Overview

Service Requests for road closures, fallen trees, grading maintenance and drainageproblems continue to be received frequently due to the 9 December rain storm andrequests are being attended to as resources are available.

Temporary/part road closures in the week ending 7th January 201 1 were:

Significant damage in excess of $100,000 was incurred on Bridge Creek Road, FoggsCrossing Road, Kangaloolah Road, Mulgowrie Road, Rhyanna Road, Lost RiverRoad, Hollywood Road, Woodhouselee Road, Gunning Road, Bevendale Road,Jerrara Road, Mullengrove Road, Glen Erin Road, Reids Flat Road and Rye ParkRoad,

On 22 December 2010, Council received an Interim Schedule of Works for FloodDamage response in the amount of eight hundred and thirty two thousand six hundredand sixteen dollars ($823,616.) This interim funding is for the costs of the emergencyresponses and 12 roads that had been assessed prior to the Christmas break.

Inspections of all of the 260 ULSC roads are well underway and as at 4 January 2011,134 roads had been inspected, photographed and an estimate of damage restorationcosts prepared. The estimated cost as at 4 January was slightly over two milliondollars ($2.0M). An update on the status of the inspections and damage costs will betabled at the Council meeting as well as a slide display of some of the most heavilydamaged roads and bridges.

A major works planning meeting is scheduled for 12 January 2011 to begin preparingan amended Works program for January - 30 June 2011. The outcome will bereported to the February 2011 Council meeting.

a. Have conducted further interviews for the position of Works Manager andmade an offer to one applicant. Council will be advised of the outcome of thenegotiations when they are finalised.

c. Attended Centroc Engineering Team Meeting at Orange on Wednesday 18January 2010. The meeting was called to discuss various regionalinfi-astructure projects that Centroc will be lobbying for to support fundingfrom Federal and State Governments.

d. Met with representatives of Origin Energy on Tuesday 18 January 2011regarding the Development Application for the proposed gas power station atKerrawary. A report relating to this meeting will be prepared for council'sFebruary meeting.

e. Lodged application for Natural Disaster Declaration as a result of heavyrainfall received in late November and early December 2010. My staff havesubsequently been actively engaged in cataloguing estimating and prioritisingrepairs to the damage sustained. Negotiations have commenced with RTAregarding funding for repairs. This matter is reported in more detail in a reportfurther in the Works Managers report.

f. Arranged a meeting of the affected residents of the North Street area regardingstormwater issues that they are experiencing. A more detailed report relatingto matter appears further in my report.

Precis: Council has sought advice from an arborist regarding a LondonPlane tree located near the proposed Collector Creek culvert.This report advises Council of his findings.

3. COLLECTOR CREEK CULVERT TREE REMOVAL

Background

During discussions (regarding the replacement of the Collector Creek bridge) with theCollector residents, some mentioned that they were concerned about the fate (bothlong and short term) of a London Plane tree located close to the site and adjacent tothe Lynwood Cafe (in Murray Street). Whilst Council's staff were hopeful that thetree could remain in its present location without a great deal of difficulty, promiseswere made to obtain the advice of an arborist to confirm Council's position (a copy ofhis report is attached for your perusal).

The tree is of unknown age and is only in fair condition at present with this conditionbeing caused by its location in relation to the road (affecting its root system) and theaggressive pruning carried out on the tree over the years. The tree has areas of diseasethat have probably been caused by trimming it to clear a power line that mns throughit and also to provide clearance for vehicles to travel underneath it. Council shouldalso note that the tree will require more aggressive trimming (approximately 2m ofmaterial) to provide clearance for trucks and buses to pass under it when the road isre-opened. This action will threaten the health of the tree, whilst excavation around itwill leave the tree exposed to overturning in windy conditions.

Whilst the Works Department are reluctant to remove the tree, the arboristrecommends that it be removed unless the amount of excavation around it and theamount of trimming required be reduced (both are almost impossible).

It also appears that even if the arborist's reqmrements are met, the tree may still diedue to its current disease status.

Arborist Report1. Introduction

The Upper Lachlan Shire Council requested an Arfaoricultural report be prepared oothepossible impact from proposed road and bridge works on a Platanus acerHolia (LdtidonPlane Tree) located on Murray Street, Collector. f

A site visit was undertaken on Friday the 3rd of December at which time Mr. Peter Mowle,the Works Manager of the Upper Lachlan Shire Council described the proposed worksover the phone at the time of the visit.

The following report contains an assessment of the present condition of the tree, the likelyimpacts of the proposed works and recommendations for alterations to the proposedworks. Tree protection measures to minimise the impact of construction on this tree areincluded.

1.2 Aims

To undertake a visual assessment of the tree and the location of the proposed works..

.To prepare a report containing an impact assessment on the tree from the proposedworks.

