The JCCMHFB Meeting was called to order by Beth Diveley at 8:55am. 1. Approval of Agenda
The June 18, 2018 meeting agenda were reviewed with no changes requested.
Recommendations: “I, Jerry Rogers move that the June 18, 2018 agenda be approved as
presented.” Josh Isaacson seconded the motion. The motion carried.
2. Approval of April 9, 2018 Meeting Minutes
The April 9, 2018 meeting minutes were reviewed with no changes requested.
Recommendations: “I, Josh Isaacson move that the April 9, 2018 meeting minutes be
approved as presented.” Mark Mertens seconded the motion. The motion carried.
3. Financial Report

The financial report was sent out ahead of time for the board members to review.
Recommendations: “I, Jerry Rogers move that the JCCMHFB approve the financials as
presented” Josh Isaacson seconded the motion. The motion carried.
4. Approval of JCCMHFB contract
The updated JCCMHFB contract with the county was presented for approval and signatures.
Recommendations: “I, Josh Isaacson move that the JCCMHFB Board approve the contract
with the county.” Kelly Steffens seconded the motion. The motion carried with Mark Mertens
abstaining.
5. RFP Update and Award Notifications
Beth Diveley updated the board informing that the award letters were sent out and signed by
the agencies receiving them there was no questions.
6. Next RFP Schedule
Beth Diveley stated that the next RFP will open up on July 1, 2018 and the amount would be
$250,000. It will be posted in the leader for July 12 and Lisa Wigger will look into posting it in
the Countian. The schedule for the RFP’s was reviewed by Beth Diveley with the board.
Jerry Rogers asked if anyone asks regarding the funds that the board state that the $250,000
comes from the sales tax

7. Update on Diversion Pilot Program
Sue Curfman stated that Margo Pigg and she met with Jefferson R7 last Thursday and a job
description was developed for the Assessment Diversion Specialist. There was 4 candidates
that interviewed for the position and an interview panel. The individual selected will start in
that role August 1st what has driven this is changes at the state level to help avoid labeling
students. They are in the process of evaluating metrix and protocols. Sue Curfman stated
her role is to write up the data as they look to duplicate the program with hopes to present at
the state level. They will be looking at how to measure success. This is a program that is
really looking at how to do things differently. Jerry Rogers asked who is involved. Sue
Curfman stated that COMTREA, Jefferson RVII and Mercy Jefferson will partner together to
work on the pilot program. (Sue Curfman, Eric Ammons and Clint Johnston). Jerry Rogers
asked Dr. Isaacson’s take on the program, he stated that he finds it appealing. Audrey
Mitchell asked who is involved, Sue Curfman stated that judges and the juvenile office are
involved and very supportive of the pilot. Audrey Mitchell spoke of a situation in the school
she used to work with and a situation of success. Sue Curfman stated that the individual that
will be doing this is currently getting all the connections and scope of services listed for the
county. Sue Curfman also spoke of the school liaisons program and the increase in
personnel and changes that will be happening with that program. The goal with the diversion
program is to create and be able to duplicate for additional schools. Kelly Steffens asked
what the age is for this program. Sue Curfman stated that it is for any age. Sue Curfman
also spoke of trying to get in front of the superintendents meeting in August to share about
the welcome center. Margo Pigg also spoke that they will be looking at evening house at the
welcome center or having assessors go out to schools to evaluate students if needed. There
was discussion of having a greater connection between school liaisons and the behavioral

