Article I

Name of Organization The name of this organization shall be: The School Advisory Council of John I. Leonard High School.

Article II

Purpose and Function

Section 1: The School Advisory Council is a resource for the school, its teachers and its principal. Its function is to develop a School Improvement Plan that will serve as a framework for school improvement; to oversee and to implement systematic evaluation.

Section 2: The primary function of the School Advisory Council is to provide all of the stakeholders an opportunity to be active participants in the assessment of needs, development of priorities, and identification and use of resources. Specific functions include the following:

1) To develop and oversee the implementation of the School Improvement Plan. 2) To enlist, promote, and support greater interaction between school and

community. 3) To provide input and ratify the disbursement of school improvement funds

and other monies related to school improvement, and to ensure that such expenditures are consistent with the School Improvement Plan.

4) To consult with the Instructional innovation team when making decisions concerning educational practices within the school to make decisions based on available data.

5) To consult with persons or departments impacted by the School Improvement Plan.

6) School based committee will present the collective ideas for the use of A plus funds to SAC for final approval by majority vote. SAC members should refrain from membership in the committee. If SAC does not approve by majority vote, the A plus funds proposal will go back to the original committee for resubmittal.

Article III

Representation and Membership

This is in accordance with Florida Statute 1001.452, which outlines the establishment of SAC:

Section 1: The membership shall be representative of the student body and community served by the school. The SAC shall have an appropriately balanced number of teachers, parents, support employees, students, business and community members.

Section 2: The majority (50% + 1) of the members of the SAC shall not be school district employees.

Section 3: The SAC membership shall be appropriately balanced. This refers to the racial, ethnic, and socio-economic representation of the SAC in comparison to the community that the school serves.

Article IV

Membership Selection

Section 1: Parents and staff members of John I. Leonard High School will be notified of council elections by phone, website, and/or e-mail.

Section 2: The SAC membership shall be elected as follows:

1) Parents, teachers, students, and support employees and staff members will be elected by their respective groups.

2) Business and community members will be appointed by the Principal. (Policy 2.09)

3) Replacement members shall be elected by appropriate constituencies.

Section 3: Nominations and elections shall be held at the first meeting of the year and the installation of new members shall follow immediately. Collecting, counting, and voting of these nominees should take place during the first meeting by use of ballots. Resolution of disputes and/or deadlocks as to the membership, will be resolved during the meeting by the members of that representation while adhering to the Sunshine Law (Further details noted in Article VIII, Consensus, Section 2).

Article V

Tenure

Section 1: Council members will be elected annually for one year terms. A member in the parent group must have a child enrolled at John I. Leonard High School.

Section 2: Council members shall serve no more than 2 terms in an elected position.

Section 3: No member may miss more than two (2) unexcused consecutive SAC meetings. As required by Fla. Stat 1001.452 (1)(d)4, in the event of two unexcused consecutive absences from a properly noticed SAC meeting, the person’s membership will cease and the SAC Chairperson will arrange for the replacement of the member by Election as specified in Member Selection, Article IV, Section 1. Such individuals will fill the remainder of the term to which they were elected.

Meetings Section 1: There shall be a Council meeting at least once per month. Section 2: SAC meetings shall be held on or about the third Wednesday of each month,

unless otherwise agreed upon by the SAC with reasonable notice, from 6:00 pm – 7:00 pm. As required by Fla Sta. 1001.452(1)(d)(3), SAC meetings must be scheduled when parents, teachers, businesspersons, and members of the community can attend. Any changes of venue, date, or time will be made publicly available.

Section 3: Three business day advance notice will be provided to the SAC membership for

any voting matters. Section 4: Subcommittees will meet as needed. SAC Governance

1) Persons suggesting ideas for SAC consideration will submit an online form at least 7 days prior to the scheduled SAC meeting in order to be added to the agenda. (Exceptions can be made through the SAC Executive Board).

2) Persons requesting SAC Funds must submit requests using the online form 90 days prior to the requested date (further details noted in Article IX, SAC Funds Requests).

3) All ideas should have a purpose and outcome affecting school improvement and aligned to the Strategic Plan.

4) All ideas should be heard and considered prior to making any decisions. 5) The person(s) suggesting ideas(s) should be present at SAC meeting(s) where

their idea is being presented or considered for questions/comments or concerns.