To make recommendations for design and construction modifications..

To make recommendations for tree protection methods during construction works..

2. Methodology

. The tree was assessed from ground level with no soil excavation to inspect theunderground root systems.Physical structure was assessed using the VTA (Visual Tree Assessment).

(Mattheck & Breloer, 1994. The Body Language of Trees.)A tree protection zone was calculated by multiplying the trunk diameter at 1.4.

metres above soil level by a factor of 12 as recommended in the Australianstandard AS 4970-2009, Protectfon of Trees on Development Sites.

3. Observations

3.1 The site

The London Plane tree is located approximately 12 metres to the south of "LynwoodCafe", on the western side of Murray Street, Collector.

The distance between the base of the tree and the edge of the bitumen at the closest pointis 2.5 metres and 3.4 metres to the designated road surface as indicated by the white line.

A gravelly, highly compacted soil is present between the edge of the bitumen and the baseof the tree.

A drainage swale is located at the base of the tree on the western side.

The live crown height above the road deck is approximately 3.5 metres.

The tree has been extensively topped to provide clearance around powerlines runningthrough the centre of the canopy and to provide clearance over the road deck.

Epicormic growth has formed at these lopping points.

Swellings in some of the major branches and the main trunk are indications of internaldecay.

Some of the new foliage has died back most likely due to an aphid infestation.

4. Proposed works

Mr; Peter Mowte of Upper Lachlan Shire Council detailed the proposed works in thevicinity of the tree as consisting of a 500 -600 mm excavation of the existing road and theconstruction of a retaining wall approximately located where a white line marks the presentroad surface.

The required canopy height above the reconstructed road deck needs to be 5.5 metres.

5. Discussion

The Aphid infestation and fomnation of epicormic growth are minor indications of stresscaused by the over removal of foliage during line clearance.

The existing canopy clearance above the road is 3.5 metres. An additional 1.5 to 2 metreslifting of the canopy would be required for the required 5.5 clearance

Highly compacted soil at the base of the tree will reduce the availability of oxygen atdeeper levels so that the roots will grow close to the surface. Tree roots need oxygen aswell as water and nutrients to survive and grow and will be located where these areavailable.

The trunk radius measured above the root flare of this tree is 49 centimetere which whenPlotted against the diagram below gives the minimum diameter of structural root platerequired for tree stability.

The trees of a similar size to the London Plane located on the eastern side of MurraySfreetwill also provkle some protection in extreme wind conditions, reducing the risk offailureTree roots however need to extend well past this point to allow them to absorb sufficientwater and nutrients to ensure the trees health and vigour.

6. Conclusions

The London Plane tree is in a fair only condition and will deteriorate to the point of demisein the short term if the road works are carried out as initially planned. The greatest impactwould be due to the proposed 500 - 600 millimetre deep excavation. Excavating to thisdepth wouM remove nearly 50% of the trees rootsystem, creating a safety hazard, morethan likely by the tree being uprooted in adverse weather conditions.

The extensive canopy pruning required to provide height clearance over the road deck willreduce the tree's ability to photosynthesis and subsequently its resistance to adverseconditions within the rootzone. The trees coping mechanisms to withstand pest anddisease attack would also be reduced.

The Australian Standards AS4970 - 2009, Protection of trees on development sites, statesthat incursions of 10% into the Tree Protection Zone is acceptable if the area lost can becompensated for elsewhere. This tree will experience greater than 10% incursion on theeastern side but it is understood that no works are proposed on the western side of thetree which woukl provide the necessary compensation.

7. Recommendations

It is recommended that modifications are made to the proposed design and constructiontechniques for the bridge and road works to minimise the impact on the London Plane tree.

Plane trees are considered to have a good resistance to construction impacts but toprovide the best conditions for long term survival of the tree it is imperative that thefollowing measures be undertaken.

Carry out the required canopy lifting before the start of excavations to minimise.

Condition 9requires that 'The surface of Denison Lane is to be upgraded to provide a bitumensealed pavement, over a gravel base compacted to 100mm thickness from the end ofthe existing bitumen to the eastern boundary of Lot B, totalling 40 metres in length'.The estimated cost of this 40m extension is $4,800.00.

Lot B contains a small open earth channel to drain the surface water runoff fromDenison Street and the owners are prepared to construct a 300mm pipeline across LotB to drain the runoff to Denison Lane. The owners are matching the existing 300mmpipe size and are prepared to grant an easement to Council to drain the Denison Streetrunoff through their property.

