June 6, 1986LOUISIANA WILDLIFE AND FISHERIES COMMISSION

Mr. J. Burton Angelle was also present.The minutes of the meeting of May 2, 1986 were approved

unanimously with a motion from Dr. Hines and a second from Mr. Palmisano.

At Thursday’s meeting Mary Mitchell gave an overview of the Administrative Procedures Act for the Commission members.Each member received a written report and a summary is attached to these minutes.

Winton Vidrine gave the Enforcement Report for the month of April at Thursday's meeting.

At Thursday's meeting the survey report was given by Harry Schafer for the period of April 28 - May 30, 1986. During that period 165 surveys were scheduled and 2 were unable to be done. Lease rental collected was $409.14, $8,044.50 was collected for survey fees, 58 applications were filled and 185 new leases were issued.

Bennie Fontenot presented the rule for the closure of paddlefish to be ratified. All were in favor and the full text of the rule here is made a part of the record.

The Louisiana Wildlife and Fisheries Commission hereby establishes a rule prohibiting the taking of paddlefish, commonly referred to as spoonbill catfish, for a three year period beginning July 1, 1986. This prohibition shall not apply to the incidental snagging and possession of one (1) paddlefish by recreational fishermen using a single line and hook.

At Thursday's meeting a slide presentation was given by Kenneth Lantz. A discussion was held concerning the netting ban on Toledo Bend Reservoir. At Friday's meeting a Notice of Intent was passed.

The Louisiana Wildlife and Fisheries Commission hereby expresses intent to continue the present netting ban on Toledo Bend Reservoir after its expiration date on October 20, 1986.The netting prohibition presently in effect on Toledo Bend Reservoir includes the following: gill nets, trammel nets,flag webbing and fish seines are prohibited in the Louisiana portion of Toledo Bend Reservoir, and hoop nets are prohibited during March 1 through May 15 each year only in that portion ■ of Toledo Bend Reservoir from a point north of Logansport where the lake enters Texas, and south to a point on the Lake where the Texas Duck Refuge Canal intersects the old channel* of the Sabine River.

At Thursday's meeting Janice Hughes gave a report on the Caney Creek Reservoir. Mr. George Green representing the Jackson Parish Watershed Commission spoke in favor of the prohibition of nets in this area. At Friday's meeting the Notice of Intent was approved.

Hugh Bateman presented a resolution concerning permits for nuisance animal control. Mr. Gray made a motion to accept this resolution, seconded by Mr. Palmisano and passed unanimously.

WHEREAS, a variety of wildlife species in urban areas of Louisiana are relatively numerous and frequent animal-human conflicts occur, and

WHEREAS, the Louisiana Department of Wildlife and Fisheries wishes to remain committed to nuisance wildlife assistance and pro­vide for the disposition of these conflicts, and

WHEREAS, R.S. 56:112 provides for the Secretary to direct anyreputable citizen of this state to take and dispose of such nuisance species of birds or quadrupeds under conditions specified by the Secretary, now

THEREFORE BE IT RESOLVED, that the issuance of Nuisance Wildlife Control Operators Permits by the Secretary, be approved by the Louisiana Wildlife and Fisheries Commission.Hugh Bateman also presented a resolution for the closure

of hunting season for Fountainebleau State Park. Dr. Hines made a motion to accept the resolution, seconded by Mr. Gray and was approved.

WHEREAS, Fountainebleau State Park near Mandeville, Louisiana is a popular area used by thousands of citizens of our state as well as many out of state visitors for hiking, camping, swimming, nature study, and other recreational purposes, and

WHEREAS, the park provides an outdoor setting for enjoyment of family oriented activities particularly for children and older adults, and

WHEREAS, there are two small private inholdings within thispark where hunting activity has occurred during legal open seasons under circumstances that are not safe for park visitors and employees, and

WHEREAS, the Division of State Parks has requested our assistance in correcting this situation before someone is injured, and

WHEREAS, in the judgment of this Department and Commission this State Park including small inholdings is not a safe or proper environment for hunting to take place, now

THEREFORE BE IT RESOLVED, that the entire area including private lands within the boundaries of Fountainebleau State Park lying south of U. S. Highway 190 is closed until further notice to all hunting for both resident and migratory game.

After the meeting on Thursday a dedication ceremony was held at the Sherburne Wildlife Management Area. Hugh Bateman mentioned at the meeting that this was a first class shooting range and all the divisions helped with this project.

Harry Schafer presented a Notice of Intent to set the oyster season for the Oyster Seed Grounds and Reservations.All were in favor of this Notice.

The Louisiana Wildlife and Fisheries Commission advertises its intent to set the 1986-87 oyster season for the Oyster Seed Grounds and Reservations.

Interested persons may appear at the meeting of the Com­mission July 10 $ 11, 1986, in the Baton Rouge office building of the Department of Wildlife and Fisheries on Quail Drive. Interested persons may submit written comments until 4:30 PM,July 9, 1986 at the following address: J. Burton Angelle,Louisiana Department of Wildlfe and Fisheries, P. 0. Harry Schafer stated that a seismic rule that was changed at the February 1986 Commission meeting had gone through the necessary steps and was ready for ratification. This change was a reduction in the use of air guns at a certain depth. All were in favor of this ratification.

