INVICTA JUSTUM seeks to offer law students an opportunity to develop skills
which are crucial for growing into a successful lawyer and to expose them to the ever
expanding frontiers of law which helps them to develop holistically.
The process of becoming a perfect advocate is a career long journey that begins in
law schools. Virtual moot court competitions facilitate practical learning and integrated
development of young law students by engaging the youth into a learning outlet during the
Covid-19 pandemic. Moot court also teaches students professionalism and ethics, how to
apply laws to facts, how to structure and rank a legal argument by strength and not to
assert losing propositions. By giving law students opportunities to improve their legal
writings, legal researches and oral advocacy in a competitive environment prepares
students for a competitive world. It is perhaps the most significant activity that develops
all the said skills every lawyer needs to possess.

Dharma Pradesh is a state in the Indian Union. University of Dharma Pradesh was
the oldest University in the state having the tradition of 128 years. University College of
Law (UCL), the constituent college of the University, was started in 1938. At present the
college has LL.B., LL.M. and Ph.D. programmes. Six judges of the High Court of Dharma
Pradesh are former students of UCL. On 07.08.2020 UCL organized a Webinar “Criminal
Contempt: Is it an Outdated Concept”. 200 persons participated in the webinar. The
former Advocate General of Dharma Pradesh and former lecturer of UCL Sham Mohan
was the key note speaker for the webinar. In his scholarly presentation, Sham Mohan
quoted the views of Lord Denning and H.M. Seervai for highlighting the need for judicial
restraint in contempt proceedings. He continued that the judiciary is not above from
criticism. In the last portion of his speech he stated:
“As pointed out Earlier Mahadhipatis like Keshavananda and Zamindars like
Golaknath evoked a sympathetic chord nowhere in the whole country except the Supreme
Court of India. The bank magnates got higher compensation by the intervention of the
Supreme Court in Cooper’s case. Antisocial elements i.e. FERA violators, bride burners and
a whole horde of reactionaries have found their heaven in the Supreme Court. In this
country, the Jesuses are getting crucified and the Barbases are very much upheld, thanks
perhaps to the Judiciary. Our whole judicial approach has a certain independence from all
civilized behaviour. In fact to speak frankly, the Indian judiciary is non est.” He further

added that the judiciary can attain greatness only if it is made by judges who are eligible
to occupy the position. Its strength is the faith and confidence of the people in that
institution. Unfortunately, what some idiots (fools) occupying our seat of justice say is
not acceptable to the country and obeyed by the people and thereby bringing disrepute
to the entire judiciary. Judges are to interpret the laws and interpret the intention of
the Legislature which had made the laws and pass orders accordingly. In some cases, the
judiciary was becoming an obstacle in the economic progress of the State by pronouncing
arbitrary judgments in cases involving payment of compensation. He even went on and
stated that Judges sit in glass houses and pass verdicts. If they have any self-respect
they should resign and step down from their office.
During the question answer session, Sham Mohan stated that it is well known fact
that favoritism is the part of Indian Judiciary. He added that there is allegation that the
reason for the elevation of present of Chief Justice of Dharma Pradesh is that he was
the nephew of the former Chief Justice of the state rather than his individual merit. He
stated that a dispassionate study without harbouring any pre-conceived notion of water-
tight evidences, under possession, will prove beyond doubt how incapable, corrupt and
worthless are some of the present judges in our judiciary. When one participant asked
whether his statements has gone beyond the limit he answered that “The path of criticism
is public way, the wrong-headed are permitted to err therein, provided that members of

the public abstain from imputing improper motives to those taking part in the
administration of justice and are genuinely exercising a right of criticism and not acting
in malice or attempting to impart the administration of Justice, they are immune. Justice
is not a cloistered virtue; she must be allowed to suffer the scrutiny and respectful even
though outspoken comments of ordinary men".
On 09/09/2020 Kasturi Raj, a practicing lawyer of High Court of Dharma Pradesh
filed a contempt petition before the High Court. A Division Bench of the High Court
consisting of two senior judges after hearing Sham Mohan and Advocate General of the
State, ordered to convict Sham Mohan with simple imprisonment of four months and also
to debar him from practice for a period of 1 year through its judgement dated
20/11/2020.
On 04/12/2020 Sham Mohan filed a writ petition under Article 32 of the
Constitution challenging the validity of the High Court order dated 20/11/2020. It was
contended that:
1. The speech and observations made by him on 07.08.2020 do not come within the
purview of Criminal contempt.

