“Labor-only Contracting is prohibitedwhere…There is labor-onlycontracting where the contractor osub-contractor merely recruits,supplies or places workers toperform a job, work or service for aprincipal, and the following elementsare present:a) The Contractor or subcontractordoes not have substantial capital orinvestment to actually perform thejob, work or service under its ownaccount and responsibility; andb) The employees recruited, suppliedor placed by such contractor orsubcontractor are performingactivities which are directly relatedto the main business of theprincipal.”--`Section 2
“Labor-only Contracting is prohibitedwhere ...Labor-only contracting shallrefer to an arrangement where thecontractor or sub-contractor merelyrecruits, supplies or places workersto perform a job, work or service fora principal,and any of the followingelements are present:i) The contractor or subcontractordoes not have substantial capital orinvestment which relates to the job,work or service to be performed andthe employees recruited, supplied orplaced by such contractororsubcontractor are performingactivities which are directly relatedto the main business of the principal;orii) the contractor does not exercisethe right to control over theperformance of the work of thecontractualemployee.--Section 5
“Contracting or subcontracting shallbe legitimate if all the followingcircumstances concur:a)The contractor must be registeredin accordance with these Rules andcarries a distinct and independentand undertakes to perform the job,work or service on its responsibility,according to its own manner andmethod, and free from control anddirection of the principal in allmatters connected with theperformance of the work except asto the results thereof;b)The contractor has substantialcapital and/or investment; andc)The Service Agreement ensurescompliance with all the rights andbenefits under Labor Laws.--Section 4

Pati kapaligiran at oras ng pagtatrabaho ay dapat walang panganib atligtas.> ang suweldo ng manggagawa ay sapat at karapat-dapat para sa makataongpamumuhay