6) Ideas can be addressed during the scheduled SAC meeting or postponed until the next meeting.

7) When the idea(s) require a vote, the voting process set forth within the bylaws should take precedence.

8) When an idea is addressed, SAC majority vote will decide the outcome of adopting or rejecting the idea.

9) If voted and approved, the SAC chairperson must sign as approved, give a copy to school principal or designee and school’s treasurer.

10) Summary of minutes will be kept at the school site.

Article VI Officers Section 1: The officers of this Council shall be a chairperson, or a co-chairperson, a vice-

chairperson, and a secretary. In the event of a vacancy in a Council office during an existing term, the vacancy will be filled by election by the SAC membership.

Section 2: The Council shall elect its officers at the first regular meeting. The term of each

officer is September to August. Officers shall serve a maximum of two terms. Duties of Officers Section 1: Chairperson

The chair person shall preside at all meetings of the council and be a de facto member of all committees. The chair person shall act impartially, serve as a conscientious arbiter of discussion and debate, and insist on fairness in the actions and debates of the memberships.

Section 2: Vice-Chairperson

The vice-chairperson shall act as an aide to the chairperson and preside in the absence of the chairperson. In the case of a vacancy in the office of chairperson, the vice-chairperson shall become the chairperson for the remainder of the unexpired term.

Section 3: Secretary

The secretary shall keep minutes of the meetings and shall be responsible for such correspondence as is delegated to him/her by the chairperson. The secretary shall also document activities, decisions, and attendance of the Council and its committees for accountability.

Section 4: Principal

The Principal serves as a resource providing information regarding the school educational plan. The role of the Principal includes the development, through positive actions of feelings of trust and mutual regard among the SAC, the community, and the staff. The Principal is responsible for organizing and

arranging SAC meetings and presentation of interest to the SAC and encourages leadership from within the Council.

Duties of Members Section 5: Faculty and School Staff Representatives

The members of the school staff shall represent the views and interest of the entire school staff. They will act as resources for the SAC by making available specialized information about education programs, innovative ideas, and available resources. School staff representatives serve as a communication link between the SAC and the school staff, informing others of actions and activities of the council.

Section 6: Parents and Community Representatives

The parent and community members of the SAC shall represent the view of parents, citizens, and community organizations of the school community. They shall act as resource persons for the SAC in the areas of community related issues that affect the school and its students. They shall serve as a communications link between the SAC, business, community, and parent groups.

Section 7: Students Representatives

The student representatives of the SAC shall serve as voting representatives of all students, relaying suggestions and recommendations from members of the student body and Student Council to the SAC for consideration. The student representatives shall be represented at all levels on appropriate committees and shall assist in securing the support of students for programs planned to deal with problems affecting students, and serve as a link between the SAC and the student body.

Article VII

Voting Body The SAC is the formal council that is responsible for voting upon and implementing the decisions for the organization. The SAC will be comprised of an elected membership and will require a quorum if any formal action is to be taken, as required by Fla. Stat. 1001.452(1)(d)1. A quorum is a majority (50% + 1) of the SAC membership. Committees Committees are formed to research and make recommendations regarding specific areas that affect the organization.

Rules of Order Section 1: It is recommended that advisory council decisions be reached by consensus

except as provided in the deadlock resolution process. Section 2: The SAC shall operate under Robert’s Rules of Order whenever a formal decision

is required. Consensus Section 1: Consensus is achieved by polling each SAC member present for a position of

“yes,” “no,” or “discuss.” A majority (50% + 1) of the SAC membership must be present, and all of the members present must indicate a “yes” for consensus to be the official position of the SAC.

Section 2: The deadlock resolution procedure will be used when the membership has voted

and the decision is not unanimous for procedures making proposals, collecting, and narrowing suggestions and for the resolution of disputes and/or deadlocks. When time deadlines permit further deliberations, the SAC members, by majority vote, determine if there is agreement to refer the issue to a committee for further study.

If not referred, the deadlock process shall be as follows:

1. Every member of the SAC shall be given notice that a vote will be held at the next meeting on the issue.

2. If a majority of the total SAC voting body votes to adopt a position on the issue at the meeting, that position shall be the official position of the SAC.

