i. introductionTheMinistryofHealththroughthePharmaceuticalDivisionapprovespermitstoimportallchemicalsexceptpesticides ImportationofpesticidesismanagedbythePesticidesControlAuthority(PCA)whichisastatutorybodywithintheMinistryofHealth

Beinganislandstate,thecontrolofimportsisachievedthroughasystemofimportpermitorlicenseincollaborationwithJamaicaCustomsatallports

Toimprovetheinformationexchangeaboutthecharacteristicsofchemicalsbannedforuse,orsubjecttosevererestrictionsstakeholdershavebeeninvolvedinimplementationoftheRotterdamConventiononPriorInformedConsentprocedureforcertainhazardouschemicalsininternationaltrade

Whilstthereisnolegislationinplaceformanagingchemicalimportsandpermitsforchemicalsaregrantedasanadministrativemeasure,thelicensestoimportpesticidesarerequiredbythePesticidesAct1975

AmongthefunctionsofthePesticidesControlAuthorityassetoutintheActare:

(a)toregisterpesticides;and(b)tolicensepersonstoimportormanufactureregisteredpesticides

TheActstatesthat:

“Nopersonshallmanufacture,orimportanypesticideunlesshefirstobtainsintheprescribedmanneralicenseto,manufactureorimport,asthecasemayrequire,thatpesticide”

TheActalsodefines“prohibited”pesticideas:

“anypesticideofwhichthepossibleeffectsontheenvironment,plants,animalsorhumanbeingsareconsideredbytheMinistertobetoodangeroustojustifyitsuseandwhichisspecifiedinthesecondschedule

and“restricted”pesticidesas:

“anypesticidespecifiedintheThirdSchedule,andanypreparationormixturecontainingsuchpesticide,otherthan--(a)apreparationormixtureinwhichthequantityofanysuchpesticideidentifiedbyanasteriskisnotmorethan2%byweight;or(b)animpregnatedresinstripinwhichthequantityofarestrictedpesticideisnotmorethan20%byweightofdichlorvos”

PesticidesthatareprohibitedorrestrictedarelistedintheActbyScheduleswhichtheMinistermayfromtimetotime,afterconsultationwiththeAuthority,amend AMinisterialOrdercanwithdrawfromsaleoruse,andmakeprovisionforthedisposalof,anypesticideaddedtothelistofprohibitedpesticides

InformatIon reQuIred to regIster a PestIcIde 1 Applicationdossiersshouldbeboundinhardcoverbinders,andbesubmittedintriplicate They

shouldbecorrectlyindexedintheorderpresentedbelowforeasyreference 2 Thepackagesize(s)inwhichtheproductwillbeimported 3 Detailedliteratureinrespectofthechemistryandcompositionoftheproduct(includingpercentages

ofall ingredients), itsefficacy,toxicology,antidotes(togetherwithanyavailablereferences)andprecautionstobeobservedbefore,duringandafteruse

n.B. If the active ingredient is registered, only information on the formulation and the composition of the product is required.

4 Sixsamplecopiesofthelabelproposedtobeusedinconnectionwiththenewpesticide,alongwithsamplesofthepackagingmaterialsandinsertstobeusedfortradepackages LabelsshouldbeintheEnglishlanguage,andshouldconformtothelabelingstandardsofthePCA

5 Acertificateofanalysiswhichcontains: a) Anassayreportonarecentbatchoftheproductanalyzed b) Themethodofanalysisused(Thisisonlyrequirediftheactiveingredientisunregistered) 6 Adulyauthenticatedandlegalizedcertificateoffreesalefromthecompetentauthoritywithwhom

theproductisregisteredinthecountryoforigin,andtheconditionsunderwhichitmaybesoldinthatcountry,alsoacopyofthelabelstampedasbeingapprovedbythatAuthority

7 Astatementshowing:a) ThecountriesinwhichtheproductisregisteredforFreeSaleotherthanthecountryoforigin b) AnycountryinwhichtheproducthasbeenrefusedregistrationforFreeSaleandthereasonsfor

TwostampsareaffixedtothisformbythePCAtocompleteitsapproval Thefirstisanovalstampwhichgrantspermissiontoimporttheshipmentintheamountsnotexceedingthatontheform TheapprovalmustbegrantedbeforetheshipmentarrivesattheportortheimporterwouldhavebreachedCustomsLawsandisfined

Thesecondstampisarectangularstampwhichisgrantedaftertheinvoiceshavebeenpresented,theactualquantityofimportsverifiedandrecordedandtheappropriatedutiespaid Dutiesamountto2%ofCIFvalueofactualimportandthisisthemainsourceoffundingpesticidesforregulation

AllnewlineofficersthatareemployedtoCustomsaretrainedbythePCAandotheragenciesforwhichtheyperformagencyfunctionsincludingthePharmaceuticalDivisionofMOH

