In the wave of anti-political correctness wehave had a lot of flags displayed thissummer at a variety of sporting events.Most of the St. George’s flags have comedown to be saved for the next internationalfootball tournament. Some Englishmenhowever wear their patriotism on theirbacks, fronts, and sides. Ian Poulter was noexception at the Hoylake Open GolfTournament when he turned up on the firstday in what looked like an Elvis Presley style fancy dress Union Jack.Yes it was over the top, not done in the best possible taste, but nobodystopped him. Nor should they. However, some sports couldn’t cope.Can you imagine Andy Murray on Wimbledon Centre Court wearing aScottish flag tee shirt and tartan kilt? No, information overload!

I hope your holiday travel arrangements were not too badly disrupted bythe recent terrorist airport alerts. I think everybody knows somebodywho was affected on “the glorious 12th” (for the shooting connoisseursamongst you), being a change over Saturday with added chaos. Not theideal way to start or finish your holiday.

On the topic of information security, some of you may have seen theBBC’s “real story” documentary on the disposal of computer hard drivesvia local authority tips. Some hard drives were being sold for a fewpounds on the market in Lagos, Nigeria, with all the data still in tact.Any chambers information security policy would need to guarantee theremoval of all data as part of any recycling process. Dumping the PC atthe local tip will not do!

As you can imagine I was pleased to see Liverpool win the Charity Shieldand get the season off to a proper start. I am sure it will not have goneunnoticed in the Chelsea camp that Benitez did not field Gerrard andAlonzo until the second half, demonstrating an air of confidence thatseems to have deserted Mourihno, as well as the good mannersexpected in the post match handshake. But I suppose I will have tosupport one Chelsea player when he puts on an England shirt and a veryspecial arm band

Interesting Topics1. The Carter Review

The Law Society Gazette predicts a loss of some 400

firms who will no longer undertake criminal defence

work, with the report recommending a “wholesale

move to fixed pricing” in criminal and civil work. The

Government seem to have lapped up the report so

quickly they have already launched a 3 month

consultation period to get the recommendations

implemented as quickly as possible. Bar Counsel

comment: “this is as good an outcome as is available,

and the proposals are worthy of very serious

consideration”. Not many seem to go along with the

phrase used by Lord Carter “fair but not generous”.

Robert Brown, the Executive Officer of the London

Criminal Court Solicitors Association was quoted in the

Law Society Gazette as saying: “if more money is to be

made by advocacy (because it will be paid at a higher

rate than litigation), solicitors will take that in-house

and send less to the Bar”.

2. Arbitration Costs – Blame the Clerks!

Recent conferences have suggested that the high costs

of arbitration in England were being noticed and may

pose a threat. Apparently a speaker at the British

Insurance Law Association Seminar suggested that the

UK is between 5-10 times more expensive than US

arbitration.

The speaker at the International Chamber of Commerce

event is reported to have suggested that Barrister’s

Clerks often talk about Counsel’s rate when they should

be thinking about the rate for the job, not the rate for

the person. That’s always very difficult to do as nobody

can really accurately foretell how long the piece of

string is going to be. Before hourly rates, it would be

customary to weigh the Brief in the palm of your hand,

a small shake of the head, draw in breath and then add

a nought to the figure you first thought of. You just

can’t do that any more when the evidence arrives in the

form of half a dozen discs.

Anyway, I have always subscribed to the theory: “If you

have to ask the price, you can’t afford to buy!”

3. Information Security

The Law Society is about to introduce information

security guidelines for solicitors. They are currently on

draft version 0.5 which can be found at the Law Society

website. This is a consultation document with a view to

the final guidelines being completed in the autumn.

Clerksroom Magazine will return to this topic when the

final guidelines are issued but for those of you looking

at risk assessment and the topic of information security,

it might help to have a look at the guidelines in draft

form. Although they run to 39 pages, not all of it is

relevant to chambers. However, it will give you a

flavour of how the Law Society views information

security. This is particularly relevant to Email policies.

Family cases in London

The following developments have beenannounced:

• HMCS will publish a public consultation paper in August 2006, seeking views on proposals for restructuring family business in London

• HMCS announced a detailed project for between September and November 2006 to look at the reasons for delay in every public law case.

• In the interim, public law work is already being heard in Barnet, Croydon and Kingston County Courts to reduce PRFD caseload.