health side. Margo Pigg stated that they are seeing children and want to look at how to make
access easier. Dr. Isaacson stated that looking at the road blocks that are in the way and
how to take those away to be successful. Margo Pigg also spoke of the support that parents
and faculty need and taking that support to them directly.
8. Legal Review of JCCMHFB Board Nominations
Sue Curfman stated that one of the recommendations that came out of meetings in March
was to look at how appointments are made to the different boards in the county. Sue
Curfman stated that she was first made aware when Ken Waller called her in January 2018.
This was a large concern and the recommendation from the board was to get a legal opinion.
Meagan Breeze provided a legal review on the authority. The review looked at numerous
documents including bylaws the County Charter, state regulations and the board has been
provided with a letter that outlines her review of the documents. The change to the charter
form of government did not change the way the appointments would be done. The current
process of county council or county executive appointing is legal. Dr. Isaacson thanked Sue
Curfman for the legal review. Jerry Rogers stated that the board has nothing to do with the
appointments but wanted to get a clarification. Beth Diveley stated that the validity of
members on the Board is not an issue based on the legal review completed by Meagan
Breeze. Sue Curfman read a portion of the legal letter for everyone to hear the finding. Mark
Mertens spoke of how the county executive has always appointed with the county council
approval. The key issue is the county council appointing with the county executive approval.
Mark Mertens stated that there are a lot of people that disagree with the legal review. He
brought up the conflict of interest of sitting on the JCCMHFB and COMTREA Board and
voting for funds to be used. Sue Curfman stated that members on the JCCMHFB represent
the MHFB primarily. Mark Mertens stated that voting to give money is a conflict of interest.

Dr. Isaacson stated that COMTREA auditors or state auditors could answer if this was an
issue. Beth Diveley stated that the practice has been in place for years. Mark Mertens
stated that because it’s been in place doesn’t mean it’s correct. Beth Diveley stated that in
the years she has been on there was nothing brought up until recently. Mark Mertens stated
about self-funding, Jerry Rogers stated that there is no self-funding and there is an
agreement between the mental health board and COMTREA regarding the funding that is
given. Margo Pigg stated that the other county boards there was some differences that came
about that are not the same as COMTREA. Mark Mertens stated that he is not saying that
what was done in the past is right or wrong and in the past there was no other providers and
now there are other providers that are in the county and want to know why COMTREA gets
all the money. Mark Mertens stated that sitting on one board and giving money to another
board is a conflict and thinks it’s a matter of time before the board gets sued. Beth Diveley
stated that the RFP process is allowing other agencies to get funding for things COMTREA
doesn’t do is at capacity. Dr. Isaacson stated that the matter is very complex and the legal
statute was poorly written and everyone on the board volunteers their time. Sue Curfman
stated that the state law was sent out earlier and COMTREA is in compliance and the
contract between the JCCMHFB and COMTREA and it states all the services that the agency
(COMTREA) needs to provide. Sue Curfman went over the services that are to be provided
and how more than what the county provides. Sue Curfman stated that she is a stickler for
regulations. Jerry Rogers stated that the answer is not in this room.
9. Approval of COMTREA Board Actions
Recommendations: “I, Josh Isaacson move that the JCCMHFB approve the actions of the
COMTREA board.” Kelly Steffens seconded the motion. The motion carried.

10. Old Business
Jerry Rogers stated that in the past this Board was a quick meeting does a different time and
date need to be considered. Beth Diveley asked everyone to consider this and it will be
discussed. Josh Isaacson asked if everyone on this board was part of the COMTREA Board.
That was confirmed.

JCCMHFB RFP Request Overview
Funds Requested By: Lutheran Family Counseling Services
Amount Requested: $78,000
Funds will provide: Cover the cost of MH counseling services for one year for residents of Jefferson County. Pay for one full-time counselor, expect to provide services to 95 children, youth and families in Jefferson County during that year.

Diversion Program Update
1. First intervention process began within the first 30 of school on the first day.
Complicated case, many team members involved: Intervention Specialist, CSS,
counselor, supervisor, DJO, APN and others.
2. Margo and Tony also met with Steve Horn to discuss team planning, communication
methods and timing; Tony and Margo will be writing up this process for Comtrea as a
partner and referral source for our Program Manuals.
3. Tony, Margo and Steve also agreed to meet regularly for a while, monthly, as the
program gets up and moving. Then, also set up quarterly meeting to review full process,
workflow and make changes/modifications as needed.
Off to a good start, need justified on the first day.
