▸ “Advanced Model Single Window” is defined as an administrative procedure which enables to process filed applications in a seamless and simplified manner. The “Advanced Model Single Window” possesses three features to complete procedures;

① with a clearly defined Single Point of Contact (Accessibility)

② in speedy and timely manner (Efficiency)

③ without mistake, rework or misunderstanding(Transparency)

▸ “Advanced Model Single Window” fulfills below 29 requirements, which are figured out from analysis of practices in/out of India and reflection of Japanese investors’ requests.

▸ Single window in Gujarat has been continuously improved especially in Transparency, while Accessibility and Efficiency have room for improvement.

▸ Key improvements can be made by assigning single officer for individual projects for better coordination within government. Duration of approval can be shorten by eliminating unnecessary processes. Absence of notification on key regulatory changes can be addressed.

▸ Following Action Plans were agreed based on current status and points for improvements.

▸ Single window in Tamil Nadu has room for improvement in all three aspects. However, it shall be noted that current system (Single Window Portal Site) is under renovation.

▸ Improvements can be made for ambiguous contact points, long-duration of approvals involving on-site inspection, and absence of notification on key regulatory changes

▸ Following Action Plans were agreed based on current status and points for improvements.

✓ Arrangements of an interpreter conversant in Japanese, English and Chinese, in the Single Window Agency.

✓ Consideration for establishment of overseas branches in select countries for publicity of the State in an endeavour to promote investment from the countries.

1.4 Conclusion (P.76 ~ P.79)

▸ Through this project, two main the objectives were achieved;

① Establishment of common understanding between Japan and India regarding administrative procedures when entering India

② Discussion and presentation of action plans to improve the investment environment in India”

【① Establishment of common understanding between Japan and India regarding administrative procedures when entering India】

✓ Identified the items necessary for improvement on single windows in India by taking into account requests for improvement from Japanese companies, information on best practices related to single windows in and outside India, and interviews with local governments. (Identification of recognition gap)

✓ Through workshops in Gujarat and Tamil Nadu, 29 requirements of administrative procedures in line with the standards required by Japanese companies were presented as an “Advanced Model Single Window" to establish a common understanding.

【② Discussion and presentation of action plans to improve the investment environment in India】

✓ At the workshop held in Gujarat, the State government agreed with the implementation of five actions on the highly feasible requirements among the 29 requirements presented.

✓ At the workshop held in Tamil Nadu, the State government agreed with the implementation of seven actions on the highly feasible requirements among the 29 requirements presented.

Incorporated into the BRAP (Business Reform Action Plan) of DPIIT in the future, actions commonly adopted in two states can enhance India’s nationwide investment climate and business environment.

2.1 Research Background & Purpose

▸ Japanese companies are not satisfied with the complex procedures and uncertainty of the approving process, in spite of efforts for improvement made by Government of India.

✓ Unnecessary document requirements and inspections force applicants to wait for longer time to get approval

✓ Unclear process flow, standard processing time and application status are some obstacles to application

✓ Non-transparent approval criteria and inspection items lead to unfair judgement

✓ Difficult to reverse the decision even if the judgement was unfair.

✓ Approvals processed within the target time (standard processing time), not affecting investor's business plan

✓ Reduction in documents required for approvals

✓ Necessary information and documents for approvals clearly described in a comprehensive checklist or guideline

2.3.1 Research Subject (States)

▸ In order to make concrete and in-depth proposals for improvement of investment environment, 2 states, Gujarat in the west and Tamil Nadu in the south, are chosen for research subject, and 3 other states, in the north, central and the east (north: Rajasthan / central: Madhya Pradesh / east: West Bengal) are also researched with simple web-based research.

▸ 5 states are chosen because of significant presence of Japanese companies and prospects of investment attraction in the future.

✓ One of the main destinations for Japanese companies

✓ Investment attraction was promoted by the “Single Window Act”.

✓ Based on the Act, single window online system was established.

✓ Ranked 5th out of 29 states in “Business reform indicator” in 2017.

2.4.1 Research Method (Desktop research)

▸ Based on websites and other materials of the Gujarat and Tamil Nadu governments, room for improvement in terms of digitalization, visualization of the processing flow, decision of standard processing time is identified.

▸ Details of issues are clarified through interviews with Japanese companies operating in each state.

▸ In addition to the above two states, other states and countries are also researched extensively for seeking best practices.