• A new Family Hearing Centre based at Gee Street (in the new Clerkenwell and Shoreditch County Court building) will be sitting from 2 October. It will have:

• 5 additional court rooms.

• 5 additional Circuit Judges appointed.

• capacity to hear longer care cases.

• divorce jurisdiction. • Hounslow and Richmond Family Proceedings Courts have been combined to maximise hearing capacity.

• Additional Family Proceedings Court sittings at Barnet, Croydon, Richmond and Wells Street.

• A new electronic listing system to manage District Judge lists has been introduced.

• Deputy judges are being ticketed to hear care workto free up full-time judges for financial work.

• Court officials are working with users and members of the profession to improve listing at First Avenue House.

• Two additional filing clerks have been appointed atFirst Avenue House.

Should make for some fun listing cases in the run up toChristmas!

Family law practitioners based in London recently highlighted delays in thelisting of family cases in London and as the result of a survey carried out bythe Law Society, action will be taken over the next few weeks and months.

We have always encouraged comment and opinionabout the magazine [and on any other topic of interestto bar clerks]. Most of the emails I have had have beenvery positive, but that does not mean we do not haveour critics. But as they tend not to contact themagazine, it is hard to learn from your mistakes whennobody tells you.

So when a clerk does contact the Clerksroom as DaveBarber of Pump Court Chambers recently did, I decidedto be positive. Here is the main email exchange.

Dear DavidI read with interest the exchange of Emails yourecently had with Stephen Ward at the Clerksroomregarding your dislike of the current format of themagazine.

In the last eighteen months we have had manypositive and complimentary Emails from ourreadership, but as yours is the first negative responsewe have had, I thought I would correspond with youdirect to see if we can’t improve.

You have made two comments. Firstly you say thebook is “full of adverts”. As the ClerksroomMagazine is distributed free of charge to everyChambers in England and Wales, the present free

colour version at 32 pages has to rely totally onadvertising revenue to cover the costs of productionand distribution. I have looked back at some of theold black and white copies that Stephen Ward gaveto me before we took over last year. In the veryearly days for example edition number 22 was 80%advertisements. In November 2004 edition number37 had 75% advertisements and more recentlyedition number 40 was 70% advertisements. Wehave been running during the course of this year at60% advertisements and hope before too long toget this down to 50%. Edition number 22 was atotal of 20 pages; we are currently running at 32andaim to be producing 40 pages. This will put us closeto the editorial/advert ratio enjoyed by some otherglossy magazines.

I would appreciate if you could expand on what youused to enjoy in the old format and explain whatyou don’t find “very relevant” in the current format.From time to time we have asked in the magazinefor contributions from clerks and topics that interestthem. I am afraid people are slow to come forwardwith suggestions, but as you have been critical ofour magazine, I hope you will take this opportunityto make a positive contribution.I look forward to hearing from you.Bob

Spotlight on fee chasing

With the Computer System came the ability to be more

pro-active with the fee chasing, although not all

chambers have yet to fully embrace the technology.

It can produce suitable reminders, at reasonable

intervals, appropriate to the particular payment

arrangements for the case provided the cases are set up

correctly.

Using the computer system does not mean upsetting

the clients or printing off letters that you don’t want to

send. It is an excellent tool that ensures fees are chased

regularly and appropriately – if you set it up properly!

To get your software to produce the right letter at the

right time you must identify the different billing and

payment arrangements as well as the types of client

and lay client.

The type of client will give you an idea of how to

escalate the fee chasing: e.g. by writing to the Head of

Department or the Senior Partner. Private Fees may due

under the Standard Payment Term of 30 days from the

date of the fee note, pay on conclusion or paid

quarterly. An Insurance Company or Trade Union lay

client may always pay at the end of the case.

Having identified all the different types of payment

How many remember the days of chasing fees with no computer system:when fee chasing meant going through the drawer of invoices for a barrister,

taking a photocopy of each invoice to be chased, occasionally attaching a type written letter, and posting it to the solicitors. It was done on an ad-hoc basis, usually prompted a barrister plea for some cheques in order to pay VAT,

Tax, school fees, Holiday, etc., or was simply ‘having a bad month’.

The apparent animosity between Tiger Woods and Nick

Faldo [which followed Nick’s criticism of Tiger whilst

commentating in America] meant the two men kept at

least 10 paces apart for most of their round. This had

been an inspired draw by someone as the crowds

following them around were huge by any golfing

standards.

