Jávea CouncillorsDecember Meeting

We are unable to bring you a report of what theCouncillors decided at their December meeting as theTownhall did not advise us it was being held onWednesday 17th instead of the last Thursday of themonth. Afterwards Councillors and journalists joinedin a celebratory drink. We weren’t invited to themeeting or informal gathering last year, either.

The money from Alicantewas distributedproportionately to the numberof people on the ‘padrón’ ineach of Alicante’s municipalareas. It is a disturbing fact

that at the end of 2014 therewere fewer people admittingto living in Jávea than therewere at the end of 2013.Fewer inhabitants equalslower grants from Madrid.

Jávea is the beneficiary ofunspent money from theDiputación in Alicante at theend of 2013, which willfinance two projects tobenefit the municipality butwithout ongoing financialcommitment. The first iscreation of a new roundabouton the Carretera La Nao Pla,where it joins Av. de Arenal(formerly Av. Strand) andwill replace a temporaryconstruction created fromhollow plastic bollards. Thetemporary construction is not

large enough to causetraffic to slow and hasbeen the object of manycomplaints frompedestrians.

Further afield is thecommunity park atPinosol, where the servicearea has beenmodernised, and willconsist of a 200m2 Castle

construction that willincorporate different levels,towers and slides and it’s saidthe initiative for the projectcame from the children ofJávea.

The area is very popularwith families who use it forpicnics and BBQs, making itpopular most weekends andespecially for Fiestacelebrations for Andaluciansand other groups. CouncillorDoris Courcelles joined theMayor to announce the twoprojects and provided us with

patents on 3,133 ideas, according to theSpanish Patenting and Brand Office(OEPM). Of these, 2,893 were granted.Only around 300 are actually inventionsas such, and of these, only between twoand five percent are developed, most ofthem with foreign capital: around 80percent of Spanish inventions end upbeing made abroad. It’s not easy makinga living from creativity in Spain. It is acountry that has largely ignored itsinventiveness: last year, for example,around 16,000 patents were registered inFrance. In the case of internationalpatents, Spain’s 1,700 is a far cry fromGermany’s almost 18,000; in the UnitedStates the figure is 57,000. But despitethe obstacles they face, Spain’sinventors continue their work.

Taking on the mushroom mafias

The Civil Guard has carried out a seriesof operations throughout Spain as partof a crackdown on illegal harvesting ofwild mushrooms that has seen organisedgangs of up to 50 people camping out inwoodland for weeks on end andstripping forests of valuable species.

“There is huge demand,” explains aspokesman for the force’s Sepronaenvironmental protection unit. “It’s likedrugs: there is always somebodyprepared to buy.” He adds that so far theCivil Guard has been unable to establishwho is behind the practice. “But it’sclear that there are wholesale buyers.The whole thing is very well organisedand structured. So far, we don’t knowwho is selling the mushrooms.”

international private schools hasapproached JÁVEA Town Council withthe aim of building an internationalsecondary school for more than 500students in the Las Laderas area (nearthe urbanisation of the same name, nextto the Cansalades road). The projectwould involve the investment of some€15 million on a land area of 20,000m2. It would include the developmentof sporting and residencial facilitieswhich would be used by students andsports teams (e.g. cycling) who wish tocarry out pre-season training in theMarina Alta. The location is ideal sinceit connects up with the Laude primaryschool in Benitatxell. If approval is metand all goes well, ISP plans to completethe facilities by mid 2016 and startclasses in September of the same year.

Arnauda Riurau re-launched withcultural programme The 'Riurau dels Arnauda de Xàbia'relocated in the Parque Montaner abovethe Plaza de la Constitución was re-opened on Sunday December 21st witha morning of cultural events from11.30am including traditional music,dancing and poetry.

Recent works have extended theroofing along the length of its 42 archesusing traditional materials, includingsome 2000 canes and have providedelectricity and lighting to enhance thebuilding's use as a public space.

This project was voted 2nd in thecitizens' participatory budget votingexercise in November 2013.

Burnedwoodland near the picnic area has beenremoved and it is now possible to seeright across to the Torre de Gerro andValencia coast, a view which waspreviously obscured by the lush pineforest. Move to make the MarineReserve of the Cap de SanAntoni a UNESCO BiosphereReserveDenia Townhall has started moves tohave the Marine Reserve of the Cap deSan Antoni declared as a UNESCOBiosphere Reserve. They will needsupport from Jávea, the ValenciaGeneralitat, the Denia Marina and theCentral Government before the requestcan be subitted to UNESCO. Thefunction of these reserves is to preserveand protect biodiversity, as well as theeconomic and human development ofthese areas, research, education and theexchange of information among themore than 620 reserves in 117 countriesthat make up the global network.

Spain – A great place to live, aterrible place to work?Spaniards sleep fewer hours and worklonger days than their Europeanneighbours, but are less productive. Atthe same time Spain fails to attractoverseas talent, while tens of thousandsof well-educated Spanish youngsters areheading abroad in search of work. Thecountry also has one of the EU’s highestschool drop-out rates and a work culturehostile to the needs of families withyoung children. Meanwhile, its birthrate is fast approaching negative as itspopulation ages….Jaime Malet, head ofthe US-Spanish Chamber of Commerce,accepts that among the problems Spainfaces are widespread nepotism,absenteeism, and fewer incentives toimprove productivity, along with arefusal to recognise and reward talent.

Tourism ConsultativeCommittee rejects proposal to

build a hotel in the Cabo de sanAntonio Lighthouse

The proposal from the Alicante Portsauthority to build a "boutique hotel" inthe hotel of the Cabo de San Antoniowas rejected unanimously by Jávea’sTourism Consultative Committee. Theproposal, which came from a Deniacompany, did not involve the Xàbiaauthorities at all, and seems to havegone via a roundabout route. It willcreate two jobs, and an annual €30,000will be paid by the concessionaire. Thereis no mention in the proposal aboutservices such as sewerage disposal etc.The Committee was also informed oftwo initiatives: A marketing project topromote out-of-season tourism throughthemed weekend breaks and a regional"Family Club" membership and badgefor family friendly businesses. (Agenda21 Eds note: The Marketing project wasmet with much scepticism from thecommittee members, who stated that itwas important to establish a productbefore trying to market it! The proposalsfrom Committee members would bediscussed at a later meeting since someof them had to be weeded out since theywere not under the remit of Tourism).