2.5 Research Team・ Schedule

▸ The project team consists of Global Public Team of EY Japan with EY India, personnel and organizational structure to carry out the core of the research and to avoid any problems in operation.

▸ The research was conducted for four months from early May to late Octorber.

▸ In preparation for the field survey in late June, the project team conducted an “investigation of administrative procedures” and “Best practice research in/outside India” and formulated an “Advanced Model Single Window”.

▸ In late August, workshops were held to share the results of the field study and the contents of the research in Japan. The discussions and Action Plans worked out at the workshops were compiled and submitted in late October.

3.2.3 Overview of Investment Environment (Initiatives on EoDB)

▸ In 2014, DPIIT began investigating and ranking Indian states in order to build an investor-friendly business environment. In 2015, DPIIT published the results as an “Assessment of State implementation of Business Reforms”.

▸ Created “Business Reform Action Plan” (hereinafter referred to as “BRAP”) for improvement of the business environment in each state, and published the achievement status of each state on the portal site (www.eodb.dipp.gov.in).

▸ Each state is working on improving the single window while reporting the achievement of each item of BRAP to DPIIT.

▸ BRAP has announced 405 items, divided into following 12 categories, to be improved for rationalization of procedures and regulations for improvement of each state’s business environment for doing business, leading to raise the ranking of EoDB.

3.4 Singe Window in Target States (Gujarat)

In Gujarat, the IFP (Investors’ Facilitation Portal, opened in October 2015) is in operation. The approval status is monitored by the CMO (Chief Minister ’s Office). The percentage of approval within standard processing time is 99%

iNDEXTb, under the Industry Commissionarate, is responsible for IFP management.

Process flow, approval criteria, and examination items of each ministry are all publicized on the IFP and the websites or individual ministries’ web-site.

The Japan Desk set up at GIDC answers questions submitted through e-mail instead of through physically allocated personnel. The same function is implemented for Korean and Chinese.

Operation of single window portal

The complexity of the application process prior to application at IFP has caused delays in starting IFP applications. For example, employment insurance procedures for contractors, or acquisition of Environmental Impact Assessment prior to construction permission. (Labor & Employment, GPCB)

3.5 Singe Window in Target States (Tamil Nadu)

Business Facilitation Act, promulgated in March 2018, formulates standard processing time and procedures of the Single Window Portal (SWP).

SWP is under total renovation with the support of ADB (Asia Development Bank)which eliminates deficiencies in the current system. New portal enter into service in March 2020.

On the day of field interview, 75 approval requests were circulated. Of these, 40 were expected to be approved, and 8 were to be granted deemed approval.

The document circulation procedures have been fixated since the start of SWP in 1992. The on-going renovation will streamline the procedure to expedite the approval process by reducing unnecessary procedures.

If there are questions at the application submission stage, a staff will be assigned by the Guidance Bureau to respond to the questions, and the same staff will be in charge when delays happen in approval process.

Assignment of Japanese-speaking personnel are under consideration including full-time employment, in consultation with local JETRO (Japan External Trade Organization), but has not been realized.

Delays in approvals may happen when document circulation involves several ministries. Delays occur especially when there are ministries requesting hard copy submission involves. (FRSD and Guidance Bureau)

⚫ Guidance Bureau Introduced Guidance Bureau to everyone and spoke of the multifaceted functionaries that exist within the Guidance Bureau including that:

• Guidance Bureau is a Government of Tamil Nadu Organisation established with the objective of facilitating the industrial development in the State. Guidance Bureau acts as a single point contact for entrepreneurs for establishing industrial ventures.

• Guidance Bureau provides comprehensive information to support to investors about federal and State Government policies, infrastructure support, taxation, investment opportunities etc.

• Guidance Bureau functions as Single Window Documentation Centre for major investment proposals and assist investors in getting all pre-project clearances, infrastructure support like land in industrial parks, power, water, etc.

【EY India/ EY ShinNihon】

⚫ EY India set the context of the workshop and briefed the participants on the background of the project and the associated objectives including that:

• EY ShinNihon had conducted field studies in the States of Tamil Nadu and Gujarat in June 2019 and had interacted with departments under the State Governments.