2. Section 15, The Contempt of Courts Act, 1971 is in violation of Constitution on the
ground that it is in contravention of Golden Triangle constituted by the fundamental
rights under Articles 14, 19 and 21 of the Constitution.
It is further requested that the Court may declare that constitutional powers of
the Supreme Court and High Courts to contempt of Court is confined to the punish for
civil contempt in the context of the constitutional developments and human rights
jurisprudence in the postcolonial era like emergence of transformative constitutionalism.

OFFICIAL RULES AND REGULATIONS
The following are the Official Rules and Regulations for INVICTA JUSTUM,
1st National Level Virtual Moot Court Competition to be organized by the Nehru
Academy of Law, Lakkidi, Palakkad District., Kerala from 14th to 16th JANUARY,
2021.
For the purpose of these rules, the following terms shall mean:
(1) “Competition” means the INVICTA JUSTUM 1st National Level Virtual Moot
Court Competition 2021 organized by the Nehru Academy of Law, Lakkidi,
Palakkad District., Kerala.
(2) “Judge” means any person appointed to adjudicate/evaluate a participating team’s
memorial or oral submissions.
(3) “Memorial” means the written pleadings of each participating team, submitted
pursuant to these rules.
(4) “Organizers” means Nehru Academy of Law, Lakkidi, Palakkad District, Kerala.
(5) “Participating Institution” shall be presumed to be the parent Law
College/University/ Department of the participating team.

(6) “Participating Team” means the team which has registered itself for the
competition.
(7) “Penalty” means points deducted in case of violation of any rule.
It should be duly noted that:
(1) These rules are only inclusive and not exhaustive. If there is any situation which is
not contemplated in the Official Rules and Regulations, the Organizers decision on the
same shall be final.
(2) The Organizers reserve the right to vary, alter, modify, or repeal any of the rules
if so required and as they may deem appropriate.
(3) The Organizers decision as regards to the interpretation of Official Rules and
Regulations or any other matter related to the competition shall be final.
(4) Imposition of penalties including disqualification rests solely with the Organizers in
case of failure to comply with the rule(s) or deadline(s).
(5) The Organizers reserve the right to take appropriate action against any
participating team for any unethical, unprofessional and immoral conduct.
(6) The Team-ID issued to each participating team shall be their sole source of
identity throughout the competition.
(7) The team should ensure good internet connectivity during the competition.

1. GENERAL RULES
1. Date and Venue of the Competition The competition will be held from 14th - 16th January, 2021 at Nehru Academy of
Law, JCET Campus, Lakkidi, Palakkad District, Kerala via online platform. The respective
teams shall participate from their preferred physical venues.
2. Language
The official language of the competition would be English.

3. Team Eligibility and Composition i. Participation is strictly restricted to bonafide law students pursuing three years or
five years L.L.B. degree programme from any Institution/University in India
registered under the Bar Council of India.
ii. Only one team is permitted to participate from each participating institution.
iii. A mandatory team of three members is allowed, consisting of two speakers and one
researcher. Any additional member shall not be entitled to certification. However,
a team may comprise of only two members, where one of the members has to act as
both the researcher as well as the speaker.
4.Registration Procedure

Interested teams are required to register themselves by filling the registration
form through the above link latest by 14th December 2020.
II. Registration Fees: The participating team is required to pay INR 1,000/- as
registration fee.
1) The fee must be paid on or before 14th December 2020.

2) The registered teams are required to attach the screenshot of the online
transaction in the Google form itself. However, fee once paid is nonrefundable.
3) The receipt of screenshot of the payment to the aforementioned bank shall only
confirm the participation of a team in the competition.
4) Once the registration is completed, the teams must intimate the
confirmation of participation along with the details and passport size
photograph of each participant to [email protected].
5) The online platform for competition will be intimated to the registered team by
the organisers via e-mail.
6) Communication with any one of the team members shall be deemed to be
communication to the entire team for the purpose of this competition.
III. Allotment of Team Code: Every team which has successfully completed the

Registration requisites under the Rules will be allotted a unique code. Once the
Code is allotted, every team must use only the team code for any further
communication with the Organizers during the course of the competition.
IV. Change in Team Composition: Any change in team composition must be
intimated to the Organizers on or before December 30th 2020. Any change must
be accompanied with a freshly filled registration form and an authority letter
duly signed by the head of the institution.
V. Dress Code:
1) Participants shall be appropriately attired for the rounds of the competition.
Robes and collar bands are not permitted.
2) The Dress Code for the Inauguration, Oral Rounds and Valedictory should be
black and white in colour:
a) For Gentlemen-Western Formals (White formal shirt with black formal pants
and a black blazer); and
b) For Ladies - Western Formals (White formal shirt with black formal
pants/black formal skirt and a black blazer) or Indian Formals (with black
blazers).