Report

There are a number of issues that the owners have raised regarding the s94contributions and the stormwater pipeline. These are:

i.) The proposed width of the easement is three metres (3.0m) and a reducedwidth of 2.5m is requested. There is no engineermg objection to this request;

ii.) The existing 300mm pipe is not large enough to carry the runoff from heavystorms from a mostly ULSC catchment (Denison Street). The preferredengineering solution is to increase the pipe diameter to 375mm and provide asecond kerb inlet in Denison Street. The owners are prepared to construct thelarge diameter pipeline if Council supplies the pipes and pit components;

iii.) The owners are prepared to allow Council to acquire approximately onehundred and thirty square metres (130m2) for the stormwater drainageeasement at nil land value if Council can meet the survey and legal costs forthe easement.

Background

The Council has previously resolved to plant thirteen (13) Bradford Pear trees inGoulbum Street between Spring and Colyer Streets. The proposal was advertised anda letter sent to the affected businesses. At that time, the doctors surgery located at 110Goulbum Street did submit a written objection to the loss of one parking space.

Report

The location of each tree was marked and sawn by ULSC Works staff in earlyDecember 2010. Mrs Thangavelu contacted me and requested an onsite inspection. Atthe inspection Mrs Thangavelu stated her concerns as:

i.) A deciduous street tree is not an acceptable risk when the surgery has toundergo an accreditation inspection;

ii.) There is insufficient parking for patients when the visitors centre has busydays;

iii.) There is warrant for a disabled parking bay and Mrs Thangavelu has requestedthat the tree planting be withdrawn and the space be used as a disabled carparksubject to Traffic Committee approval.

Comments

There is a maximum of three (3) car parking spaces available at the front of thesurgery. The proposed planting can be relocated to the western end of Goulbum Streetor used as a replacement tree if required.

rainfall and low water usage, water restrictions will not be required in the foreseeablefuture.

Good rainfaU has been received in Gunning, Dalton and Taralga with suppliescurrently reliable in those villages.

Routine bacteriological water tests undertaken at Crookwell, Gunnmg, Taralga andDalton continue to meet the requirements of the Australian Drinking WaterGuidelines 2004. Staff have however received numerous complaints regardingaesthetic' quality of water supplied in Gunning (colour and turbidity) and Taralga

(taste and odour). The water quality problems are a direct result of conditions in rawwater sources and cannot be addressed due to a lack of appropriate water treatmentfacilities m these villages. The proposed water upgrades for Gunning and Taralga willaddress these shortcomings.

B. Wastewater Treatment and Production

A total of 140.6ML (4536kL/d) of wastewater was treated at the CrookwellWastewater Treatment Plant in December 2010. This compares with 66.7ML(2222kL/d) treated in November. Continuing, above average rainfall and saturatedsoil conditions have resulted in continuing significant inflow into the system. Theflood event led to significant inflow and damage to infrastructure resulting indischarge of dilute untreated sewerage to the Crookwell River. Regulatory authoritieswere advised and appropriate processes undertaken.

The Gunning STP continues to operate effectively with increase m flow following wetperiods less pronounced than that experienced in Crookwell. The flood event causedsignificant inflow into the system and triggered the flood mode of the treatment plant.While treabnent was reduced no direct discharges resulted.

Effluent quality produced at the respective plants continues to comply with EPAlicences; however discharges that occurred are a breach of licensing conditions. The

EPA has been advised and owing to the extreme rainfall event and appropriate actionby Council staff, no further regulatory action is expected.

C. Maintenance Activities

Maintenance tasks undertaken include water meter reading, mains flushing, the repairof leaking water services, and mamtaining and servicing pumping equipment.

D. Flood Damage

The December flood events resulted in damage to water infrastructure in Crookwelland Gunning. The main issues involved scouring of the inlet well at Gunning andscouring of a retaining wall immediately downstream of the Crookwell Dam. Fullservices were mamtained throughout the event.

Significant damage to Crookwell Sewer infrastructure occurred with a 400mm sewermain crossing Crookwell River being dislodged by debris. The mpture resulted indischarge of untreated sewerage and inflow of flood water. An emergency pump(70L/s) was put in place the following day and a temporary pipe and support installedthe following week. A more permanent structure being a suspension bridge capable ofwithstanding a similar flood event is currently under design and fabrication.Regulatory authorities were advised of the event and have commended Council stafffor their rapid and innovative approach in addressing the problem.

Emergency response and restoration costs are being compiled to support anapplication to NSW Public Works for Funding Support under the GovernmentsNatural Disaster Relief and Recovery Fund. Council will be advised of full costs asthey become available.

Capital Projects

A. Taralea Sewerage Scheme

The construction of the Taralga Sewage Treatment Plant is now complete andcommissioning of the system is currently underway. Sludge from the Crookwell planthas been transferred to the plant as seed to commence generating the biologicalprocesst

C. Taralea Water Supply Uoerade

A concept design for a packaged water treabnent plant for Taralga is well advanced,with negotiations regarding the scope of work, treatment process and fundingarrangements continuing.