Article IX

SAC Fund Request Guidelines

1) All SAC Fund Requests must be submitted online using the SAC Fund Request Form.

2) All requests must be submitted 90 days prior to the date the funds are needed. (Any exceptions must be reviewed and voted on by the SAC Budget Committee).

3) SAC Fund Requests will be reviewed by the SAC Budget Committee before presenting to the JILHS SAC membership. This review will verify that the request aligns with the School Strategic Plan, that all documentation is included and that all local and state requirements have been met.

4) SAC Fund Requests must include proof of fundraising and/or pursuit of funding elsewhere (Exceptions of a case to case basis).

5) SAC Fund Requests cannot exceed $4000.

6) All oral presentations related to proposals for funding should be limited to 5 minutes, followed by a questions and answer session.

7) The use of school improvement funds requires a vote, the voting process set forth within the bylaws should take precedence.

Article X

Amendments Section 1: These bylaws may be amended at any regular meeting by a two-thirds majority of

the members present and voting. Written notice to the members of the proposed amendment shall be a least three (3) days prior to the meeting at which it is to be voted upon. A quorum is required for any meeting at which actions will be taken.

Section 2: The SAC shall review annually and when appropriate, recommend revisions of

the SAC Bylaws annually. The adoption of revised Bylaws shall follow the procedures for amendments.

Policy 2.09 - School Advisory Councils

1. Purpose

This policy is to ensure compliance with Fla. Stat. § 1001.452 and to clarify the role of School AdvisoryCouncils.

2. Applicability

Each school in this school district shall have a School Advisory Council ("SAC") as set forth in Fla. Stat. §1001.452(1)(a).

3. Composition of Councils

a. Membership of the SAC shall meet the requirements within Fla. Stat. § 1001.452(1)(a). Theserequirements include that the SAC be composed of the school Principal/Director (who, pursuant to Fla.Stat. § 1001.54(2), must provide instructional leadership in the development, revision, andimplementation of the School Improvement Plan) and an appropriately balanced number of teachers,education support employees, students (where appropriate), parents, and business and communityrepresentatives.

i. Middle schools may include student representation on their SACs

ii. Career centers and high schools must include student representatives on their SACs.

iii. Career centers and Adult Education Centers are not required to have parent participation on theSACs.

iv. In accordance with Fla. Stat. § 1001.452(1)(a), the term "education support employee" as usedherein refers to any person who is employed by a school who is not defined as instructional oradministrative personnel pursuant to Fla. Stat. § 1012.01 and whose duties require twenty (20) ormore hours in each normal working week.

v. For purposes of School Advisory Council membership, the term "teacher" includes classroomteachers, certified student services personnel, and media specialists pursuant to Fla. Stat. §1001.452(1)(a).

b. As required by Fla. Stat. § 1001.452(1)(a), the majority (fifty percent plus one (50% + 1)) of themembers of the SAC shall be persons who are not employed by the school district.

c. Membership shall be representative of the ethnic, racial, and economic community served by the school,as required by Fla. Stat. § 1001.452(1)(a).

a. All council members shall be elected by their respective peer group, except for business and communityrepresentatives and the school Principal/Director. The SAC bylaws will establish the term of membershipand a process for ensuring staggered terms to provide continuity on the SAC.

b. As required by Fla. Stat. § 1001.452(1)(a), the following council members shall be elected by theirrespective peer group in a fair and equitable manner through an election as set forth in the bylaws of theSAC. Procedures in the bylaws should include the means of ensuring wide notice of vacancies.

i. Teacher(s) shall be elected by teachers;

ii. Education support employee(s) shall be elected by education support employees;

iii. Student(s), when appropriate, shall be elected by students; and

iv. Parent(s) members shall be elected by parents in general, with all parents having an opportunityto participate in voting for any parent as set forth in the bylaws of the SAC.

c. For the appointment of business and community member(s) to serve on the SAC, the procedures in theSAC bylaws will include the means of ensuring wide notice of vacancies and of taking input on possiblemembers from local businesses, chambers of commerce, community and civic organizations and groups,and the public at large. Business and community members will be appointed by the Principal.