II. WRITTEN SUBMISSIONS
1. Strict Adherence to Rules Regarding Written Submissions: All
requirements have to be strictly followed. Non adherence to the same will attract
penalties as provided under the Rules.
2. Written Submissions to be prepared from Both Sides: Each team
must
prepare written submissions for both sides to the dispute.

3. Submission of Memorials:
a. Submission of Soft Copy
i. The soft copies of the written submission from each side (Appellant/Petitioner and
Defendant/Respondent) should reach the Organizers to the e-mail address
“[email protected]” in “.pdf” format at the latest by 8th January, 2021 by 23:59
Hours. ii. Written Submissions from both sides shall be sent in a single e-mail.
iii. A penalty of 1 mark shall be levied in case the written submission is submitted in
any other format or as a multiple file by the team.
iv. The team submitting the Memorials 2 days after the last date of the submission of
shall stand disqualified from the competition.
b. Submission of Hard Copy
i. The two hard copies of the written submission from each side must reach the
Organisers on or before 14th January 2021 via speed post to the following address.
“Nehru Academy of Law, Jawahar Gardens, Lakkidi, Mangalam, Ottapalam,
Palakkad, Kerala, 679301”.
ii. The envelope containing the memorials shall be superscribed “INVICTA JUSTUM -
Team Code”

4. Penalty for Late Submission:
A penalty of 1 mark per side shall be levied in case of delay in submission of
Memorials beginning from the last date of submission up to 48 hours after which the
team shall be disqualified from competition.
5. General Conditions for Written Submissions
i. The Written Submissions shall not contain any form of identification apart
from the team code. If any such identification or mark, symbol, etc. which has the
effect of identifying the team is found on the written submission, then it shall result in
instant disqualification of the participating team.
ii. Appellant’s Written Submissions are required to have a blue cover and
Respondent’s Written Submissions are required to have a Red cover.
iii. A penalty of 1 mark per side shall be levied in case the team uses wrong cover
for written submission.
6. Guidelines for Formatting:
i. Written Submissions Structure: The Written Submissions must contain following
contents:

a. Cover Page–The cover page shall contain the case title, side of the written
submission, year of competition, name of the forum and team Code on top right
corner;
b. Table of Contents;
c. List of Abbreviations;
d. Index of Authorities: The Index of Authorities must list all the authorities
cited in the written submission. The Index must indicate the page number(s) and/
or the paragraph number(s) of the written submission in which the authority is
cited;
e. Statement of Jurisdiction;
f. Statement of Facts: The Statement of Facts must contain a concise
statement of the relevant facts of the dispute. As far as may be, the Statement
of Facts should be limited to the stipulated facts and legitimate inferences which
can be drawn from those facts. Argumentative facts are prohibited. Statement of
Facts shall not exceed 2 pages. Non- compliance will result in a penalty of 1 mark
for each exceeded page;
g. Issues Raised;
h. Summary of Arguments: The Summary of Arguments should contain a
summary of the substance of the arguments, and should not merely be production

of the various headings and sub-headings of the arguments. The Summary of
Arguments shall not exceed 2 pages.
i. Pleadings/Arguments Advanced:
a. All legal arguments must be limited to the Pleadings/Arguments Advanced
section of the written submission.
b. The Pleadings/Arguments Advanced and Prayer must not exceed 20 pages. j.
Prayer.
ii. Team Code: The team code must be ascribed on the top right corner of the cover
page. The code must be succeeded by the side for which the written submission is
prepared. Teams must use “P” for Petitioner and “R” for Respondent. For example: in
case the
Team Code is NAL-100 the team must write “NAL-100P” in case of written
submission for Petitioner and “NAL-100R” in case of written submission for
Respondent.
iii. Margin: The Written submission must maintain an equal margin of 1 inch on all
sides.
iv. Font, size and line spacing: The text font should be ‘Times New Roman’, size
12 and must be in 1.5 line spacing. Non-compliance will result in a penalty of 2 marks per
memorial.