Montgo Calendar sales to gotowards recovery of NaturalParkJávea Tourism Department has issued1000 copies of a calendar featuring theflora and fauna of the Montgo NaturalPark which will go on sale for €2 each.Photographers and writers havecontributed voluntarily to the project andproceeds from the sale will go towardsthe recuperation of the burned area ofthe Montgó Natural Park. iI the past,such calendars were given away free,but by charging for them the Town Hallnot only raises money, but also hopesthat people will value the calendar more.The calendar includes photographs ofMontgo, Cap de Sant Antoni, the CovaTallada its endemic flora and fauna, andheritage sites of the windmills and cavepaintings. Also some of the images areaccompanied by poems.

Jávea starts replantingindigenous trees in fire affected Jávea Townall staff have started to plantindegenous species such as wild oliveand kermes oak in areas affected by lastSeptember's wild fire. They have alsoput up signs asking people to keep away

How to be deepwithout Drowning

People are always asking me how Icame to be so decisive. My usualanswer is to say that I never wastetime thinking about things, believingthat the answer to most decisions canbe found on the back of a chair.Consequently I spend very little timein front of the mirror and never sayanything more complex than ‘yes’ tomy barber and ‘stop’ to mygreengrocer.People haven’t always appreciatedchoice; there have been times in historywhen men have consulted smoke, flocksof birds and even the entrails ofslaughtered animals (actually, I don’tknow if those animals were reallyconsulted), in order to try and work outwhat the Gods had in store, and whetherthis was the right moment to fill theplains with chariots of fire, buckets ofblood and ranks of flashing swords orstock up for a prolonged siege.The Ancient Greeks used to consult the‘Oracle’ when decisions needed to betaken. The original Oracle was locatedat Delphi in Ancient Greece on thesouth-western spur of Mount Parnassusin the valley of Phocis. There weremany rivals, as many as there arefrighteningly garish women and evenmore flamboyant men (or so I am told)shuffling cards on disreputable TV

channels today; but Delphi wasthe shining Nike (Goddess ofVictory) among the batteredplimsoles of defeat in those days.

The Chinese were far moreerudite when it came to makingchoices and would usually justpop down to the library to consultthe I Ching, the book of changes,which was a symbol systemdesigned to establish order inwhat seemed like random, chanceevents. The philosophy centres onthe ideas of the dynamic balanceof opposites, the evolution ofevents as a process, andacceptance of the inevitability ofchange..

The three keys tounderstanding the I Ching (apartfrom the useful skill of beingfluent in Mandarin) are simplicity,variability and persistence. Thelaws of the Universe are simple,however complex they may seem.Life is change, and a man mustadapt and be flexible. It doesn’tmention what women should do,but I imagine the men knew howto avoid arguments in those days.

As you would expect, with all simpleundeniable truths, Man has taken it uponhimself to argue about interpretation,although it’s generally agreed that Fu Hsiwas the creator of the I Ching, eventhough the adjective that is generallyapplied to him is ‘mythical’, which is notan especially helpful term for the seriousresearcher.Fu lived out his mythical days about2,800 years before the birth of Christ,discussing philosophy while our ancestorsin Europe, the heart of civilisation as weknow and love it, were picking nits fromeach other’s hair, often with clubs.

Fu was followed eight hundred yearslater by Yu, not much of an advance as faras nomenclature is concerned admittedly.He was however known and sometimesaddressed by the adjective ‘legendary’,and he developed Fu’s original 8 trigramsinto 64 hexagrams.After that, dynasties came and went,along with their vases, and anybody whowas anybody interpreted the I Ching asthe fancy took them. And even today,angels continue to pack themselves intophone booths after a few pints ofGuinness, and the more cynical among usstill contend that the I Ching is really onlya more sophisticated way of tossing acoin.

Nevertheless, the I Ching remains animportant influence, so much so that theflag of South Korea

pays homage to it, containing as it doesthe four trigrams representing Heaven,Water, Earth, and Fire, as well as theT'ai Chi symbol, (yin and yang indynamic balance). Yin and Yang, whichhave entered the English language andfound a nice cosy corner for themselvesamong the furniture-hungry middleclasses, are of course generalizeddescriptions of the antitheses or mutualcorrelations in human perceptions ofphenomena in the natural world,combining to create a unity of oppositesrepresenting the origin of all things inthe universe. Australia is 28 hours from Jávea - not asthe bird flies - but as the airline delivers!

Having come over to Australia forChristmas, I was asked by Clive if Iwould compare the differences in systemand entertainment living in Sydneycompared with Jávea. I did warn himthat such comparisons were difficult fora ‘Bradford Lad’ who lives in the 'Multi-Cultural Society', of Balcon al Mar.Clive, I did warn you - on your ownhead be it!

Oz TVFirst, television reception is in English(however there is a News programmethat makes several other languagesavailable) and much of the programmematerial is a direct copy of that from theUK. material, carrying lots of our ownfavourites, dramas like 'Missing' and of

course U.K. Premier Football, etc. In myopinion Oz TV has much to offer and ofcourse a fantastic range of Ozprogrammes covering every possibleinterest.

The Oz television distributioncompanies make a first class job ofproduction and distribution and qualityof both sound and vision was excellentat all times, even some of the older filmsemanating from the USA did not seem tocarry the grainy effect encounteredsometimes on programmes from the UKreceived in Spain!

Licence FeesAll TV and Radio are supported byAdvertising totally and so there is noescape from the ‘Unnatural Breaks’ ......however I do miss the Annual Feepayable in the U.K.

Signal ReceptionOf more interest I would imagine is themethods of transmission available in Ozand how they compare to the UK butmore importantly what the future mayoffer to us who have decided to makeour home in (Jávea or surroundingdistricts) Spain? I am sure it willdisappoint Clive that I did not squeezemy signal strength measuring kit into myluggage, and leave items like cothingbehind!