d. SAC bylaws should include procedures for the:

i. Collecting nominees for membership,

ii. Counting these nominees,

iii. Voting on these nominees,

iv. Counting votes on these nominees,

v. Resolution of disputes and/or deadlocks as to the membership if done at a SAC meeting, must bein compliance with the Sunshine laws.

e. The bylaws of the SAC must set forth a process for appointment of additional SAC members if theelection process does not produce representative membership as provided within Fla. Stat. §1001.452(1)(a). If the process set forth in the SAC bylaws still does not produce representativemembership, the School Board or Superintendent/designee, will appoint additional SAC members toachieve proper representation.

f. Each school year and prior to or at the beginning of the first SAC meeting, each SAC member shallregister as: a) a volunteer using the Volunteer Tracking Systems, subject to the provisions within SchoolBoard Policy 2.53-Volunteers in Public Schools; and b) a SAC member for that school by submittingonline a completed PBSD e-form 1710 (School Advisory Council (SAC) Membership Report), which isattached hereto and incorporated herein as part of this Policy.

5. SAC Governance

a. Each SAC shall be governed by the Sunshine Law (Fla. Stat. § 286.011), the Public Records Law (Fla.Stat. Chapter 119), the SAC Statute (Fla. Stat. § 1001.452), and other relevant Florida statutes andState Board of Education Rules relating to SACs.

b. Each SAC will adopt bylaws, including membership selection procedures that meet the requirements ofFlorida Statutes, State Board of Education Rule, and this School Board Policy.

i. As required by Fla. Stat. § 1001.452(1)(d), the bylaws must establish procedures for thefollowing:

A. Requiring a quorum to be present before a vote may be taken by the School AdvisoryCouncil. A majority of the membership of the council constitutes a quorum.

B. Requiring at least three (3) business days’ advance notice in writing to all members of theAdvisory Council of any matter that is scheduled to come before the council for a vote.(This notice to members is in addition to the meeting notice for the general public underthe Sunshine Law.)

C. Scheduling meetings when parents, students, teachers, businesspersons, and members ofthe community can attend.

D. Replacing any member who has two consecutive unexcused absences (as determined bythe SAC Chair) from SAC meetings scheduled according to the procedures in the bylaws.

E. Recording minutes of meetings (and, as required by Fla. Stat. § 1001.452(1)(d)5, theSchool Board shall maintain a record of minutes of council meetings).

ii. Establishing procedures for making proposals; collecting, counting, and narrowing suggestions;and for the resolution of disputes and/or deadlocks.

iii. The SAC shall annually review its bylaws to ensure alignment with current Statutes and SchoolBoard Policy.

iv. The SAC shall submit the SAC bylaws when submitting the School Improvement Plan for SchoolBoard approval.

v. Sample SAC bylaws that are consistent with Florida Statutes and School Board policy are providedon the web site of the Department of School Improvement to assist SACS in the development oftheir bylaws. These bylaws serve only as an example, although some content is required by thecited Statutes.

6. Validation of SAC Membership Composition

a. The Superintendent/designee will validate each school's membership composition, including reviewingwhether "schools have maximized their efforts to include minority persons and persons of lowersocioeconomic status," pursuant to Fla. Stat. § 1001.452(1)(a).

b. The Superintendent shall annually submit the membership lists composition of all SACs to the SchoolBoard for review during a regular or special Board meeting in, or before, December of each school year.

i. The School Board shall review the SAC membership composition to determine if it isrepresentative of the ethnic, racial, and economic community served by the school, as required byFla. Stat. § 1001.452(1)(a).

ii. If necessary to achieve proper representation, the School Board or the Superintendent/designeeshall appoint additional members to a SAC.

7. SAC Powers and Duties

a. Each SAC has the authority to exercise the functions and duties provided to SACs by the Florida Statutesand State Board of Education Rules, but has no powers or duties now reserved by law to the Board.

b. Each SAC shall assist in the preparation of the school's annual budget and plan as required by Fla. Stat.§§ 1001.452(2) and 1008.385(1).

c. As required by Fla. Stat. § 1008.36(4), school recognition funds (A plus funds) "must be used forpurposes listed in Fla. Stat. § 1008.36(5) as determined jointly by the school's staff and School AdvisoryCouncil." For purposes of this subsection, "school staff" means all employees assigned to that school atthe time of the decision. The SAC bylaws should include procedures for collecting ideas and determiningthe use of these funds.

