    IllS Excellency the Lieutenant-Governor in ExecutiveCouncil, acting uniTer the provisions of the CemeteriesAct, 1897, and the Acts amending the same, has beenpleased to approve of the following by-laws for thecontrol and management of the Albani- Public Cemetery,Reserve No. 22406.

    PUBLIC CEMETERY, ALBANYBY-LAWS.By virtue of all powers in that behalf vested in the

    trustees of the Albany Public Cemetery, the said trusteesmake the following by-laws:-

    All fees and charges payable to the trustees, asset forth in Schedule A, shall be paid at the times andmanner therein mentioned, unless otherwise ordered.

    The ''secretary,'' as referred to in these by-laws,means the person fm the time being employed by thetrnstees as the secretary of the Cemeteiy, and such

    person shall, subject to the trustees, exercise a generalsupervision and control over all matters pertaining tothe Cemetery and to time carrying out and enforcementof these by-laws, and the direction of such person shallin all cases and for all puiposes be presunied to he andto have been the direction of the trustees.

    The ''superintendent,'' as refeired to iii these by-laws, means the person for the time being eniployed bythe trustees as time superintendent of the Cemetery, andsuch person shall, subject to the tiustees, have charge ofthe general care of the Cemetery, the supervision ofthe erection or placuig of monumental work and fix-tures, also time supervision of intermeilts, the opening,closing and dressing of graves, and such other duties asare mentioned in these by-laws om om-dered by thetrustees.

    Any person desiring to inter any dead body in theCemetery shall make an application in the form con-tained in Schedule B.

    All applications for interment shall be made atthe offices of the tiustees in such time as to allow atleast five working hours' notice being given to thesuperintendent at the Cemetery prior to time time fixedfor burial, otherwise an extra charge shall be made.

    The trustees shall cause nil graves to be dug andvaults, brick graves, or graves to be re-opened as andwhen required.

    Every coffin shall have upon the lid an approvedmetal plate bearing time name of the deceased stampedor otherwise indelibly inscribed in legible charactemsthereon. Any coffin nut complying with this by-lawwill not be admitted to or be interred in the Cemetery.

    S. Every grave shall be at least 7ft. deep at timefirst interment, and no interment shall he allowed inany grave with a less depth than 3ft. from the top oftime coffin to the original surface of the surroundingground.

    In the case of an application for interment inany private grave or vault to which the deceased hadno claim during life, the written and verified consentof the grantee shall be handed in with the application.

    If application be made foi- an ''interment'' inany grave or vault of time remains of any person otherthan the person to whom the giant was issued, or hisregistered assign, the written and verified consent ofsuch grantee or assignee shall he produced, togetherwith the ''Grant of Right of Bumial.

    Should tile grantee be unable to produce theGrant of Right of Burial'' on mak ig application for

    a grave to be re-opened, for tIme purposes of interment,through having lost same, time said grantee shall makea sworn declaration to this effect, and shall pay the feefor a copy of such ' ' Grant of Eight of Burial,'' asprescribed iii Schedule A, before time interment takesplace.

    No burial shall be allowed to take place in theCemetery, nor shall any coffin be allowed to enter theCemeteiy, unless a certificate from the District Registrarof Deaths that the death has been registered or aCoroner's order for burial is handed to the secretary,at the latest, upon the funeral entering the Cemetery.Should time undertaker or his representative be unableto produce the said certificate from the Registrar, lieshall give a written guarantee to produce same withinthmmee days, and satisfactory reasons nmust be given forthe non-production of such certifiente in the first instance.In default of the production of the said certificatewitlnn three days, the undertaker's license may be sus-pended until such cem-tificate is prodneed. The cei-tificatewill be retained, but tile Coroner's ordei- shall be re-turned to the person delivering the smime.

    No interment shall be allowed on Sunday exceptwhen it is certified in writing by a Medical Officer ofHealth, or by a Police Magistrate, or by two Justicesof the Peace, that for sanitary om special religious rea-soils it is necessary or advisable that the burial take placeoim that day.

    Unless otherwise ordered the principal entranceto the Cemetery shall be open daily between the hoursof 8 am, and 5 p.m.

    The hours for burial shall be as follows Week-daysf torn S am, to 4.30 p.m.; Sundaysf roin 2 p.m. to4.30 1)111., amid 110 burial shall be allowed to take place,nor ally coffin allowed to enter the Cemetery, at anyother hour except by written pci-mission of the trustees.

  • 1(3. The time fixed for auy burial shall he the timeat which the funeral is to arrive at the Cemetery gates,and, if not punctually observed, the undertaker respon-sible shall be liable to a fine of lOs. Gd.