D. Dalton Water Supuly Uoerade

The Mayor, General Manager and staff recently met with Minister for Water the HonPhil Costa, and the member for Bumnjuck Katrina Hodgkinson regarding the Daltonwater supply project. Negotiations are continuing with respect to funding for a 14kmpipeline to link Dalton to the Gunning water supply system.

E. Gunning Sewer Extensions

Survey and design for the extension of reticulated sewerage services within Gunninghas been delayed due to staff availability. When completed, the design will allow forthe completion of a firm estimate which can be used to determine the likelycontributions of the Gunning sewer fund, landowner and developers towards theproject.

F. Collector Water and Sewer Strategy

Work has commenced on the development of a water and sewer strategy for thevillage of Collector. The strategy will develop a concept to provide direction forpossible future water and sewer utilities with in the village. Council's application tothe Federal Governments, Strengthening Basin Communities fanding program wasunsuccessful.

G. Gunning Water Upgrade

The Mayor and staff recently met with Minister for Water the Hon Phil Costa, and themember for Burrinjuck Katrina Hodgkinson regarding the Gunning water supplyproject. Negotiations are continuing with respect to funding for 100 ML off-streamstorage to address current and future needs of the Gunning water supply.

7. DRAINAGE PROBLEMS NORTH STREET CROOKWELL

Background

The entire area surrounding North Street is relatively flat and poorly drained. Theresidents requesting assistance from Council own lots 16 and 15 in DP 1809, howeverthe majority of lots in the area bounded by North Street, Soudan Road and GordonRoad are affected by water lying on them after heavy rain. This situation is caused bythe natural shape of the land as there is a natural depression in the middle of the area.The problem has a significant effect on the two dwellings with water lying in thebackyards for several days after rain.

There are a number of circumstances surrounding the present situation that aresummarised as follows:

The land was subdivided as part of the original town plan for Crookwell which.

was drawn up in the late 1870's. The subdivision is therefore not a subdivisionthat has been approved by Council.Council has had no opportunity to impose development conditions on any.

developer that would lead to the construction of the required drainage works.No Section 64 and Section 94 developer contributions have been collected in.

In answer to requests from the affected landowners, a meeting was held at the site onTuesday, 21 December 2010 at 6.00pm. The meeting was attended by Director ofWorks and Operations, Director of Environment and Planning, Clr Bill, Clr Barlowand approximately 20 residents. The residents advised the meeting of the effects thatthe flooding was having on their properties. The Directors and Councillors advised themeeting of the circumstances described above as well as dispelling many of the mythsthat the landowners had in their minds.

The Director of Works and Operations put forward a proposal to install aninterallotment drain along the rear boundaries of the properties as a communityproject that would be funded by the residents as a collective. This work would involveconstruction of the pipeline to a standard acceptable to Council and the creation of aneasement over the pipeline to ensure that it was appropriately protected and that therights of the adjoining landowners were also protected. It would be normal in thesecircumstances for Council to assume ownership and maintenance responsibilities forthe completed pipeline. The cost of the project is unknown at present as no designwork or estimates have been carried out. However a figure of $2,000 per lot wassuggested for discussion. Most residents accepted this as reasonable and several askedif they could participate in a pipelme project for a reduced number of lots ifunanimous acceptance wasn't reached. The owners of the majority of the remaininglots (approximately 10) advised that they were not interested in paying anythingtowards the project. Some of those present suggested that Council might be able tofinance the work and allow the residents to repay the costs over a period of 5 years (orso).

The meeting concluded with the Director of Works and Operations offering to carryout more investigation and costing of the pipeline proposal for discussion at another

8. ROADS FLOOD DAMAGE INTEMM OFFER OF ASSISTANCE

Background

As Council is well aware, the storms received during December 2010 have created asignificant amount of damage across Upper Lachlan Shire. Council staff are stillcataloguing and estimating the cost of the damage. An initial inspection of the shirewas carried out with RTA staff on 22 December 2010.

At that time, preliminary agreement was reached regarding some of the workrequired. RTA has subsequently made Council an interim offer of assistance that willbe revised when a full claim is lodged. Council staff have agreed to lodge the fullclaim by 28 January 2011.

The interim offer has been made to enable Council to commence work on somepermanent restoration works and has a value of $832,616.00 (a copy of the documentsare attached). Council is obligated to formally accept the interim offer.

Recommendation: That Council formally accept the RTA Interim Offer of flooddamage assistance to the value of $832,616.

Variations to an estimate of cost for ttie permanent restoration ofdamage will only be considered where it can be demonstrated that the necessity for the variationcould not be known at the time of estimating. Funding is in the form of an upper limit grant andonly actual expenditure up to the approved amount on any item may be claimed.