Customs officers are posted at the Post Offices,Airports and Seaports and make interceptions ofimportedpesticides ImporterswhofailtoproducealicenseintheprescribedmanneraresenttothePCA Iftheproductisregistered,alicenseisissued However,wheretheproductisnotregistered,itisseizedbythePCAInspector PCAmonitorssellersofpesticidesandwiththeassistanceofthePoliceprosecutessellersofunregisteredpesticides

PCAmaintainsadatabaseofallimportsandpublishesaRegisterofPesticides

d. importation of induStrial chemicalS

Therearenoregistrationprocessesforchemicalsexceptpharmaceuticals Therangeofchemicalsiswiderthanpesticides Apermitisgrantedonacasebycasebasis Apermitisvalidforanapprovedamountoveraperiodofsixmonths

CustomsreleasestheimportedchemicalprovidedthereisapermitfromtheMOH

e. on-line notificationS

TheGovernmentofJamaicahasinitiatedaprojecttocreateelectroniclinksbetweencriticalagenciesinvolvedwiththeissuanceofpermits Asaresult,thePesticidesControlAuthorityandthePharmaceuticalDivisionofMOHwillreceiveapplicationsforpermitsandpaymentsonline

Theseapplicationswillbedirectly linkedtoCustomsallowingonlinecommunicationon importsofinterest to the PCA PCA has seized this opportunity to request notification of all importations ofchemicalsthatarelistedonRotterdamasanextraprecautionagainstillegalimports

Inkeepingwiththisnewdevelopment,anotificationwillbemadetoPCAassoonasan importerpreparesanimportpermitwithaHarmonisedSystems(HS)CodecorrespondingtothoselistedontheRotterdamConvention TherelevantHScodesareenteredintothedatabaseforcrossreference

Whilstitisexpectedthattheimportresponsedecisionswillbehonored,thenotificationprocesswillhighlightanyattempttoimportAnnexIIIchemicalswhetherfromPartiesorNon-Partiesandwillseektoidentifyproductsthatcontainthesechemicals

LegislationisbeingdevelopedtorequireimportlicenseforallchemicalsandendproductscontainingchemicalsthatarebannedorseverelyrestrictedincludingthoselistedonAnnexIII

Therearenorequirementsforimportpermitsforendproductsandnopermitforexportofchemicals ThenewlegislationrequireapermitfromthePCAforimportandexportofbannedorseverelyrestrictedchemicalsandendproductscontainingthesechemicals Permitswillspecifyconditions

Whilst therearenoexportpermits, Jamaica isnotamanufacturerofchemicals All formulationaremadeofimportedrawmaterial PCAregisterstherawmaterialandissuesimportlicensesforpesticidesrawmaterials ThepermittoimportthechemicalasarawmaterialwouldnotbegrantedhencethereisnoimmediateneedforJamaicatohaveexportpermittocomplywiththeConvention

iv. export of chemicalsThereisnosystemtomonitorexportofchemicals Theexportermustberegisteredasanexporter ThequantitiesofexportedchemicalsarerecordedbytheStatisticalInstitute Thereisneedtodevelopexportcontrolsandtheregulationstosupporttheimplementation TheexportofbannedandseverelyrestrictedchemicalswillbeaddressedbythelegislationtosupportRotterdam

1.BaCKGRounD ThePesticidesControlAuthority(PCA)isthegoverningbodymandatedthroughthePesticidesActof1975toregulatepesticidesJamaica TheBoardmeetsmonthlyandsetsthepoliciesforthecontrolandregulationoftheindustry ThePCAisastatutorybodywithstaffcomplimentoften(10)

TheMinistryofHealthhasportfolioresponsibilityforthePesticidesControlAuthority(PCA) ThefunctionsasoutlinedinthePesticidesActare:•Toregisterpesticides;•Tolicencepersonstoimportormanufactureregisteredpesticides;•Toauthorizepersonstosellrestrictedpesticides;•Toregisterpremisesinwhicharestrictedpesticidemaybesold;•Tolicencepestcontroloperators;•ToconsideranddetermineapplicationsmadepursuanttothisActandtodealwithallaspectsofthe

importation,manufacturepackaging,preparationforsale,sale,disposalanduseofpesticidesandtoadvisetheMinisteronallmattersinrelationthereto;and

•TodosuchotherthingsasmaybeexpedientornecessaryfortheproperperformanceofitsfunctionsunderthisAct

PCAalsohasresponsibilityforimplementingtheRotterdamConventiononthePriorInformConsentProcedureforcertainHazardousChemicalsandpesticidesininternationaltrade HazardousChemicalsthatarelistedinAnnexIIIofRotterdamhavebeenprohibitedandshouldnotbeimportedorexportedfromJamaicawithoutPCA’spermit However,theConventionisbindingonlyonparties,asitispossiblethatnon-partiescouldattempttoexporttheseprohibitedchemicalstoJamaica There is currently no legislation or registration process for importing chemicals These are beingdevelopedandwillbesupportedbythisnotificationprocessforgreaterefficiencies
