Attention: Mr Chris Sharpe Dear Chris Byron Bay Bypass - Stage 2 Post Clearing Report Introduction and Methodology

This letter report presents the results of clearing phase fauna surveys and spotter catcher work undertaken by GeoLINK for Hazell Bros Group (HBG) and Byron Shire Council (BSC) for Stage 2 of the Byron Bay Bypass Project (approximate chainage 650 to 1100). Clearing phase surveys were undertaken in accordance with:

■ The HBG Environmental Management Plan (EMP) Flora and Fauna Management Sub-plan, with consideration of the findings of the Byron Bay Bypass - Stage 2 Pre-clearing Report (GeoLINK 2019a).

■ The Byron Bay Bypass: Mitchell’s Rainforest Snail (MRS) Habitat Clearing Protocol (GeoLINK 2019b).

Key activities undertaken as part of pre/during clearing surveys and inspections included:

■ Diurnal Mitchell’s Rainforest Snail (MRS; Thersites mitchellae) surveys during survey set out and delineation (flagging) of the clearing limit.

■ Ensuring clearing limits were delineated. ■ Diurnal and nocturnal pre-clearing MRS surveys and phased habitat reduction

on the two days and nights immediately prior to commencement of clearing. This was undertaken twice to capture commencement of clearing in the southern and northern portions of Stage 2 (delineated by the drain at approximate chainage 900).

■ Diurnal (pre and during) and nocturnal MRS surveys each day of clearing. Nocturnal MRS surveys were also undertaken the night prior to re-commencement of clearing when clearing activities ceased over the weekends.

■ Pre-clearing flush surveys in areas of dense understorey vegetation. ■ Pre-clearing searches through understorey habitat features (including leaf litter,

vegetation and fallen timber). ■ Canopy inspections, pre and during clearing. ■ Inspections of fallen timber. ■ Ground habitat searches for fauna post tree removal, and pre and during

grubbing. ■ Habitat tree removal co-ordination (including two stage clearing) and

inspections. ■ Fauna rescue and relocation as required.

Byron Bay Bypass Stage 2 Post Clearing Report 2 3351-1038

A summary of the ecologist survey and spotter catcher effort is provided in Table 1. Detailed survey timing, methodology and results data is provided in the clearing registers in Appendix A. Surveys undertaken in February 2020 when the clearing was originally scheduled to commence are included.

Stage 2 clearing and mulching activities were undertaken over 21 days between 9 March and 4 April 2020. Weather conditions during clearing are provided in Appendix B.

Results and Discussion

The results of the subject pre/ during clearing surveys and inspections are provided in the clearing registers in Appendix A. Key findings include:

■ 140 MRS were captured from the Stage 2 clearing footprint and relocated within the adjoining habitat to the east and south (refer to Illustration 1 and Table A3 of Appendix A).

■ Other fauna capture and relocations included:

- Three Carpet Pythons (Morelia spilota). - One Short-beaked Echidna (Tachyglossus aculeatus) - Seven Sun Skinks (Lampropholis delicata). - 103 Striped Marsh Frogs (Limnodynastes peronii) - One Green Tree Frog (Litoria caerulea). - One Bandy-Bandy Snake (Vermicella annulata). These individuals were relocated to the adjoining habitat on public land adjacent to the clearing footprint.

■ A number of other fauna species self-relocated out of the clearing area including Swamp Wallaby (Wallabia bicolor), Eastern Water Dragon (Intellagama lesueurii), Rough-scaled Snake (Tropidechis carinatus), and a number of avifauna.

■ Arboreal mammals observed adjacent to the site during nocturnal surveys included Ringtail Possums (Pseudocheirus peregrinus), Short-eared Possums (Trichosurus caninus) and gliders (Petaurus sp.). None of these species where encountered on the site during the actual clearing.

■ Eight actual hollow-bearing trees were removed (refer to Table A5 in Appendix A). The trees were not occupied at the time of clearing.

■ Four Ringtail Possum dreys were encountered. All the dreys were empty at the time of clearing. ■ Two non-active bird nests were encountered during clearing: one Australian Brush-turkey

(Alectura lathami) nest and one honeyeater nest.

Byron Bay Bypass Stage 2 Post Clearing Report 3 3351-1038

■ One dead Striped Marsh Frog was detected, which appeared to have died as a result of crushing injuries.

■ No other direct fauna injuries or mortalities were encountered. ■ Salvaged habitat features include:

- Small logs. - Palm fronds. - Leaf litter deposits. These were relocated to the edge of the clearing limit, outside of the works footprint.

The results show that the Byron Bay Bypass: Mitchell’s Rainforest Snail (MRS) Habitat Clearing Protocol (GeoLINK 2019b) was effective in detecting MRS for capture and relocation. All survey phases of the protocol were valuable, including pre, during and post clearing diurnal and nocturnal surveys. Nocturnal surveys were generally more effective than diurnal surveys, particularly in areas with dense understorey. Multiple surveys were warranted.

The surveys found the MRS in varying habitats, similar to that documented in GeoLINK (2019c) Byron Bay Bypass – Mitchell’s Rainforest Snail Surveys and Habitat Mapping. Again the occupied swamp sclerophyll forest habitat included areas where the groundcover was variable with:

■ Structural variation ranging from sparse vegetation cover and leaf litter dominant, to areas with dense grass, rush and/ or reed cover.

■ Different species dominating the understorey including Phragmites australis, Gahnia clarkei, ferns, Leersia hexandra and Para Grass (Urochloa mutica).

Areas with edge effects and weed invasion were also occupied.

These findings support the GeoLINK (2019c) suggestion that the MRS is associated with broad habitat types (i.e. rainforest and swamp sclerophyll forest) within a restricted distribution, rather than specific floristic associations.

The MRS survey guidelines in the Australian and state government adopted Mitchell’s Rainforest Snail Thersites mitchellae (Cox, 1864) Recovery Plan (NPWS 2001) suggest a survey effort ‘for small sites (less than 0.5 ha) at least three hours be spent searching and then scaled up appropriately for larger areas’. The survey results suggest this should be revised, particularly for sites with dense understorey vegetation. They should include a requirement for nocturnal surveys should diurnal surveys return a negative result, as well as multiple surveys under suitable conditions.

Please contact the undersigned if you require any further information.

Yours sincerely GeoLINK