I find in Oz, and in particular Sydney,the system clearly way in front is that oftaking a feed signal from the existingtelephone system, (they enjoy the WiFisystem which is incorporated andsupplies a speed signal that can only beachieved by using the very latesttechnology), fibre optics.

This - now and in the future wouldseem the way to develop! With apopulation exceeding four millionpeople it is a very cost effective systempromising a huge catchment area andinstallers were guaranteed success as hasproved the case.

These findings are very similar tothose experienced in the UK, as moreareas are covered to meet a risingdemand. The speeds now available in Ozand the UK are not available here inJávea. Movistar can only supply me withspeeds up to 3Mb at best, however inJávea town for instance speeds up to9Mb and more are possible. Major citiesin Spain are coming on stream withmuch faster download times. As these

speeds become available there is sure tobe a swing to the acceptance of thissystem, after all, you would no longerrequire that large satellite dish anymore,making for a much more pleasingaesthetic appearance of your property!

Some of the local firms are nowoffering a small dish where there isdirect ‘line-of-sight’ to a strategicallypositioned transmission site situated on aconvenient mountain able to cover anarea, with a ready supply of candidatesinterested in such a system?

This method has proved to be quitesuccessful and has achieved some quiterespectful results, ranging from 4 to20Mb - more than adequate for themajority of users.

The future of 'fibre' when finallyavailable - cannot be understated - in theJávea area! Of course all these methodsinvolve a monthly subscription and if

December 8: 6:00 pm. It started tosnow. The first snow of the season andthe wife and I sat for hours by thewindow watching the huge soft flakesdrift down from heaven. It looked like aGrandma Moses print. So romantic, wefelt like newlyweds again. I love snow!December 9: We woke to a beautifulblanket of crystal-white snow coveringevery inch of the landscape. What afantastic sight! Can there be a morelovely place in the whole world?Moving here was the best idea I've everhad. Shovelled for the first time in yearsand felt like a boy again. I did both ourdriveway and the sidewalks. Thisafternoon the snow plow came alongand covered up the sidewalks and closedin the driveway, so I got to shovel again.What a perfect life.December 12: The sun has melted allour lovely snow. Such a disappointment.My neighbour tells me not to worry;we'll definitely have a white Christmas.No snow on Christmas would be awful!Bob says we'll have so much by the endof winter that I'll never want to see snowagain. I don't think that's possible. Bobis such a nice man. I'm glad he's ourneighbour.December 14: Snow, lovely snow! Wehad 8" last night. The temperaturedropped to -20. The cold makeseverything sparkle so. The wind tookmy breath away, but I warmed up byshovelling the driveway and sidewalks.This is the life! The snowplow cameback this afternoon and buriedeverything again. I didn't realize I wouldhave to do quite this much shovelling,but I'll certainly get back in shape thisway. I wish I wouldn't huff and puff so.December 15: 20 inches forecast. Soldmy van and bought a 4x4 Explorer.Bought snow tyres for the wife's car andtwo extra shovels. Stocked the freezer.The wife wants a wood stove in case theelectricity goes out. I think that's silly.We aren't in Alaska, after all.December 16: Ice storm this morning.Fell on my butt on the ice in thedriveway putting down salt. Hurt likeheck. The wife laughed for an hour,which I think was very cruel.December 17: Still way below freezing.Roads are too icy to go anywhere.Electricity was off for five hours. I hadto pile the blankets on to stay warm.Nothing to do but stare at the wife and

try not to irritate her. Guess I should'vebought a wood stove, but I won't admitit to her. I hate it when she's right. I can'tbelieve I'm freezing to death in my ownliving room.December 20: Electricity's back on, butwe had another 14" of the stuff lastnight. More shovelling. Took all day.Snowplow came by twice. Tried to finda neighbour’s kid to shovel, but theysaid they're too busy playing hockey. Ithink they're lying. Called the onlyhardware store around to see aboutbuying a snow blower and they're out.Might have another shipment in March.I think they're lying. Bob says I have toshovel or the city will have it done andbill me. I think he's lying.December 22: Bob was right about awhite Christmas because 13 more inchesof the white stuff fell today, and it's socold it probably won't melt till August.Took me 45 minutes to get all dressedup to go out to shovel and then I had topee. By the time I got undressed, peed,and dressed again, I was too tired toshovel. Tried to hire Bob, who has aplow on his truck for the rest of thewinter, but he says he's too busy. I thinkhe's is lying.December 23: Only 2" of snow today.And it warmed up to 0. The wife wantedme to decorate the front of the housethis morning. What is she ... nuts???Why didn't she tell me to do that amonth ago? She says she did, but I thinkshe's lying.December 24: 6" Snow packed so hardby snowplow, I broke the shovel.Thought I was having a heart attack. If Iever catch that guy who drives thatsnowplow, I'll drag him through thesnow by his hair. I know he hidesaround the corner and waits for me tofinish shovelling and then he comesdown the street at a 100 miles an hourand throws snow all over where I've justbeen! Tonight the wife wanted me tosing Christmas carols with her and openour presents, but I was busy watchingfor the snowplow.December 25: Merry Christmas. 20more inches of the slop tonight. Snowedin. The idea of shovelling makes myblood boil. I hate the snow! Then thesnowplow driver came by asking for adonation and I hit him over the headwith my shovel. The wife says I have abad attitude. I think she's an idiot. If Ihave to watch "It's a Wonderful Life"one more time, I'm going to kill her.

Wrapped up in there may be someinformation, very private to the owner ofthe Smart T.V. A good imagination willcause you to think twice before usingSmart TV to buy items, using your bank,credit card or PIN codes.

First impressions of SydneyNow a little about Sydney itself. Myrelatives live in an area that comprises oflarge housing areas with, on average, aplot of between half an acre and four orfive acres, with only one dwelling houseallowed per plot! Of course as youwander around and head into the Cityproper, it's very much of a cosmopolitannature, colour really does not seem to bean issue. It is nice to see besides the mixof those from the Continent, Africa,Middle-East etc. Turning my attentionto food, always a favourite, on offer are

the very best Restaurants of the World,capable of supplying top quality cuisineand at very sensible prices and a variety ofwines suitable for any palate (I amassured)!