    If for any reason the funeral shall, on arrivalat the entrance gates of the Cemetery, remain there formore than 15 minutes prior to proceeding to the grave-side, the undertaker responsible shall be liable to a fineof ten shillings and sixpenee.

    Every funeral shall entei' by the principalentrance, and no vehicic, except the hearse and mourn-ing coaches, shall he permitted to enter the Cemetery,or stand opposite the entrance gates. Horses shall nothe allowed to proceed faster than at a walking pacewithin the Cemetery, and shall proceed at and by suchroads as directed by the superintendent or other officerof the trustees from time to time. Ally driver or otherperson failing or neglecting to observe such directionsmay he forthwith expelled from the Cemetery. 7obicycle shall be ridden withia the Cemetery.

    If application be made to the trustees to exhumeany corpse for the purpose of examination or identifi-cation, or for the purpose of its being buried elsewherein aecol-dance with the wishes of the deceased or of Insfannls-, an older from tile Governor os the warrant ofa Coroner or of a Justice of the Peace issued in accord-ance with the law autlioi-ising the Board to permit ofthe exhumation must be attached to the applicationfor in.

    No dogs shall be admitted into the Cemetery,and any found there shall be liable to be destroyed.

    No person shall remove any plant, tree, shrub,flower (other than withered flowers, which are to beplaced in the receptacles provided by the trustees forsame), or any article from any grave without first ob-taiilnsg a permit from the trustees os theii- representa-tb-cs.

    No pem'son shall pluck any tree, plaiit, shrill), orflower growing in any portion of the Cemetery.

    No person shah remove oi- carry out of or attemptto carry out of the Cemetery any tree, plant, shrub,flower, earths or other material without the written auth-ority of the trustees or their representative.

    No person shall promote or advertise, or carry onwithin the Cemetery any trade, business, or calling,either by solicitation, distribution of cireulars, by cardsor otherwise, or by any other system of advertisementwhatsoever, without the written consent of the trusees,and any person infringing this by-law shall he expelledfrom the Cemetery.

    2.7. No person employed by al under the trusteesshall be pernntted to accept any gratuity whatever, norshall he be pecuniarily interested iii any work in theCemetery, other than the relnulleration he 1-eceives fromthe trustees, and ally such person pi-oved guilty ofaccepting any gratuity, or being pecuniarily interestedin any such work, shall be liable to sumnlnary dismissal.

    Any person desiring to place or erect, or to alteror add to ally monnnient, tombstone, or eisclosure ill anypart of the Censetes-y must first obtain the is-ritten con-sent and approval of the trustees, and otherwise complywith section 23 of the Act ((31 Vict., No. 23).

    Every tombstone, monument, or enelosui-e shallhe placed on propel and substantial foundations, which,f i'eqnired by the trustees or their officers, shall extend

    to the bottom of the grave.i0. The materials used in every such erection shall

    be subject to the approval of the superintendent orother offices- appointed by the trustees, and any materiall-e3ected shall be insniediately removed from the Ceme-tery by the contractor for the erection. All refuse andutliel- rubbish remalning after any work is completedshall be immediately remnoved from the Cemetery by theCC50ll causing the same.

    Should any work by masons or others be notcompleted before a Sunday, they shall be required toleave the work in a neat and safe condition, to thesatisfaction of the superintendent.

    Monumental masons and other tradesmen silall,before commencing any work within the Cemetery, de-posit with the secretamy to the trustees the sum of one

    pound (il) winch shall be forfeited if the provisionsof either of the two preceding by-laws be not compliedwith to the satisfaction of the superintendent.

    All material required in the erection and com-pletion of ally work shall, as far as possible, be preparedbefore being taken to the Cemetery; and all materialsrequired by tradesmen shall be admitted at such entranceas the snperintendent shall dlil-ect, and no vehicle con-veying ally such niaterials with wheels less than fourniches broad shall be permitted to enter the Cemetery.No sand, earth oi- other material shall be taken fromany part of the Cenieter for use in the erection ofany nionumuent or svoi-k except with the written approvalof the tiustees.

    No catacomb shall be allowed.Monumental masons shall not be permitted to

    carry n work within the Cemetery during other thanthe 110111-s specified for the opening and closing of thegates on w-eek days, Saturday and Sunday excepted,when no work is to he done floni noon Saturday to theopening of gates 011 the Monday morning, without thewritten permission of the trustees.