Eventually Tiger Woods eagled the 18th hole to go 5-

under for the round and one stroke behind the leader

on the first day. His challenge was up and running.

Tiger’s handshake with Nick Faldo at the end brought

its own ripple of applause from an approving gallery.

The rest is history.

terms you have to cater for, you can create appropriate

cycles, and ensure the correct one is assigned to each

case at the time of creation or billing (at whatever point

it is reasonable to record this).

I would suggest:

• Don’t have letters coming off that you won’t want

to post. So, leave any contentiously worded letters

out, including the Bar Council Letter B – you can

still comply with Bar Council regulations without

including them in your fee chasing cycles;

• Don’t have letters that say ‘I haven’t heard from

you’: the letters need to work regardless of

whether or not the solicitor has responded to

previous letters. You are writing because they

haven’t paid, not necessarily because they haven’t

responded…so by all means stress the age of the

debt, and the fact that is it overdue; and

• Don’t have letters addressed to the Senior Partners

on cases where the client doesn’t have one!

In my capacity as Clerk’s Room Magazine golfing

correspondent for the day, I duly attended on the

opening day, Thursday 20 July. Well, somebody had to

go and I drew the only straw!

Whatever sport you are into, there is nothing like

experiencing professional focussed vision and

concentration first hand. Mix those ingredients with

ability, skill and dedication and you will have a top

sports person, whether it’s tiddlywinks, conkers or golf.

And what a crowd. Record numbers enjoyed the day [or

week] out. I heard several cockney accents that would

have been at home in any London clerks’ room. Every

vantage point was taken and there were many

memorable moments.

Bernard Langer came within inches of an albatross

(scoring two on a par 5) when he eagled the 5th hole.

I was standing next to the free drop zone adjacent to

the main stand alongside the 18th green, when

somebody from the back of the stand screamed out:

“incoming!” A split second later a golf ball rattled the

back of the stand and another spectator suggested:

“that’ll be Seve Balesteros.” Sure enough it was. The

ball was thrown back to him and he placed it in the

free drop zone just in front of me. His face portrayed a

steely determination. He paced out the 40 yards from

the drop zone across the rough, beyond the deep pot

bunker protecting the flag 12 feet beyond.

After briefly checking the contours of the green, he

again paced out the yardage to the drop zone, instantly

selected the right club and after one practice swing,

lofted the ball high into the clear blue sky. To rapturous

applause it landed about three feet from the hole, and

Seve secured a birdie. Just Brilliant!

Dear Ted ‘n’ AliceMr. Sleepless, one of my barristers, rings me atmidnight at least once a week. My wife gets upat 5.00am, and is not best pleased at thisinterruption – especially when the call could soeasily be dealt with at 8.00 the next morningwhen I arrive in chambers.

Ted: Sounds like you need call divert and voicemail onyour mobile. At bedtime, divert calls to your mobile andswitch it off. Then when you are traveling to Chambersthe next morning you can pick up any late messagesfrom the night before. It may cost a few pence [checkwith your mobile phone provider] but well worth theuninterrupted sleep. If you are quizzed, you can sayyour calls are diverted to your mobile so you areavailable, but after bedtime the phone goes on chargeovernight.Alice: If that does not work, get your wife to answerhis calls with some heavy breathing!

Opportunities at Keating Chambers

for Junior Clerks

Keating Chambers is a leading commercial set of 48 barristers specializing in

high-profile construction, engineering, IT, energy work and professional

negligence actions within these areas of expertise.

We are seeking applications for the new positions of Team Junior Clerks

within our existing clerks’ structure working with either

the Silks or Junior tenants.

These roles have been specifically created to enhance the practice

management services we provide to our barristers and clients. The position

will continue to develop over time with more responsibility as the successful

candidates develop with the aid of a bespoke clerks training program.

Duties will include liaising with solicitors, diary management, data entry

work, booking travel and generally assisting the other members of the

clerks’ team. Chambers has a messengers’ team who deal with the traditional

junior clerk duties such as taking papers to Court, however the successful

applicants may be asked to assist on occasion.

We are looking for intelligent, motivated individuals with the potential to

become a long term employees of Keating Chambers. Applicants should have a

minimum of six GCSE’s at Grade C or above including Mathematics and English.

An excellent package includes a competitive salary (subject to experience),