Equally, having tried more competitivepriced restaurants I can vouch the value isstill very good at more economical prices.All nations seemed very well catered forand to suit all pockets!Places of WorshipClive did ask me (well, he would,wouldn’t he?) to check out the situationregarding Churches. My late wife Jeanwas very much a Church-goer and I didnotice a wide variety of places availablefor the many demands of the variousreligious convictions. Some weremagnificent buildings others much lessopulent, but judging from the attendanceon their chosen days, clearly thecommunity had much on offer whatevertheir beliefs.

Record year for foreign touristsBetween January and November lastyear, more than 61.7 millioninternational tourists visited Spain. Thatfigure is higher than the total for all of2013, 60.65 million, which is to say that2014 has already been a record year fortourist visits to the country. The countrybroke the 60-million barrier for the firsttime in 2013 – a figure that looked likeit would be difficult to beat, given that itwas partly due to the weakness of othertourist markets, such as Egypt, whichwas the victim of political instabilityduring the year. The United Kingdomcontinues to be the main source oftourist visits to Spain, accounting for aquarter of the total.

A Catholic Priest, a Baptist Preacher anda Rabbi all served as Chaplains to thestudents of Northern Michigan Universityat Marquette in the Upper Peninsula ofMichigan. They would get together twoor three times a week for coffee and totalk shop.

One day, someone made the commentthat preaching to people isn't really allthat hard, a real challenge would be topreach to a bear. One thing led to another,and they decided to do an experiment.They would all go out into the woods,find a bear, preach to it, and attempt toconvert it to their religion.

Seven days later, they all cametogether to discuss their experiences.Father Flannery, who had his arm in asling, was on crutches, and had variousbandages on his body and limbs, wentfirst.

'Well,' he said, 'I went into the woodsto find me a bear. And when I found him,I began to read to him from theCatechism. Well, that bear wantednothing to do with me and began to slapme around. So I quickly grabbed my holywater, sprinkled him and, Holy MaryMother of God, he became as gentle as alamb. The Bishop is coming out nextweek to give him first communion andconfirmation.'

Reverend Billy Bob the Baptist, spokenext. He was in a wheelchair, had onearm and both legs in casts, and had an IVdrip. In his best fire-and-brimstoneoratory, he exclaimed, ‘WELL, brothers,you KNOW that we Baptists don'tsprinkle! I went out and I FOUND me abear. And then I began to read to my bearfrom God's HOLY WORD! But that bearwanted nothing to do with me. So I tookHOLD of him and we began to wrestle.We wrestled down one hill, UP anotherand DOWN another until we came to acreek. So I quickly DUNKED him andBAPTISED his hairy soul. And just likeyou said, he became as gentle as a lamb.We spent the rest of the day praisingJesus. Hallelujah!’

Townhall proposes newLaw to put limits on

activities which disruptcivic life

Jávea Councillors discussed a proposednew Law for civic coexistence andsecurity, an administrative tool thatregulates the uses of public space "as aplace of coexistence and civility inwhich to develop free citizenshipactivities with full respect for the dignityand rights of others and the plurality ofexpressions and various life formsexisting in Jávea".

Mayor, José Chulvi, said the proposalwill replace a Law passed in 1953 andanswers many current problems, givinga legal framework with which to tackleproblems in legal limbo, such as ‘bottleparties’ on open land, door-to-doorselling, abandoning plots or disobeyingred flags on the beaches.

The Mayor insists the basic purposeof this ordinance is not to pursue thecitizen, but to be an effective tool incircumstances that may affect or altercoexistence.

It is the outcome of almost two yearsof work in departments such as PublicSafety, Services and input from advisorycouncils as Planning or the Agrarian. Itwas discussed in the Information andServices Committee which unanimouslyapproved the proposals. Once approvedby Councillors it will be effective withina month.

Police Inspector Jose AntonioMonfort, said the 189 articles (theChurch of England has only 39) of theordinance-limiting actions thatundermine dignity, deal with visualdegradation of the urban environment(painted, banners, posters and leaflets)and activities such as betting, intrusivebegging and the demand for sexualservices, conducting physiologicalneeds, noise, consumption of alcohol,unauthorised street vendors, the vandalattitudes in the use of street furniture,obligations when organising publicevents and other behaviours that disturbpeaceful coexistence.

Another section is limited to theprovisions relating to the cleaning ofpublic areas and collecting municipalwaste. And other sections regulatecleaning buildings, plots and agriculturalplots, use and enjoyment of the beachesand coastal areas and ownership of petsand their limits in public areas.

Among the new penalties introducedis that besides the powers given topolice inspectors to open disciplinaryproceedings, and to rescuers to prohibitbathing at beaches, is a power to theMayor, who may issue orders to addressurgent situations.

I would like to takethis opportunity to thank all thosepeople who brought food for theHarvest Festival and gifts for thechildren, they were veryappreciated.As I write this article, news isjust coming in that more than 40bodies have been retrieved fromthe Java Sea after the discoveryof debris from missing AirAsiaflight QZ8501. Our thoughts andprayers are with the family andfriends of all those people whohave had their lives so suddenlytaken from them. It makes usrealise how fragile life is andhow important it is to heal brokenrelationships and to forgive thosethat have hurt us. It must havebeen terrifying for those peopleon board that flight when theplane got into difficulties. I havebeen on flights, one in particular

hit by the crisis, which wereplaced under the tree. In the weekbefore Christmas Pastor Marcosfrom the Spanish EvangelicalChurch who holds his services inthe town, came and collectedmost of the food we had from ourHarvest Festival table. Marcoswas organising a lunch onChristmas Day for homelesspeople or families hit by thecrisis and he wanted to give eachfamily extra food to take homewith them as a gift.On Christmas Day after our ownChurch service at the Oasis,which was well attended, Cliveand I collected all the gifts fromunder the tree and delivered them

Christmas is over for anotheryear, for me it was last minutepreparation and shopping. Inmid-October when we put ourChristmas cards on display atthe Oasis Centre it seemed to beweeks away, but where havethose weeks gone? Decemberwas a busy time for us at theOasis selling cards andcalendars, as well as helping oradvising people when they haveproblems or need advice.As I wrote in the last issue, wehad a Christmas tree andencouraged readers andcustomers to bring small giftseither wrapped, or for me towrap, for children from families

ANSWER: This regulation of the EU650/2012 deals with different things,but the reason English citizens need tolook at their will is that this newRegulation of the EU establishes that:

1. When a person dies residentin one country of the European Unionbut national of another, the lawapplicable to his/her inheritance willbe the one that he/she has establishedexpressly in his will and not the oneestablished by the International Normsof each country (which may be inconflict). This is good news becausean English national living in Spain canestablish that he/she wishes EnglishLaw to rule his/her inheritance andthis will avoid any possible risk ofclaims from children against thespouse on the basis of the system ofobligatory heirs established in Spanishlaw, which has always caused worryand concern in the case of childrenfrom previous marriages etc.

