final

offer, the Tribe and IHS agreed to an extension of the existing contract and AFA

for an additional 45 day period until February 15, 2007.

FOF No. 16: Defendant Charles W. Grim, by letter dated January 29, 2007, to Tribal Chairman

Stacy Dixon, rejected the Tribe’s final offer, on the grounds set forth therein. See

Stipulated Exhibit E, Letter from Dr. Charles W. Grim to Chairman Stacy Dixon,

January 29, 2007.

FOF No. 17: The 2007 HHS federal poverty guideline for an individual is $10,210 and $20,650

for a family of four. Susanville’s indigent fund program applies to those whose