i. Pursuant to Fla. Stat. § 1008.36(5), school recognition funds must be used for any of thefollowing:

A. Nonrecurring bonuses to the faculty and staff;

B. Nonrecurring expenditures for educational equipment or materials to assist in maintainingand improving student performance; or

C. Temporary personnel for the school to assist in maintaining and improving studentperformance.

ii. Pursuant to Fla. Stat. § 1008.36(4), if school staff and the School Advisory Council cannot reachan agreement by the date specified in the Statute, "the awards must be equally distributed to allclassroom teachers currently teaching in the school." The term "classroom teachers" is defined inFla. Stat. § 1012.01(2)(a) as "staff members assigned the professional activity of instructingstudents in courses in classroom situations, including basic instruction, exceptional studenteducation, career education, and adult education, including substitute teachers" who are assignedto that school as of the deadline stated above. (The term does not include other instructionalpersonnel which are separately defined in Fla. Stat. § 1012.01(2)(b)-(e)).

d. General Appropriations Act: The School Board shall provide School Improvement funds to schools fordeveloping and implementing School Improvement Plans pursuant to Fla. Stat. § 1001.42(18)(d). TheSAC bylaws should include procedures for collecting ideas and determining the use of these funds.

i. Such funds shall include those funds appropriated for the purpose of School Improvementpursuant to Fla. Stat. § 24.121(5)(c).

A. School Improvement funds provided under Fla. Stat. § 24.121(5)(c) may be expended onlyon programs or projects selected by the SAC for enhancing school performance throughdevelopment and implementation of a School Improvement Plan. As stated in Fla. Stat. §24.121(5)(c), the school Principal may not override the recommendations of the SAC onuse of these funds.

B. These monies may not be used for capital improvements, nor may they be used for anyproject or program that has a duration of more than one (1) year; however, as allowed byFla. Stat. § 24.121(5)(c), a SAC may independently determine that a program or projectformerly funded under this paragraph should receive funds in a subsequent year. 8. School Improvement Plan (SIP)

a. Each SAC at the school level shall assist in the preparation, evaluation, and approvalof the School Improvement Plan during a SAC meeting pursuant to Fla. Stat. §§1001.42(18); 24.121(5), and 1008.33 to raise student performance. Pursuant to Fla.Stat. § 1001.42(18), identified schools must have an approved School ImprovementPlan. In addition, the Superintendent can determine on an annual basis that allschools will have a School Improvement Plan. Moreover, consistent with Fla. Stat. §1008.345(6)(c), new schools must have a School Improvement Plan uponcompleting one full school year of operation, after one (1) full school year of planningand development.

b. Schools are required by the Florida Department of Education to complete theirSchool Improvement Plan (SIP) templates with the assistance of their SchoolAdvisory Councils. In addition to the content in the SIP template, schools arerequired to include:

i. Single school culture and appreciation of multicultural diversity (applicable toall grade levels).

ii. Content as required by Florida Statute 1003.42(2), as applicable toappropriate grade levels, including but not limited to:

A. History of Holocaust,B. History of Africans and African Americans,C. Hispanic Contributions,D. Women's Contributions,E. Sacrifices of Veterans and the value of Medal of Honor recipients.

iii. Alignment, as determined by School District Leadership, to the School DistrictStrategic Plan.

c. The matrix attached hereto and incorporated herein as part of this Policy states the grade levels wherethe content areas required by Florida Statute 1003.42(2) are infused.

d. The school principal shall verify completion to the designated Supervisor and submit the SchoolImprovement Plan to the Florida Department of Education (FDOE) as required by the School Board orSuperintendent/designee and FDOE.

e. The Principal shall complete PBSD e-form 2248 the SIP Checklist with the requested attachments. Thisform is attached hereto and incorporated herein as part of this Policy. The form is submitted to thePrincipal’s supervisors for review and approval and the final copy is routed to the Superintendent’sdesignee. Prior to the Board meeting to approve the SIPs, the Superintendent designee will make thesechecklists available to the Board members.

f. The Supervisor/designee shall review and verify respective School Improvement Plans, SAC membershipcompliance, and the school's SAC bylaws.