2. If a person passes away afterthe 17th of August of 2015, unless hehas said differently in his will (asexplained above), the legislationapplicable to his inheritance will bethat of his country of last residence.This is very important for Englishpeople living in Spain, because underSpanish law you cannot leaveeverything to your wife as 2/3 of theestate has to be left to children. Ombudsman orderstransfer from suspected

liberation schemeThe Pensions Ombudsman has ordered amember be allowed to transfer out of asuspected pensions liberation scheme ina landmark ruling.

However, while the Ombudsman hasordered for the scheme to repay atransfer value of at least the originalamount plus interest to the member it hassaid it possible the member’s entirepension savings have ‘disappeared’.

Pension liberation, also known aspension release or pension unlocking, isthe practice of transferring legitimatepension savings into a new scheme thatallows the saver to access their pensioncash before they reach 55.

This case is one of many suspectedpension liberation cases the Ombudsmanis currently deciding. In early January2015 the Ombudsman will publish aseries of decisions relating to caseswhere members have requested atransfer, but have been blocked by theceding scheme due to fears that the newscheme is a scam.

These cases are different to the onethe Ombudsman has ruled on. In the caseof ‘Mr X’, he transferred almost£370,000 in June 2012 out of definedbenefit NHS Scotland scheme to theCapita Oak Pension Scheme after beingtold he would get investment returns of 8to 12%.

Once the transfer went through, hebecame concerned about his decisionand asked to transfer out of the CapitaOak Scheme. The trustee, ImperialTrustees Services, never responded to hismany requests.

The Ombudsman ruled the membershould be entitled to transfer out of thescheme.

The ruling stated: ‘We directed thetrustee to pay a transfer value of at leastthe original amount, plus interest. Mr Xcan enforce the direction in the courts,though the Ombudsman noted that evenif the trustee engaged with enforcement,Mr X might find that some or all of themoney had disappeared.’The Pensions Ombudsman said that as ofOctober it had received 140 complaintsin relation to pension liberation andnearly 90% of these are from peoplewhose pension provider has not alloweda transfer because the provider believesthat its purpose is pension liberation.

Conclusion:The new regulation has given muchmore strength to the testators /testatrix,letting them choose between Englishor Spanish Law, which is good, butprecaution is a must because under thenew regulation, if nothing is said andyou are a resident in Spain,automatically the law applicable willbe Spanish law which does not permitthat spouses leave everything to eachother if there are children.

To avoid nasty surprises visit yoursolicitor and arrange for the Notary tochange the wording of your will due tothe new Regulation of the EU.650/2012.

Capital Gains Tax in Spainfor 65 years old or over

Question I am a 65 year old IrishCitizen, and I intend to sell my propertyin Spain. I have heard that my age givestax advantages in the amount of CapitalGains Tax payable on the sale. Is thistrue?

Dear reader, thank you for your enquiry.In article 33 4. B) of Law 35/2006 ofIncome Tax for Individuals, it stipulates:

‘the gains as a consequence oftransfer of the habitual residence (home)by any person 65 years old or over, orpeople experiencing severe or highdependency’ shall be exempt fromCapital Gains Tax.

Therefore, you would pay no capitalgains tax if you meet the following tworequirements:

i) That you are 65 years old or overat the time of transfer, or in this case, atthe time of the sale, and

ii) If the property sold is your mainand habitual residence. You must be taxresident in Spain, the law says that "theproperty would be deemed as habitualresidence….that in which the taxpayerresides for a continuous period of threeyears", although some exceptions areallowed.

As always, if you are going to sellyour property, it is very important thatyou prepare all documentation and verifythat you have everything in order to sellwithout problems. Also, for tax purposesit is essential to check that your propertyis registered as your main and habitualresidence.

However, it is worth noting thatrecent tax reforms approved by Law26/2014, of 27 November, introducesome changes that affect people’s capitalgains when they are 65 or over. The newArticle 38.3, says: ‘any gain as aconsequence of the transfer of assets by ataxpayer 65 years old or over, may beexempted from capital gains tax,provided that the total amount obtainedby the transmission, is within six monthsinvested into or to establish a life annuity(renta vitalicia) secured in his favour ...The maximum total amount that could beused to set up these annuities will be240,000 euros.”

Therefore, in the future, if you are 65or over, and you sell a property, even if itis not your principal residence, you couldend up paying zero capital gains tax ifthe proceeds of the sale are invested inan annuity.

Following a review on recent courtprecedents, we are happy to report anincrease in court orders granted againstbanks forcing them to repay buyers themoney they lost in the purchase ofproperties off-plan, even when thepurchasers did not have individualguarantees set up in their favour, for themoney paid on account. The bank undertaking to guarantee ina general way the amounts paid inadvance by the purchasers in adevelopment (i.e: general bankguarantees line), even though the bankdid not hand over an individualguarantee for the purchaser.2.-That the payments on account werenot guaranteed by the developer orguaranteed at all, and the bank receivedthe money in their opened accountwithout ensuring that the guarantees ofthe law 57/68 (bank guarantee orinsurance policy) to cover the moneywere set up by the developer, as the lawrequires.