Thomas A. Marullo, Mayor of Grand Isle, presented a resolution which was adopted by the Council. A length discussion was held and it was decided to adopt this resolution with a few changes.Dr. Hines made a motion to accept this resolution, seconded by Mr. Palmisano and all were in favor. This was made effective immediately with a declaration of emergency.

The Louisiana Wildlife and Fisheries Commission hereby expresses intent to prohibit the use of gill nets, trammel nets, seines more than 30 feet in length and trawls, from May 1 through September 15 of each year, along the seaward boundary of the main island. Grand Isle, Louisiana. The boundaries of the closed area shall be: from the easternmost jetty at theGrand Isle State Park to the easternmost shoreline of Caminada Pass, seaward to a water depth of six (6) feet. Such Commission action has been requested by the City of Grand Isle which has also effected a similar ordinance, entitled. Resolution No. 852♦

The action is necessary to curb interference of commercial net use to recreational fishermen who are surf fishing in this relatively small area; and, because of fish remains and trash being brought onto the beach, by use of said nets, and presenting a health hazard to children and other beach users.

Interested persons may submit written comments on the proposed rule until 4:30 PM, July 8, 1986 at the following address: J. Burton Angelle, Secretary, Louisiana Departmentof Wildlife and Fisheries, P. 0. Box 15570, Baton Rouge, LA 70895.

Dr. Hines made a motion to add an item to the agenda which was inadvertently omitted. The notice of future hunting dates are to be printed in the hunting regulations pamphlet in order that hunters can make plans for vacations. He said he would like for this notice to read that the Louisiana Wildlife and Fisheries Commission has scheduled opening dates for the next resident game seasons to accommodate hunters who want to schedule vacations in advance of the hunting season. The length of seasons may vary from year to year but opening days will remain as follow until further notice. Squirrel and Rabbit, the first Saturday inOctober; Quail, Thanksgiving Day; Deer, archery, October 1st;Deer, gun, still hunting areas 1 and 5, the Saturday before Thanks­giving; still hunting areas, 2, 3 and 4, the Saturday occurring nineteen (19) days before Thanksgiving. Dog hunting in all areas open for dogs the first Saturday in December. Mr. Gray seconded the motion and all were in favor.

WHEREAS, the Commission has received numerous requests to standardize and publicize future opening dates for resident game species so citizens can schedule vacations accordingly, and

WHEREAS, for many years the same traditional opening dates have been established for squirrel, rabbit, quail and deer archery hunting, and

WHEREAS, the Commission also desires to establish a pattern of tradition for opening days affecting gun seasons for deer, now

THEREFORE BE IT RESOLVED, that during the succeeding years opening dates for squirrel, rabbit, quail and deer seasons will be published in the Department's annual Hunting, Fishing and Motorboat Regulations so hunters can schedule vacations in advance of these important events.

Hugh Bateman stated that the waterfowl outlook is much improved over last year. He stated that is is too early to make a final judgment on production but he will keep every­one up to date on what is happening.

The dates of the October meeting was set for Thursday and Friday, the 2nd and 3rd to be held at the Community Center on Grand Isle.

The meeting was adjourned at 11:20 AM.

recommended by the Division of State Parks and adopted by the Louisiana Wildlife

and Fisheries Commission and becomes effective on publication in the Louisiana

Register.

RESOLUTION CONCERNING STEEL*SHOT VERSUS LEAD SHOT

Acknowledge lead poisoning as a problem.

Question whether steel shot may cause a greater threat because of crippling based on scientific studies in Louisiana, as much so possible as lead poisoning in lead shot does.

State case against steel shot:

a. The public is not generally aware of the danger that steel shot poses in potential harm to older guns such as barrel separation eruption which could also cause serious bodily injuries to the shooter. Many sportsmen in the State of Louisiana have shot the same gun for years and most of these guns would substain severe damage by the use of steel shot.

b. The availability of steel shot in small gauges such as 410and 28 gauge is non-existence. These gauges are used primarily by youth in being taught how to hunt waterfowl.

c. Cost of steel shot.

To state the need to find through research a non-toxic shot that is a better solution to the problem than either lead or steel shot and to urge continuing research by the U.S. Fish and Widllife Service, shell manufacturers and others to develop a suitable solution.

Object to the use of steel shot as proposed by the U.S. Fish and Widllife Service since we do not consider it a good solution to the problem and if it is used widely as they recommend, in all likelihood, it would be preceived by the public as the answer to the problem rather than what could be the introduction of a shot that could be equally as hazardeous to waterfowl as lead pensioning is now.

Now therefore, be it resolved by the Board of Aldermen of the Town of Grand ,Isle that all netting be prohibited from May 1st to September 15 along the seaward boundary of the main island.The boundaries of the closed area shall be: From the Easternmostjetty at the Grand Isle State Park to the easternmost shoreline of Caminada Pass, seaward to an approximate water: depth of 7 feet.
