To examine the “hot” topic of legal transparency from a unique cultural and historical perspective, this book relies on Western and Chinese sources to explain how the competing ideologies of Legalism and Confucianism were melded in the 3rd century BCE to create a legal system that for two millennia balanced definitiveness with vagueness, and reflected cultural values still at work in China. CHINA’S LEGAL SOUL: THE CHINESE LEGAL IDENTITY IN HISTORICAL CONTEXT (Carolina Academic Press, 2009). A central aim of this book is to explore modern China’s law – and particularly its 30-year legal reform effort (1979-2009) – against the backdrop of the highly sophisticated dynastic legal tradition that collapsed a century ago. PROCEDURES FOR HANDLING INSOLVENT BANKS (Kluwer Law International, 2000) (co-authored with Robert Lee Ramsey). Drawn from experience in both the legal and the operational side of banking law practice in developing countries, this book offers explanations and normative recommendations about a central problem in many such countries – risks posed by weak banking systems. A GENERAL INTRODUCTION TO ECONOMIC LAW (University of Wisconsin, 2007). This is the second edition of a book first published in both English and Bahasa Indonesia in 1997 under the joint authority of the Indonesian “ELIPS” legal-capacity-building project and the University of Indonesia Law Faculty.