When Clive and I come intocontact with people living ontheir own, we suggest they find afriend who lives nearby tobecome their telephone safe lineand hold a spare key to their villaor apartment. It is very easy tooperate. Each morning at anagreed time, friend "A" ringsfriend "B", lets the phone ringtwice and then replaces thehandset. Within seconds friend"B" returns the call, lets it ringtwice and then terminates thecall. The telephone hasn't beenanswered so there is no chargebut each friend knows the other isalright. If one or the other doesn'trespond, the spare key is used toenter the house.Have you made any New Year'sResolutions this year? from Paris to Johannesburg, whenwe have hit bad turbulence. Itlasted for 20 minutes and at thetime it hit, Clive was in the toilet.He explained afterwards that afterinitially feeling alarmed he had noalternative but sit on the seat andgrab hold of the handles. He saysthat locked into a 1.5metre roomby 4 walls, next to the tail, Godreminded him that planes rarelyreverse into anything at 30,000ft.I know the holdups at airports forsecurity checks are annoying attimes but I feel much safer flyingknowing so much care is taken toprevent anything dangerous beingtaken taken (or placed) in theplane. I remember many yearsago we were going on a flightfrom Manchester to Palma, was itwith Dan Dare Airlines? and aswe were climbing the steps to theplane, a young man pushed pastin the opposite direction, rushingto get off the plane and mutteringloudly "Let me get off. I just can'tdo this. Let me get off." He wasn'tstopped or challenged by any ofthe aircraft staff and when wewere seated and the plane hadtaken off, I noticed a small casepushed under the seat on the otherside of the plane. I pointed it outto Clive as there was nobodysitting there. We called thestewardess and pointed out theunaccompanied case and wassurprised at how uninterested shewas in it. "It probably belongs tothe young man that got off theplane before we took off, I willtake it up to the captain." Andwith that she was gone - with thecase - and us wondering what wasin it and why was the young manso intent on leaving the plane,without his hand luggage. It wasnot a pleasant flight for us!!!I have heard during this pastmonth, of a lady who fell over inher villa and wasn't able to letanyone know she needed help.The other problem was that

We stopped at a busyservice area in the Alicanteprovince to fill up with diesel.After we had filled up, we left thecar and went to use the toilet andwhen we returned and belted upready to continue our journey, aMoroccan came and knocked onthe window and indicated that wehad a flat tyre. I got out andlooked and it was well and trulyflat. There was definitely nothingwrong with the tyre when wedrove in for diesel. At the time Iwas editing the Grapevinemagazine and always updatingreaders on the latest scams orantics that robbers got up to.Clive and I looked at each otherand he said "We have been set-up, but at least we have beenwarned!" Clive got out of the carand went to open the boot, takeout the spare tyre, jack and toolswhile I stayed in the car. He shutthe boot and I got out of the carand we locked the car up. If Cliveneeded anything from the boot, Iopened the boot, got the item outand locked the boot again. Therewere several people watching uschange the tyre, including oneteenager about 17 years old on aspeed bike that was so close tothe car he was almost touching itand he was watching everythingso intently. Because we were on astretch of motorway that was freeof tolls, the service area could beused by motorway traffic and alsoother traffic in the area. If the boydid manage to snatch anything, hewould have been away on hisbike in no time. When we tookthe tyre to get it repaired the next

Spotlight on Jávea People

This column is about the people in ourcommunity and their everyday lives andconnections to the area of Jávea. Lastmonth we turned on the Spotlight tofeature a local artist named Sally Marand her personal history and connectionsto Jávea.

Our Jávea Jeard spotlight this monthfocuses on Michael Taylor a skilledArchetier - a bow maker for stringedinstruments - who learned the craft whenhe was an apprentice to Luthier, astringed instrument maker.

During a recent conversation with Clivein the Oasis Centre about our favouritetypes of music we somehow managed toget onto the subject of how instrumentsare made, Clive then asked me if I hadever seen a bow maker in action.

My reply to his question was, “NoClive, have you?” He said “Yes and Ithink you should contact Michael Taylorand arrange an interview with him as hewill show you how he makes his bowsout of a block of wood.”

I thought to myself that this assignmentwould be an easy one as using a lathe toturn a block of wood into a bow andthen adding an elastic band must bestraight forward, but how wrong andignorant of me to think like this.

Our report begins when I contactedMichael and arranged to meet with him

at his workshop near to Jávea GolfClub. After introducing ourselves,Michael escorted Linda and I into hisworkshop.

The workshop had a store room, lathe(where I thought ‘here we go’), workbench and all the intricate tools requiredto make and restore fine bows. Michaelwas born in my home town ofWimbledon, London, on December 30th1949 but grew up in Merstham nearRedhill and attended Albury ManorSchool where he excelled in most of hisstudies, especially art and music. Hisfavourite lesson was metalwork and wasselected by his teacher to take uptechnical drawing as well. During hismetalwork classes he built a three and ahalf inch gauge (0-4-0) model of RobertStevenson’s Rocket, which later helpedhim secure his first job.Before leaving school Michael fanciedhimself as a musician because he was agood accordion player, although he oncefocused on becoming an architect. Theteachers put Michael’s musician’sdreams down but his head teacher, MrJones, had more of a sympathetic earand suggested to him that he should takeup an apprenticeship as a maker ofmusical instruments which wouldprovide a skill to fall back on should his

music career not work out.

Mr Jones arranged for Michael to havean interview with Mrs Fazakerley, thecompany secretary who was responsiblefor the hire and fire of staff at ArnoldDolmetsch Limited. For the interviewMichael took with him the model he hadbuilt of Stevenson’s Rocket. The modelso impressed Mrs Fazakerley that hercomments to him were, “if you canmake a model like this then I am sureyou can make anything”. Needless to say in 1968, Michael leftschool and took his first job as a luthierat Arnold Dolmetsch Limited inHaslemere, Surrey. Ironically all hismetal work skills he had gained duringschool now had to be retuned in favourof wood work. The company was wellestablished as the founder was Eugène

Arnold Dolmetsch (24/2/1858 to28/2/1940), a French born musician andinstrument maker who became knownfor reproducing almost every kind of oldtime musical instrument from the 15thto 18th Century. During his time he hadbuilt viols, lutes, violins, cellos,recorders and a range of keyboardinstruments.