    Subject to the appl-oval of the trustees, eachapplicant for an ''Order for Burial'' shall, within threemonths frons date of the application, enclose thegins-c memitioned ill such application with a kerbing oftiles, slate, or stone, and shall cause to be placed thea-eona unnaber plate bearing the llu,nber of tile grave orvault.     No wooden fence, railing, cross oi other woodenerection shall be ahloss-ed on or around any grave orVallIt.

    No trees or shrubs shall be planted on any graveexcept such as shall be approved by the superiatendent.

    All workmen, w-hethser employed by tile trusteesor by any othel- person, shall at all times whilst withinthe boundaries of the Cemetery, be subject to the super-vision of the superintendent, and shall obey such thiec-tions as that officer may find it necessary to give; andany workman commnittimlg any breach of these regulationsand by-laws, or i-efus.ing or neglecting to comply svithany directions of time said superintendent, shall be me-moved from tile Cemetery.

    Licenses for grave dressing or decorating may beissued by tim tiustees, such licenses to be renewedannually in the momlth of July.

    Any person taking pal-t in dressing or attendingto any grave sisahl comply with tile following rules :(a) No rubbish, soil, sand, or other material removedill dressing a grave shall be placed 011 any other grave,and if placed in any adjoining ground shall be removedimnlnediately the work is completed. (b) No sand, soil,oi- loam shall be taken from any portion of tise Ceme-tery for tile purpose of dressing any grave, except withtIme permission of the superintemsdent. (c) The dressingof all graves, and the wheeling and carting of anyinateijal shall be subject to the supervision of the super-ilitemldent. (dl) Work in all eases to be carried on with(lime dispatch, and only durimig regulation hours.

    Prior to conducting any interment within timeCemetery or nicking use of the Censetery for any pur-pose connected with interments every undertaker shallpay to the trustees an anmmual fee as prescribed in Sche-dule A and shall at the time of mucking such paymentgive his assemit in writing to such conditions as thetrustees may deem fit to impose. Upon such assent be-lug given, and paymemit of the fee made, lie shall re-ceive a ''Pem-mnit,'' to hold good during good behaviourand until the first day of July followimig, and unless inthe possession of such a ''Permit'' no undertaker shallbe allowed to engage imi or carry out any duty or workwithin the Cemetery.

    The trustees may decorate graves from time totime, when desired by the grantee so to do. If thegrantees do not desire the trustees to carry out thiswork, time grantees may either do it themselves or em-ploy any person licensed by the trustees for that purpose.

    No person, except the relatives of the deceased,the trustees, or those licensed by the trustees, shall hepermitted to decorate any grave.

    If for the purpose of re-opening a grave tiletrustees find it necessary to remove edging tiles, plants,shrubs, etc., from off tile grave, the person so orderingtile re-opening shall iay to the trustees tile charges laiddown in Schedule A.

    Notwithstanding anything contained ill the exist-ing by-lairs to the contrary, permission may be grantedto tile Defence Department of the Coutnionwealth toerect headstones on the graves of deceased soldiers with-out payment of any fee.

    Free ground may be granted if it is proved totile satisfaction of the trustees (a) that tile deceasedwas a returned soldier, and that lie died as the resultof injuries received in war; and (b) that the relativesof the deceased are in necessitous circuinstniices: Provided that such grant shall be made subject to the con-dition that only the remains of deceased soldiers shallbe interred in the grave.

    A plan of the Cemetery showing the distributionof tile land, compartments, sections, situation and num-ber of grave, and a register of all certificates of ''Rightsof Burial,'' shall be kept at the offee.

    Any person violating the rules of propriety anddecorum, or committing any iluisanee or trespass, orinjuring any tree, shrub, flower, border, grave or anyerection, or in any way infringing these by-laws, shallbe expelled from the Cemetery.

    Any person committing any breach of an by- haivor regulation, or of any other rules, regulations, or by-laws lawfully niade under the authority of any Act relat-ing to cenieteries, shall for every such offence be liableto a penalty not exceeding five pounds, and in case ofa continuing breach a further sum not exceeding onepound for every day during which such breach continues.

    Any person committing a breach of any by-lawin the Cemetery shall in addition to being liable to apenalty under any by-law be liable to he forthwith re-moved from the Cemetery by the trustees 01 the suuer-intendent or other employee of the trustees or by anypolice constable. If such person resists removal, orif and as often as such person so removed shall, unlesswith the consent of the superintendent, again enter theCemetery within 24 hours of his removal therefrom,he shall be liable to a penalty not exceeding five pounds.

    The foregoing by-laws, with the accompanyingSchedules, were duly framed and presented to a meetingof the Board of Trustees of the Albany Public Ceme-tery held at the Council Ohambers, Albany, on the9th day of June, 1944, and adopted.
