ISLAMIC LAW

INTRODUCTION

• The code of law derived from the Quran and

form the teaching example of Prophet

Muhammad (SAWW) known as Shari’ah.

• The word Shari’ah comes from the Arabic:

shara’a it means a way or path.

• Shari’ah is the way to the source of life.

• Shari’ah in Islam refers to the way according

to divine guidance leading to a peaceful and

happy life in this world and the next.

Goal of Shari’ah

• Shari’ah contains categories and subjects of

Islamic Law called the branches of Fiqha.

Include:

1. State Affair

2. Justice

3. Injunctions

4. Treaty(Obligations)

5. Jihad(Holy War)

6. Others etc.

1.State Affairs

• In an Islamic state, affairs are conducted

within limits laid down by the Quran.

• Nobody has the right to transgress these

limits; In other words, the right to rule belongs

to Almighty ALLAH.

• The duty of ummah is to establish an order

according to the Quran.

2.Justice

• To establish the rule of justice is a basic

responsibility of an Islamic State. The

demand of justice prevails in all walk of life,

but there we shall talk only the judicial justice.

• ALLAH says in Quran:

“Allah does command you that you restore

deposits to their owners, and, if you judge

between mankind, that you judge with

justice.” (4:58)

3.Injunctions

• Islamic Law or Shari’ah provides injunction of

life:

1. General injunction for Family Life

2. The status of men or Women

3. Nikkah

4. Age of Nikkah

5. Relation b/w Husband and Wife

6. Others etc.

4.Treaty

• Islamic Law of peace treaties in Islam. Its

findings are the Muslim head of state can

enter into a peace treaty if it is beneficed for

the Muslims and its provisions are not against

the injunctions of Shari’ah.

• Example treaty of Hudaibia, by Prophet

Muhammad (SAWW).

5.JIHAD(Holy War)

• Jihad is an Arabic word which means ‘to

struggle’ and ‘to try one’s utmost’.

• Purpose of jihad is the use of all our energies

and resources to establish the ISLAMIC LAW

STATE in order to gain Almighty ALLAH’s

favor.

• Almighty ALLAH says:

"Go forth, light-armed and heavy-armed,

and strive with your wealth and your lives in

the way of Allah! That is best for you if ye but

knew." (9:41)

Sources of Islamic Law

• There are four sources of Islamic Law:

1. Holy Quran

2. Sunnah

3. Ijma

4. Qiyas

1.Holy Quran

• The primary or basic source of Islamic law is the

Holy Quran.

• The Holy Quran was revealed to last Prophet,

Holy Prophet Muhammad (SAWW).Period of 23

Years.

• The Holy Quran covers all dimensions of human

life.

• ALLAH says in Quran:

“This is a book, in it is guidance sure

without

doubt to those who fear ALLAH”. (2 : 2)

2.SUNNAH

• The primary or 2nd source of Islamic law is the Holy

Prophet (SAWW) Sunnah.

• After the Quran the Islamic Law drawn from the

Sunnah.

• The detail of Quran are found in the Sunnah of

Prophet (SAWW).

• ALLAH says in Quran:

“Obey ALLAH and obey PROPHET”. (64 : 12)

• Holy Prophet (SAWW) says:

“I leave with you two things if you hold fast by

them both, you will never to misguided. The book

of ALLAH (Quran)

and Sunnah of Prophet (SAWW)”.

3.IJMA

• The secondary or 3rd source of Islamic law is “Ijma”.

• Ijma is an Arabic word which means “Consensus of Opinion”.

• Unanimous agreement of Jurists, Sahaba or Scholar is called Ijma.

• Holy Prophet (SAWW) says:

“My community will never agree upon an err”.

(Tirmizi)

“The hand of ALLAH is with the community”.

4.Qiyas(Analogy)

• The secondary or 4th source of Islamic law is

“Qiyas”.

• Qiyas is an Arabic word which means “To

measure, To compare, Judge etc”.

• Expert of Quran and Sunnah had strived to

interpret them.

• There interpretation is called Qiyas (individual

effort).

• The Qiyas is an analogical deduction from

the Quran, Sunnah and Ijma.

conclusion

• Islamic Law or Shari’ah is the “Centerpiece

and Backbone of the religion of Islam”.

• Muslim do not believe in Democratic

principles.

• Muslims are using stealthy techniques and

agendas with the express aim of destroying

Western civilization from within and

“establishing caliphate here”.

Shari’ah is part of a plan to turn the US into an Islamic state