He was also famed for the revival of therecorder and for the InternationalDolmetsch Early Music Festivals. TheDolmetsch family still operate theirbusiness today hand crafting and sellinginstrument masterpieces from days goneby.

In the first year of Michael’sapprenticeship he made seven rebecinstruments, (a narrow boat shapedinstrument with between one and fivestrings. It is held under the chin or armand played using a bow). DuringMichael’s second and third year hemade two early forms of harp (the logoof Guinness) and started to make atreble and tenor viol (Violin soundinginstrument played between the legs andthe strings are also played using a bow).In the strings department of ArnoldDolmetsch they were great believersthat one person should hand-build thewhole instrument which Michael alsoadopted and continues to do so throughto this day.

At the start of his third year the bowmaker for Arnold Dolmetsch announcedthat he would no longer be makingbows and Michael was asked to learn“Baroque Bow” making, which was thetype of bow used during the Baroqueperiod of music. This period startedafter the Renaissance and before theClassical periods. He was promised bythe company that he would be trainedby Arthur Richard Bultitude, MBE(14/02/1908 – 1990) as he was acraftsman bow maker who had workedfor W.E Hill & Sons, the mostprestigious violin firm for most of the20th century. However this nevermaterialised, although Michael taughthimself how to hand-make Baroquebows which was the start of his bowmaking career.

Michael became increasingly fed upwith his apprenticeship as he felt histraining had been lacking the qualitywhich was not helped by the supervisor,who often turned up for work late anddid not dedicate the necessaryapprenticeship time for Michael. After a chat with the company owner,Michael decided to resign and leave

Both Pamela and Michael finallydecided in 2001 that the British climatewas not serving their best interests anddecided to move to the Costa Blancawhere they had been coming for theirholidays over the past twenty sevenyears. Although a few issues arose withthe sale of their house it was not untilApril 2002 that the move was finallyrealised. After moving to Jávea, Pamelaretired but Michael decided to set up aworkshop as he wanted to continue withhis work.

Sadly, Pamela passed away a few yearsago but I understand that she enjoyedthe local beaches, the climate andalways found the time to ask afterothers.

Many of the great bow makers usedmaterials that are now found on theendangered species list and therefore itis technically illegal to sell or acceptthese fine bows because they containIvory, Tortoise Shell, Whale Bone andthe wood from trees like Pernambucoand Ebony. Michael said we have to becareful about the CITES list:Convention on International Trade inEndangered Species, as some materialsare on the appendix B list which meansthey can be used providing they arederived from a sustainable method andare not taken illegally from the wild. Heconfirms it is true that future bowmakers will have to adapt and find newmaterials to use and adds that there aresome materials like carbon fibre andsplit cane that are being appraised.

An article I read on the web prior to myinterview with Michael indicated thatfossilised mammoth ivory, bone andsynthetic shell are becoming widelyavailable to the bow makers but when Iput this to Michael he said that he wasnot sure if this was the case. He said “Ihave recently written a letter toPresident Barrack Obama outlining myconcerns about the comments made bythe U.S. customs who have suggestedthey will confiscate and destroy anyitems now containing any illegal parts.My question to President Obama is this,“would you take a valuable and historicpainting such as the Mona Lisa, whichin theory could contain illegalingredients within the paint, and destroyit?” …. of course not, so why ban themovements across the world of certifiedantiques from private collectors after allthe materials used at the time weretotally legal?”

Arnold Dolmetsch, and so in 1972,Michael walked out on hisapprenticeship completing all but threemonths of the four years. He was thenoffered a job with Ealing Strings, Ealing.This is where Michael learnt the art ofmaking fine bows and eventually hebecame the head of the bow workshop.Ealing Strings was founded by the lateMalcolm Saddler (D 1994), BrianParkinson and Alan Mann. A wellrespected bow maker William CharlesRetford (1875 – 1970), also lived just around the corner from the company and William planted a deep interest in bowsfor Malcolm. William had previouslyworked for the W. E Hill and Sons(Established 1887 - 1992) workshops inHanwell, and was influential on whatbecame known as The Hill Bow. Manyfamous stringed instruments like theAlard Stradivarius, Messiah Stradivariusand Lipinski Stradivarius passed throughthese workshops.

By the time Michael had joined EalingStrings, William C. Retford had beenpassed away for a few years butMalcolm Saddler continued his greatlove for bows and under his guidanceMichael developed further knowledge ofthe modern bow and soon foundadmiration for the classic French bowmakers including Peccatte and Tourte(the founders of the modern bow in1780).

While attempting to reproduce theclassic French bows, Michael found thatthe early bow makers were more thanfine craftsmen - they were true artists.Early bow makers like Peccatte andTourte seemed to comprehend thescience of how and why a bow workedenabling them to produce not only finepieces of crafted work but also aninstrumental tool in itself. As Michaelbegan to restore bows from the earlyperiods he began to understand thefundamental importance of why acertain bow was made and therefore hewas then able to emulate and recreatethe works of the great craftsmen. Duringhis time at Ealing Strings he had worked

on as many as fifteen thousand bowswhich included many fine specimensfrom the great makers of the past.In 1975, Ealing Strings decided topublish a book and hold an exhibition tocelebrate the 100th anniversary of thebirth of William Charles Retford.Michael produced the photographs forthe book which he proudly showed me.In 1982, Michael was involved inorganising the bicentenary birth ofNicolo Paganini where he made twentyfour violin bows. Each bow had piecesof gold and ivory mounted onto them.Each piece of ivory had scrimshawimages of Nicolo Paganini engraved onthem and were completed with bars ofmusic from each of the twenty fourcaprices (musical pieces written byPaganini between 1802 and 1817. Theworks were published in 1819) whichwere engraved in gold by Derek Tipsonwhose work Michael has always beenproud to see on his bows.In 1987 another three exhibitions werearranged in the shop at Ealing Strings,the first praised the work of Portugueseviolin maker Antonio Capela (B 1932),the second praised William Luff, MBE,(7/9/1904 – 30/10/1993) English violinmaker and the final exhibitioncommemorated the 350th anniversary ofAntonio Stradivari (1644 - 18/12/1737)who is regarded as the greatest stringedinstrument craftsman ever and today theprices of his original instruments canfetch millions of pounds making themalmost priceless.