g. The Superintendent shall annually submit the School Improvement Plan for each school to the SchoolBoard for approval. The School Board must annually approve and require implementation of a new,amended, or continuation School Improvement Plan for each school in the District that is required tosubmit a SIP. 9. Waiver of Local or State Regulation-Local Level Decision Making Pursuant to Fla. Stat. § 1001.42(19)(b)

a. In order to exercise maximum flexibility, should a school identify a District or State policy that itwants to waive, the SAC shall be notified of this process.

i. The waiver request must be consistent with federal and state statutes, regulations, and rules.

ii. The waiver must be focused on maximizing student outcomes.

iii. The waiver must be based on research and best practices.

b. Except as provided in sub-section (c) below, the waiver process shall be as follows:

i. The school principal submits the waiver request for review and approval by the RegionalSuperintendent/designee and Superintendent/designee.

ii. If the Superintendent/designee agrees, the matter will be sent to Labor Relations to ensure thereare no labor relation issues to be negotiated or that this does not fall under Article IX, Section A ofthe CTA contract.

iii. If Labor Relations has no issue with the waiver, the Superintendent may recommend on a Boardmeeting agenda that the waiver request be approved by the School Board.

c. If the School Improvement Plan requires a waiver of the provisions covered by Article IX, Section A ofthe CTA contract, the waiver process shall include the steps in accordance with that Section A of the CTAcontract and

i. The SAC votes on a waiver proposal. If approved, the SAC submits the waiver request for review andapproval of the School Principal, Regional Superintendent/designee, and Superintendent/designee. Withtheir approval the SAC may submit the waiver request to the District's Waiver Committee (DWC), acommittee that is subject to the Sunshine Law.

ii. The DWC consists of: A. One elementary, middle, and high school Principal selected by their respective Associations; B. One department representative as appointed by the Superintendent and when the waiver isapplicable to the department; C. One representative from the Classroom Teachers Association (CTA).

iii. If approved by the DWC, the Superintendent/designee will submit the waiver proposal to the CTAPresident.

iv. The CTA shall review each waiver pursuant to the standards set forth in the CTA BargainingAgreement, to determine if the waiver constitutes a change in employee hours, terms orconditions of employment (the CTA Board of Directors is the governing body authorized to acceptwaivers, reject waivers, or accept waivers with conditions if they require a waiver of contractstandard).

v. If the waiver is not recommended by the DWC, the Principal and SAC will be notified by theSuperintendent/designee of any issues or questions the DWC has regarding the waiver and willhave an opportunity to amend the waiver for further consideration.

vi. If the waiver of Board Policy is recommended by the DWC and approved by the CTA, theSuperintendent may submit the waiver request(s) to the School Board for approval.

10. Training and Support

a. Training, support, and written materials shall be available for SAC members that include State andDistrict requirements for SACs, roles and responsibilities of SAC members, use of data for decision-making, the budget process, and timelines for developing the School Improvement Plan. All SACmembers are encouraged to review the SAC materials posted on the web site of the District'sDepartment of School Improvement.

b. If a SAC member or other member of the school community has a concern about the SAC's operation orcompliance with this Policy, such person may contact the District's Department of School Improvementoffice. The Department of School Improvement office will coordinate resolution of the issue, with theadvice and assistance of appropriate sources as needed, such as the Principal, Regional Superintendent,Deputy Superintendent Chief of Schools (or appropriate supervisory position), or Office of GeneralCounsel.

c. The Superintendent/designee shall schedule at least two (2) district-wide meetings regarding SchoolImprovement and SACs each school year. One meeting will provide School Improvement Training, andone meeting will provide School Advisory Council training and also provide an opportunity for SACmembers to give input on School Improvement to the Superintendent/designee.

11. School Budget

a. Each SAC shall assist in the preparation of the school's annual budget, which is prepared by BudgetServices, as required by Fla. Stat. §§ 1001.452(2) and 1008.385(1) for School Improvement Planpurposes.

b. To facilitate the budgeting process for the purposes of the school improvement plan, the SAC will havethe school's current fiscal year's Budget Status Summary as provided by Budget Services.

c. Information regarding other resources of the school, such as internal accounts, will be shared with theSAC on an annual basis for information purposes only as it relates to the School Improvement Plan ifrequested by SAC.