v. Footnotes: The foot notes must be in font Times New Roman, size 10 and singly
spaced. A Uniform Style of Citation (Bluebook, 20th Edition) is required to be followed
throughout the written submission. Non-compliance will result in a penalty of 2 marks
per memorial.
vi. Header and Footer: The font used for the header/footer, if any, shall be Times
New Roman, size10, 1 spacing.
vii. Page Limit: Maximum page limit is of 30 (thirty pages).
viii. The written submissions shall be marked on the parameters described under

III. ORAL ROUNDS
The Competition shall consist of the following rounds:
a. Preliminary Rounds: The preliminary rounds will start after the Inaugural Session
on 14th January 2021. The teams will be arranged and grouped based on a draw of lots
on 13th January 2021. The lots so drawn will determine who will contest against whom
and for which side the respective teams would put up their oral arguments. Each team
should argue for petitioner and respondent with different teams .The cumulative
results based on the aggregate score of the participating teams in the knock-out
Preliminary Rounds will be declared on the evening of 14th January 2021. The eight
teams that are on the top of the order of merit shall qualify for the Quarter-finals
and shall be ranked accordingly.

b. Advanced Rounds:
1) Quarter-finals;
2) Semi-finals; 3) Finals.
4). During each of the abovementioned rounds, the order in which the teams
shall present their arguments is as follows:
a. Appellant/Petitioner Speaker-1
b. Appellant/ Petitioner Speaker -2
c. Respondent/Defendant Speaker-1
d. Respondent/Defendant Speaker-2
e. Rebuttal (Appellant/Petitioner) - Any one of the two Speakers
f. Sur-rebuttal (Respondent/Defendant) - Any one of the two speakers.
Sur-rebuttal may be permitted only at the discretion of the Judges.
c. Marking Criteria for Oral Submissions
1. Each Judge will mark an individual speaker on a total of 100 marks.
2. The Round total will be the aggregate of the total of the two (2) speakers.
3. The following will be the marking criteria and the marks allocated to compute the
Round Total for each team:

The Best Speaker Award shall be determined on the basis of the individual aggregate
score of the speaker taken only from the Preliminary Rounds. Individual Aggregate
Score shall be determined as the sum of the following:
a) Score of Speaker in Preliminary Round I;
b) Half of Written Submission Score.
Teams are not permitted to raise issues in the Oral Rounds which have not been
submitted in the Written Submissions.
e. Researcher’s Interview
An individual interview will be conducted to adjudge the Best Researcher on 15th
January 2021.
IV. AWARDS
The following awards shall be awarded in the Competition:
1. Best Team: Team winning the final round of the Competition shall be given a cash
prize of INR 10,000/- (INR Ten Thousand Only).
2. Runners Up: The runners up team in the final round of the Competition shall be
given a cash prize of INR 8,000/- (INR Eight Thousand Only).
3. Best Speaker: The speaker having the highest score in the preliminary rounds shall
be given a cash prize of INR 2,500/- (INR Two Thousand Five Hundred Only).

4. Best Memorial: The team having the highest average written submission score from
both sides shall be given a cash prize of INR 5,000 /- (INR Five Thousand Only)
5. Best lady advocate: The lady speaker having the highest score in the preliminary
rounds shall be given a cash prize of INR 2,500/- (INR Two Thousand Five Hundred
Only).
6. Best Researcher: The best researcher will be awarded with a cash prize of INR
2,500/- (INR Two thousand Five Hundred Only).
7. E-Certificates of merit shall be given to all the teams qualifying for the Advanced
Rounds
8. E-Certificate of participation shall be given to all the participating teams.
V. MISCELLANEOUS
1. No audio or videotaping of oral pleadings is permitted without the permission of the
Organisers.
2. The organisers shall not be responsible for any loss due to slow or non-functional
Internet Connection during the Competition. We request all the participants to
arrange a sound Internet Connection.

3. No additional documentation or screen-sharing will be allowed and any information
which has to be provided to the court should be submitted beforehand along with
the Compendium and the Memorial.
4. If a team believes that violation of any of the Competition Rules has taken place at
any stage of the competition, the teams within half an hour after the completion of
the round wherein a violation has allegedly occurred shall register a complaint with
the Faculty/Student Convener of the Advocates’ Legion and under no
circumstances the teams are allowed to approach the Judges for any complaints.
5. The Organisers reserve all rights to audio and videotaping, or any other form of
audio or visual reproduction, of any oral round or part thereof.

The team may request clarifications regarding the official rules of the competition via
e-mail to [email protected]. The subject of such e-mails must read “REQUEST
FOR CLARIFICATIONS”.