Both Antonio Capela and William Luffhad made a number of Stradivari copiesso the idea for the exhibition was tobring together these copies with theexhibition theme being called the“Eternal Influence of AntonioStradivari”, who as we know had amassive influence on the community ofthe stringed instrument makers. Michaelcontributed by making a copy of thefamous “Hellier Stradivarius Violin”,where the original was made circa 1679,and he photographed all the violins,violas and cellos used in the exhibitionfor the catalogues. During the 1990sEaling Strings became a Limitedcompany and Michael was offered aDirectorship within the business.

In 1994, eleven months after MalcolmSadler passed away Michael decided toleave Ealing Strings and branch out onhis own calling his new company TaylorBows. Both he and his partner Pameladecided to make the company Limitedand for several years they worked fromtheir village home in Hedgerley in theleafy suburbs of South Bucks. The

There are bow collectors in the U.S. whohold original works from the greatmakers like Tourte and Peccatte and nowhave no access to the best craftsmen whocan properly refurbish and restore theseworks of art. The fear is that customscould confiscate and destroy a pricelesspiece. It is the case now that many bowsare being damaged or destroyed byunskilled craftsmen and others will beallowed to simply fall into natural decay.

Michael said that bows cannot beshipped from the U.S. to Europealthough movements within Europe areallowed but for how long is the primequestion. At the time of writing Michaelhad not received a reply from the WhiteHouse but he does expect to have one inthe near future.

So how is a bow made?Michael says “Before we start there aretwo things you need to know, first aluthier needs to be a cabinet maker, awood carver and must understand howstringed instruments work, and anarchetier must be a wood carver,jeweller, engineer and toolmaker.”

Michael makesall his specialtools andgauges to createthe types ofbow he ismaking.A question bothLinda and I hadis why is a bownot called a stick? Michael said “Thebow is the entire assembly whichincludes the stick, hair (ribbon), frog andbutton although there are other parts.”

The bow assembly is a precisionpiece of equipment and is influential increating the sound when the ribbon orhair of the bow is moved across thestrings of an instrument such as a Violin,Viola and Cello.

Michael showed Linda and I, asmall trunk of Pernambuco wood, anexotic hard wood with a burnt reddishorange colour. He explains the trunkmust be checked for the position ofnatural cracks and then you can start tomark out the trunk into quarters like acake avoiding the cracks. From onepiece of half a trunk measuring 1 metre(3 ft) with a diameter of 30 centimetres(12 inches), Michael might expect tomake seven

to eighteen bow sticks but it depends onhow many natural cracks are in thetrunk. After marking out the quarters Michaelcuts the log into billets using a bandsaw. The billets are then marked outcreating the shape of a bow with thehead at one end and a taper towards theother.

Once the shape is marked onto thebillet, the next stage is to hand-plane thewood and smooth out both sides of thewood. He then uses a homemademeasuring scale with various incrementsto provide a better and more accuratemeasurement for the bow tapering fromthe head to the butt.

After planing down the wood the featurehas a bow like shape but there is morework to be done so the next stage is touse a standard block plane tool thatwhen used, again by hand, gives thewood an octagonal shape as this iswhere the frog is fixed. After fitting thefrog to the stick it is hand-planed againbut Michael then uses a round bladedplane running up and down the length ofthe stick to create a cylindrical finish.The process of planing continues manytimes until Michael is happy with theend result.

Once Michael is happy with theshape of the stick he then begins themost nerve wracking and delicate part, a3Kw fan heater is switched on and thenMichael puts pressure onto the stickforcing it up to almost breaking point.When the stick pushes back he thenstops and takes the stick immediatelyaway from the heat creating a gentlecurve or camber. He repeats the processmany times before the curve or camberis correct. At this point he says to me“Can you imagine how jittery it can bewhen you have a priceless bow in yourhand to restore?” I tried with a damagedstick and can assure the reader thatwhen you are putting pressure upon thestick it feels as if it could snap at anymoment and the anxiety levels rise buthaving a priceless stick in your handsdoes not bear thinking about.The stick is then hung for up to twoweeks with daily curve or camberchecks and further adjustments are madeif required. Once the stick passes thecurvature test the hand polishing processstarts with different grades of paper.Starting with grade 320 silicon carbidepaper (smoother than standard emerypaper), the stick is hand sanded usinggrades 600, 1000 and 2000 to completethe process, which takes about five

hours from start to finish.

There are two options offinish, Michael usesboiled linseed which hebrushes onto the sticksand leaves out in the sunto dry. The sun alsodarkens the wood to givea splendid natural finishor another technique heuses is French polishingusing shellac.

To make the ribbon forthe bow you need a hankof horse hair and the strand quantitydepends on the type of bow you aremaking, take 140 strands of naturalwhite horse hair for a violin, 160 strandsfor viola or 200 strands for a cello. For adouble bass you will need 340 strands ofgrey hair. The mix of grey and white hairis also known in the trade as salt andpepper.Once the hairs have been soaked inwater and combed they are then threadedunder a wedge while wet and insertedinto the head. At the other end the hairattaches into the frog forming a ribbonrunning the length of what is now calledthe bow stick or bow.

A tension screw is added

at the same end as thefrog and this willeventually be used totighten the bow. Did youknow that if you touchthe dry horse hair withyour fingers then the oilin your fingertips willtransfer into the hair anddecrease the quality ofthe finished ribbon. We all conntinue to see our townneighbours jobless and a considerablereduction in loss of social rights,especially in affected families, andgroups most at risk are our children, theelderly, pensioners and unemployed.

An event that will remain etched inthe retina this year to all who live here isthe fire on La Plana Natural ParkMontgó.

I also want to highlight thefrustration suffered when the Ministrydenied us permission to dischargefireworks at the conclusion of the Marede Deu del Loreto fiestas, after morethan 50 safe launches and huge publicappreciation.One wish: that economic recoveryfinally becomes a reality. Thatrecuperation reaches all citizens and notonly macro or micro sections, which isfine, but we want these improvements toreach everyone. If so, we will recoverthe illusion of truth in the immediatefuture that awaits us.