⚫ EY Japan opened the presentation on “Advanced Model Single Window” with introduction to the Project Overview, mentioning that:

• In order to realize the “Make in India” initiative, attracting foreign investors continue to be the prerogative of the Government of India. Towards this end, business environment enabler is the most important enabler for realizing the earlier mentioned initiative and improving single window system is one of the most effective way.

• Based on the research on the best practices from India and abroad, a 29-point checklist was developed.

⚫ EY Japan shared the findings from the interviews with Japanese companies:

• Issues such as extensive documentation and inspections force applicants to dedicate extended durations for attaining readiness and getting approval

• There are also complaints against unclear approval criteria, standard processing time, procedures, etc., which are all necessary information for application, and the lack of a easy-to-understand guideline.

• In the event where multiple departments are required to provide their NOCs(NOC: No Objection Certificate), it is often witnessed that the applicant is required to coordinate with each of them, thereby making the process difficult and time consuming.

⚫ EY Japan emphasized the importance to have an action plan that establishes an “Advanced Model Single Window” which realizes accessibility, efficiency, transparency to resolve issues as cited above and may further help achieve the objective of establishing an improved business ecosystem.

【Answer】 (EY ShinNihon)⚫ It is suggested that process flows in the form of pictorial representation, be uploaded, so that it is easier for the

investors understand the movement of applications. Further, checklists for inspection and document requirements for a service should have cross-references to the concerning Acts/ Rules along with the applicable clauses so that the applicant may read and understand the requirements in detail and attain readiness before the scheduled inspection.

【Question】 (Guidance Bureau Officer)⚫ How do you suggest operationalization of Central Inspection Authority (CIA) and what should be the functions of

such an Authority?

【Answer】 (EY India)⚫ Latvia and Moldova are the two countries that have established CIA. Essentially, this body is vested with the

responsibility of conducting all kinds of inspections that in present-day model is conducted by concerned departments. This not only ensures that count of inspection visits are minimized but also helps the establishment attain readiness for such reduced visits only.

【Question】 (Tamil Nadu Pollution Control Board)⚫ By establishing CIA, is it possible that an inspection report uploaded by one department would affect the inspection

report of another department?

【Answer】 (EY India)⚫ While transparency in the entire process is of utmost importance, one must also not be swayed by an overload of

information and should mark compliances/ non-compliances based only on the inspection that is carried out and as per the checklists defined, according to the point of fairness.

⚫ Establishment of Helpdesks to support investors from foreign countries is currently under process. Guidance Bureau is collaborating with JICA(Japan International Cooperation Agency)/ JETRO (Japan External Trade Organization) to identify interpreter. The Bureau is also currently facing infrastructure related bottlenecks at this point. However, the same is expected to get addressed in the next 3 months as the office shall be shifted to a new location. (Guidance Bureau)

⚫ To answer questions on licensing, a single person may not have all the answers. Robotics could only help up to a preliminary level of questions. As we deep dive further into the subject, a Robot may not yield desired result. Virtual meeting through the new single window portal, with concerned licensing officers could be explored. ⚫ It is often witnessed that looking up a specific Act or a Rule or an amendment could be extremely challenging. Often, it is also time consuming to understand the sequence of amendments. Therefore, this process may be streamlined and all such amendments could be made available in the relevant portal with a brief description on the type of amendments made. Additionally, such amendments may also be pushed to the relevant stakeholders (business users) for their consumption and knowledge.(EY India)

⚫ The Bureau is exploring the feature of parallel processing of clearances that are interlinked. For example: if Fire NOC is a prerequisite to Building Plan Approval, the application form could be made composite in nature with the system having the capability to push application to Level 1 Department (Fire) and Building Permit Authority, then immediately upon grant of the NOC (Fire NOC), the system pushes the application automatically to the authorities for Building Plan Approval.

▸ Through this project, two main the objectives were achieved;

① Establishment of common understanding between Japan and India regarding administrative procedures when entering India

② Discussion and presentation of action plans to improve the investment environment in India”

✓ Identified the items necessary for improvement on single windows in India by taking into account requests for improvement from Japanese companies, information on best practices related to single windows in and outside India, and interviews with local governments. (Identification of recognition gap)

✓ Through workshops in Gujarat and Tamil Nadu, 29 requirements of administrative procedures in line with the standards required by Japanese companies were presented as an “Advanced Model Single Window" to establish a common understanding.

✓ At the workshop held in Gujarat, the State government agreed with the implementation of five actions on the highly feasible requirements among the 29 requirements presented.
